Lori Lightfoot wins runoff to become next mayor of Chicago Chicago Former Chicago Police Board President Lori Lightfoot defeated Cook County Board of Commissioners President Toni Preckwinkle in the runoff election for mayor of Chicago Tuesday. With 97 percent of precincts reporting, Lightfoot received 74 percent of the vote to Preckwinkle’s 26 percent. Lightfoot was president of the Chicago Police Board from 2015 to 2018. She also chaired the Police Accountability Task Force and was a senior equity partner at the law firm Mayer Brown. Lightfoot held several positions in city government under former Mayor Richard M. Daley, who was mayor from 1989 to 2011. Both Lightfoot and Preckwinkle described themselves as progressives and called each other’s progressive credentials into question based on their political and professional histories. Lightfoot noted her background and past roles in city government as evidence of her experience managing teams and budgets. Lightfoot finished first among 14 candidates in the February 26 general election with 17.5 percent of the vote. In three polls conducted during December 2018 and January 2019, she was the first choice of between 3 and 5 percent of respondents. This year’s election was Chicago’s fourth open-seat mayoral race in 100 years and the second mayoral runoff election in the city’s history. Lightfoot will be the city’s first female African-American mayor and its first openly gay mayor.
Wisconsin With 97 percent of precincts reporting, Appeals Judge Brian Hagedorn led Appeals Chief Judge Lisa Neubauer, 50.2 percent to 49.8 percent, for an open seat on the Wisconsin Supreme Court. Under Wisconsin state law, a losing candidate may request a recount if the margin is 1 percent or less of the total votes cast. Although state Supreme Court elections in Wisconsin are officially nonpartisan, liberal and conservative groups typically coalesce around specific candidates. Conservatives, who back Hagedorn, currently have a 4-3 majority on the court while liberals, who supported retiring Justice Shirley Abrahamson, back Neubauer.
Pennsylvania Pam Iovino (D) defeated D. Raja (R) in the special election for the District 37 seat in the Pennsylvania State Senate. With all precincts reporting, Iovino received 52 percent of the vote to Raja’s 48 percent. This is the first state legislative seat to flip from Republican to Democratic control as a result of a special election in 2019. Four others have flipped from Democratic to Republican control in Minnesota, Connecticut, and Kentucky, and one previously Republican-held seat was won by an independent candidate in Louisiana. California’s ban on large-capacity firearm magazines declared unconstitutional by federal judge A federal judge ruled Friday that California’s ban on firearm magazines that can hold more than 10 rounds of ammunition is unconstitutional.   The decision from Judge Roger Benitez invalidates a portion of California Proposition 63, the Background Checks for Ammunition Purchases and Large-Capacity Ammunition Magazine Ban Initiative. That measure was approved by state voters in November 2016, 63 percent to 37 percent. Benitez, a judge of the U.S. District Court of Southern California, wrote in his opinion, “[Proposition 63] burdens the core of the Second Amendment by criminalizing the acquisition and possession of these magazines that are commonly held by law-abiding citizens for defense of self, home, and state.” Benitez joined the court in 2004 after being appointed by President George W. Bush. Current California Gov. Gavin Newsom (D) was lieutenant governor in 2016 and a supporter of Proposition 63. He responded to Judge Benitez’s ruling, saying, “This District Court Judge’s failure to uphold a ban on high-capacity magazines is indefensible, dangerous for our communities and contradicts well-established case law.” Before Proposition 63, residents who owned such large-capacity magazines prior to 2000 could keep them. Proposition 63 was designed to criminalize the possession of large-capacity magazines and require owners, including those who possessed them before 2000, to remove them from the state, sell them to a firearms dealer, or surrender them to law enforcement. In May 2017, five San Diego County residents and the California Rifle & Pistol Association sued the state claiming this ban violated the 2nd Amendment. On June 29, 2017, Judge Benitez issued an injunction preventing the state from enforcing the ban. If Benitez’s decision is appealed, the case would go before the 9th Circuit Court of Appeals. California Attorney General Xavier Becerra (D) said his office is “reviewing the decision to evaluate next steps.” Another provision of Proposition 63 is also under legal scrutiny. In April 2018, the California Rifle & Pistol Association and ten other plaintiffs sued the state arguing that the prohibition on purchasing ammunition from outside the state and bringing it into California without first having it delivered to a licensed dealer also violates the 2nd Amendment. That case has not yet been decided. Learn more→

Wednesday, April 3, 2019 Biden’s Behavior Under Scrutiny “On Friday, former Nevada assemblywoman Lucy Flores recalled a 2014 campaign event where Biden approached her from behind, smelled her hair and kissed her head… [Since then] a second woman has come forward, claiming former Vice President Joe Biden touched her inappropriately at a political event. Former congressional aide Amy Lappos told the Hartford Courant that Biden reached for her face and rubbed noses with her during a 2009 fundraiser in Greenwich, Connecticut.” CBS News From the Left The left is considering whether Biden’s behavior should preclude him from the 2020 presidential race. “Biden is a career politician and an extraordinarily charismatic one at that. His life’s work has been built on his ability to read individual people, gain their trust, make them feel comfortable, and modulate his emotions to mirror theirs. [But] even those of us with a less preternatural knack for schmoozing would surely be able to guess that a new acquaintance, a young woman trying to earn political power with an imminent speech, might not appreciate an unsolicited back-of-the-head kiss… 

“His famously touchy demeanor usually manifests as bro-y back slaps and bear hugs with men; with women, it’s a patronizing set of hands on the shoulders, an unsettlingly close lean, a kiss on the head… A politician concerned with gender equity might have given some thought to why that is.”

Some argue furthermore that “the widespread assumption that Biden would pose the strongest challenge to Donald Trump is unwarranted. In recent years, neither party has done well when they’ve chosen candidates who were meant to appeal to some elusive cadre of swing voters but lacked a robust grass-roots base. On paper, the war heroes John Kerry and John McCain looked electable; Obama and Trump did not… No one should judge the whole span of Biden’s career by the standards of 2019, but if he’s going to run for president, it’s fair to ask whether he’s the right leader for this moment. He is a product of his time, but that time is up.”

Others ask, “Is there someone better positioned to beat Trump?… His touching is often inappropriate and can be unnerving. He should cut it out and apologize to those who felt uncomfortable. However, this is not #MeToo sexual harassment or assault. In the crazed atmosphere of immediate takes and absolute judgments, it’s difficult for some to make distinctions, but that is what grown-ups are supposed to do. Biden’s habitual embraces can be inappropriate without being sexual harassment; his conduct can be a demerit without being disqualifying.”

A longtime aide and former press secretary of the Vice President writes, “From 2006 to 2011, I worked closely with Joe Biden on both his Senate and White House staff. I traveled the country and the world with him, certainly logging more miles and sometimes feeling as if I spent more time with him than I did with my own family. Wherever he was during those years, be it Wilmington or Baghdad, I wasn’t far away. I saw him at his best and his worst, in quiet moments and on the world’s largest stages. Through it all, in big ways and in the small ways that sometimes matter even more, he was, is and always has been a champion for women and equality.”

Alexander, USA Today From the Right The right points out that Biden’s behavior has been common knowledge for years, but does not think the allegations are in and of themselves disqualifying. “For a long time, Democrats benefited from a media mentality that almost always interpreted their traits through the most positive lens. Rahm Emanuel’s stabbing a table with a steak knife or sending a dead fish to some pollster wasn’t seen as a sign of psychological instability or rage issues; that behavior demonstrated he was a passionate, fiery competitor with a relentless drive. Bill Clinton was a passionate extrovert who wanted to connect with people, not a shameless womanizer… 

“For eight years, Biden got away with a lot because the media chose to perceive him as that ‘wacky, lovable Uncle Joe’ and if the media paid too much attention to his flaws outside of comic relief from the usually serious Obama, it would call into question Obama’s judgment in picking him.”

DRIVING THE DAY

THE PRESIDENT spoke Tuesday night at the NRCC’s annual spring dinner at the National Building Museum. Eli Stokols of the L.A. Times, Tuesday’s intrepid pooler, sat through the one-hour-twenty-eight-minute address, and here are the highlights:

— “[TRUMP] said House Republicans were ‘just taking a little break’ [from controlling the House] and joked that he took some of the blame for November’s results: ‘They blamed me. I said what the hell do I have to do with it.’ But he predicted, ‘we’re gonna take the House back.’”

— TRUMP ON BIDEN: “‘The socialists are really taking care of him,’ Trump said, apparently insinuating that Bernie Sanders supporters were behind recent stories about former Vice President Joe Biden making some women uncomfortable. ‘Our former vice president … I was going to say welcome to the world, Joe. You having a good time, Joe?’”

— TRUMP ON AOC: “‘The Great New Deal, done by a young bartender, 29 years old,’ Trump said.”

— TRUMP ON HEALTH CARE: “Continuing to speak about the raw politics of various issues, Trump claimed that Republicans have the immigration issue, but indicated that Democrats have the edge in one area: ‘They have healthcare right now … We have to take that away from them. We have to protect and cannot run away from a thing called preexisting conditions…”

“‘If you don’t support it, you have no chance of winning,’ he went on. ‘The Republican Party will be the champion of preexisting conditions … not only for politics, it’s also the right thing.’ … ‘I will be asking that this be my first vote immediately after the election,’ he said predicting that Republicans will win back the presidency and both chambers of Congress.

“Trump expressed regret about failing to repeal and replace Obamacare in the last Congress, obliquely complaining about former Speaker Paul Ryan and former Sen. John McCain. ‘We blew it last time … Man, I was fed a bill of goods.’”

NOTE: It was supposed to be the first vote after the last election!

WHAT PAUL RYAN IS UP TO … JANESVILLE GAZETTE: “Ryan said he is working at … the offices of a foundation he is establishing to work on the ideas in two laws he pushed through Congress to address poverty. His longtime chief of staff, Andy Speth, is running the American Idea Foundation, he said. The focus is to make sure the laws are ‘properly implemented,’ he said.

“Longtime Ryan campaign finance director Susan Jacobson, who is working for the foundation, said it will be launched later this year. Ryan said he also will teach economics and government courses at a Midwestern university. He couldn’t say where but said it would be announced soon. And he’ll be doing speaking engagements and is on the boards of some charities that focus on poverty, including one where he joins NFL great Deion Sanders to keep kids out of gangs in North Dallas, he said.” Gazette

THE BIG PICTURE … WAPO’S SEUNG MIN KIM and ERICA WERNER: “Trump leaves Washington reeling with policy whiplash as he struggles with domestic agenda”: “‘Obviously this is a president who tends sometimes to move on his own and then obviously has some of those conversations later,’ Senate Majority Whip John Thune (R-S.D.) said Tuesday of Trump’s recent push on health care and the border. ‘That’s the dynamic that everybody up here deals with.’

“During a conversation Monday, the majority leader made the case that while the GOP-led Senate could pass a health-care bill endorsed by Trump, the president would not be able to support the product that would emerge from the House once Democrats got their hands on it, the official said. McConnell told reporters Tuesday that he had a ‘good conversation’ with Trump and that he and the president were now on the same page. …

“‘I made it clear to him we were not going to be doing that in the Senate,’ McConnell said of health care, stressing the challenges of writing legislation that could pass muster with House Speaker Nancy Pelosi (D-Calif.). ‘We don’t have a misunderstanding about that.’” WaPo

POLITICO/MORNING CONSULT POLL … STEVEN SHEPARD: “Poll: Majority of voters don’t trust Trump on health care”: “The survey, conducted in the days after the Trump administration asked a federal court to strike down the entire Affordable Care Act, finds that a plurality of voters support former President Barack Obama’s signature legislation. Voters also trust Democrats over Republicans when it comes to health care, and a majority has little faith in the president to make the system better.” POLITICO

NYT’S ALEX BURNS and JONATHAN MARTIN: “Trump’s Takeover of the Republican Party Is Almost Complete”

ON BIDEN …

— NYT’S SHERYL GAY STOLBERG and SYDNEY EMBER: “Biden’s Tactile Politics Threaten His Return in the #MeToo Era”: “Joseph R. Biden Jr. came up in politics as an old-school backslapper whose greatest strength was his ability to connect. He doled out handshakes and hugs to friends and strangers alike, and his tendency to lavish his affections on women and girls was so central to his persona that it became fodder for late-night television jokes.

“But the political ground has shifted under Mr. Biden, and his tactile style of retail politicking is no longer a laughing matter in the era of #MeToo. Now, as he considers a run for president, Mr. Biden is struggling to prevent a strength from turning into a crippling liability; on Tuesday alone, two more women told The New York Times that the former vice president’s touches made them uncomfortable.

“For Mr. Biden, 76, the risks are obvious: the accusations feed into a narrative that he is a relic of the past, unsuited to represent his party in the modern era, against an incumbent president whose treatment of women should be a central line of attack. Mr. Biden has denied acting inappropriately but has said he will ‘listen respectfully.’

“So far, no prominent Democrat has suggested he not run, and the women complaining about him have not claimed sexual harassment or assault. Other women have stepped forward to say Mr. Biden’s touches were welcome. But the accusations lodged against Mr. Biden have raised questions about when a ‘tactile politician’ crosses the line into inappropriateness.” NYT

— MORE WOMEN: “Caitlyn Caruso, a former college student and sexual assault survivor, said Mr. Biden rested his hand on her thigh — even as she squirmed in her seat to show her discomfort — and hugged her ‘just a little bit too long’ at an event on sexual assault at the University of Nevada, Las Vegas. She was 19. …

“D. J. Hill, 59, a writer who recalled meeting Mr. Biden in 2012 at a fund-raising event in Minneapolis, said that when she and her husband, Robert, stepped up to take their photograph with the vice president, he put his hand on her shoulder and then started dropping it down her back, which made her ‘very uncomfortable.’”

— MARC CAPUTO, NATASHA KORECKI and ALEX THOMPSON, “New accusations strain Biden defense”: “The controversy surrounding Joe Biden’s past physical behavior with women seemed to have stopped metastasizing after a team of Democratic defenders fanned out in his defense, seeking to knock down the notion that his tendency to be touchy with women was anything more than innocent affection. …

“Prominent female voices including former Biden staffers, former Obama White House adviser Valerie Jarrett, actress-turned-activist Alyssa Milano and House Speaker Nancy Pelosi publicly voiced their support during the day, providing a degree of encouragement to Biden backers, supporters and possible staff hires who have watched with dread as his team struggled with the accusations of the first two women who said he made them feel uncomfortable in unrelated instances.” POLITICO

Subpoena scuffle divides Oversight committee

The House Committee on Oversight and Reform on Tuesday authorized Chairman Elijah Cummings to issue a subpoena for White House Personnel Security Director Carl Kline. Chaos Continues at the Border…and Back in D.C.
In response to President Trump’s threat to shut down the Southern border, Republicans including his top aides and Senate Majority Leader Mitch McConnell are warning the move could have “catastrophic” consequences.
 
“Closing down the border would have potentially catastrophic economic impact on our country, and I would hope we would not be doing that,” McConnell said.
 
Trump’s response?
 
“Sure, it will have a negative effect on the economy,” he told reporters yesterday in the Oval Office. “But to me, trading is very important, the borders are very important, but security is what is most important. I mean, we have to have security.”
 
Meanwhile, Democrats are still in denial that the situation along the border is, in fact, a real crisis. And while they’re quick to say “no” to anything President Trump or Republicans recommend, they’ve yet to offer a single solution of their own. (Hypocrisy much?)
 
More than 76,000 migrants crossed the border in February, and that total is expected to top 100,000 in March. The situation is so bad, that former Obama DHS Secretary Jeh Johnson is now speaking out.
 
“When I was in office in Kirstjen Nielsen’s job, at her desk, I’d get to work around 6:30 in the morning and there’d be my intelligence book sitting on my desk, the PDB, and also the apprehension numbers from the day before,” Johnson said. “And I’d look at them every morning, it’d be the first thing I’d look at. And I probably got too close to the problem, and my staff will tell you if it was under 1,000 apprehensions the day before that was a relatively good number, and if it was above 1,000 it was a relatively bad number, and I was gonna be in a bad mood the whole day,” he said.
 
“On Tuesday, there were 4,000 apprehensions. I know that a thousand overwhelms the system. I cannot begin to imagine what 4,000 a day looks like, so we are truly in a crisis.”
 


‘Equal Pay Day’ Isn’t Real
The Left is at it once again, making victims of the freest, most prosperous women in the world. Yes, I’m talking about us—American women.
 
In honor of Equal Pay Day, Mother Jones claimed the pay gap costs women $840 billion every year. CNBC reported it represents a $1 million shortfall for “some women.” 
 
But as our Thursday BRIGHT editor Inez Stepman wrote in The Daily Caller, this isn’t really true. 
 
“The Department of Labor compiled more than 50 peer-reviewed studies and concluded that the often-cited 77 cents on the dollar gap — calculated by comparing the average female wage with the average male one — was ‘almost entirely’ the result of differing career choices rather than discrimination,” she wrote, adding:
 
“Despite earning more degrees than their male counterparts, American women continue to frustrate left-wing feminists by making different work-life balance decisions. When given the same choices as men, women select different fields of study, value flexibility over salary, work fewer hours, and avoid physically dangerous employment.”
 
“Four out of five of the top-paying college majors have large majorities of male students, while the reverse is true of the five lowest-paid majors, where women boast large majorities in all but one. Women take about twice as many unpaid hours off, and men work 83 percent more overtime. And a plurality of mothers with young children still report that their ideal situation involves part-time, not full-time, work.”
 
More quick facts, from the Independent Women’s Forum:  Wage discrimination is illegal and has been in the U.S. since 1963, when the Equal Pay Act was signed into law. The 1964 Civil Rights Act also protects women from baseless gender discrimination in the workplace. “Equal Pay Day” is based on a misleading interpretation of wage data. The wage gap doesn’t take into account variables like profession, education, experience, benefits, work conditions, or hours worked. And it doesn’t compare men and women with the same jobs, experience, training, or hours. The wage gap is not a measure of “equal pay for equal work.” Instead, it’s largely a reflection of individual choices about work among women and men. When controlling for relevant factors, the pay gap shrinks to $0.98.  FWIW, I can’t help but find it ironic that on the same day the Left claims it’s advocating for women, it’s advocating to erase women with the Equality Act, which would treat womanhood as a mutable feeling rather than an immutable fact. Here are 7 reasons why the Equality Act is anything but.
 
Government Regulations Are Putting Homeowners Dreams on Hold
The Obama-era Dodd-Frank reforms, which came in response to the 2008 financial crisis, were meant to (in part) protect consumers from bad loans. But instead of helping, one Habitat for Humanity branch in Texas says the regulations are costing people homes.
 
“All across the state, Habitat affiliates, and there are dozens of them all over the state just like us, they have significantly limited the amount of homes they build each year,” Charley Coats, a director at the local Habitat branch in Bryan/College Station, told The Daily Signal. “In fact, there are a few of them [that] have actually had to shut their doors.”

“Amazon and Whole Foods Market announced a new round of price cuts on hundreds of items will start Wednesday with a focus on produce that may help the company start to shed the persistent ‘Whole Paycheck’ nickname.”
 
“Prices will be reduced by an average of 20% on select items throughout Whole Foods, according to a joint Amazon and Whole Foods statement.”
 
“Along with the price reductions, Prime members will find ‘double the number of exclusive weekly Prime member deals and deeper discounts,’ the statement said, noting ‘customers can expect more than 300 Prime member deals on some of the season’s most popular items.’”

Looking ahead to 2020, Joe Biden leads Donald Trump by nine in a head-to-head match-up. Bernie Sanders has a 3-point advantage while the president leads other Democratic contenders.Biden continues to attract far more social media chatter than any other Democratic nominee, but 55% of it is negative. Conversations involving Biden address gender equality more than anything else. For O’Rourke and Buttigieg, it’s immigration. For Sanders, taxation; Harris, union workers; and, Warren, climate change.
Today’s Number of the Day notes that federal spending for the first five months of fiscal 2019 is the highest in a decade. Before the year is out, federal spending will set an all-time record and top $4.5 trillion for the first time ever.
Finally, 43% of basketball fans believe the Michigan State Wolverines will win the NCAA Men’s Basketball Championship.
