BIDEN’S BLUES: Joe Biden’s potential 2020 candidacy may be in jeopardy before it even begins after a second woman has come forward to accuse former vice president of inappropriate touching … Amy Lappos, 43, first told the Hartford Courant in an interview published Monday that Biden grabbed her during a $1,000-per-plate October 2009 fundraiser for U.S. Rep. Jim Himes, D-Conn. Lappos, who was working as an aide for Himes at the time, said Biden’s action’s weren’t sexual, but that he did grab her. Tuesday, April 2, 2019 Facebook and Breaking Up Big Tech On Saturday, Facebook founder and CEO Mark Zuckerberg penned an op-ed calling for “new regulation in four areas: harmful content, election integrity, privacy and data portability… By updating the rules for the Internet, we can preserve what’s best about it — the freedom for people to express themselves and for entrepreneurs to build new things — while also protecting society from broader harms.”

Worth noting: Facebook is facing “a lawsuit from the Department of Housing and Urban Development, as well as a policy change regarding white nationalist and separationist content,” and other forthcoming changes.

Three weeks ago, Senator and Democratic hopeful Elizabeth Warren (D-MA) released a proposal to “make big, structural changes to the tech sector to promote more competition — including breaking up Amazon, Facebook, and Google.”
Elizabeth Warren, Medium From the Left The left is skeptical of Zuckerberg’s motives, and generally supportive of the intent behind Warren’s proposal. “All of this might sound reasonable on its face—Zuckerberg even endorsed leveling ‘sanctions’ against his own company when it screws up—but a skeptic might argue that the show of goodwill doubles as an attempt to pre-empt tougher laws. Partnering with D.C. lawmakers gives Facebook the chance to impose its viewpoint, and a front-row seat to whatever changes regulators may propose.”

“Facebook claims its users would be able to freely take their information from one network to the next, giving people the ability to choose where they spend their time while allowing competitors a fair chance at winning over audiences. In reality, Facebook already owns the lion’s share of much of the world’s social networking companies — Facebook, Messenger, Instagram and WhatsApp. And Mr. Zuckerberg is moving to integrate the messaging services he owns, further tightening the networks of users across all of his services… 
 
“Facebook also grew to an enormous size by collecting user data when there were virtually no online privacy regulations about this practice. If laws are enacted to limit data collection in the future, Facebook may be able to squash smaller companies who want to challenge Mr. Zuckerberg’s dominance in social networking.”

Some note, “I know what you’re thinking: isn’t Zuck just passing the buck? Hasn’t his company very publicly failed to tackle all of the issues he’s saying it’s up to governments to fix? You’re not wrong. The four areas he’s concerned about do happen to overlap with recent Facebook scandals. But that doesn’t mean his announcement isn’t good news… Businesses such as Uber and Facebook pride themselves on being ‘disruptors’, arguing the existing rules are too outdated to apply to them at all. And until now they haven’t been keen on any new rules to replace the old ones. The change of heart should be welcomed.”

Regarding Warren’s proposal, “Jeff Bezos didn’t come up with the idea of owning a marketplace and using it to sell your own stuff at an unfair advantage against rivals. Reading Railroad, for example, became the largest company in the world by owning the rails that carried anthracite coal, as well as the coal mines along the route. Rival coal producers that wanted to use the lines got less favorable rates, fell behind, and got swallowed up by Reading Railroad. Congress put a stop to it in 1906 by adopting the Hepburn Act, which prevented the railroads from carrying products that they owned… Warren’s central proposal — to structurally separate business lines in an effort to eliminate anti-competitive conduct and foster competition — has a century-old pedigree.”

Some caution that “the problem with applying a one-size-fits-four model to tech… is that the large tech companies have different business models that pose different anti-competitive risks. The stranglehold that Google and Facebook have on the digital advertising market is different from the way Amazon muscles out e-commerce brands, which is different from the way Apple uses its App Store to force burdensome terms on developers… 
 
“The possibility of unintended consequences means that tailoring regulations to address each of these problems is important. A law that banned Amazon from competing with third-party sellers on its platform could also cripple Chromebook laptops, or prevent iPhone users from getting access to their iTunes libraries. Rather than one giant package that crams everything together, a set of effective tech regulations would treat each problem [discreetly], and address each with surgical precision.”
Kevin Roose, New York Times From the Right The right is disturbed by the free speech implications of regulating content on Facebook, and critical of Warren’s proposal. “Facebook’s nominal raison d’etre is to serve as a space for empowering speech by people who might not have had a platform in ages past. That Zuckerberg would thus wish for government constraint over speech is deeply concerning… The founders rightly recognized that while some controversial ideas are inherently negative, others are immensely positive. But unlike Zuckerberg, they also realized that you can’t get the latter without tolerating the former.”

Zuckerberg “claims that ‘we,’ as society, now have a special responsibility to facilitate his efforts to keep people ‘safe’ from reprehensible rhetoric. We have no such obligation. Facebook already offers users the ability to block or ignore accounts they find distasteful. If they don’t like how Facebook is governing speech, they can quit… 

“Moreover, Zuckerberg wants to institute these plans in ‘common global framework.’ Well, Vladimir Putin recently signed a bill that makes it a crime to ‘disrespect’ the state and spread ‘fake news.’ France, who Zuckerberg says he is already working with, has passed hate-speech laws that allow the banning of political content. As do many other nations, including Canada. And let’s not forget fully authoritarian nations like China. Are those the countries that Zuckerberg trusts to assist the United States in instituting a framework for acceptable Internet speech?”

She argues that it was Washington’s trust-busting effort in the 1990s against Microsoft that helped give birth to Google and Facebook… These are dubious claims, at best. Microsoft didn’t miss the mobile revolution because it was distracted by the Clinton administration’s decision to sue the company over unfair dealings with Netscape… It’s much more likely that Microsoft fell into a trap that often ensnares large, dominant firms: It simply couldn’t adjust to a business paradigm shift where its model — desktop PCs running Windows — was no longer the center of the universe.”

“Warren’s proposal is obviously formulated without taking any account of the interests of users and consumers… Why does Google provide a tool without which it’s impossible to imagine contemporary life — and has opened up vast vistas of readily available information — for free? Because it can monetize it with advertising. Without the advertising revenue, which Warren insists should be a separate business, Google has no incentive to devote engineers to constantly improving its search engine… 

“Amazon doesn’t have anything close to a monopoly in food retail. Rather than taking over the sector, it’s spurring investment and innovation. The nation’s largest supermarket chain, Kroger was founded in 1883. It was slated to increase its spending on investment 200 percent in 2018, developing a self-checkout app and robot delivery, precisely because the space is so competitive. We’ve seen the same effect in retail. Falling behind Amazon, Target invested massively on improving across the board, and in one quarter in 2018, had its best sales growth in more than a decade. This past holiday season it sought to one-up Amazon by offering free two-day shipping. This is the market working.”

Good morning,
New polling on the Democratic presidential primary shows little change from a month ago. Vice President Joe Biden is still on top with 29% of the primary vote followed by Vermont Senator Bernie Sanders with 18% of the vote. There remains a wide gap between the two leaders and the rest of the pack. California Senator Kamala Harris and  former Congressman Beto O’Rourke are both at 6%. They are trailed by Massachusetts Senator Elizabeth Warren (5%), New Jersey Senator Cory Booker (4%), and South Bend Mayor Pete Buttigieg (3%).Biden also moved past Beto O’Rourke to take the lead on our social media monitoring of the race. However, the dynamics are interesting. Biden is attracting three times more chatter than O’Rourke or any other contenders. Yet, 55% of the chatter is negative. So, he still has more positive chatter than anyone else, but also far more negative chatter.Conventional polling shows that the former Vice President is still viewed favorably by 83% of all Democrats. This will be an important figure to watch as the intense scrutiny of Biden continues. Sanders gets favorable reviews from 74%.On the Republican side of the aisle, 64% of GOP voters want President Trump to be their party nominee in 2020. Eighty-nine percent (89%) believe it’s likely he will be the nominee.
Finally, 73% of voters nationwide consider Antisemitism to be a serious problem. Sixty-seven percent (67%) have a favorable opinion of Israel. That total includes 78% of Republicans, 67% of Independents, and 58% of Democrats.In the ongoing Middle Eastern conflict, 32% believe the U.S. should support Israel while 5% believe our nation should support the Palestinians.Among all voters, 45% support the decision of moving the U.S. embassy to Jerusalem while 26% are opposed. As for recognizing Israel’s sovereignty over the Golan Heights, 41% think it was a good decision while 24% disagree.Thirty-two percent (32%) believe Republicans are more supportive of Israel than Democrats while 15% believe the Democrats are more supportive. FIRST READ: Trump just turned the 2020 election into a referendum on health care

In a trio of tweets Monday night, President Trump simultaneously caved on health care – and also made the 2020 election a referendum on the issue.

He said: The Republicans are developing a really great HealthCare Plan with far lower premiums (cost) & deductibles than ObamaCare. In other words it will be far less expensive & much more usable than ObamaCare.”

And: Vote will be taken right after the Election when Republicans hold the Senate & win……back the House.

Of course, we know Republicans don’t have a plan – at least one that could pass Congress in 2017-2018.

And now Democrats are in charge of the House for at least the next year and half.

But for the short term, Trump’s decision to punt on health care for the time being relieves some anxiety for congressional Republicans after Trump’s Justice Department said the entire Affordable Care Act, a.k.a. Obamacare, is unconstitutional.

[We’re imagining this thought bubble for a GOP senator: “Phew, we don’t have to come up with another plan to repeal and replace Obamacare.”]

But in the long term, at least through the 2020 election, Trump’s tweets allow every Democratic campaign to say, “The president wants the presidential election to be a referendum on health care!”

And we saw how that played out in 2018…

Biden’s inevitable campaign no longer seems so inevitable 

After Friday’s accusation against Joe Biden – and after another one on Monday – there’s a question that should be on every single political reporter’s mind:

Is the former vice president really going to run for president in 2020?

What seemed inevitable a month ago no longer seems that inevitable right now.

Buzzfeed’s Katherine Miller nicely sums up the dilemma for Biden, as well as for the political news media:

“Everybody already knows what they think about Joe Biden putting his hands on people, because we’ve all seen this happen in public. We’ve seen Biden kiss people at public events! We’ve all had years to think about it! Does anyone need a photograph of Lucy Flores and Joe Biden to know that, at some point, somewhere, over the last 40 years, someone might have been uncomfortable because the situation wasn’t quite right?

But the current system still isn’t ready to handle a well-known, gray-area subject like this. As she said on TV over the weekend, Flores didn’t consider it sexual harassment, she just was uncomfortable, and we all know what she means.”

Harris reports $12 million for 1st quarter

Kamala Harris’ campaign last night said it raised $12 million for the quarter from 218,000 individual contributions.

(That’s since launching her presidential bid on January 21.)

To put Harris’ $12 million into perspective:

  • Pete Buttigieg, the only other Dem 2020er to reveal his first quarter numbers so far, said he raised more than $7 million. (He announced his exploratory committee on January 23.)
  • Beto O’Rourke raised $6.1 million in his first 24 hours after launching on March 14.
  • Bernie Sanders raised $5.9 million in his first 24 hours, and appears to be on pace to raise more than $20 million for the quarter after announcing on February 19.

The candidates have until April 15 to file their first quarter numbers with the Federal Election Commission.

2020 VISION: We The Policy Proposers

At yesterday’s “We The People” presidential forum in DC, several of the 2020 Dem hopefuls spelled out policy proposals, per NBC’s Ben Kamisar.

Julian Castro: felons should be allowed to vote in every state after they serve their time; $15 minimum wage; abolish the Electoral College; make Congress subject to Freedom of Information Act requests (FOIAs).

Cory Booker: more policies to stop mass incarceration; increased regulations on tech companies to protect privacy and security; defended the Senate filibuster.

Amy Klobuchar: In first 100 days as president, push for DC statehood, rejoining the Paris climate accord and passing comprehensive immigration reform. Also supported passing laws to allow felons to vote after leaving prison, and to have automatic same-day voter registration.

Beto O’Rourke: executive order for cabinet secretaries to hold a town hall each month with the public; redistricting reform; new Voting Rights Act; constitutional amendment reversing Citizens United.

Elizabeth Warren: get rid of private prisons; overturn Citizens United; equal access to voting; new bill for public housing; more aggressive enforcement to protect voting rights; and pursue her anti-corruption and anti-monopoly policies.

And here’s more from NBC’s Alex Seitz-Wald, Lauren Egan and Eileen Street at the forum:

“Sen. Bernie Sanders, I-Vt., said he does not support expanding the size of the Supreme Court, as a growing number of progressives have advocated, which would allow a Democratic president to tilt the ideological balance of the court back in their favor.”

On the campaign trail today … Kamala Harris travels to Nevada, where she keynotes a Battle Born Progress event in Carson City.

48 percent.

That’s the share of regular viewers of Fox News who say — based on what they’ve heard about the conclusion of Robert Mueller’s report — that the special counsel’s investigation has cleared Trump of wrongdoing, per our latest NBC/WSJ poll.

Compare that to 29 percent of Americans overall who say Trump has been cleared.

About one-in-five (22 percent) of those who regularly watch broadcast news to stay informed say the same, along with just 15 percent of regular MSNBC viewers.  
 
More MSNBC viewers say that Trump HAS NOT been exonerated compared with Fox News viewers who say that he HAS been cleared.

About two-thirds (64 percent) of MSNBC viewers say Trump was not cleared by the Mueller investigation, while 28 percent of Fox News viewers say he was cleared.
