Wedday, June 12, 2019 YouTube’s Crowder Controversy Last week, Vox journalist Carlos Maza accused conservative comedian Steven Crowder of harassing him on YouTube. YouTube initially determined that Crowder had not violated any policies. However, it then reversed course and demonetized Crowder’s channel, preventing him from receiving ad revenue but leaving his content online. Twitter, Business Insider From the Left The left urges YouTube and other tech companies to increase transparency, host public forums, and develop better policies. Some argue, “If the repeated harassment in these videos doesn’t cross the line by YouTube’s standards, then your line needs to be moved. Without a serious change to YouTube’s interpretation of its standards, Crowder is free to continue to make videos where he hurls slurs at journalists and creators, who will then keep getting hit with the same sort of harassment, invective, and dangerous leaking of personal information that Carlos has continued to experience from Crowder’s fans.”
Lauren Williams and Joe Posner, Vox

“If you engage your right to say what you want, you’d better be prepared to face the consequences of that. If you refer to a gay guest as a ‘lispy queer,’ as Crowder did on his podcast, you’d better be prepared to be held accountable by people who are offended, including the corporate executives who allow Crowder to present such remarks on their platform… if you want to blurt homophobic smears, white power agitprop or ludicrous conspiracy theories about the Sandy Hook massacre, create your own platform and knock yourself out. Until then, don’t act bewildered or run crying to the president when you’re booted off a platform you neither own nor control.”
Bob Cesca, Salon

Others contend that “Crowder is a comic, doing exactly what comics do: Mocking a public figure… He didn’t claim that heterosexual white guys are inherently superior to Latino homosexuals (although I would not be surprised if he believes it). He didn’t dox Maza (who is actually of Cuban, not Mexican, descent) himself or even ask his fans to it for him. He didn’t call for violence or harassment or issue any threats. He didn’t even lie about him. He made fun of the guy. That’s it… There’s nothing illegal about that, and if YouTube does reverse its decision and start to ban everyone who mocks people for their sexuality or race, they’re going to have to ban a whole lot of queer people of color who enjoy making fun of straight white dudes next. That’s not a precedent I’d like to see set.”
Katie Herzog, The Stranger

“The problem for YouTube is that for rules to be taken seriously by the people they govern, they need to be applied consistently and clearly. And YouTube has done a very bad job of that. Crowder’s behavior was okay, until 12 hours later it wasn’t; Alex Jones was okay, until he wasn’t; clips of feminists being beaten up in a video game were okay, then they weren’t, then they were again. The company has a habit of tacking between empty, tedious literalism and broad, sweeping judgment as it moves back and forth in its moderation decisions.”
Max Read, New York Magazine

“The primary principle guiding YouTube in these cases appears to have been the imperative to avoid making very many people very angry very publicly… YouTube could have said from the outset this week that its commitment to providing a forum for public figures to argue with each other over political topics outweighed its commitment to preventing cruelty or protecting the marginalized, if that’s what it believes. It could have said the opposite. Or it could have said that the doxxing and other attacks Maza was suffering from Crowder’s followers made the balancing act moot, because any content that leads to real-world harm is unacceptable…

“Instead of dispensing a bunch of unsigned tweets full of byzantine reversals, YouTube also could have told us how it was coming to its decision. Better yet, it could establish a transparent process, like the sort of oversight board Facebook is crafting, untethered to profits or stock price. Platforms need to do the work and show their work — show not only that they have rules but also that those rules are built on a foundation of principle and that the principle is more meaningful than just trying to avoid making people angry on the Internet.”
Molly Roberts, Washington Post

“Hosting and delivering information means, inevitably, making choices about how and why to do so — through the design itself and the policies imposed. It is only a question of what the rules should be, how they are enforced and — I think this is important — who should make them… platforms [should] make space for that debate to occur, publicly and among its users, and then enforce the conclusions they reach. It should matter what Maza thinks, what Crowder thinks, what I think and what all of us think — more so than what YouTube thinks.”
Henry Farrell, Washington Post

Some say, “Bring back the golden age of broadcast regulation… In today’s terms, that might mean actual rules against broadcasting hate speech that is sure to reach a large audience—like a channel that has more than a certain large number of subscribers… It could mean an obligation to regularly report on efforts to purge viral misinformation or regular reporting on removing foreign and domestic actors who create fake accounts intended to meddle in electoral politics. It could mean clear requirements for handling user data responsibly or not allowing ads that lead to discrimination, like in housing and employment…

“Corporations that want to make as much money as possible will always prioritize profits above all else. Protecting the safety of their users will always come second. That’s where laws are supposed to come in. It’s time we got some.”
April Glaser, Slate

Others think that “regulation on the basis of speech is bound to be a disaster — and probably unconstitutional to boot. And the people who are currently in power aren’t just weirdly comfortable with white nationalism, there’s a strong antipathy toward journalism and free speech. It would be a self-own to give the government more power over speech. My ‘hope’ here is that breaking up Google and YouTube would do a lot to stem the network effects from being the only game in town.”
Charlie Warzel and Sarah Jeong, New York Times From the Right The right believes YouTube was wrong to demonetize Crowder and that tech companies discriminate against conservatives, but cautions against government intervention. “Steven Crowder’s mocking Carlos Maza as a ‘lisping queer’ is ugly and stupid. It is not violence, near to violence, or even rhetorically violent. And the protestations of Mark Zuckerberg and his fellow technology titans notwithstanding, suppressing that kind of speech has nothing to do with ‘public safety.’ It has to do with Carlos Maza’s stated desire to ‘humiliate’ and, if possible, to silence those who see the world in a different way. That Google and Twitter and Facebook and other companies choose to make themselves a party to that is shameful, and a disservice to democratic discourse.”
Kevin D. Williamson, National Review

“Given [that] Crowder is a comedian, you would figure that mocking is a regular part of his shtick—and given [that] there are so-called ‘mainstream’ comedians who have said a whole lot worse about other people (I’m looking at you, Samatha Bee and Stephen Coal-bert), why some Vox writer getting his Underoos in a bunch would warrant such drastic action from YouTube would seem to be a mystery. That is, until you consider that the likes of Bee and Coal-bert are avowed liberals, whereas Crowder is a conservative.”
Marc Giller, The Resurgent

“There are many who might say they are fans of comedy, but can’t support offensive comedy. I understand the desire to live in a society where no one is ever made uncomfortable. But as with all attempts to create utopia, trying to weed out offensive material will do far more harm than good. In an effort to crack down on what it deems to be hate speech posted on its website, YouTube has also been deleting educational and historical videos on Nazism. This isn’t merely a flaw in YouTube’s processes—it is simply impossible to create an objective standard for offensive speech…

“When people are banned from speaking publicly, we miss out on new ideas, and we lose the ability to debate bad ideas. We thus stagnate into the status quo of whatever is considered acceptable at the time. Whether the fear of speaking out stems from government censorship or actions from private citizens, the stagnation occurs all the same. Like them or not, it is those who have been willing to step outside the bounds of acceptable language who have been able to push important conversations into new territory.”
Eric Cervone, Townhall

“As a private company YouTube has the right to choose which content it hosts. But YouTube also has a moral and social responsibility to the maximal exchange of information and ideas. History tells us that it is a bad idea to censor ideas most of us consider bad, Nazis included… In preventing viewers from witnessing the evil absurdities of neo-Nazi videos, YouTube will also obstruct those who know little about the Nazis from knowing why Nazism is so bad. Remember, the source of Nazi power is the ability of its agents to present its immorality as a cause of necessary virtue. The best weapon against that effort is maximal public debate of Nazism. Its nature, unveiled, is rightly repellent to most.”
Tom Rogan, Washington Examiner

In a similar vein, “conservatives should think twice before endorsing government policing of speech online. They won’t like the rules they get and will regret selling out their principles to get them… Letting the government patrol content has never been a boon for conservative voices. The Federal Communications Commission’s defunct 1949 Fairness Doctrine, required broadcast license holders to align their content with what FCC regulators deemed honest, equitable, and balanced. In practice, the doctrine resulted in the stifling of speech deemed controversial because of the threat of federal investigations and fines…

“Need further proof that government regulation of speech on social media is a bad idea? Behold Mark Zuckerberg’s written request for it in a March Washington Post op-ed: ‘Regulation could set baselines for what’s prohibited and require companies to build systems for keeping harmful content to a bare minimum.’ Zuckerberg calling for regulation? Isn’t regulation big business’ worst fear? Not when you’re the market leader like Facebook is right now. With a $478 billion market cap, Facebook will have a seat at the table when the regulations are crafted and can afford compliance costs. Not so for the next, yet-to-be-created, social media competitor.”
Jessica Melugin, Fox News

“Conservatives have to engage two audiences, first and most directly the small audience of men and women who hold the levers of corporate power. Do not presume bad faith. Do not presume that every key executive in every social-media company has closed his or her mind… At the same time, conservatives need to reach the very large audience of indifferent Americans who either don’t see the problem with demonetizing a comedian they don’t know or don’t fear the slippery slope enough to take any meaningful action. This is the longtime challenge of the free-speech advocate, to convince people to care about free speech even when the relevant speaker says words they don’t like. This is an old problem, but free-speech advocates have won that argument for a very long time. They can win it again.”
David French, National Review

Some, however, note that “Section 230 of the 1996 Communications Decency Act explicitly states that ‘interactive computer services’ are not publishers (so, unlike newspapers, they can’t be held responsible for bad stuff that appears on their platforms)… Yet Section 230 (a)(3) explicitly assumed that online platforms would ‘offer a forum for a true diversity of political discourse’… The network platforms handle far too much content to be effective publishers. They are entitled to Section 230’s protection — but only if they uphold the diversity of discourse envisaged by Congress. The alternative is to repeal Section 230 and impose on big tech something like a First Amendment obligation not to limit free speech.”
Niall Ferguson, Boston Globe On the bright side…

See More Top Stories Is ‘Democratic Socialism’ a Cover for Communism?
By Christopher Hull

Last month, Sen. Bernie Sanders claimed to oppose Soviet “authoritarian communism” and to support “democratic socialism.” Yet, according to Bishop E.W. Jackson, chairman of the new group Stand Against Communism, “Socialism and communism are exactly the same, and we will not allow euphemisms to lull us to sleep.” Who is right? By Andy Puzder

China’s recent “threat” to restrict sales of rare earth minerals to the United States is actually a tremendous opportunity for America. Although China currently dominates global production of rare earth minerals—which are vital for high-tech electronics, military hardware, and other crucial products—that won’t be true for long if Beijing imposes higher tariffs or stricter export quotas as leverage in its ongoing… Read more
See More Opinions Democrats Allow Communists to Infiltrate Their Party Across the Nation
By Trevor Loudon

The Communist Party USA is infiltrating the Democratic Party across the country. Communists, some openly, some secretly, are working in Democratic campaigns, holding Democratic Party leadership positions, and even running for public office on the Democratic Party ballot line. They also are pushing their policies inside the Democratic Party, to the point where it’s almost impossible to distinguish between the CPUSA and Democratic Party programs. They do this work 15 hours a day, while being fed subsistence meals and receiving a pittance or no pay at all. Some inmates, exhausted, are shown lying down to sleep under their work tables. Those who protest their mistreatment are badly beaten. One video shows an inmate, injured from such a beating, shackled to his bed. POLITICO Playbook: That old shutdown feeling

By ANNA PALMER, JAKE SHERMAN and DANIEL LIPPMAN

Presented by

Senate Majority Leader Mitch McConnell

DRIVING THE DAY

HAS NO ONE LEARNED ANYTHING? … Washington is just four months removed from the longest government shutdown in American history and …

… AT THIS MOMENT, there’s no plan to raise the debt limit just a few months ahead of the deadline.

… THERE’S NO DEAL IN PLACE to avoid $100 billion in spending cuts that take hold at the beginning of next year. Senate Majority Leader MITCH MCCONNELL (R-Ky.) seems less than eager to negotiate with OMB Director Russ Vought and chief of staff MICK MULVANEY. Instead, the White House has deputized Treasury Secretary STEVEN MNUCHIN, a man who has never in his life led a successful fiscal negotiation with Congress. More on that from Burgess Everett, Nancy Cook and John Bresnahan

… THE SPEAKER OF THE HOUSE told CNN’s Manu Raju yesterday she was “done” with President DONALD TRUMP, showing just how little patience she has for the president, even with daunting deadlines looming.

BREAKING OVERNIGHT … AP/HONG KONG: “Hong Kong police use tear gas on protesters”: “Hong Kong police have used tear gas, pepper spray and high-pressure water hoses against protesters who have laid siege to government buildings to oppose a contentious extradition bill.

“Thousands of protesters blocked entry to Hong Kong’s government headquarters Wednesday, delaying a legislative session on a proposed extradition bill that has become a lightning rod for concerns over greater Chinese control and erosion of civil liberties in the territory.

“The protesters overflowed onto a major downtown road as they overturned barriers and tussled with police outside the building that also houses the chambers where the legislature was to discuss the bill, which would allow criminal suspects in Hong Kong to be sent for trial in mainland China.” AP

NEW … BIG PROBLEMS BREWING ON 1ST STREET SE … MELANIE ZANONA and JAKE: “Liz Cheney clashes with NRCC chief behind closed doors”: “Rep. Liz Cheney, the No. 3 House Republican, privately battled with the chairman of the [NRCC] Monday night, where she raised concerns from members about the direction of the party’s campaign arm as they try to win back the chamber.

“Rep. Tom Emmer of Minnesota used a members’ only leadership meeting Monday night to press lawmakers about their party dues and contributions to the party committee. At one point, he questioned whether Cheney would continue to contribute campaign cash to the NRCC, according to multiple sources.

“Cheney, the House Republican Conference chair who outranks Emmer, fired back that she has met her fundraising benchmarks and paid her party dues. The Wyoming Republican — who is mulling a Senate bid after Sen. Mike Enzi declared his retirement — countered that some members are concerned Emmer is artificially inflating the fundraising numbers he brings in, according to sources.

“Cheney also told Emmer that some lawmakers are worried about the campaign arm’s general strategy going forward as it seeks to rebuild the GOP’s fortunes in 2020.” POLITICO

— THE NO. 3 HOUSE REPUBLICAN going after the chairman of the NRCC in such sharp terms is certainly unusual. Cheney is questioning Emmer’s stewardship of the organization 17 months before the election, and Emmer is wondering if he could count on Cheney to continue to dole out money.

MEANWHILE … SARAH FERRIS and HEATHER CAYGLE: “Steny Hoyer faces storm over congressional pay boost”: “House Majority Leader Steny Hoyer led the charge this week in pushing the first pay raise for members of Congress in a decade. But now he’s paying for it.

“The No. 2 House Democrat is taking fire from across the caucus after trying to enact the salary hike, a move some vulnerable Democrats fretted would be politically disastrous and could even cost them their seats next year. …

“Hoyer is now waging war on multiple fronts — an ugly public relations battle, a fraught fight with Republicans, and fierce criticism within his own party, including some close allies — in an effort to give lawmakers a cost-of-living boost.” POLITICO

Good Wednesday morning. Donald Trump Jr. is testifying before the Senate Intelligence Committee today, per AP: “Senators want to discuss answers Trump Jr. gave the panel’s staff in a 2017 interview, as well as answers he gave to the Senate Judiciary Committee in a separate interview behind closed doors that year.”

DEFENSE ONE’S PATRICK TUCKER: “EXCLUSIVE: U.S. Intelligence Officials and Satellite Photos Detail Russian Military Buildup on Crimea”

A message from PhRMA:

There are wrong and right prescriptions for changing Medicare. Seniors need Washington to focus on the right ones. Cutting costs for everyone except seniors and limiting access to lifesaving medicines are the wrong prescription for Medicare. Making changes that help seniors pay less out-of-pocket are the .

FOR JARED … TIMES OF ISRAEL: “Erekat pleads with Arab states: Do not undermine Palestinian cause for your gain”: “A top Palestinian official is urging Arab states that have decided to participate in the U.S.-led economic workshop in Bahrain later this month against advancing their own interests at the expense of the Palestinian cause.

“Saeb Erekat, the secretary-general of the Palestine Liberation Organization’s Executive Committee, made the plea in a wide-ranging interview with The Times of Israel at his Ramallah office on Sunday. …

“[H]e predicted that Jared Kushner, a key architect of the American peace plan, will not be pleased with the public statements Arab delegations will make at the summit. ‘This conference in Manama will be the biggest setback and embarrassment for Kushner,’ Erekat said, ‘because I know that no Arab will [attend] without saying: ‘Palestinian state with East Jerusalem as its capital living side by side with Israel on the 1967 borders.’” Times of Israel

WEST WING ZEITGEIST … WAPO’S ASHLEY PARKER: “Trump doesn’t want to be impeached — but he is fascinated by ‘the I-word’”: “President Trump has threatened to take legal action if Democrats try to impeach him, musing that he’ll ‘sue.’ He has peppered confidants and advisers with questions about how an impeachment inquiry might unfold. And he has coined his own cheeky term — ‘the I-word’ — to refer to the legal and political morass that threatens to overshadow his presidency as he heads into his 2020 reelection campaign.

“As Democrats struggle with how to handle calls from their liberal flank to impeach the president, Trump himself is eager to avoid such proceedings — while also fixated on his belief that Democrats can’t impeach him because he has done nothing wrong, according to interviews with 15 White House aides, outside advisers, Republican lawmakers and friends, many of whom spoke on the condition of anonymity to share candid conversations.

“The president is intrigued by the notion of impeachment but wary of its practical dangers, one outside adviser said. Trump remembers how Republican impeachment proceedings in the late 1990s against President Bill Clinton seemed to boost Clinton’s approval ratings, and Trump is at his best when battling a perceived foe, several advisers added.

“Yet he also views impeachment in deeply personal terms. He is less concerned about the potential historical stain on his legacy — Clinton and Andrew Johnson are the only presidents to have been impeached — and more about what he sees as yet another Democratic attack on the legitimacy of his presidency, according to an outside adviser and a White House aide.” WaPo

HAPPENING TODAY … BERNIE SANDERS ON ‘WHAT DEMOCRATIC SOCIALISM MEANS TO ME’: “The Vermont senator is set to deliver a full-throated defense Wednesday of democratic socialism — a label that has helped inspire a movement to elect him president while at the same time raising persistent doubts about his electability. In an interview with POLITICO, Sanders said his goal for his speech at George Washington University is to explain ‘what democratic socialism means to me, and in fact what democratic socialism means to me is a continuation of what Franklin Delano Roosevelt talked about.’” More from Holly Otterbein’s interview of Sanders

— WHAT HE’LL SAY: “Over 80 years ago, Franklin Delano Roosevelt helped create a government that made huge progress in protecting the needs of working families. … Today in the second decade of the 21st century, we must take up the unfinished business of the New Deal and carry it to completion.”

— ON CAPITALISM: “In 2008, after their greed, recklessness and illegal behavior created the worst financial disaster since the Great Depression — with millions of Americans losing their jobs, their homes and their life savings — Wall Street’s religious adherence to unfettered capitalism suddenly came to an end. … Overnight, Wall Street became big-government socialists and begged for the largest federal bailout in American history — over $1 trillion from the Treasury and even more from the Fed.”

JOSH HAWLEY GETS A SCALP — “Michigan judicial nominee Bogren withdraws from consideration,” by Detroit News’ Melissa Nann Burke: “[Michigan attorney Michael Bogren’s] withdrawal comes after his nomination had faced unusual public rebuke by three Republicans on the Senate Judiciary Committee who accused him of comparing Catholic beliefs to those of the Ku Klux Klan and exhibiting personal ‘hostility’ toward religious faith.” Detroit News

TRUMP INC. — “Trump’s Net Worth Rises to $3 Billion Despite Business Setbacks,” by Bloomberg’s Shahien Nasiripour and Caleb Melby: “President Donald Trump’s net worth rose to $3 billion, a 5% gain over the past year, thanks to a jump in the value of an office-building deal he once sued to prevent.

“The increase in Trump’s wealth reverses two years of declines and brings his net worth back to 2016 levels, according to figures compiled by the Bloomberg Billionaires Index from lenders, property records, securities filings, market data and a May 16 financial disclosure. It comes despite setbacks at his family company, including the cancellation of two new hotel chains and reduced business at his Mar-a-Lago resort in Florida and seven golf courses.” Bloomberg

2020 WATCH — “As 2020 Candidates Struggle to Be Heard, Their Grumbling Gets Louder,” by NYT’s Lisa Lerer and Reid Epstein: “‘It’s a ‘Hunger Games’ situation,’ Senator Amy Klobuchar told reporters over the weekend. ‘I’ll start with that.’ The bloated Democratic primary field is aggrieved, available and aggressively thirsty. Of the 23 candidates running, only eight routinely break 1 percent in national polls. Most have not yet qualified for the fall debates. And cable news channels, which have emerged as an early driving force in the race, have only so many hours of programming each day.

“That has moved the campaign into a new, yet familiar, phase: the ritual airing of grievances. Weeks’ worth of pent-up frustration is beginning to trickle into the public arena, as a way for candidates to explain their lowly positions — both to themselves and to the voters.” NYT

— NPR: “Harris: Justice Dept. ‘Would Have No Choice’ But To Prosecute Trump After Presidency”

— JOHN F. HARRIS ON THE TRUMP-BIDEN SPLIT: “Iowa has a senior moment: The showdown between Donald Trump and Joe Biden was as much about psychological intimidation as political persuasion.” POLITICO

MONEY LINE: “Trump mocks his leading opponents because that’s what he has always done, giving no more thought than a shark does about whether he prefers to bite first in the swimmer’s thigh or torso.”

— WaPo’s Matt Viser (@mviser): “Joe Biden has done something no other Democrat has been able to do in this race: Command attention from all cable networks, and have them stream his entire event live.”

WAPO’S GREGORY SCHNEIDER, JENNA PORTNOY and LAURA VOZELLA on primary night in Virginia: “Virginia Democratic voters signaled impatience with establishment politicians in primary elections Tuesday, sending home one high-profile state senator who had been embraced by top leaders and giving the scare of a lifetime to another.” WaPo

TRUMP’S WEDNESDAY — The president and first lady Melania Trump will participate in the arrival and bilateral meeting with Polish President Andrzej Duda and the first lady of Poland Agata Kornhauser-Duda at 12:10 p.m. in the Oval Office. Trump and Duda will have a working lunch in the Cabinet Room at 12:35 p.m. The two will participate in a joint signing ceremony at 1:40 p.m. in the Diplomatic Reception Room followed by a joint press conference at 2:15 p.m. in the Rose Garden. Trump and the first lady will attend the Polish-American reception at 5:15 p.m. in the East Room.

GOOD QUESTION … NYT’S MARK LEIBOVICH: “23 Democrats Are Running for President. Do Any of Them Know What They’re Doing?”

KNOWING PAT CIPOLLONE … ELIANA JOHNSON: “In six months on the job, Cipollone has turned the White House Counsel’s Office into a central hub of activity and made himself a constant presence in the Oval Office. A 53-year-old former corporate lawyer with an affable style, he has also made enough of an impression on Trump that the president has begun asking aides for their assessment of the White House’s top lawyer — a sign that, at the least, Cipollone has his client’s attention.” POLITICO

NYT’S CORAL DAVENPORT: “Climate Change Poses Major Risks to Financial Markets, Regulator Warns”: “A top financial regulator is opening a public effort to highlight the risk that climate change poses to the nation’s financial markets, setting up a clash with a president who has mocked global warming and whose administration has sought to suppress climate science.

“Rostin Behnam, who sits on the federal government’s five-member Commodities Futures Trading Commission, a powerful agency overseeing major financial markets including grain futures, oil trading and complex derivatives, said in an interview on Monday that the financial risks from climate change were comparable to those posed by the mortgage meltdown that triggered the 2008 financial crisis.

“‘If climate change causes more volatile frequent and extreme weather events, you’re going to have a scenario where these large providers of financial products — mortgages, home insurance, pensions — cannot shift risk away from their portfolios,’ he said. ‘It’s abundantly clear that climate change poses financial risk to the stability of the financial system.’”

HMM … USA TODAY: Rep. Greg Pence amends filing that showed lodging charge at Trump hotel”: “Greg Pence, a freshman congressman and brother of Vice President Mike Pence, reported spending more than $7,600 in campaign funds on lodging at the Trump International Hotel in the first few months after his election in November, although lawmakers are supposed to pay for their own housing in Washington.

“After USA TODAY asked about the expenses included on his Federal Election Commission disclosure reports, Pence’s spokesman, Kyle Robertson, declined to say whether the Indiana Republican stayed at the hotel before getting an apartment in Washington.

“Hours after USA TODAY pressed for more detail on the nature of the lodging expenses, the campaign filed an amended FEC report that changed the designation of the expenses to ‘fundraising event costs.’”

VALLEY TALK — “Tech elites dismiss breakup threats from Washington,” by Nancy Scola at the Code Conference in Scottsdale, Arizona: “The idea that Silicon Valley’s biggest companies should be broken apart has gotten momentum in recent months in both parties in Washington, as both Trump administration regulators and Democrats like Sen. Elizabeth Warren express interest in curbing the dominance of companies like Google, Facebook and Amazon. But leaders from several major American tech companies insist that trust-busting worries are far from their minds …

“‘We don’t spend a lot of time talking about it,’ Andy Jassy, CEO of Amazon Web Services, said about the possibility that federal regulators could spin off his unit from its parent company, Amazon.” POLITICO

— WSJ: “Chinese Cash That Powered Silicon Valley Is Suddenly Toxic,” by Rolfe Winkler: “The FBI office has conducted hundreds of briefings for companies on cybersecurity threats and economic espionage. It discourages people from using their regular smartphones and laptops when traveling in China and warns male U.S. executives to avoid ‘honeypot’ espionage attempts by attractive women. ‘If you’re not a 10 in the U.S., you’re not a 10 in China,’ officials say they’ve told the executives.”

MEDIAWATCH — “MSNBC and New York Times at odds over reporter appearances on Maddow,” by CNN’s Brian Stelter: “New York Times executive editor Dean Baquet and MSNBC president Phil Griffin met last week amid tensions between their two news organizations. But the lengthy lunch did not resolve the issues at hand, according to four sources with knowledge of the sit-down.

“The executives remain at an impasse. The specific issue is about television appearances by Times reporters on Rachel Maddow’s MSNBC show. The larger issue is about the line between news versus opinion on cable networks, including CNN.” CNN

It consisted of one person, Elizabeth Jensen, from NPR, the last remaining full-time public editor or ombudsman at a major news outlet in America. …

A message from PhRMA:

There are wrong and right prescriptions for changing Medicare. Seniors need Washington to focus on the right ones. There’s a lot of talk in Washington about changing Medicare to reduce costs. But while many proposals would cut costs for governments and insurers, they won’t cut costs for seniors; and even worse, they would limit access to the medicines that could save their lives – now and in the future. Cutting costs for everyone except seniors and limiting access to medicines are the wrong prescription for Medicare. On the other hand, making changes that help seniors pay less out-of-pocket are the .

The Resurgent’s Morning Briefing for June 12,2019 View this email in your browser Share Tweet Forward Good morning,

Here is all the news conservatives need to know to start their day.  At 4pm ET, you can catch me on radio to bring you up to speed on developments throughout the day.  You can listen live here.

The President Should Withdraw the Nomination of Halil Suleyman (“Sul”) Ozerden or the Senate Should Reject Ozerden Halil Suleyman (“Sul”) Ozerden is the President’s nominee for the 5th Circuit Court of Appeals. The nominations process for circuit court nominees has largely been uneventful throughout this President’s term and conservatives have widely supported his circuit court nominees. It is notable that conservatives across the political spectrum are starting to speak out against Ozerden. Ozerden currently sits on the federal bench in the Southern District of Mississippi. President George W. Bush nominated Ozerden in 2007. What is most remarkable about Ozerden is how unremarkable his track record is except for one detail. Every DC lobby’s favorite way to buy Democrats off: Minority caucuses and interest groups In the era of hyper-regulation-and-taxation-happy Democratic Socialists, it’s tough for big businesses to get any love– or even neutrality– from today’s Democratic Party. When it comes to rainbow flags, Mike Pence is right and Franklin Graham is wrong. The recent flap (pun intended) over rainbow flags on American embassies has revealed another layer of hypocrisy in the punditocracy. It started because Secretary of State Mike Pompeo reversed the Obama administration’s policy of our American embassies flying the rainbow flag to celebrate gay pride. Naturally, the gay rights community has been outraged. LEGAL INSURRECTION

Share This   Professor Jacobson’s op-ed discussing the Oberlin case is featured today’s Wall Street Journal. An excerpt: On a different campus on a different day, it is unlikely a simple shoplifting case would have gained much attention. But the incident occurred the day after Donald Trump was elected president, in the wake of which Oberlin students appeared ready to build on the school’s history of left-wing activism to exercise their angst. Thus this otherwise unexciting crime became their cause célèbre…. This historic case received scant media attention during the trial. My publication, Legal Insurrection, was the only national outlet to be present for the entire trial, because we felt Gibson Bros. v. Oberlin College was emblematic of tensions in American culture, particularly the “town vs. gown” divide that pits activist colleges against the places that host them…. For Oberlin, it didn’t have to end this way. At the height of the controversy, the Gibson family says it asked the school to send a letter to students reiterating what had already become clear: The bakery didn’t engage in racial profiling. Administrators refused. Had the college agreed to refute the baseless claims of racism, it is unlikely that the Gibson family would have pursued the matter in court. This might remind you of 2017 Politico report that found that the Obama administration undercut efforts to disrupt Hezbollah’s drug trade in the U.S., apparently, also, to protect the nuclear deal. I might point out that Iranian IRGC-Quds Force Commander Qassem Soleimani – under an international travel ban – traveled to Moscow in July 2015 to enlist Russia’s support in propping Bashar Assad. Russia has been an essential ally to Assad and Syria, and ensured that the mass killing would accelerate. There are other incidents that we can point to to show that the nuclear deal wasn’t just a disaster for failing to prevent Iran from developing nuclear weapons but because it served as a license to Iran to expand its aggression across the world.”                 Legal Insurrection Foundation is a Rhode Island tax-exempt corporation established exclusively for charitable purposes within the meaning of Section 501(c)(3) of the Internal Revenue Code to educate and inform the public on legal, historical, economic, academic, and cultural issues related to the Constitution, liberty, and world events. AOC Already Wants a Raise
Apparently, the modest salary of $174,000, plus benefits, isn’t enough for socialist Democrat AOC. The freshman Democrat told reporters the $4,500 pay hike her party proposed as part of a new spending bill is “not even like a raise.” She said:

“It may be politically convenient and it may make you look good in the short term to say, ‘Oh, we’re not paying for pay increases,’ but we should be fighting for pay increases for every American worker. We should be fighting for a $15 minimum wage pegged to inflation so that everybody in the United States with a salary, with a wage, gets a pay increase. Members of Congress, retail workers, everybody should get cost of living increases to account for changes in our economy. And then when we don’t do that, it only increases the pressure on members of exploit loopholes like insider trader loopers to make it on the backend.”

In sum: AOC thinks the solution to preventing members of Congress (including herself!) from engaging in insider trading and exploiting loopholes isn’t to do their jobs and pass laws making these things illegal. No—it’s to reward members of Congress for engaging or wanting to engage in illegal and/or immoral behavior by paying them more! Doh!

As The Federalist’s Joy Pullmann put it,“’Guys, I need to earn $174k/year or I just might have to steal’ may be the most socialist thing ever said.”

Salaries for members of Congress, of course, are paid for by American taxpayers, whose median household income is $59,000/year. This amounts to about one-third of what members of Congress make. Does anyone, besides the Democratic socialist who wants to take everyone else’s money, really think they deserve more?

In AOC’s defense, House Minority Leader Kevin McCarthy and House Minority Whip Steve Scalise reportedly supported the measure, which House Democrats yanked from consideration after pushback from within their own caucus.

🥊Trump v. Biden: Round 1🥊
Let the games begin. The president and the Democratic frontrunner went at it yesterday, trading insults at dueling events in Iowa.

Trump said he’d rather run against Biden more than any other Democrats running for president.

“I think he’s the weakest mentally. I like running against people who are weak mentally. I think he is the weakest up here [pointing to his head],” Trump said, according to Politico. “The other ones have much more energy. I don’t agree with their policies, but I — I call him 1 percent Joe, because until Obama came along he did very well.”

During his speech, Biden mocked Trump, saying, “he’s got his tail between his legs. He also hit Trump on a number of his policy positions, including his ongoing trade wars, his climate agenda, and his stance on Obamacare. He also attempted to walk back his comments dismissing the China threat, calling on allies to present a “united front” against “China’s abusive behavior.”

“We need to rally more than half the world’s economy to hold China to account for their cheating,” he said, according to Politico. “And get a chorus of voices speaking out on China’s repression.” Yet another flip-flop.

Anti-Abortion Group Gets Banned From Pinterest
In another example of big tech companies demonetizing or de-platforming conservatives, Pinterest permanently banned pro-life group Live Action from its website. Pinterest claimed Live Action’s pro-life content or “pins” went against their policy on “misinformation” and “may have immediate and detrimental effects on Pinner’s [what Pinterest calls its users] health or public safety.” Live Action tweeted the entire email.

Just last week, YouTube announced it would block conservative commentator Steven Crowder from monetizing videos he uploaded to their site.

NYT Cartooning Falls Victim to the Politically-Correct
Amid anti-Semitism backlash, The New York Times made the decision to cancel all political cartoons. On the tragedy, from Dave Marcus at The Federalist

“Political cartoons have a long history of racism, from blacks and Irish being portrayed as monkeys in the 19th century to Netanyahu being portrayed as a dog this year. But the value of satire far outstrips the inevitable bad joke, the one that goes too far, the one that crosses the line we demand comedians and cartoonists tip toe up to every day without triggering the tripwire.”

“We need comedy and cartoons. We always have, whether in ancient Greece or modern midtown Manhattan. We need to laugh at ourselves, at the absurd condition we find ourselves puttering around in. That the New York Times has acquiesced to fear and decided to stop running political cartoons is a shame, but a likely one.”

MARIJUANA WON’T HELP US OUT OF THE OPIOID EPIDEMIC
Robert VerBruggen. http://vlt.tc/3nyy “A much-hyped 2014 study, combining more than a decade’s worth of data (1999–2010), found that medical-marijuana laws reduce opioid-painkiller overdoses. It seemed like a glimmer of hope amid a worsening epidemic. People would toke reefer instead of popping Oxy if you just gave them the chance to.”

Trump: ‘I’d rather run against Biden than anybody. Benny Gantz cosmetically shifts center-right in attempt to ‘Trump Netanyahu’s Ace’ Posted: 11 Jun 2019 07:47 PM PDT In a transparent appeal for right-of-center votes, the left-of-center Blue & White party (B&W) of Benny Gantz and Yair Lapid is looking to go Right. 06/12/2019 Share: Carl Cannon’s Morning Note Job Corps Reforms; Bruce Ohr; Reagan at the Wall By Carl M. Cannon on Jun 12, 2019 08:52 am
Good morning, it’s Wednesday, June 12, 2019. Thirty-two years ago today, Ronald Wilson Reagan arrived at the Brandenberg Gate in the starkly divided city of Berlin, where he mustered all his presidential eloquence — along with his thespian training and personal indignation — in a speech that advanced the cause of human freedom. The 40th U.S. president arrived in Germany 24 years after John F. Kennedy electrified the world with his speech there. Now, it was Reagan’s turn. Although the atmosphere was much different, and Reagan was hardly idolized in Europe the way President Kennedy had been, what ensued on June 12, 1987 contained a more momentous kind of magic. I’ll have more on that in a moment. First, I’d point you to RealClearPolitics’ front page, which presents our poll averages, videos, breaking news stories, and aggregated opinion columns spanning the political spectrum. We also offer original material from our own reporters and contributors, including the following: * * * Trump’s Job Corps Reforms Stir Rural Lawmakers’ Unease. Phil Wegmann has the story. An Alternative to Impeachment. Les Francis offers advice to lawmakers who, like him, are eager to see Donald Trump return to private life. Bruce Ohr’s Linchpin Role in Russiagate. In RealClearInvestigations, Eric Felten explores why Ohr omitted from his Justice Department ethics disclosure his wife’s work for Clinton-paid opposition researchers.  Will SCOTUS Check Government’s Power of Confiscation? In RealClearPolicy, John Eastman considers a case involving Love Field in Dallas and the Constitution’s “Takings Clause.” The People Are the Press. Also in RCPolicy, Matthew Daniels decries “black holes” of internet censorship in China, Saudi Arabia and elsewhere. Your Coffee-Buying Habit Could Hamper Your Retirement. In RealClearMarkets, Dustin Siggins explains how daily stops at Starbucks and its ilk add up to lost potential on a grand scale over the years. The Underground Arms Race in the Middle East. In RealClearWorld, Yaacov Ayish warns that militant groups’ subterranean networks are a growing feature of modern warfare.  * * * Although he received little credit for it, by the time President Reagan arrived in Berlin, he’d been fixated for decades on reducing the world’s nuclear arsenal. The hang-up, from his standpoint, was the Kremlin’s aversion to allowing inspectors into the Soviet Union to verify implementation of arms reduction treaties. This reluctance convinced many Americans, Reagan included, that the Russians were not to be trusted. In 1986, Soviet leader Mikhail Gorbachev altered the calculation. After NATO called for elimination of intermediate and short-range nuclear missiles on a “global and effectively verifiable basis,” Gorbachev announced that his government would comply if the United States would do the same. In so doing, Gorbachev threw verification back onto the Americans’ laps. Gorby’s gambit achieved its purpose. Although U.S. intelligence services warned Reagan that mutual verification might work to the Soviets’ advantage, the Gipper didn’t care. This was the opening he’d been looking for: Reagan instructed Secretary of State George Shultz to begin negotiating a deal. But the arms race — and the insane doctrine of “mutually assured destruction” — was only part the problem as far as Reagan was concerned. For him, the other half of the equation had always been the Soviet Union’s virtual enslavement of its own people and those in Eastern Europe trapped behind the Iron Curtain. And so, on his visit to Germany 32 years ago today, it was Reagan’s turn to see if Gorbachev was bluffing. At the Brandenburg Gate, before a huge crowd, the American president praised the sounds of “reform and openness” emanating from Moscow, but said the question was whether they signaled “profound changes” or were “token gestures.” “There is one sign the Soviets can make that would be unmistakable, that would advance dramatically the cause of freedom and peace,” Reagan said. “Secretary General Gorbachev, if you seek peace — if you seek prosperity for the Soviet Union and Eastern Europe, if you seek liberalization — come here, to this gate. “Mr. Gorbachev, open this gate! Mr. Gorbachev, tear down this wall!” It was a dramatic gesture, which the aging actor knew. “I got a tremendous reception,” he wrote in his diary, “interrupted 28 times by cheers.” Later, Reagan would tell his best biographer that he could hear the anger in his own voice as he spoke the famous lines in his speech; Reagan was vexed because he’d learned just before taking the podium that East German police had forced thousands of people on the other side of the wall away from loudspeakers so they couldn’t hear the president’s remarks. It wouldn’t matter. Reagan’s words echoed from Berlin all the way to Moscow. Instead of falling on deaf ears, they resonated in the heart of a Soviet leader who was ready for change. The immediate future included an invitation by Reagan to his Russian counterpart to visit Washington, where he would receive a reaction so unexpected it resulted in the incongruous phrase “Gorby Fever.” There is a lesson here for other presidents, and for other leaders. In 1987, neither George Shultz nor the White House National Security Council wanted Reagan to call on Gorbachev to tear down the Berlin Wall. They considered it too provocative and feared that Kremlin hard-liners would use it to undermine Gorbachev. The language State Department speechwriters put in Reagan’s address? “Someday this ugly wall will disappear,” they wrote. Fortunately, the old Hollywood leading man at the head of our government chose to replace this wooden prose with his own clarion call to action. Although Reagan’s theatrics did not end the Cold War, they did set the stage for successful diplomacy with his Russian counterpart, as Shultz later admitted. “People were afraid of the consequences of what Reagan would say,” Shultz told Time magazine two decades later. “But it turns out he was right.”  Carl M. MEET THE PRESS

From NBC’s Chuck Todd, Mark Murray and Carrie Dann

FIRST READ: Bernie Sanders has upped his game. But does it matter?

Both of these things can be true: Bernie Sanders is running a better campaign than he did four years ago …

… AND he’s in worse shape to win the Dem nomination than in ’16.

The better campaign: Sanders has more aggressively worked on his shortcomings with African-American and Latino Democrats.

And today he delivers a speech on why democratic socialism is the only way to defeat to oligarchy and authoritarianism (more on that below).

But here’s how he’s in worse shape: He’s one of some 20-plus Democrats running instead of Hillary Clinton’s main competition.

He and Elizabeth Warren are competing on much of the same turf (see Data Download below).

The 2018 midterms proved that Dems can win tough races without democratic socialism – look at Kyrsten Sinema in Arizona, or Gretchen Whitmer in Michigan or Abigail Spanberger in Virginia.

And maybe most important of all, the Democratic memories about 2016 – the fights with the DNC, the chaos at the Philly convention, the dispute over superdelegates – make it harder to win over a party that wants to MOVE ON from that last presidential campaign.

“Loser” vs. “Childishness”: Trump and Biden brawl in Iowa

Trump vs. Biden in Iowa yesterday pretty much played out as expected.

Before departing for the Hawkeye State, Trump called Biden a “loser” and someone who never won “more than 1 percent except Obama took him off the trash heap.”

More: “Now, I have to tell you, he’s a different guy. He looks different than he used to, he acts different than he used to, he’s even slower than he used to be.”

And when Trump got to Iowa: “Sleepy Joe. He was someplace in Iowa today, and he said my name so many times that people couldn’t stand it anymore.”

Meanwhile, here was Biden on Trump: “By the way, I was pleased to know that his alliance with Kim Jong Un where he and Kim Jong Un thought that maybe I shouldn’t be president.”

Also: “Whoa. You know, he doesn’t do any of the right things. Instead he gets up in the middle of the night while he is at Normandy and tweets an attack on Bette Midler? The mayor of London because he’s Muslim. The Speaker of the House who is there with him at Normandy. Stunning display of childishness and the whole world watched.”

Buttigieg makes his case

As Trump and Biden traded verbal punches yesterday, Pete Buttigieg took on both men – directly regarding Trump, indirectly regarding Biden – in his foreign policy speech at Indiana University.

“Faced with this moment of great challenge and possibility, it’s not enough just to say we won’t conduct foreign policy by tweet,” Buttigieg said, per NBC’s Jonathan Allen.

“Nor would it be honest to promise that we can restore an old order that cannot, in any case, meet the realities of a new moment. Democrats can no more turn the clock back to the 1990s than Republicans can return us to the 1950s.”

As Allen reminds us, Biden served as ranking member and chair of the Senate Foreign Relations Committee in the 1990s and early 2000s.

2020 VISION: FDR = democratic socialist?

At 2:00 pm ET, Bernie Sanders will give a speech from DC on democratic socialism – and how it’s the only way to defeat oligarchy and authoritarianism.

Sanders ties Franklin Roosevelt to democratic socialism, according to excerpts of his prepared remarks.

“It is the path that I call democratic socialism. Over eighty years ago Franklin Delano Roosevelt helped create a government that made huge progress in protecting the needs of working families,” Sanders is expected to say, per NBC’s Shaquille Brewster.

“Today in the second decade of the 21st century we must take up the unfinished business of the New Deal and carry it to completion. This is the unfinished business of the Democratic Party and the vision we must accomplish.”

Historians, however, point out that FDR was a capitalist, though he believed capitalism needed to be saved after the Great Depression.

FDR also was criticized from the left – hello, Huey Long – for the New Deal not going far enough.

And as the New York Times’ Jonathan Martin reminds us, Roosevelt had a socialist opponent in 1932 and 1936: Norman Thomas.

On the campaign trail today: Joe Biden remains in Iowa, traveling to Eldridge and Clinton before hitting a fundraiser in Chicago… Bernie Sanders delivers his address on democratic socialism in DC… Jay Inslee stumps in New Hampshire… Beto O’Rourke appears on the Late Show with Stephen Colbert… And Eric Swalwell discusses gun violence in Las Vegas.

DATA DOWNLOAD: And the number of the day is… 29 percent.

29 percent.

That’s the share of support that BOTH Elizabeth Warren and Bernie Sanders are pulling from Democratic primary voters who describe themselves as “very liberal” in the latest Quinnipiac University poll.

That’s compared with 16 percent of very liberal Democrats who say they support Joe Biden and 12 percent who support Pete Buttigieg.

It’s been apparent that Warren and Sanders are battling over voters in the same progressive lane, but the fact that they’ve got exactly the same share of support in the progressive wing of the party hammers home that neither has a lock on them yet.

Sanders does lead Warren and the rest of the Democratic pack among voters under 50, pulling about 32 percent support, compared with 18 percent for Biden and 16 percent for Warren.
