Attention is a commodity, which means that memes — a way of focusing and scaling attention online — are a way to create value. No one understands this better than Elon Musk, Felix Salmon reports.
- Why it matters: Experts in propagating memes — viral (often goofy) online imagery — can make them millions. Or, in Musk’s case, even billions.
Tesla converted $1.5 billion of cash into bitcoin last month. When news of the purchase became public yesterday, the value of the world’s bitcoin rose by about $90 billion — while the value of Tesla rose by about $8 billion.
- Since Musk owns more than 20% of Tesla, his own net worth went up by well over $1 billion as a result of the announcement.
The price action ratified Musk’s power as a memelord — someone who can instantly focus the attention of millions.

Global fears of China’s authoritarian rise are sparking calls for a boycott of the 2022 Winter Olympics in Beijing, Axios China author Bethany Allen-Ebrahimian and Axios Sports editor Kendall Baker write in a cross-newsletter collaboration.
- Why it matters: By openly flouting human rights norms while claiming leadership of the international system, China is cracking the foundation upon which global traditions such as the Olympics are based.
Democratic governments worry that allowing Beijing to host the Olympics without protest would further entrench China’s authoritarianism domestically and abroad.

- Clubhouse has been downloaded about 4.7 million times since September — all but 1 million of those since the end of last year, according to Apptopia.
There were early concerns that Clubhouse was too exclusive to Silicon Valley’s homogeneous insiders.

Impeachment trial of Donald John Trump, one year ago and today:
In New Jersey, which has the highest death rate in the nation, 1 out of every 406 residents has died from the virus. In neighboring New York, 1 out of every 437 people has died, Axios’ Caitlin Owens and Michelle McGhee report.
- In Mississippi, 1 out of every 477 people has died. And in South Dakota, which was slammed in the fall, 1 of every 489 people has died.

MLB told teams in an internal memo that slightly deadened balls for this season will fly 1 to 2 feet shorter when hit over 375 feet, after the makeup of official Rawlings baseballs came under scrutiny in recent years, AP reports.
- A record 6,776 homers were hit during the 2019 regular season. The rate of home runs fell only slightly during the pandemic-shortened 2020 season — from 6.6% of plate appearances resulting in homers in 2019 to 6.5% last year.

Accountability and conviction for the ”most grievous constitutional crime” or a trial staged for ”political theater?”
The prosecution and defense will set forth their arguments this week in Donald Trump’s historic second impeachment trial in the Senate, an undertaking like no other in U.S. history, report Lisa Mascaro, Eric Tucker, Mary Clare Jalonick and Jill Colvin.
The defeated one-term president is charged by the House with inciting the violent mob attack on the U.S. Capitol to overturn the election.
Trump’s lawyers insist as the trial opens today that he is not guilty on the sole charge of “incitement of insurrection,” that his fiery words were just a figure of speech, even as he encouraged a rally crowd to “fight like hell” for his presidency.
The Capitol siege on Jan. 6 stunned the world as rioters stormed the building to try to stop the certification of then-President-elect Joe Biden’s victory.
With senators gathered as the court of impeachment, the trial begins today with a debate and vote on whether it’s constitutionally permissible to prosecute the former president, an argument that could resonate with Republicans keen on voting to acquit Trump without being seen as condoning his behavior.
Under an agreement between Senate Majority Leader Chuck Schumer and Republican leader Mitch McConnell, the opening arguments start at noon Wednesday, with up to 16 hours per side.

Democracy Poll: Only a fragment of Americans believe democracy is thriving in the U.S., even as broad majorities agree that representative government is one of the country’s bedrock principles. That’s according to a new poll from The AP-NORC Center for Public Affairs Research. Just 16% of Americans say democracy is working well or extremely well, a pessimism that spans the political spectrum. Nearly half of Americans, 45%, think democracy isn’t functioning properly, while another 38% say it’s working only somewhat well. Steven Sloan and Thomas Beaumont report.

“When I go to a restaurant and I pay for my own food, I’m not taking anyone else’s food.” That’s how a 68 year-old marketing executive rationalizes being among the wealthy Brazilians who will pay for a COVID-19 vaccination if an association of private clinics can close a deal to bring 5 million shots to the nation.
Many don’t see vaccine inequality the same way in a country with one of the world’s most inequitable distributions of wealth.
Brazil’s government, led by President Jair Bolsonaro, a far-right virus denialist who was stricken by the disease himself, has been failing to secure COVID-19 vaccine doses for its 210 million people, Mauricio Savarese reports from Sao Paulo.
Private clinics, business leaders and some authorities are defending efforts to allow those who can pay to jump the queue and buy jabs to help the country get an economic reboot.
Health experts view such efforts as unethical, given vaccines are scarce globally and at-risk groups are in more immediate need.
The debate is causing intense friction in a nation where nearly 230,000 have died due to the virus, but only 1% have been vaccinated. So far, Brazil has 12.8 million vaccine shots available, with no clear end in sight for immunization efforts.
Iran Vaccination: The Islamic Republic has launched an inoculation campaign among healthcare professionals with Russian Sputnik V vaccines as the country struggles to stem the worst outbreak in the Middle East. The death toll in Iran is nearing 59,000. The health minister said the vaccinations would be simultaneously carried out in more than 600 medical centers across the country. The coronavirus has so far claimed the lives of more that 300 healthcare professionals in Iran.
Portugal’s Surge: Hopes are rising in the Iberian nation that the worst of a devastating surge might be over, as the number of deaths reported was the lowest in three weeks. The country’s COVId-19 picture is mixed, however. Hospital admissions rose for the first time in a week, but the advance of the virus has by some metrics been slowing since the end of January, Barry Hatton reports from Lisbon.
Portugal, blaming the sudden fast spread on a variant first identified in England, went into lockdown on Jan. 15. Portugal became the world’s worst-hit country last month compared to its population, with a deluge of daily deaths and new infections. Evidence is mounting that having COVID-19 may not protect a person against getting infected again with some of the new variants emerging around the world.
New research also suggests that people can get second infections with earlier versions of the coronavirus if they mounted a weak defense the first time, Marilynn Marchione reports.
How long immunity lasts from natural infection is a major question. Scientists still think reinfections are fairly rare and usually less serious.
But recent cases in Brazil and South Africa have caused concern. Health officials are urging vaccination as a longer-term solution and encouraging people to wear masks, keep their physical distance and wash their hands frequently.
“It’s an incentive to do what we have been saying all along: to vaccinate as many people as we can and to do so as quickly as we can,” said Dr. Anthony Fauci, the U.S. government’s top infectious disease expert.
U.S. Surge: The drive to vaccinate Americans is gaining speed and newly recorded cases have fallen to their lowest level in three months, but authorities worry that raucous Super Bowl celebrations could have fueled new outbreaks. More than 4 million more vaccinations were reported over the weekend, a significantly faster rate than in previous days, according to the Centers for Disease Control and Prevention. But health authorities say Americans may have to pay the price for Super Bowl Sunday, when many flouted safety guidelines, Adam Geller and Matthew Perrone report.
U.S. Relief Package: Democrats are proposing an additional $1,400 in direct payments to individuals, higher unemployment benefits and more generous tax breaks for families with children and for lower earners. It comes as Congress starts piecing together a $1.9 trillion COVID-19 relief package. The plan is expected to closely follow President Biden’s proposed package to address the tolls of the pandemic, which has killed over 460,000 Americans, and the nation’s still-staggering economy, which has lost 10 million jobs since the crisis began, Alan Fram, Kevin Freking and Josh Boak report.
Vaccinating Florida Seniors: The vaccination campaign for seniors at Miami’s largest hospital starts with the delivery of frozen glass vials that arrive with armed guards. The vials are immediately whisked to a secret location and placed inside a padlocked freezer. The AP was given exclusive access to a day of vaccinations at Jackson Memorial hospital system. The effort is an anxious undertaking for both vaccine providers and Americans seeking the shots, and everyone has to watch the clock. Once mixed, the vaccine is good for only six hours. Kelli Kennedy reports from Miami.

Distance Learning: After seeing two academic years thrown off course by the pandemic, school leaders around the U.S. are planning for the possibility of more distance learning next fall. President Biden has made reopening schools a top priority, but administrators say there’s much to consider with new strains of the virus and teachers waiting their turn for vaccinations. And while many parents are demanding that schools fully reopen, others say they won’t feel safe sending children back to classrooms until vaccines are available to even young students, Carolyn Thompson reports.
Mars Missions
A United Arab Emirates spacecraft is preparing to swing into orbit around Mars later today.
The step, if successful, would begin the Arab world’s first interplanetary mission and mark a victory for the oil-rich country seeking a future in space.
Having traveled some 300 million miles and seven months to Mars, the unmanned robot craft called Amal, Arabic for Hope, is poised for a its critical moment, Isabel DeBre reports from Dubai.
Landmarks across the UAE, including Burj Khalifa, the tallest tower on Earth, have been glowing red for days to mark the occasion.
The probe will provide a complete glimpse for the first time of the Martian atmosphere during different seasons. The sheikhdom is hoping to join the elite club of nations exploring the red planet and accelerate its fledgling, ambitious space program.
Six spacecraft are orbiting Mars now: three American, two European and one from India. The red planet is receiving plenty more traffic this month — China’s Tianwen-1 mission is due to slip into Mars’ orbit in less than 24 hours and attempt a landing in May. And a rover from the U.S. named Perseverance is aiming for a landing on Feb. 18.
About 60% of all Mars missions have ended in failure, crashing, burning up or otherwise falling short in a testament to the complexity of interplanetary travel and the difficulty of making a descent through Mars’ thin atmosphere. Other Top Stories Police were cracking down on the demonstrators against Myanmar’s military takeover who took to the streets in defiance of new protest bans. Water cannons were used against a crowd in Mandalay, where witnesses said at least two warning shots were fired. Unconfirmed reports said more than two dozen people were arrested. Police also used water cannons in the capital Natpyitaw for a second day running. The growing defiance is striking in a country where past movements against juntas have been met with deadly force. But in a small sign of restraint by the military government, police rather than soldiers were enforcing the new bans on large gatherings. Hundreds of rescue workers were scouring muck-filled ravines and valleys in northern India for survivors after part of a Himalayan glacier broke off, sending a devastating flood downriver that has left at least 31 people dead and 165 missing. One of the rescue efforts is focused on a tunnel at a power plant where more than three dozen workers are trapped. Rescuers used excavators and shovels to clear sludge from the tunnel. Scientists have gone to the site to investigate what happened. Experts say climate change may be to blame since warming temperatures are shrinking glaciers and making them unstable worldwide. A Sudanese-American father of three was among dozens killed in recent ethnic fighting in Darfur after the withdrawal of a joint U.N. and African Union peacekeeping force. His family and others now warn the violence could reignite a simmering conflict. The clashes pose a significant challenge to efforts by Sudan’s transitional government to end decades-long rebellions. The African nation is on a fragile path to democracy after a popular uprising led the military to overthrow longtime autocratic President Omar al-Bashir in April 2019. The U.N. says the fighting last month in Darfur spanned two provinces, killing at least 250 people and displacing 120,000, mostly women and children. The postponed Tokyo Olympics have another problem besides the pandemic. This time it’s the president of the local organizing committee. Almost a week ago Yoshiro Mori made derogatory comments about women in a meeting of the Japanese Olympic Committee. He was forced to apologize but calls for his resignation have continued. The Japanese news agency Kyodo reported that its poll showed almost 60% believe he is not qualified for the job. Mori, an 83-year-old former prime minister, has headed the organizing committee since 2014. The Summer Olympics are to open on July 23. We’ll leave you with this…

POLITICO Playbook: Trump compares impeachment to ‘The Apprentice’
DRIVING THE DAY
As Republicans get ready to beat back a DONALD TRUMP impeachment conviction for the second time, sources close to the former president say he’s already imagining his comeback.
“He’s compared it to that time in between seasons of ‘The Apprentice,’ building anticipation and wonderment for what’s to come,” one adviser told us of the period between his White House exit, eventual acquittal and his second act.
Other Trump advisers said he has revelled in his silence on Twitter — expressing amazement at how much coverage his few public statements have garnered.
“He finally realizes less is more,” one of them said.
IVANKA TRUMP and JARED KUSHNER have warned Trump that while he has the votes for acquittal, he can still screw this up. “Snatch defeat from the jaws of victory” is the phrase Kushner has been heard using most frequently to describe the worry.
Trump has actually taken the advice, spending most of his days golfing when he’s not tossing out bad legal advice to his lawyers, advisers said.
“Right now Trump is thinking, ‘I’ve got 45 votes, all I have to do is go golfing and not do anything,’” one of the aides told us.
As for the actual impeachment programming, expect it to start with Trump’s lawyers laying out an argument that the trial itself is unconstitutional.
After that, they will “roll the tape” — video that one source likened to “the first three segments of a Hannity monologue.”
The montage will include:
— Democrats objecting to the results of elections, including Rep. Harris will also swear in DENIS MCDONOUGH as VA secretary at noon.

WHAT TO WATCH FOR — Proceedings will begin at noon with a four-hour debate on whether it’s constitutionally permissible to impeach an ex-president. Then lawmakers will take a vote on the question.
Watch this vote carefully. It will give us a good indication right away about whether any Republicans beyond the usual suspects like MITT ROMNEY and SUSAN COLLINS are open to conviction.
Remember: Last week, 45 Senate Republicans led by Paul voted that it’s unconstitutional to try Trump now that he’s exited the White House. Since then, several conservative lawyers have pushed back on this argument. We’ll learn today if any Republicans have been persuaded.
MAKE IT HURT — “How to watch Trump’s second impeachment trial like a boss,” by Kyle Cheney: The Dems’ plan is to “exact as much pain as possible on Republicans …
“And the newly disclosed rules for the trial provide a road map of sorts for how they’ll do it. Here are the crucial flashpoints in the trial, key details to watch and how Democrats plan to squeeze Republicans ahead of Trump’s near-certain acquittal.”
PROGRAMMING NOTE: Late Monday night, Trump attorney DAVID SCHOEN, who had asked Senate leaders to suspend the trial on Friday evening and through Saturday so he could observe the Sabbath, penned a letter saying he changed his mind. This means we could see proceedings run straight through the weekend. Buckle up.
— WSJ’S @rebeccaballhaus: “Bruce Castor told @WSJ today that Schoen will present the defense’s case on Tues, but after that Castor and his associate Michael van der Veen are expected to handle the rest of the defense.”
A LONG TIME COMING — In a way, the House Democratic impeachment managers — or at least several of them — have been preparing for this moment for the better part of 20 months. Five of the nine House prosecutors were part of a band of House Judiciary Committee members who first started agitating to impeach Trump after the Mueller report was released way back in April 2019.
Trump’s subsequent vow to ignore “all the subpoenas” — which seems almost quaint compared to the current charges against him — triggered a movement led by Reps. JAMIE RASKIN (D-Md.), JOE NEGUSE (D-Colo.), DAVID CICILLINE (D-R.I.), TED LIEU (D-Calif.) and MADELEINE DEAN (D-Pa.) to build support among House Democrats to impeach Trump that summer, a time when Pelosi was adamantly opposed.
The group was sidelined during Trump’s first impeachment as Pelosi designated Intelligence Committee Chair ADAM SCHIFF (D-Calif.) and his panel to lead. But now they’re in the spotlight, prosecuting a president they viewed as dangerous to the nation before many of their colleagues were willing to utter the word “impeachment” out loud.

“In a call Monday night, acting Attorney General Monty Wilkinson asked Delaware US Attorney David Weiss to remain in office, where he is overseeing the tax probe of Hunter Biden, President Joe Biden’s son. John Durham, appointed as special counsel by former Attorney General William Barr to reinvestigate the origins of the Trump-Russia probe, will also continue his work, but he is expected to resign as US attorney in Connecticut, the Justice official said.”
— AP: “The Senate has overwhelmingly voted to confirm President Joe Biden’s pick to oversee the Department of Veterans Affairs. The Senate confirmed Denis McDonough as VA secretary by a vote of 87-7 on Monday. McDonough was President Barack Obama’s chief of staff.”

THE THRESHOLD IS SET — “House Democrats settle income debate for direct payments,” by Heather Caygle and Sarah Ferris: “House Democrats will move ahead with a coronavirus stimulus package that would keep the existing income limits for Americans who receive stimulus checks, while tightening eligibility for higher-earning Americans — a major win for progressives.
“The plan, which was unveiled Monday night, would keep $1,400 stimulus checks flowing to Americans making up to $75,000 a year — rather than the $50,000 threshold that some moderate Democrats had proposed. It would, however, tighten eligibility for those making over $75,000 as an individual — a higher-earning group that previously qualified for smaller checks. Couples making $150,000 would also qualify for direct payments.”

The lawyer played a role in at least 12 clemency grants, including two pardons, which wipe out convictions, and 10 commutations, which reduce prison sentences, while also helping to win a temporary reprieve from sanctions for an Israeli mining billionaire.”

OPEN SECRET — Axios has allowed one of its reporters to continue to write about Joe Biden after she disclosed in November that she is dating his transition spokesman and now White House deputy press secretary, TJ DUCKLO.
ALEXI MCCAMMOND shifted in November to covering progressives, but some of her reporting has been more specific to Biden and his administration. One story billed as a scoop reported that Atlanta Mayor KEISHA LANCE BOTTOMS turned down Biden’s offer to head the Small Business Administration. Another said GINA MCCARTHY of California was a leading candidate to become Biden’s climate czar.
McCammond, whose beat also includes Harris, reported that Biden’s transition team warned Harris’ niece that she can’t profit off her aunt’s image. After the Jan. 20 inauguration, McCammond participated in an Axios podcast in which she said, “What we’ve seen from Biden is compassion and empathy and a focus on unity in a way we certainly haven’t seen from President Trump.”
McCammond declined to comment. Ducklo and his boss, Psaki, also did not comment.
An Axios spokesperson initially said last month that McCammond had been taken off the Biden beat. In a later email, she said the reporter “has taken a backseat” on Biden coverage.
On Monday, the spokesperson said in a statement, “Alexi disclosed her relationship with TJ to her editors in November and asked to be taken off of the Biden beat. We reassigned her to cover progressives in Congress, the progressive movement, and Vice President Kamala Harris. Alexi is a valued member of the Axios team, and we stand behind her and her coverage.”
McCammond has posted about the relationship on Instagram, prompting chatter among media and political types.
POLITICO first contacted the White House in late January with questions about Ducklo and McCammond. On Monday evening, Playbook informed Biden’s comms staff that this item would be published today. Hours later, a glowing profile of McCammond and Ducklo’s relationship was published by People.
This isn’t the first time a reporter has been romantically intertwined with a source involved in his or her coverage area. Newsrooms have different policies to handle those situations. Axios was asked about its policy but did not describe it in its statement.
Reached by phone late last month, Axios co-founder JIM VANDEHEI, who also co-founded POLITICO, said he was “pretty removed from who [McCammond] dates.” When pressed, he said he did know “a little bit about it.” He added: “She’s not covering him. Well, maybe she talks about him on TV.”

At a time when media outlets are trying to diversify and young women of color are a fast-growing political force, Phillip feels like the network’s future. ‘I’ve come to realize, especially since coming to CNN, how important it is for other people to see me where I am,’ she says.”

Second Impeachment Trial Is Final Nail In the Unity Coffin
Happy Tuesday, dear Kruiser Morning Briefing friends. I’ve never played Clue.
The dismantling of our beloved Republic is continuing at quite a breakneck pace. I fully expect President Puppet to completely lose it and soon issue an executive order in which he declares the United States Constitution to be unconstitutional. I know I shouldn’t joke about things like that because they might come true now that we are this far through the looking glass. It’s a bad LSD trip now. Biden might run out to the Rose Garden in the middle of the night wearing footie pajamas and say that ferrets are sacred alien beings that are now our overlords.
We all know that the old boy doesn’t really have this much stamina. They probably just wake him up from naps a few times a day and tell him to sign his name. The people pulling his strings, however, seem to be working 24/7.
This was the team that promised a benevolent grandpa president who was going to heal the divisions that were supposedly created by ORANGE MAN BAD.
I bring it up again because they keep doing it. If all of the “blah, blah, blah” about healing and unity were at all real goals the Dalai Biden could have gone a long way towards achieving them by doing just one thing: by telling Nancy Pelosi and Chuck Schumer to back off of this sham kangaroo court impeachment proceeding.
Of course, we are well beyond that point now. I’m just pointing it out to reinforce the fact that virtually everything Team Biden said in order to get elected was a bald-faced lie.
The Democrats are getting underway with yet another public exercise of daddy issues, wasting time and taxpayer dollars in what will amount to nothing more than an on camera diaper filling. They get to spend more time complaining about the man who is now developing prime, rent-free real estate in the heads of every Democrat in Congress.
It’s also a clear message to the 74+ million people who voted for President Trump that the Democrats hate us and plan on hating us forever.
The entire premise is a joke. Trump didn’t incite a riot, no matter how many times Jake Tapper and the Idiot Chorus at CNN say he did.
There is also the question of whether this circus is even constitutional, which Jeff wrote about yesterday.
Tyler wrote a detailed rundown of the defense brief filed by Trump’s legal team, which also questions whether these proceedings are valid:
The defense brief echoed Sen. Rand Paul (R-Ky.) and the 44 other Senate Republicans who voted against holding the impeachment trial, claiming that it is unconstitutional for the Senate to try a former president and therefore a private citizen.
“The Senate is being asked to do something patently ridiculous: try a private citizen in a process that is designed to remove him from an office that he no longer holds,” the brief argues. It claims that if the Senate were to bar Trump from holding public office in the future, that would constitute a bill of attainder, “a legislative act which inflicts punishment without a judicial trial,” violating Article I, Section 9 of the Constitution.
There are obviously more pressing issues that Congress could be dealing with right now. Something like, say, the pandemic they said would take priority under the new administration.
Back to the messaging.
Democrats — especially those in D.C. — keep trying to wish away the millions of people who voted for Trump. They and their media mouthpieces think that if they just keep blowing smoke up Liz Cheney’s you-know-what that we’ll all crave the same attention and fall in line.
What’s actually going to happen is that this second impeachment trial is going to polarize this nation in a way that will make the last four years feel like we were all having a raucous bipartisan hot tub party.
Even the Democrats who understand this don’t care. Every time they get power like this they mistakenly believe that it is going to be forever and they go scorched earth. As we are all aware, present day Dems are worse than ever before. It’s popular to say that Trump broke them but in reality, they broke themselves.
They’re so far gone that they can’t realize that this impeachment garbage is going to break them even further.

Senate Majority Leader Chuck Schumer announced Monday that rules for the trial had been agreed upon by Senate Democrats and Republicans, Trump’s legal team, and the House impeachment managers. The House impeachment managers will have 16 hours to lay out their case over the next two days, after which Trump’s defense team will have the same amount of time.
- Rep. Ron Wright—a Texas Republican who was reelected to a second term in November—died Sunday at the age of 67 after testing positive for COVID-19 in late January. He had been battling lung cancer for years.

- In an 87-7 vote, the Senate confirmed Denis McDonough, President Obama’s former chief of staff, to serve as President Biden’s secretary of Veterans Affairs.
- The Biden administration announced yesterday it will “reengage” with the United Nations’ Human Rights Council, reversing the Trump administration’s withdrawal from the organization in June 2018. Secretary of State Antony Blinken conceded that the Council is a “flawed body” in need of reform, but he added the Trump administration’s withdrawal “created a vacuum of U.S. leadership, which countries with authoritarian agendas have used to their advantage.”
- At least 26 are dead and 165 people are still unaccounted for after part of a Himalayan glacier broke off in India’s Uttarakhand state Sunday, creating an avalanche of rock, mud, and water.
- The United States confirmed 83,329 new cases of COVID-19 yesterday per the Johns Hopkins University COVID-19 Dashboard, with 5.6 percent of the 1,477,997 tests reported coming back positive. An additional 1,412 deaths were attributed to the virus on Monday, bringing the pandemic’s American death toll to 464,845. According to the COVID Tracking Project, 80,055 Americans are currently hospitalized with COVID-19. According to the Centers for Disease Control, 1,206,680 COVID-19 vaccine doses were administered yesterday, bringing the nationwide total to 42,417,617.
Trump’s Second Impeachment Trial Begins
The second annual February Impeachment Trial of Donald Trump is set to commence later today. In her Uphill congressional newsletter, Haley previews the arguments both sides will make and breaks down what to expect in a proceeding where “the outcome isn’t really in doubt.” (Reminder: If you haven’t subscribed to Uphill, you can do so by clicking here and checking the box.)
Where are Republicans positioning themselves heading into this?
Most are expected to vote against convicting Trump after hearing the House managers’ case against him. Only five Republicans—Sens. Mitt Romney, Ben Sasse, Susan Collins, Lisa Murkowski, and Pat Toomey—voted to proceed to the trial alongside Democrats last month in the face of a GOP effort to dismiss it. Seventeen Republicans would have to join Democrats for conviction to be successful. That looks unlikely.
“It’s not a question of how the trial ends, it’s a question of when it ends,” South Carolina Republican Sen. Lindsey Graham said on CBS over the weekend. “Republicans are going to view this as an unconstitutional exercise, and the only question is, will they call witnesses, how long does the trial take?”
How will the trial be structured?
The impeachment managers and Trump’s counsel are expected to spend up to four hours, equally divided between the two sides, presenting arguments today about the constitutionality of the trial. After that, the full chamber will vote on whether the Senate has jurisdiction to try the former president, according to Senate Majority Leader Chuck Schumer. A simple majority is needed to proceed.
After that—with the expectation that the Senate will vote to affirm the trial as constitutional—the agreement between Schumer and Minority Leader Mitch McConnell for the schedule provides the managers and the defense with up to 16 hours each, spread out over two days per side, to present their cases. Those arguments will begin at noon on Wednesday.
Some Encouraging COVID Numbers
The trend is undeniable: Coronavirus numbers are improving across the U.S. At the worst point of our winter surge in late January, more than 250,000 COVID-19 cases were being reported per day. Now, the seven-day average for new daily cases is just north of 100,000—and falling fast. Fewer Americans are hospitalized with the virus than at any point since November; the percentage of COVID tests coming back positive continues to shrink.
What accounts for the dip? It’s unlikely any specific U.S. policy deserves the credit—the same slowdown in new cases can be observed in Europe and other continents. By the same token, every region in America is experiencing a comparable improvement—the first time in the course of the entire pandemic that this has been the case.
Some experts point to the fact that the holiday months of November and December offered substantial temptation for people to have virus-spreading indoor gatherings, compared with the relatively surly and antisocial months of January and February.
Others have speculated that COVID might be susceptible to ordinary viral seasonal fluctuations in a way that was obscured during its first year on the planet, when it was working from a standing start in Wuhan. (This theory, popular among optimists in the early months of the pandemic, fell out of favor as cases rose through the summer—but in retrospect, that summer spike looks like a gentle slope compared to what we experienced in the last months of 2020.)
Then there’s the simple fact that the U.S. population as a whole is somewhat less susceptible to the virus than we were a year ago, due to the sheer number of people who have already had it. The U.S. has logged over 27 million cases of COVID-19 since the pandemic began, but the Centers for Disease Control (CDC) estimates that the number who have actually had it is actually far higher: 83.1 million as of the end of last year, which would be a full quarter of the U.S. population. That isn’t anywhere close to the level of saturation you’d need to see for the virus to burn itself out on its own, but it could certainly play a role in slowing the speed of transmission.

- Donald Trump’s legal team—and the majority of Republicans in the Senate, led by Sen. Rand Paul—have been arguing in recent weeks that the former president’s impeachment trial is unconstitutional because he’s no longer in office. In a Wall Street Journal opinion piece, Charles Cooper—one of the top conservative constitutional lawyers in the country—argues they are mistaken. “If removal were the only punishment that could be imposed, the argument against trying former officers would be compelling,” he says. “But it isn’t. Article I, Section 3 authorizes the Senate to impose an optional punishment on conviction: ‘disqualification to hold and enjoy any office of honor, trust, or profit under the United States.’” That punishment, he reminds us, can only be imposed on former officeholders. “The senators who supported Mr. Paul’s motion,” Cooper concludes, “should reconsider their view and judge the former president’s misconduct on the merits.”
- If you asked an American to guess which state’s vaccine distribution process has been the most successful thus far, few would likely choose West Virginia. But West Virginia is near the top in every key distribution statistic: It has administered 91 percent of the doses allocated by the federal government, nearly 12.5 percent of its population has received at least one dose thus far, and six percent has received both. According to Christopher Martin, a professor at West Virginia University’s school of public health, much of this success can be chalked up to the state’s strong sense of shared identity and public officials’ eagerness to collaborate with community leaders on the local level. “Unlike many other states, we modified the national vaccine-administration plans to reflect regional realities,” Martin writes in The Atlantic. Rather than follow the federal government’s plan to administer vaccines to long-term care facilities through CVS and Walgreens, West Virginia opted to run distribution through independent, community-based pharmacies across the state. “Most of the pharmacists at these stores, which often carry the names of owners who were born and raised in that community, are people whom residents know, and who know the residents.”
- In a piece for Vanity Fair, Peter Hamby argues it was Sarah Palin—not Donald Trump—who first fused “backlash politics and anti-elitism with the mighty American power of celebrity.” He urges readers to consider the former Alaska governor’s career arc when prognosticating about Trump’s future. “Right now, for Trump, that kind of political trajectory—from the center of the known universe to a lesser moon orbiting Pluto—feels like an impossibility,” he writes. “He will tease a presidential run, and maybe box out other Republican contenders in the process. But the center of gravity in politics always changes, whether he decides to run or not.”

Trump supporters are the real target of this sham impeachment

That’s what Democrats and even some Republicans are giving as an excuse to continue with the impeachment trial in the Senate this week. Is that the real reason? No. Even if we dismiss this idiocy of trying to ban an American and a former president from running for office over the false evidence they used to impeach him in the first place, there’s an even bigger reason they’re lying. Allegedly, they beat him in the 2020 election. While millions of Americans believe that it was a rigged election, mainstream media has declared it anathema to discuss voter fraud. If they beat him fair and square, then the last thing they should want to do is bar him from running in 2024. When someone was beatable once, they should be easier to beat the second time. That is, unless there was rampant, widespread voter fraud and a massive cover-up afterwards. And still there are more reasons this couldn’t be the reason for the impeachment trial of a private citizen. All we need to do is look at the case of Alcee Hastings. According to ABC News:

As I noted in the latest episode of Conservative News Briefs, it will be like watching industries walking carefully down the stairs representing the evolution of their business models, only to be shoved down those stairs by the minimum wage hike. An impeachment trial that cannot succeed against a man they want to disappear makes no sense on its surface. But when we take into account the effect they desire for it to have on his base, it becomes clear we’re the real targets.

From there, the state will determine if they should seek exemption from the order or challenge the order on constitutional grounds. Daniel Horowitz over at The Blaze writes Missouri county authorizes arrest of feds who violate Second Amendment: What is our recourse when our own government criminalizes our most basic rights while it allows Black Lives Matter and Antifa to rampage through our streets with impunity? Is there no Plan B when the federal or state governments treat all conservatives like terrorists, business owners like pariahs, and those who yearn to breathe unmasked air like murderers? Well, one Missouri county is demonstrating the importance of sheriffs and county officials returning to self-government and interposing between the governmental usurpers and the most sacred rights of the people. On Feb. 3, the Newton County, Missouri, Commission passed a bill that will not only block federal enforcement of unconstitutional gun policies, but criminalize their implantation thereof within the jurisdiction of the county. The “Second Amendment Preservation Act of Newton County Missouri” declares that “all federal acts, laws, orders, rules, and regulations passed by the federal government and specifically any Presidential Administration whether past, present, or future, which infringe on the people’s right to keep and bear arms as guaranteed by the Second Amendment of the United States Constitution and Article I, Section 23 of the Missouri Constitution shall be invalid in the county.” Across the nation, states are rediscovering the protections the Constitution gives them against an oppressive federal government. They are the strongest line of defense against draconian edicts from the Biden regime.

Google’s monopoly power allows it to weaponize data against its political opposition

In a recent interview with SiriusXM’s Breitbart News Daily, Texas Attorney General Ken Paxton told host Alex Marlow that Google and other Big Tech companies hold all kinds of personal information about powerful people that they can weaponize in an instant if it suits their agenda. Paxton and attorneys general from eight other states filed an antitrust lawsuit back in December alleging that the tech giants routinely abuse their monopoly power in this way, particularly with digital advertising that can be manipulated to harm both consumers and businesses. Google’s monopoly power is especially concerning as it controls the ads that appear not just on its search engine and on many websites, but also on YouTube. Offenders who say the wrong thing or promote the wrong agenda can easily be cut off the financial gravy train, and many of them are learning this the hard way. “It’s extremely intimidating because [Google is] not just bigger than any state. They have more money than most countries,” Paxton told Marlow. “We have a limited budget by which we can do these investigations and file litigation, and it’s a challenge for any state to take them on. They have billions and billions. They can hire as many lawyers, as many lobbyists … They can hire all your friends to come out and criticize you. They can fund campaigns [for] your opponent.” Paxton is sure that the next time he runs for office his opponents “will all be funded heavily by Google and other Big Tech companies that are concerned about their monopolistic behavior.” Big Tech: All your thoughts belong to usBack in October, the Department of Justice (DoJ) filed an antitrust lawsuit against Google that was joined by 11 states. At the time, Reuters reported that the DoJ case against Google marks the biggest antitrust case in a generation, comparable to the suits that were filed against Microsoft in 1998 and against AT&T in 1974. “When you take them on,” Paxton added about trying to sue these powerful monopolies, “they know a lot about people, and they can use that information as well. So it’s definitely a risky proposition. If you want safety, these are not the companies you sue.” Google currently has a market capitalization of $1.283 trillion. It ranks among the most highly valued public companies, which include Amazon, Apple, Facebook, and Microsoft. “Politicians are afraid that if they speak out, that their opponents will be funded,” Paxton laments. “But if we don’t speak out, eventually it will affect all of us, and it is affecting all of us.” “When only a few speak out, they wipe them out, and then they’ll just work their way down the line until they control everything. If people don’t wake up and start speaking out in every possible way right now, it may be too late for all of us.” Marlow’s response was to categorize what is going on as “viewpoint discrimination,” meaning the tech giants are punishing people for viewpoints that are considered to be politically incorrect. Is John MacArthur’s wealth a real scandal?

Pastoring Grace Community Church and being one of the most influential pastors in the United States undoubtedly comes with wealth from books, broadcasting, speaking gigs, and more. John MacArthur has a diverse portfolio of income streams tied to his brand as a pastor. All of this was known. So, is the extravagant wealth of MacArthur a real scandal? Julie Roys would seem to think so. On February 3rd, she published her piece, “The Prosperous Lifestyle of America’s Anti-Prosperity Gospel Preacher.” This is a story with three basic elements and most people are only discussing the first one:

AZ GOP state senator Paul Boyer upends efforts to hold Maricopa Board of Supervisors in contempt

In fact, patriots across this nation have been waiting impatiently to see a proper audit done on the allegedly fraudulent election results. But one Republican lawmaker took a stand on behalf of the perpetrators of election fraud by voting with Democrats to continue blocking the audit. State Senator Paul Boyer voted against holding the Maricopa Board of Supervisors in contempt for blocking an audit that the people want done. In doing so, he forced a tie, 15-15, with means the measure failed. State GOP Chair Kelli Ward gave us an update:
For weeks, the Board of Supervisors have refused to comply with an order to allow the Senate to audit the election results. Their claim is that it would break the law by exposing voter information, but this is a disingenuous argument. Auditors would be safely capable of shielding identities and personal information as they determined the level of voter fraud in the county. Joe Biden allegedly won Arizona by just over 10K votes. COVID-19 lockdowns in 2020 caused temporary global warming, study shows
Posted: 08 Feb 2021 05:33 PM PST When much of the world was plunged into lockdown last year as a result of the coronavirus pandemic, there was a lot of speculation that the lack of activity would benefit the environment. However, a new study shows that these changes to our lifestyles actually slightly warmed the planet for several months in 2020 in a counterintuitive finding that underscores the role of airborne particles in influencing temperatures. In fact, the temperatures in some places of the eastern United States as well as China and Russia rose by as much as half to two-thirds of a degree, according to the study, which was published in Geophysical Research Letters. This was because there were fewer soot and sulfate particles in the air from car exhaust and burning coal. These particles normally have a temporary cooling effect on the atmosphere as they reflect the sun’s heat. When the emissions of aerosols dropped suddenly last spring, it meant that more of the sun’s heat was able to reach the planet, particularly in countries that are heavily industrialized and normally pump significant amounts of aerosols into the atmosphere. For example, the warming reached around 0.7 degrees Fahrenheit across much of Russia and the United States. The effects were mixed in the tropics and relatively minor in the southern hemisphere, where the emissions of aerosol generally tend to be far less pervasive. The study’s lead author, National Center for Atmospheric Research Atmospheric Scientist Andrew Gettelman explained: “Cleaning up the air can actually warm the planet because that (soot and sulfate) pollution results in cooling.” To perform his calculations, he compared the weather in 2020 to computer models that simulated what the conditions in 2020 would have likely been without the reductions in pollution due to pandemic lockdowns. He and his coauthors used two leading climate models to run simulations, making adjustments to the emissions of aerosols and using actual meteorological conditions seen during the year, such as winds. Overall, the planet was .05 degrees warmer for 2020 on average because there were fewer cooling aerosols in the air. The temporary warming effect caused by the reduction in particles was stronger last year than the effect of the reduction in heat-trapping carbon dioxide emissions. This is because carbon remains in the atmosphere for more than a century and its effects are seen over the long term, whereas the effects of aerosols can be seen for around a week. Although there were warming effects in the short term, Gettelman said that the pandemic may slow climate change in the long term given the more gradual influence of reduced carbon dioxide emissions on climate. Even without the decrease in cooling aerosols, the global temperatures for the year were already showing the potential to break the yearly heat record due to burning oil, natural gas and coal. However, the aerosol effect may be enough for this to go down as the hottest year since NASA started measuring temperatures. Gettelman said: “Clean air warms the planet a tiny bit, but it kills a lot fewer people with air pollution.” Different study shows lockdowns improved air quality in some ways, but less than expectedMeanwhile, a study that was published in the journal Science Advances found that although COVID lockdowns improved air quality to some degree, those gains were smaller than researchers expected and fluctuated depending on the city studied. In that study, the researchers found small reductions in the levels of NO2, an air pollutant caused by traffic emissions that has been linked to respiratory problems, and increases in concentrations of ozone, which is harmful to human and animal health as well as crops. The concentrations of PM2.5, meanwhile, dropped in all of the cities studied except for Paris and London. It’s still too early to say how the changes in human activity last year will impact the environment in the long term, but it’s already clear that the lockdowns actually caused global temperatures to rise. The minimum wage hike is more than a job-killer. It’s a nation killer.

Considering it is in the process of failing in cities with high costs of living like Seattle and New York City, the effects of a nationalized version will be devastating to middle America. Knowing this—and they certainly do know it to be true—why would they be willing to kill off millions of jobs? Most would say it’s for political expediency as they pander to the ignorant but passionate radical progressive base. But that’s just a side benefit. They understand that to achieve their real goals, they NEED to destroy the foundation of the economy and send millions of Americans into destitution. I’ll explain why in a minute, but let’s get some background first from Free Beacon: President Joe Biden’s plan to raise the federal minimum wage to $15 would hike the nation’s deficit by tens of billions of dollars and kill over a million jobs, according to a Congressional Budget Office report. The nonpartisan agency’s analysis concluded Monday that a $15 minimum wage would reduce the nation’s workforce by 1.4 million—half a million more than the number it would raise out of poverty. It would also increase the cumulative federal budget deficit by $54 billion over the next 10 years, with interest-rate bumps and inflation adding another $16 billion. Promoted by President Biden and introduced as a bill by Sen. Bernie Sanders (I., Vt.), the measure is one of several proposals Democrats hope to tuck into their $1.9 trillion coronavirus relief legislation. Democrats approved a $1.9 trillion budget resolution Friday, skirting a 60-vote threshold in the narrowly divided Senate through a process known as reconciliation. The resolution now heads to congressional committees, which will debate such hot-button proposals as a $15 minimum wage and $1,400 direct relief payments. The 1.4 million jobs projected by the OMB is likely low. The “nonpartisan” group has been notoriously bad at predicting anything. But if we look more closely at the other effects of a minimum wage hike, that’s where it becomes a clearly existential threat. There’s an evolution that happens to businesses based on progress, both technological and societal. The carriage industry didn’t fail. It was replaced by the automotive industry. Currently, we’re seeing an evolution in many industries as automation and technological replacements for workers are becoming more prevalent. Many fast food restaurants are reducing their workforce by incorporating ordering kiosks, for example. But Biden’s minimum wage hike will accelerate the evolution unnaturally. As I noted in the latest episode of Conservative News Briefs, it will be like watching industries walking carefully down the stairs representing the evolution of their business models, only to be shoved down those stairs by the minimum wage hike. Businesses will fail. Entire industries will collapse. The poverty that comes from losing so many jobs will vastly supersede the number of people who are “lifted” out of poverty through government mandates. It will expand the dependency on Big Government, and that’s the point. Democrats aren’t wanting to destroy jobs out of ignorance. They’re wanting to destroy jobs to put more people into their welfare state.

Could the Trump Hotel prices hint at the return of President Trump?

According to those who believe this, they are pushing the narrative that President Trump will be inaugurated on March 4th as the 19th President of the United States of America, since, according to the theory, he would be reinstating America as a Constitutional Republic as opposed the corporation that we’ve allegedly been living under. An interesting development with pricing at Trump Hotel in Washington DC is potentially supporting this theory. As explained in this episode of Let’s Talk Right Now, Trump Hotel has raised their prices from the normal $400-$600 a night to over $1300 per night only on the night of March 3rd, which is highly unusual. A similar thing occurred the night before President Trump’s inauguration in 2016. So what does this mean?
The mainstream media has even been pointing out that this corresponds with what they refer to as a “dangerous conspiracy theory” regarding Trump taking office. If this theory pans out to be true, as explained in this podcast, that would mean that Trump was able to prove that the election was stolen… thus, how would it be “dangerous” to have the duly elected President of the United States reclaim his rightful place in the White House? Now, I’m not saying that this conspiracy theory is true. What I am pointing out is the interesting correlation between the pricing of the Trump Hotel in DC and the alleged inauguration that would occur on March 4th. What does this mean? Is Trump pulling strings behind the scenes attempting to forge a path back to the presidency? Will he be able to expose the Deep State’s rigging of the 2020 Election? Only time will tell. It is interesting, though, to see this seemingly strange change at Trump Hotel corresponding with a theory that, if true, would put President Trump back in his rightful place. Why did the left have to conspire to ‘save’ the election before the COVID pandemic came along?
Posted: 08 Feb 2021 04:59 PM PST There are several disturbing aspects on the now-infamous Time magazine piece entitled: The Secret History of the Shadow Campaign That Saved the 2020 Election. Beginning with the reason and timing of this piece and a similar article in the NYT from a few days ago. Both at times seem to be taking the tone of bragging in what they had done in ‘fortifying’ the election while being propaganda efforts as the first drafts of history. However, worse than that is the fact that the Time piece shows that some of this secret planning took place long before there was an emergency – ostensibly the reason for the mail-in voting emergency measures and restrictions on counting observation. Then there is the issue of the timing of the realization of these articles at this time of heightened tensions in a divided nation. Add to that the issue of the meaningless impeachment trial and the mostly peaceful Capitol Hill protest over a month ago and it would seem that some are trying to once again add fuel to the fire. How did the authoritarian socialist left know they would have to plan for an emergency?The piece in Time seems to be part of propaganda at pre-writing history with the authoritarian left cabal in the hero role, and partially a bit of look at what we did. With a silent, what are you going to do about it along for good measure. It starts out admitting that sure:
[Emphasis added] It’s only later on in the piece that they admit to the suspicious timing of all of this:
[Emphasis added] Interestingly enough, both statements are at odds with reality since they admit all of this began before the pandemic and one would be hard-pressed to accuse President Trump of being ‘autocratic’ given the fact that there was a smooth transition of power. They then go on to detail how their work touched every aspect of the election, dancing a very fine line between ‘saving’ and election and rigging an election. But I’m sure they would easily accede to this saying:
That kind of thinking can be seen all through the piece in Time, the authoritarians have convinced themselves that they are doing good, so they have free reign to do whatever they what that is evil – including the rigging of an election. Somehow the crisis started in the fall of 2019, long before COVID was on the sceneLater on in the piece, they detail the hero in this drama and his concerns that “Sometime in the fall of 2019” the election was headed for disaster. They refer to months of research and a newsletter in October 2019. Of course, they found it necessary to make the false case for the ends justifying the means, with some mean spirited name-calling – while pretending ‘steer clear’ of such talk:
Further on they talk of Mark Zuckerberg inviting civil rights leaders to his home in November 2019. The alleged purpose here was to fight disinformation on the crisis that was to arise. Keep in mind that all of this took place months before anyone knew of SARS-CoV-2 and the ensuing pandemic. Mail-in voting was an extremely flawed solution looking for a crisis that wouldn’t for quite some time. Why did the NYT and Time magazine choose to inflame tensions with these articles at this time?There is also a question of the timing of the publication of these two pieces, why at this point in time? The proximity to the anniversary of the Jan 6th protest and the sham Impeachment should raise some suspicions. Both will pieces will only serve to inflame the tensions that already exist in the nation. Publishing them now will only add fuel to the fire when everyone would be better served with a cooling-off period. But instead of taking this rational approach, these propaganda organs of the national socialist media chose to drop petrol on an already raging dumpster fire, for what purpose? The bottom line: The authoritarian socialist left is still trying to provoke the pro-liberty rightSo why would the authoritarian socialist left go to all the trouble of admitting to all of this? They of course want to brag, the truth will come out at some point, so they wanted their spin on it. They also wanted a chance at rewriting history, the election was clearly rigged, they want the story to be that they were ‘saving democracy’ by destroying it. But they also want to see if they can provoke the right one more time. They were able to get a lot out of the mostly peaceful protest of Jan 6, so they want to try the same scam once again. Having word out there that it was a conspiracy and on top of the impeachment debacle, could be their last chance in while to get the pro-liberty right to do something they will regret. For once the impeachment scam is put to rest, and they run out of excuses to bring up a story from over a month ago, they won’t have any reason to clamp down on free speech or social media. This is their last chance for a while to get the pro-liberty right to act as the left for a little while so the media can whine about it once again. COVID-19 lockdowns are taking down an independent news outletNobody said running a media site would be easy. L.A. columnist in ‘anguish’ after Trump supporters plow her driveway in snowstorm
Posted: 08 Feb 2021 02:32 PM PST A Los Angeles Times columnist is in “anguish” after her neighbors plowed her driveway open during a snowstorm. It’s because they are Trump supporters.
The Times’ Virginia Heffernan pointed out that even members of Hezbollah do nice things now and then, as did Nazis. Constitutional expert Jonathan Turley of George Washington University noted on his website that Heffernan “explores her struggle with how to respond while comparing all Trump supporters to Nazis and Hezbollah.” “It is unfortunately hardly surprising to see such unhinged hateful comparisons in today’s age of rage. What was surprising is need to publish such a column containing gratuitous attacks on over 70 million voters as compared to genocidal murders or terrorists,” he wrote. “While most of us would find a thank you as natural and immediate, Heffernan explores her struggle in decision how to respond: ‘Of course, on some level, I realize I owe them thanks — and, man, it really looks like the guy back-dragged the driveway like a pro — but how much thanks? These neighbors are staunch partisans.’” Turley said that under “the guise of working through these issues, the column seems more of a vehicle for suggesting Trump voters are little better than terrorists and murderers.” “It matter-of-factly treats such references as obvious comparisons. There is less evidence of honest internal debate as much as satisfaction in being able to demean and marginalize almost half of the electorate,” he said. “The fact is that people are addicted to rage,” wrote Turley, Many continue to use Trump as a license to hate, even portraying such hate as virtuous. It is so consuming that even kindness from a neighbor is treated as a moral dilemma.” In her column, Heffernan noted Hezbollah cares for its own — sick, elderly and hungry Shiite Muslims, as did the Nazis. But her neighbors, she complained, “supported a man who showed near-murderous contempt for the majority of Americans. They kept him in business with their support.” And she insists her offer of a “standing invitation to make amends” depends on “recognizing the truth about the Trump administration.” That, she said, requires working “to repair the damage of the last four years.”

SCOTUS: Cracking the Case of Election Law?

by Ruth Moreno: On February 19, the Supreme Court will consider several lawsuits regarding the contested 2020 elections. These high-profile lawsuits, including those brought by attorneys Sidney Powell and Lin Wood, and the Trump campaign, will be considered for hearings at the Supreme Court’s scheduled conference. The lawsuits under consideration concern four states: Michigan, Pennsylvania, Wisconsin, and Georgia. All these cases allege unlawful election-related conduct which may have affected the results of the elections within each respective state. Some of the alleged misconduct includes the changing of state election laws to accommodate expanding mail-in voting, a lack of adequate security measures, issues with voting machines, and denial of adequate access to poll watchers. Although they concern different kinds of irregularities, each of the lawsuits ultimately is asking the Supreme Court to weigh in on questions of legality surrounding the election. Sidney Powell’s Michigan petition calls for “emergency declaratory relief avowing that the presidential election results certified by Michigan officials were unconstitutional and otherwise contrary to law, together with injunctive relief de-certifying those results.” In his Georgia petition, Lin Wood asks the Supreme Court to “enter an emergency order instructing Respondents to de-certify the results of the General Election for the Office of the President.” Rep. Mike Kelly’s (R) Pennsylvania petition asks the court for an injunction “that prohibits the Executive-Respondents from taking official action to tabulate, compute, canvass, certify, or otherwise finalize the results of the Election.” The Trump campaign lawsuits also advocate emergency injunctive relief, calling for expedited hearings and the blocking of certification of the electoral college votes for Joe Biden. The cases will be considered on Friday, but it remains unclear whether or not it will end up taking any of them up. So far, the Supreme Court has remained largely uninvolved in the challenges to the 2020 elections: its only decisive action so far has been to dismiss a Texas attorney general’s lawsuit which sought to decertify the election results in several other states. The court said that the attorney general’s accusation lacked standing. Many predict the Supreme Court will reject these later cases as well, as it already declined to fast-track them in order to hear them before President Joe Biden’s inauguration. If the Supreme Court does decide to take up one or more of these lawsuits, it is likely the court will not hear them before October of this year. To those who doubt the integrity of the 2020 election, the court’s decision whether to hear cases regarding irregularities affects more than the most recent presidential election. Peter Navarro, an advisor to President Trump, concluded in a report on the integrity of the 2020 election that without a full investigation, “this nation runs the very real risk of never being able to have a fair presidential election again.” The continued pursuit of these cases in the courts ultimately points back to the need for election-related issues to be addressed at the state level. State legislators have broad authority over laws concerning how elections work in their states, and they should go to work. For many, trust in our nation’s election systems is in doubt, and they will be watching how their state handles it. The Impeachment Sham, Faith Wins

by Gary Bauer: The Impeachment Sham The purpose of this sham trial is simply to smear Donald Trump and make it impossible for him to run again. Democrats are hoping to demoralize millions of his 74 million supporters. The left has been involved in a non-stop effort that accelerated on January 6th to do exactly that. Since President Trump has been silenced by our leftist social media giants, I want to speak out for him and point out that almost everything he is being accused of is not only untrue, but the left is itself guilty of those very charges. For example:
One final point. Democrats are claiming that under Donald Trump, America lost the moral high ground. To the contrary, Trump kept his promises and did exactly what he said he would do. He took serious steps to secure the border. He moved the U.S. embassy in Israel to Jerusalem. He crushed ISIS, and confronted communist China, Iran and Russia. It is the left that is attempting to knock America off the moral high ground by claiming our country was founded on racism and genocide. Just last week, Joe Biden said that we have never lived up to our promise. Speaking Of Collusion. . . Even the author of the report concedes that it “sounds like a paranoid fever dream — a well-funded cabal of powerful people, ranging across industries and ideologies, working together behind the scenes to influence perceptions, change rules and laws, steer media coverage and control the flow of information.” The last part of that sentence says it all – change rules and laws, steer coverage and control information. That’s exactly what the left did to interfere in the election. As I have repeatedly noted, the left exploited the pandemic to change election rules and laws. At least now they admit it, even if they claim they were simply trying to “save the 2020 election.” Big Media and Big Tech manipulated the news and covered up major stories that were embarrassing to Biden and the left. And I was struck by the admission in this article of just how much the street protests we have seen in the past year were coordinated and not spontaneous events. There were plans for major post-election protests, but liberal activists were ordered to “stand down.” One progressive leader said, “We wanted to be mindful of when was the right time to call for moving masses of people into the street.” I am bringing this article to your attention not to demoralize you but to urge you to remain in the battle for faith, family and freedom. The left succeeds in part because it never gives up. It is constantly organizing, constantly fundraising, constantly influencing officials, constantly registering new voters, etc., etc. We must be just as committed to our values as the left is to theirs. Faith Wins Late Friday, the Supreme Court recognized that the First Amendment’s guarantee of religious freedom still applies during the pandemic by overturning California’s egregious ban on in-person worship. Predictably, the court’s three liberals sided with California’s liberal governor and voted to continue the ban on religious services. The 6-to-3 decision, however, declared that Governor Gavin Newsom could not discriminate against houses of worship by holding them to different standards than businesses were being subjected to. Thanks to the court’s order, houses of worship may now hold in-person services up to 25% or 50% capacity, depending on conditions in various parts of the state. Writing for the majority, Justice Neil Gorsuch explained: “We are not scientists, but neither may we abandon the field when government officials with experts in tow seek to infringe a constitutionally protected liberty. . . No one is barred from lingering in shopping malls, salons, or bus terminals. . . Our Animal Farm

Victor Davis Hanson: George Orwell published Animal Farm in August 1945, in the closing weeks of the Pacific War. Even then, most naïve supporters of the wartime Soviet-British-American alliance were no longer in denial about the contours of Moscow’s impending postwar communist aggression. The short, allegorical novel’s human-like farm animals replay the transition of supposedly 1917 revolutionary Bolsheviks into cynical 1930s Stalinists. Thereby, they remind us that leftist totalitarianism inevitably becomes far worse than the supposed parasitical capitalists they once toppled. Orwell saw that the desire for power stamps out all ideological pretenses. It creates an untouchable ruling clique central to all totalitarian movements. Beware, he warns, of the powerful who claim to help the helpless. Something so far less violent, but no less bizarre and disturbing, now characterizes the American New New Left. It is completing its final Animal Farm metamorphosis as it finishes its long march through our cultural, economic, and social institutions. Leftists may talk of revolutionary transformation, but their agenda is to help friends, punish enemies, and to keep and expand power. First, remember the 1960s and 1970s agendas of the once impotent, young, and supposedly idealistic leftist revolutionaries. We were lectured 60 years ago that “free speech” preserves were needed on university campuses to be immune from all reactionary administrative censorship. Transparency and “truth” were the revolution’s brands. The First Amendment was said by them to be sacred, even as the “free speech movement” transitioned to the “filthy speech movement.” Leftists sued to mainstream nudity in film. They wanted easy access to pornography. They mainstreamed crude profanity. The supposed right-wingers were repressed. They were the “control freaks” who sought to stop the further “liberation” of the common culture. In those days, the ACLU still defined the right of free expression as protecting the odious, whether the unhinged Nazis, the pathetic old-Left Communists, or nihilistic Weather Underground terrorists. “Censorship” was a dirty word. It purportedly involved the religious bigots and medieval minds that in vain had tried to cancel ideological and cultural mavericks and geniuses from Lenny Bruce to Dalton Trumbo. “Banned in Boston” was a sign of cretinism. Only drunken “paranoids” like Joe McCarthy resorted to “blacklists.” We were reminded that the inferior nuts tried to cancel the brilliant careers of their betters whom they disliked, or feared. The Right supposedly had sunk into fluoride and “precious bodily fluid” paranoias, and “Who lost China?” conspiracy theories. Conservatives, the radicals lectured us, masked the poverty of their thinking by “red-baiting.” They talked as if “commies” and “insurrectionists” were around every corner—in hopes of militarizing the country, and using police and troops to intimidate the “people.” Snooping, surveillance, wiretaps—all that and more was awful—the purported work of nutty J. Edgar Hoover. His flat-topped, wing-tipped “G-men” usually outnumbered Black Panthers, Weathermen, and SDS members at secret strategy sessions. Hollywood went wild in the 1960s and 1970s by warning us about “them.” Endless movies detailed the solo efforts of heroes, who were watched and threatened by the “government,” working hand in glove, of course, with either corporations or the “rich.” In films like “Three Days of the Condor,” “The Conversation,” or “Blowup,” we were warned of the nefarious powers of surveillance. Fearing Russia was the mark of a conspiracist nut. In films like “The Russians are Coming, the Russians Are Coming,” we were reminded that the paranoia about the Soviets was as deadly as the Soviets themselves, who were pleasant enough, not much different from us. Students in the 1960s high schools were spoon-fed Nineteen Eighty-Four, Animal Farm, Brave New World, and other dystopian novels. Orwell and Huxley warned them of the dangers of a super-spy apparat, a one-party state that reorders a docile subservient population, and the combination of “science” with thought control—the sort of stuff that Nixon or Goldwater was no doubt plotting. So better to be an individualist, the Left preached, a rebel at war with all orthodoxy and conformity, a “Rebel Without a Cause,” Holden Caulfield, or one of the good renegades in “The Wild Ones.” We were to worship James Dean, Marlon Brando, and Steve McQueen because they were “free,” “didn’t give a s—t,” and demolished “the Man’s” silly imposed “rules and regulations.” “Easy Rider” was the 1960’s bible. On campus, professors began to drop F-bombs in class. They dressed like students, tore down hierarchies between student and teacher (“Just call me Mike”). Once staid academics now invited edgy campus speakers to blast America. In melodramatic fashion, they considered themselves perennially teaching from the barricades. We were told that they were the frontline speakers of truth to power. These were the nonconformists who had defeated loyalty oaths. After all, they dated their students and joined radicals to storm the college president’s office. They preached a “do your thing” credo of letting professors pretty much say whatever they wished. Reporters were either iconoclastic Gonzos or shoe-leather investigators on the scent of deep state overreach. They were obsessed with wrongdoing at the CIA and FBI. Politicians, of course, weren’t to be trusted—given the corporations who pulled their puppet strings. The enemy of America, we were told, was the “big guys,” especially the international conglomerates like ITT with global reach. The corporationists refined the arts of the cartel, trust, and monopoly. “Small is beautiful” was the antithetical mantra. Radical sons of the Left crusaded against “dirty money” and “the plutocratic rich” with their “concentration of wealth”—as if the Rockefellers or the Gettys posed existential threats to America by their abilities to insert huge amounts of cash to warp elections or to buy officials. Generals were caricatured as caudillos, cigar choppers with shades, showy ribbons and bronze on their chests, and oversized hats and epaulets. We were warned they threatened us with a militarized police state. The “revolving door” was a mortal sin, as the tentacles of the Pentagon octopus now squeezed out public money for bombs, rockets, and jets to fight needless wars. About every three weeks Ike’s farewell warning about the “military-industrial complex” was trotted out by liberal columnists to remind us of felonious corruption. Civil and women’s rights were the twin pillars of the 1960s radicals. From Martin Luther King, Jr. to Malcolm X, the themes were for “white America” to live up to the ideals of their Constitution, to finally realize the “promises of the Declaration of Independence” and to treat people on the basis of the “content of their character” and not on “the color of their skin.” The problem was never 1776 or 1787, but those who had not yet fully met the Founders’ exceptional ideals. A “color-blind society” was a ’60s sobriquet. Women strove to ensure girls had the same rights as boys, from leadership roles to sports. The point of the 1960s, again we were taught, was to tear down the rules, the traditions and customs, the hierarchies of the old guys. The targets were supposedly the uptight, short-hair, square-tie, adult generation who grew up in the Depression, won World War II, and were fighting to defeat Cold War Soviet Union. The good guys, the students, and the activists, if they only had power, were going to break up corporations, shame (or “eat”) the rich, and bring in young, hip politicians. Reformers like the younger Kennedy brothers, the John Kerry war hero-resisters, the Bay Area Dianne Feinsteins, and the hip Nancy Pelosis would disrupt the “status quo” of politics. Yes, the downtrodden pigs, the exploited horses, and the victimized sheep finally did expel Farmer Jones from America’s Animal Farm. But in his place, as Orwell predicted, revolutionary pigs began walking on two feet and absorbed all the levers of American cultural influence and power: the media, the bureaucracies, Wall Street, Silicon Valley, publishing, the academy, K-12 education, professional sports, and entertainment. And to them all, the revolutionaries added their past coarseness and 1960s-era by-any-means-necessary absolutism. We are now finally witnessing the logical fruition of their radical utopia: Censorship, electronic surveillance, internal spying, monopolies, cartels, conspiracy theories, weaponization of the intelligence agencies, pouring billions of dollars into campaigns, changing voting laws by fiat, a woke revolutionary military, book banning, bleeding the First Amendment, canceling careers, blacklisting, separate-but-equal racial segregation and separatism. Conspiracies? Now they brag of them in Time. Read their hubristic confessionals in “The Secret History of the Shadow Campaign That Saved the 2020 Election.” Once upon a Time, radicals used to talk of a “secret history” in terms of the Pentagon Papers, or a “shadow campaign” in detailing Hollywood blacklisting. They are exactly what they once despised, with one key qualifier: Sixties crudity and venom are central to their metamorphosis. Our left-wing American revolutionary cycle from the barricades to the boardroom was pretty quick—in the manner that the ideology of the Battleship Potemkin soon led to Stalin’s show trials, or Mao’s “long march” logically resulted in the Cultural Revolution. The credo, again, is that the noble ends of forced “equity” require any means necessary to achieve them. The Left censors books in our schools, whether To Kill a Mockingbird or Tom Sawyer. It is the Left who organizes efforts to shout down campus speakers or even allows them to be roughed up. The Left demands not free-speech areas anymore, but no-speech “safe spaces” and “theme houses”—euphemisms for racially segregated, “separate-but-equal” zones. “Microaggressions” are tantamount to thought crimes. The mere way we look, smile, or blink can indict us as counterrevolutionaries. Stalin’s Trotskyization of all incorrect names, statues, and commemoratives is the Left’s ideal, as they seek to relabel Old America in one fell swoop. No one is spared from the new racists, not Honest Abe, not Tom Jefferson, not you, not me. For “teach-ins,” we now have indoctrination sessions. But the handlers are no longer long-haired 1960’s dreamy, sloppy, and incoherent mentors. They are disciplined, no-nonsense brain-washers. The Left’s Russia is our new old bogeyman. Putin is the new “We will bury you” Khrushchev. The Left spun conspiracy theories about computer pings in Trump Tower, and nefarious meetings of Trump’s campaign officials colluding with Russian agents. CNN and MSNBC tell us that the whole plot was laid out in a bought dossier—as the fantasies of Christopher Steele’s canonical hired hit piece became the Left’s version of The Protocols of the Elders of Zion. No longer were we told that our toothpaste and water were making us sterile. Instead, the Duke Lacrosse team was emblematic of the return of epidemic 1930s-style racial rape. The Virginia frat boys routinely roughed up and had their way with girls. The racist Covington kids, on the National Mall no less, mocked and insulted a noble indigenous combat veteran. And Jussie Smollett fought off racist thugs while managing to hold his sandwich and cell phone, as he stumbled home with a racist rope around his neck, stained with iconic bleach. “Hands up, don’t shoot” should have been true, even if it wasn’t. Assimilation and integration are not our goals. Instead, we are to ferret out “cultural appropriation” and the odious culture of “white supremacy” and “unearned privilege.” “All men are created equal. But some are more equal than others” is now posted on the electric barn wall. Deprogramming 74 million “whites” and “Republicans” is the advice on the pages of the progressive Washington Post. Don’t like an idea? Then wash clean the polluted minds of those who embraced it. The new and improved ACLU’s job is to encourage the suppression of conservative free speech. ACLU trains its handlers not to protect unfettered speech, but to spot “hate speech.” To advocate burning or destroying a book is not some nightmare from Fahrenheit 451, but a woke way to “stop the hate.” A new Orwellian phrase is “free speech is not free reach”—as leftists become the intellectual inheritors of the racists of the open-housing fights of the 1950s and 1960. The old racist boilerplate of apartment owners and realtors was “You can live anywhere you want, just not here.” The new hate mantra of Silicon Valley cartels is, “You can tweet or socially post anywhere you like—if you can manage to find a place.” Surveillance and spying are now good. How else to ferret out “right-wingers,” “white supremacists,” and “insurrectionists”? So the FBI and CIA have transmogrified into heroic agencies run by stalwart social activist fighters like John Brennan, the old Gus Hall supporter, James Clapper, James Comey, and Andrew McCabe. They cut to the quick to achieve social justice, without the messy give and take of Congress, or that albatross, the relic Constitution. What a wonderful world they have created: Eavesdropping on the national security advisor, forging FISA documents, spying on American citizens, aiding one presidential candidate by surveilling another. Finally, they can use their skills and surveillance to investigate and hound the “right” enemies, for the “right causes.” The CIA and FBI always secretly wished to be beloved by the Left. Now they are deified. And the military elite? Militarization is now beautiful. The U.S. Army may become our People’s Revolutionary Army as generals sniff out counterrevolutionaries hidden deeply in their ranks. Maybe a cleansing purge or two is necessary, in the Soviet fashion. Barb-wiring the capitol and stocking it with camouflaged troops send the message that the military is, at last, woke and in control of America’s central nervous system. Corporate profiteering for retired generals and admirals is a necessary amplifier of their critical work. How else to have the resources to spot new Mussolinis, Nazi tactics, Auschwitz caging, and the al-Qaeda-like terrorists among us? Bank of America helps to find out which enemy of the people bought which coffee where. The financial heroes are not hip basement day traders taking down hedge funds by boomeranging them their own manipulative tactics, but Wall Street hedge fund traders, the holy wall between sober investment and Trumpian barbarians at the gate. Could we have ever stopped the hate without the help of billions of dollars from Mark Zuckerberg and George Soros? Why break up monopolies and cartels when their profits pour into progressive wokeness? Only their warping of communication and knowledge retrieval correctly guides Americans to the “right” conclusions. Jeff Bezos’ net worth alone is as much as the combined GDP of Idaho and Alaska. But then again, we are to think he is far more valuable than two states full of bitter clingers, dregs, and deplorables. The media? It is a Ministry of Truth. Informers and readers beg the Great Leader to let drop his favorite flavor of ice cream or the details of the Oval Office makeover. There is no need for censorship: the media are the censors. Whatever sinister idea a paranoid politician has for muzzling journalists, reporters themselves have already trumped it. Pravda is their model. Who can be disinterested when there is a war to be fought for diversity and equity, against climate change and white supremacy? The revolutionary animals are now running the farm in a way that would be nightmarish even to Farmer Jones. They won. They are now one with—but also far, far worse than—what they rebelled against. Bipartisan Baloney – The High Courts Reformation
Posted: 08 Feb 2021 08:47 PM PST by Newt Gingrich & Staff: In the final days of the 2020 presidential campaign, President Joe Biden either refused to respond — or was extremely measured in his response – to questions about potentially “packing” the Supreme Court. Biden declared, “you’ll know my opinion on court packing the minute the election is over.” Well, the election has come and gone, and we still don’t know if the Biden administration plans to add additional justices. Since the beginning of America, our founding fathers believed in a government limited by the separation of power. One of the essential aspects of this power separation is the Judiciary Branch, which ensures that all laws are constitutional. The Trump administration was able to seat an unprecedented three justices, ultimately skewing the Court to a 6-3 conservative favorite. Since justices serve for life, far left groups fear conservative values could rule in the Supreme Court for decades to come. They quickly began calling for efforts to expand the court. Despite a failed attempt by FDR in 1937 to pack the Court to ensure a liberal majority that would support his New Deal, the Supreme Court’s membership has remained at nine justices since 1869. As a senator, President Biden himself saw FDR’s attempt to place additional justices as “a bonehead idea.” But the new Biden administration quickly created a commission set on reforming the High Court. Under the direction of the White House Counsel’s office, the bipartisan Supreme Court Commission plans to study reforms for the Supreme Court and federal judiciary. Many Republicans in Congress fear the commission is the first step to appeasing progressive groups’ calls to expand the Court’s bench. As Rep. Ken Buck, R-Colo., said, “Well that didn’t take long. President Biden is already organizing a commission on Supreme Court ‘reforms’ (read: Court-packing).” According to Politico, the Biden administration is expected to appoint between nine and 15 members to the commission, which will be co-chaired by former Obama Department of Justice Deputy Assistant Attorney General Cristina Rodríguez and Biden campaign lawyer Bob Bauer. In a 2018 article in The Atlantic, Bauer says, “court packing is not a reform in response to concerns about the Court’s wider and controversial role in resolving political and policy conflicts. To pack the Court does not serve to strengthen the institution, even if it maximizes the chances of winning particular cases.” In addition to Rodriguez and Bauer, Caroline Fredrickson and Jack Goldsmith will also serve on the commission. Fredrickson, the former president of the American Constitution Society, is supportive of Court expansion. For many voters, Democrat and Republican, Biden was a centrist choice to unite a divided country. At his inauguration, Biden said that he would be a president for all Americans, not just the ones who voted for him. A recent poll found that only 46 percent of respondents were in favor of increasing the number of Supreme Court Justices, with one-third of those respondents being Republican. It’s hard to imagine how an attempt to pack the Supreme Court would promote unity — and not merely be seen as a partisan political powerplay. Although there has been immense pressure for President Biden to expand the Supreme Court, the only way to do so would be if the newly Democrat–controlled Senate abolished the filibuster. This would allow Congress to pass a bill changing the number of justices in both chambers by simple majorities, which Biden could then sign into law. As Biden said in October, “The last thing we need to do is turn the Supreme Court into just a political football, whoever has the most votes gets whatever they want. Presidents come and go. Supreme Court justices stay for generations.” You are exactly right Mr. President! Packing the Court creates a precedent that whenever a party gains power, they can change the rules to keep that power, sowing the seeds for more political division. Resistance To Pope’s Pleas Growing In U.S.
Posted: 08 Feb 2021 08:29 PM PST by Bill Donohue: Comments on two important statements made by Pope Francis: There is nothing new about the Catholic Church’s opposition to abortion or human trafficking, but what Pope Francis said about them on February 8 is worth a closer look. The pope decried the fact that many nations are retreating on these key life issues. What he said bears application to the vector of change apparent in the United States. The pope said “it was painful” to observe that “under the pretext of guaranteeing presumed subjective rights, a growing number of legal systems in our world seem to be moving away from their inalienable duty to protect human life at every one of its phases.” Calling the right to life “a foundational human right,” the Holy Father said, “If we deprive the weakest among us of the right to life, how can we effectively guarantee respect for every other right?” Among those other rights, he noted in a separate forum, is the right to be free from exploitation. He pointedly mentioned the plight of those who suffer from human trafficking, the most vulnerable among us. He encouraged all of us to continue “praying and fighting together” in hopes of ridding ourselves of this horrendous condition. Unfortunately, in the United States we are going backwards on both issues. President Biden is determined to be the most pro-abortion president in American history. He spent his first few weeks in office rolling back many restrictions on abortion enacted by the Trump administration. Moreover, never has Biden, or anyone on his staff, called the right to life “a foundational human right.” Just as disturbing are the Biden administration’s policies governing border security. Let’s be honest: He is bent on relaxing the strictures that worked to stop the caravans of Central Americans from crashing our borders. Now they are back. Who is leading them? Human traffickers. They traffic in women, children and drugs. Biden professes to be a “devout” Catholic, and it would be unfair to question his personal relationship with God. But he can be judged on his abortion policies, and on that score he fails miserably. As for human trafficking, no one champions its cause. But that matters little. What matters is whether the policies being promoted act as a deterrent or a lure. Pope Francis has a right to expect more fidelity to his teachings from those who wear their Catholicism on their sleeve than from those who do not. Farewell, Professor Shultz -Dead at Age 100
Posted: 08 Feb 2021 08:13 PM PST While proper protocol would be to refer to George Shultz as “Secretary” given his remarkable service as President Reagan’s secretary of state, on the few occasions I crossed paths with Secretary Shultz in the Reagan years (the last being in 1987 after our Moscow embassy was compromised), I found myself more like a student in awe of his quiet and unassuming yet extraordinarily powerful intellect. I always thought of him as “Professor.” Shultz was born in New York and grew up in New Jersey, and he was all American. He was a graduate of Princeton and earned a PhD from MIT. His education was interrupted by his service as a Marine in World War II as an artillery officer in the Pacific theater. He taught economics at MIT, served in Dwight Eisenhower’s administration, and was the dean of the University of Chicago Graduate School of Business, where he sharpened his free market economy views as shaped by Milton Friedman. He went on to serve as Richard Nixon’s secretary of labor, director of the Office of Management and Budget, and then as treasury secretary in 1972. In the wake of disastrous foreign policy decisions by Jimmy Carter’s administration, Shultz accepted President Reagan’s call as secretary of state, serving from 1982 to the end of Reagan’s second term in 1989. He masterfully crafted Reagan’s relationship with Soviet dictator Mikhail Gorbachev and our overall policy with the USSR — leading to the implosion of the Soviet Union in George H.W. Bush’s first year in office. In an interview 20 years later, Shultz noted: “Détente said, ‘We’re here, you’re here, that’s life, the name of the game is peaceful coexistence.’ Reagan said, ‘No, they have a very unstable system, and it’s not going to last. It’s going to change.'” Indeed it did for the better of all mankind. Shultz memoir, Turmoil and Triumph, is a primary resource on the end of the old Cold War and how Reagan won the Cold War. Shultz went on to serve as an adviser to George W. Bush, crafting his doctrine of using preemptive and overwhelming force after the 9/11 Islamist attack on our nation, the result of Bill Clinton having largely ignored the emerging Jihadistan threat over the previous eight years. Shultz mentored Bush’s second-term secretary of state, Condoleezza Rice, but the only secretary of state who has approached his impressive foreign policy record was our most recent, Mike Pompeo, who also relied on his wisdom. Shultz was one of only two men to have held four presidential cabinet positions. He spent his last years as an active intellectual force with several think tanks — primarily as a distinguished fellow at Stanford’s Hoover Institution — but he was also an influencer with the Institute for International Economics and the Washington Institute for Near East Policy. He will be missed, especially by those who knew him more casually at Bohemian Grove’s Mandalay Camp. Former Secretary of State Henry Kissinger wrote of Shultz in his own memoirs, noting: “I met no one in public life for whom I developed greater respect and affection. Highly analytical, calm, and unselfish, Shultz made up in integrity and judgment for his lack of the flamboyance by which some of his more insecure colleagues attempted to make their mark.” Kissinger concluded, “If I could choose one American to whom I would entrust the nation’s fate in a crisis, it would be George Shultz.” Farewell, Professor. Governments Everywhere Need to Stop Treating Internet Providers Like ATMs and Punching Bags

Especially so – so long as governments insist on doing everything antithetical to everything we know about viruses. Locking down people in their homes – means the people’s only lines to the outside world are their Web-connecting fiber lines, coax cables and smart phones. So you would think government would do as little as possible to damage or hinder Internet Service Providers (ISPs) from doing what they have so spectacularly done – connect rapidly and seamlessly a massive country of one-third of a billion people. Government says they want ISPs to connect people. Their every action belies them. Every level of government looks for as many ways as possible to tax ISPs – and pile upon them ever more mandates and regulations. You wouldn’t do that – if you actually wanted ISPs to connect people. Because every tax, mandate and regulation – makes it more difficult for ISPs to connect people. Want Cheaper, Better Internet? Limit the Local Government Shakedowns of Internet Providers: “The number of cities and towns making these ridiculous demands is staggering. The wide variety of these ridiculous demands is mind-numbing. “All of which are geared by government – to find new and additional ways to extract ever more money from the ISPs.” How Much Do I Pay in Wireless Taxes?: “Wireless taxes, fees, and surcharges make up 22.6% of the national-average bill, ‘the highest rate ever,’ according to a new study from the Tax Foundation, which has been reporting wireless taxes annually since 2013.” Government Disproportionately Harms Poorer Americans More Poorest, Most Rural Areas of Country Hit HardestOur nation is HUGE. Connecting our massive land mass is much more difficult and expensive than stringing together, say, the tiny nations of Europe. And yet we’ve done it MUCH better than has, say, Europe. “At stake, in other words, is whether an administrative agency should be permitted to re-write the law — especially when it does so simply to fit a political agenda.”Then came Donald Trump. The federal government under Trump was rolling back regulations all over the place – including on the Internet. And Trump’s deregulation came just in time for our governments’ shutting us all up in our homes. “Chairman Pai led the FCC effort to repeal the destructive Obama Administration rule, and return federal internet service regulation to the light-touch regulatory environment that prevailed from 1996 to 2015…. “Chairman Pai’s effort bore immediate fruit. In the first year alone, U.S. internet speeds increased by 40%….”Well that free market success – was fun while it lasted. Liberals Aim to Restore Net Neutrality Rules and Go Much FurtherJoe Biden wishes to reinstate Barack Obama’s awful Net Neutrality – and then some. Excellent news. Of course, government mandates and regulations cost companies time and money. Compliance ain’t easy – or cheap. So of course…. Every second or penny companies waste on government – is a second or penny they can’t spend on improving their products and services. And companies have to charge more for their products and services – to recoup the time and money they wasted on government. So We the Consumers pay more – for less. Because of government. ISPs are supposed to connect We the People to the Internet. They are not supposed to be government cash machines and regulatory abuse victims. LV Sun Finally Reveals Biden Interview That Exposes Depths of Anti-Gun Views to Public
Posted: 08 Feb 2021 06:44 PM PST by NRA-ILA: Those who stay involved in the efforts to defend the Second Amendment have always known President Joe Biden is, to put it lightly, no friend to gun owners. During his campaign for the White House last year, the legacy media did everything they could to conceal that fact. The Las Vegas Sun recently revealed that it went so far as to bury an interview with candidate Biden that showed not just his disdain for our right to keep and bear arms, but his utter lack of comprehension of reality. The interview took place on January 11, 2020, and was published last week—more than one year later—with the paper noting they “felt the interview was worth publishing to give readers a better idea of where Biden will lead the country.” Perhaps it would have been more helpful to their readers to have published the information BEFORE the 2020 election, rather than after, so they actually knew the views of Biden when they cast their ballot for President. Again, people reading this already knew how anti-gun Biden is, but many others did not. We always thought that one of the purposes of the media was to get information that may not be widely known out to the public, especially when that information may better inform voters about candidates they may be considering supporting. When seeking the Democrat nomination, Biden and his fellow candidates did everything possible to try to position themselves as the most anti-gun candidate. But after securing the nomination, Biden stopped talking about his anti-gun agenda, and most in the media stopped mentioning it. The Biden-Trump debates didn’t bring up guns, and neither did the vice-presidential debate. The failure to discuss such an important topic seems odd, considering the Sun’s contention that “public sentiment for (gun control) is growing and support for the NRA is weakening.” If that were true, wouldn’t it be important to note the stark difference between Biden—an avowed anti-gun politician with a decades-long record of opposing the Second Amendment—and Donald Trump—a strong supporter of the right to keep and bear arms? The truth is, most Americans do not believe in Joe Biden’s agenda of targeting lawful gun owners, and the media knows it. That’s most likely the reason this Sun interview didn’t see the light of day until now. It may also explain why anti-gun lobbying groups spent millions on electing candidates while rarely actually mentioning gun control, until they got called out on it. So, what would the LV Sun interview have revealed to voters—especially those in a battleground state like Nevada? Right at the start, Biden’s delusion shows through, as he continues to repeat the fantasy that he is the only reason Congress passed the Brady Bill and ban on so-called “assault weapons” in the early ‘90s. “I’m the guy who got the Brady Bill up and passed and expanded, No. 1,” Biden claimed. “No. 2,” he continued, “I was able to include an assault weapons ban and the number of rounds that could be held in any magazine.” It’s as if then-Senator Biden was in charge of the Senate (he was not) and was the lone voice calling for such restriction (again, he was not). Yes, he worked against law-abiding gun owners on those two measures, but there were plenty of anti-gun Senators who helped ram the bills through—who then sat back and watched as the 1994 mid-term elections saw control of the House and Senate flip in one of the worst mid-term thrashings a party that held the White House and both chambers of Congress has ever seen. But Biden’s delusions didn’t stop with his belief that he alone is capable of passing anti-gun bills. He also claimed in this year-old interview, “An overwhelming majority of NRA members thought we should do away with assault weapons.” Of course, only NRA knows who are its members, so only NRA is capable of gauging what its members do and do not support. Biden’s claim, quite simply, is just his personal fantasy, based on nothing more than what he would like people to believe. When speaking of what he supports, though, the interview does become quite revealing. He still wants to ban the standard-capacity magazines that come with most new semi-automatic firearms, but he says the old anti-gun standard of limiting capacity to 10 rounds is still “too much in my view.” Who knows what isn’t “too much” for Joe? We know he has alluded to limits of three rounds, but he may even be open to just one round. He also mentioned the alternate reality where he believes “we have the capacity now to build any weapon where it can only be fired with your biometric marker.” While he probably meant capability, not capacity, the fact is that such technology is only available in Hollywood, and only on the big screen. He does mention dealing with people in Silicon Valley to, apparently, support his claim. And while those developers have made great strides in computers, we have yet to see them develop any firearms—other than those virtual ones you might see while gaming. If Silicon Valley is able to develop firearm technology that the public wants, that’s great. Biden accurately notes that developing such “biometric marker” technology doesn’t infringe on the Second Amendment. Allowing the public access to such things is not a problem, but the President went on to imply that he would mandate these types of guns—if they are ever a reality—be all that would be allowed, stating, “If you pass the background check, you can purchase a weapon which only you can pull the trigger.” Look, as good as the R&D people in Silicon Valley are, people who own firearms for the purpose of defending their lives and those of their loved ones may take pause before deciding the latest pistol from Microsoft or Apple is their best choice. One need only to think back to the last time your computer crashed, or failed to boot up, before determining something from an actual gun maker might be a bit more reliable when lives are at stake. Mandating such technology, if it is ever actually developed, would clearly violate the Second Amendment. Joe went on to reveal how he intends to pass his anti-gun proposals; he wants to hide it in larger bills that legislators may feel forced to support. In other words, Biden admits that he cannot pass gun control as a standalone measure, which certainly undermines the Sun’s claim of “growing” public support for gun control. Then again, maybe it just points out the fact that there might very well be “growing” support, but the growth is small, and the vast majority of Americans still don’t think restricting law-abiding gun owners is what Congress (or Biden) should do if they want to address the problem of violent crime. Perhaps the Sun should have made this scheme a little more public, so voters could decide if this type of political arm-twisting was what they wanted out of the candidate they decided to support. Finally, but perhaps most importantly, Biden makes it clear that he intends to try to cripple the firearms industry under crushing legal fees by repealing the Protection of Lawful Commerce in Arms Act (PLCAA). While this has always been part of his agenda, the media didn’t talk about it much prior to the 2020 election. Thanks to the Sun burying this year-old interview, many Nevada voters were likely unaware of this aspect of Biden’s anti-gun scheme. Biden lied about the PLCAA, as he often does, claiming it exempts the firearms industry from being sued. It does nothing of the sort, but Biden keeps saying it, and his supporters in the media never question him about it. So, Biden told the Sun in January 2020 that he wants to ban most commonly-owned magazines and limit their capacity to fewer than 10 rounds, and perhaps as few as three rounds, or even one; he wants to cripple gun manufacturers under the burden of expensive, meritless lawsuits; he wants to mandate only firearms equipped with technology that does not exist be lawful for sale in America; and he wants to do all this through secretive backroom deals on larger legislative packages that might force reluctant, relatively pro-gun lawmakers to betray their constituents. And the Las Vegas Sun decided to sit on this information for a year. In Nevada. A battleground state that wasn’t called for Biden until several days after Election Day. A state where more than 160,000 background checks for firearm purchases were conducted through the first week of November 2020—a new annual record with nearly two months still to be tallied. It’s no wonder the public’s trust of the media is so low. Whether it’s through legislative bullying, executive action, anti-gun cabinet nominees, or attacking NRA and its members, there is little doubt that Joe Biden will do everything he can to eviscerate the Second Amendment. Perhaps the legacy media might find those attempts newsworthy. The Trump Political Show Trial

by Ron Paul: The Senate trial for now twice-impeached former President Donald Trump is set to begin this week, with little doubt over the outcome. A procedural vote in the Senate on the constitutionality of “removing from office” someone who is not in office revealed that nowhere near enough Republicans were willing to join their Democrat counterparts in voting to convict. Supreme Court Chief Justice John Roberts, who is required by the Constitution to preside, has by refusing to participate made it clear that he does not consider the upcoming action in the Senate to be a legitimate impeachment trial. So if it is not a legitimate trial, what is it, then? Judging from the House impeachment resolution, it looks more like a banana republic “show trial” than a careful case detailing Trump’s “high crimes and misdemeanors.” Trump was impeached by the Democrat-controlled US House for “incitement of insurrection” over the January 6th melee at the US Capitol. Telling his supporters they must fight or they’re “not going to have a country any more” was cited in the impeachment resolution as evidence that Trump “gravely endangered the security of the United States and its institutions of Government” and has “demonstrated that he will remain a threat to national security, democracy, and the Constitution if allowed to remain in office.” Trump also told them to march to the Capitol “peacefully and patriotically” to encourage Congress to consider his claims of election fraud, but Democrats in the House say that he didn’t really mean it. Why the snap impeachment? Why not, as Constitutional law professor Jonathan Turley has written, hold hearings and call witnesses to explore whether the former president actually had insurrection on his mind? Did he call off or delay the National Guard troops from protecting the Capitol, for example? Or was he simply using heated political rhetoric that his accusers in Congress have also used plenty of times? Weeks of hearings in the House with dozens of witnesses could have helped make the case for the Senate that Trump was guilty of inciting insurrection. Such hearings could have turned the tide against Trump in the Senate, where he is certainly not universally supported within his own party. But the House had no interest in such hearings. They wanted a snap impeachment. They wanted no witnesses. They wanted to benefit from the universal mainstream media narrative that the mob who entered the Capitol building was not just unruly Americans angry over what they believed was a rigged election, but was actually trying to overthrow the government to keep Trump in power. The House Democrats knew that the “insurrection” narrative would not stand the test of time – anyone familiar with “color revolutions” or coups overseas would easily recognize that this was not one. So they rushed through the impeachment not because they wanted to remove him from an office he no longer occupied, but because they wanted to bar him from ever running for office again. It does raise the question: what are they afraid of? They called their impeachment a victory for democracy, but isn’t preventing Trump from running again a subversion of democracy? Trump would do well to ignore the Senate proceedings. There is no reason to participate in a show trial. The media has reported that he intends to focus on the “stolen” election in his defense before the Senate. That would be counterproductive. The right question to ask is, “what if they held a show trial and nobody came”? I See a Bill

But what if the scary thing you are supposed to report is someone’s heated political opinion? A bill called the “See Something, Say Something Online Act of 2020” — just reintroduced last week — would require websites and interactive service providers to report “suspicious” activity that may later be connected with “terrorism, serious drug offenses, and violent crimes.” If a provider fails to exercise “due care” in reporting major crimes and “suspicious transmission activity,” the company’s liability protections would be at risk. Suspicious transmissions would have to be reported to the Justice Department within 30 days. Though, reporting at the end of that window wouldn’t do much to stop an imminent crime committed, say, five days after a dubious text message. What the legislation would do, notes Reason magazine’s Elizabeth Brown, is “set up a massive new system of intense user monitoring and reporting that would lead to more perfectly innocent people getting booted from internet platforms” and give government another way to clobber “disfavored tech companies.” Of course, neither hyperbolic opinions nor gleeful snitching are rarities on the Internet. So if such legislation leads to instituting easy and anonymous ways to complain to the government about somebody’s online opining, we can expect false positives to skyrocket. Time and energy wasted harassing innocent people would not be used to catch actual thugs and terrorists. And we’d have yet another chilling effect on our freedom of expression. The Silencing of the American Conservative

ALG President Rick Manning is not thrilled to see this.ALG President Rick Manning said “freedom isn’t free. Freedom has a cost. The signers of the Declaration of Independence, or basically wealthy people who put everything on the line for freedom. Their lives and their fortunes on the line for freedom. And, you know, I never thought in my lifetime that I would be put in that position, but I’ll be damned if I’m going to let a bunch of pimply faced Silicon Valley creeps define for me what I can say what I can believe and try to change America through intimidation.” Manning denounced the “Twitter mobs” and refuses to let others dictate what he can and cannot say in his exercise of free speech. “When a small mob, a small percentage of the mob goes off and shuts up the rest of the population, that’s when you have real problems. That’s when you have Hitler rise in Germany, is when a small mob intimidate the rest of people. It is the answer to the question that everybody always asked, ‘How can a civilized country like Germany and fallen into Hitler’s hands?’ It’s because the people were intimidated and didn’t want to lose their stuff. And as a result, they were not willing to speak up and say no, you cannot do that here. I’m saying right now. No, you can’t do that here.” Manning is also not thrilled to hear how Donald Trump is being treated. “The impeachment trial of Donald Trump is an attack on political speech. Nothing more, nothing less. And anybody who bows to that attack on political speech is effectively saying we want we will only allow discourse between people where there’s no discussion of anything that might at all want to change the administrative states. It is plummeting towards full federal government control. That’s about shutting people up.” Should people be afraid to exercise their first amendment rights in America? Manning said, “I think it’s pretty clear that there’s been an intimidation campaign run by the left. The whole cancel culture campaign was designed as attack on corporations. It is pretty obvious that there’s an attempt by the left to make it so if you speak out on politics, if you say anything that’s not on the approved list of things to say that they will go after you and jump to cancel you. We apologize for saying ‘all lives matter.’ A lot of a lot of people pretty high profile and so obviously people who are lower profile and feeling more vulnerable are beginning to say, ‘No, maybe I don’t need to speak out I still think the same way. But I don’t need to put myself in the crosshairs ‘“ Will there be consequences for speaking your mind? Some have experienced them. The answer, according to Manning, is, yes. “There is a group of people who are aggressively seeking to shut up, anybody who doesn’t mean just kneel to them. And that group of people will you know they’ll attack, you know local barber and they’ll attack somebody who’s just trying to bake cakes. We saw that in a masterpiece cake case which, you know, one, cake, cake baker in Colorado, ended up having his entire life turned upside down because he didn’t want to bake a cake for a gay wedding. Similarly, we’ve seen florists and others, and that occurred in the last, you know, five to six years have been kind of building, and now they now the left is becoming even more emboldened and they want to stop anybody from talking having any kind of speech. And if you want to know if it’s effective, all you have to do is look at the Newsmax interview with Michael Lindell a couple days ago, when Lindell was talking about the elections and Newsmax, the anchor got to their state their statement out saying, ‘we believe Joe Biden won.’ And we’re worried. And that was strictly driven by federal lawsuit, and you know so people are being shut up and people aren’t choosing not to speak because, for one of the first times in American history. It’s almost state sponsored terrorism. Or there’s a war. There’s a group of people who in fact do attack the for your point of view, and not attack you with a just verbally but they attempt to ruin you. And people make those choices.” Manning believes the courts will be very busy fighting for those who want to fight for their rights. “We’re entering a new era in America and what’s really going to depend upon is whether the courts work or not, you know, because here’s what we know. The Left, through the bill called HR 1, wants to make it so if you give money to a group like Americans for Limited Government that that money will have to be reported. As a result, there’s anonymity as there shouldn’t be under law, the left is going to try to force reporting because they want to do. They want to basically intimidate people away from being able to give money to groups like Americans for Limited Government. “So here’s what that means. They view what we’re doing here on this camera, having an honest conversation about what’s happening in America as to be such a threat to their ability to control this country that they want to shut down the ability to do that. And you know that’s kind of antithetical to the concept of free speech. In fact, it is antithetical, but you know they don’t care about that because it’s about power and control. When the good news is in the courts. The courts have come down repeatedly saying they can’t do that. “And so there’s a case Alabama the NAACP, which, you know, the state of Alabama was trying to get the, the membership list and the importance of people giving money to the local NAACP. NAACP said no, and the courts agreed that the NAACP didn’t have to. And the reason for that protection was because of politically it was an attempt to intimidate people from giving money to the NAACP. That that case which was from the early 1960s late 1950s is every bit as applicable today on the other side. And so the courts are honest the courts are real, you don’t have anything to worry about. And if they aren’t, then you got a lot more to worry about than way to get your money.” We will have to see what people will feel free to do in the coming months and years. 6 Things to Know About Democrats’ COVID-19 Package
Posted: 08 Feb 2021 05:24 PM PST by Fred Lucas: Democrats are poised to use Senate rules to pass a mostly partisan COVID-19 “stimulus” package, despite President Joe Biden’s appearing to be open to Republicans’ concerns earlier in the week about spending too much. The House and Senate each passed separate spending measures Friday, and the legislation will go to a conference committee including members of both chambers. Biden has called for Congress to act quickly. The Senate is using the so-called reconciliation process to push through what it calls the American Rescue Plan, a $1.9 trillion package that goes well beyond relief for the pandemic. The details of the legislation haven’t been settled, but some on the left flank of the Democrats are pushing for expansive elements of the Green New Deal, universal basic income, and a public option for health insurance. “If the Senate abuses the reconciliation process to jam through their laundry list of policy priorities, that’s the ‘nuclear option’ by another name,” Jessica Anderson, executive director of Heritage Action for America, said in a formal statement, adding: Biden met with House Democratic leaders Friday at the White House. In remarks to reporters, the president said it was urgent to act and attacked Republican proposals as insufficient. “If I have to choose between getting help right now to Americans who are hurting so badly and getting bogged down in a lengthy negotiation or compromising on a bill that’s up to the crisis, that’s an easy choice,” Biden said at the White House. “I’m going to help the American people who are hurting now. What Republicans have proposed is either to do nothing or not enough.” Although details of a final bill are evolving, here’s a look at what Democrats, and some Republicans, are pushing for in the package. 1. Who Gets $1,400 Checks The Senate approved an amendment from Sens. Joe Manchin, D-W.Va., and Susan Collins, R-Maine, to prevent the checks from going to high-income earners—although it didn’t put direct parameters on income. However, several proposals exist for what the limits should be, one considered most likely for families earning $100,000 or less. Even a package containing limited direct relief checks still would cost about $420 billion, according to the Committee for a Responsible Federal Budget. That’s modestly less than Biden’s proposal to devote $465 billion to relief checks, which would have targeted singles earning up to $75,000 and couples earning up to $150,000. Former President Donald Trump demanded $2,000 in relief checks to Americans during his final weeks in office. In this case, Democrats largely sided with Trump while most Republicans opposed the additional spending. One proposal is to issue $1,400 payments to individuals earning $50,000 or less and $2,800 to couples earning up to $100,000. Parents could get another $1,400 per child—bringing the total for an average, two-child household to $5,600. Some Democrats reportedly are pushing for a separate, more permanent child tax credit of $3,600 per child up to age 6, dropping to $3,000 for ages 6 to 17. Lawmakers and policymakers have used two terms, stimulus checks and relief checks. The latter might be more appropriate, as more than two-thirds of the first round of COVID-19 checks went into savings or to pay down debt, rather than being spent to boost the economy, according to a survey from the New York Federal Reserve. 2. Path to Universal Basic Income? Such a proposal would be a heavy lift in the conference committee, however. A nonprofit women’s organization called Girls Who Code is among those leading a movement to push the Biden administration to include a provision for guaranteed income. Entrepreneur Andrew Yang sought the Democratic presidential nomination last year by promoting the idea of the federal government sending $1,000 a month to all Americans. This would have a price tag of $2.8 trillion per year, according to the Tax Foundation. “Some Democrats are pushing for universal basic income that would continue the $1,400 checks automatically,” Matthew Dickerson, director of the Grover M. Hermann Center for the Federal Budget at The Heritage Foundation, told The Daily Signal. 3. Bailing Out Union Pensions This would allow companies that lack the ability to pay their negotiated union pensions to get relief, as taxpayers would kick the money in. “A lot of members want to bail out the union pension funds,” Heritage’s Dickerson said. “These union pensions have been underfunded for years and years.” The proposal would strengthen the Pension Benefit Guaranty Corp., the chief federal insurer of pension funds. Under the plan, the Treasury Department would make direct payments to the PBGC, which would assist the pension funds. The proposed $60 billion bailout doesn’t include the cost to taxpayers in later years, Roll Call reported. Democrats say the Pension Benefit Guaranty Corp. faces a shortfall of $82.3 billion through the end of the decade, and that 124 pension plans with about 1.3 million participants are expected to run out of money by 2040. 4. Bailing Out States for Overspending These bailouts primarily would target states facing the most need because of their lack of fiscal restraint before the pandemic, critics say. Last year, then-Senate Majority Leader Mitch McConnell, R-Ky., referred to the Democratic proposal as a “blue state bailout.” But now Democrats control the White House and both houses of Congress. The portion for state aid would cost $350 billion, which Biden said would keep police and firefighters working. The president also proposes $170 billion to states for schools. A group of 10 more liberal Republican senators met with Biden at the White House earlier this week and suggested lowering the income threshold for getting a stimulus check to no more than $40,000 for singles and $80,000 for couples. But that plan doesn’t appear to be going anywhere, since Democrats have moved on to the reconciliation process, which doesn’t require Republican votes. The overall price tag of the GOP counteroffer would have been $618 billion, less than half of Biden’s $1.9 trillion package, according to The Associated Press. The Republican proposal also nixed aid for states. The GOP plan supported $160 billion in aid to states specifically for health care response such as vaccines, testing, and personal protective equipment and gear. However, Democrats view stopping there as not doing enough. 5. Raising the Minimum Wage The Senate adopted an amendment from Sen. Joni Ernst, R-Iowa, prohibiting a $15 minimum wage during the global pandemic. It passed by a voice vote. In another GOP victory, the Senate approved an amendment from Sens. Rick Scott and Marco Rubio, both of Florida, to block tax hikes on small businesses during the pandemic. Manchin opposed the $15 minimum wage that many Democrats were demanding. With the Senate split 50-50 between Democrats and Republicans, and Vice President Kamala Harris casting any tie-breaking vote in favor of the Democrats, every vote matters. However, Manchin indicated that he isn’t opposed to any increase in the federal minimum wage of $7.25 an hour for low-skilled workers, often younger and working at fast food chains or retail outlets. By law, no state can have a lower minimum wage than the nationally mandated minimum wage for all employees. However, a state may go higher. So, the national minimum wage of $7.25 per hour is a floor for pay, not a ceiling. Already, 26 states have a minimum wage higher than the federal one, according to the National Conference of State Legislators. Before the pandemic, the Congressional Budget Office estimated that a $15 federal minimum wage would cost about 3.7 million jobs, though it would increase income for 17 million Americans who are able to keep their jobs. “A $15 minimum wage may not occur, but there is a real risk [that] Sen. Manchin would accept what he considers correct for West Virginia,” Heritage’s Dickerson said. West Virginia’s minimum wage is $8.75. “There is a lot of pressure on the Biden administration to raise the minimum wage,” Dickerson said. “To more than double the wage might be just opening the Overton window. But we could see a $10 or $12 minimum wage that would still have a detrimental impact on people’s ability to earn a living and for businesses to turn a profit.” 6. Impact of National Debt This would increase annual debt payments by $40 billion. It also could boost inflation and higher prices, according to the CBO. The federal government, through past legislation, already has spent $6 trillion for COVID-19 relief, according to the Committee for a Responsible Federal Budget. The White House argues that the Congressional Budget Office’s estimate that unemployment likely will remain above pre-pandemic levels until 2024 is a reason for aggressive action. The CBO projects that 7 million Americans would be unemployed in 2021 who otherwise would be working. The Biden administration points to a Moody’s Analytics report projecting that the American Rescue Plan would bring employment to pre-pandemic levels by 2023, a year earlier than the CBO prediction. Biden Invents An Economic Crisis To Justify His Reckless $1.9 Trillion COVID ‘Relief’
Posted: 08 Feb 2021 02:29 PM PST by I & I Editorial Board: President Joe Biden used Friday’s jobs report as another justification for his massive $1.9 trillion stimulus bill. “A once-in-a-century virus has decimated our economy, and it’s still wreaking havoc on our economy today,” he said. Funny, because that’s not what the data show. Some Democrats are already coming to realize that piling another $1.9 trillion in deficit spending on top of the more than $3 trillion already targeting COVID relief is an enormous mistake. Here’s what Politico reported last week after liberal economist Larry Summers cautioned that the Biden plan was too big. Give Summers and those anonymous “liberal wonks” credit, at least, for staying in the neighborhood of reality, something that seems to have escaped “No Malarky” Biden. Let’s review some of the more recent economic data to see where things actually stand. Unemployment: The Labor Department reported Friday that the unemployment rate fell again to 6.3%. Not only is that well below where economists expected it to be, and it’s also lower than where it stood for two-thirds of the time Barack Obama and Biden were in the White House. In fact, when Obama gave his State of the Union address in 2014, during which he bragged about how great the economy was, unemployment was at 6.6%. Nor is the recent decline in the unemployment rate merely the result of people dropping out of the labor force (which was often the case during the Obama years). In fact, the number of people not in the work force – those who aren’t working or looking for a job – dropped by 2.7 million from last April to this January. So what’s going on is that more people are reentering the labor force, and finding jobs. Biden Treasury Secretary Janet Yellen said Sunday that with the $1.9 trillion spending billion, “we would get back to full employment next year.” But the economy doesn’t need another massive stimulus for that, it just needs government to stop forcing businesses to stay shut. GDP: Although it captured little attention, the Commerce Department reported on Jan. 28 that the economy grew by 4% in the last three months of 2020, after exploding by 33.4% in the third quarter. As a result, the economy has already made up more than 86% of the ground it lost due to the (largely unnecessary) economic lockdowns of last year. By the way, that 4% quarterly gain was higher than all but four of the 32 quarters under the Obama-Biden administration. Now that even blue states are starting loosen the reins on their people and businesses, and as the vaccines reach more and more people, don’t be surprised if these outsized growth rates continue. (At least, that is, until Biden’s economic policies start to drag it down again.) This Governor Faces Impeachment Over COVID-19 Mandates

by Fred Lucas: As the nation’s capital braces for its second impeachment trial in just over a year and far-flung states clash over COVID-19 restrictions, Kentucky’s governor faces an impeachment probe by state legislators for what his critics say were overly strict rules during the pandemic. With impeachment threatened by foes who say his COVID-19 mandates violated the state and federal constitutions, Gov. Andy Beshear, a Democrat, sued the state Legislature for overriding his veto of two bills that would rein in his power to impose such restrictions. At the same time, Kentucky Attorney General Daniel Cameron, a Republican, faces his own impeachment push over what critics say was his poor handling of the investigation into the fatal police shooting last year of Breonna Taylor. In the Bluegrass State, the Legislature is required to refer a citizens’ petition for impeachment to a committee. More than 60,000 signatures calling for Beshear’s ouster were delivered Tuesday to the Kentucky Capitol in Frankfort via U-Haul truck, WHAS-TV (Channel 11) in Louisville reported. Kentucky House Speaker David Osborne, a Republican, appointed four Republicans and three Democrats to a special impeachment committee to consider all the cases—as well as a petition to impeach a state legislator. The GOP holds a supermajority in the House and Senate, and could reach the two-thirds vote needed to remove a state official. State Rep. Jason Nemes, a Louisville Republican who is chairman of the impeachment committee, last week sent a letter to Beshear’s office seeking information on the monitoring of churches Easter Sunday by the governor’s office. “Rather than reaching conclusions by way of speculation, we are requesting some additional information,” Nemes said in the letter. “We have read the reply filed by the petitioners, which references the monitoring of churches by the Kentucky State Police at the direction of the Office of the Governor. This request asks that the governor provide information related to those monitoring efforts.” None of the impeachment petitions likely will go far, Al Cross, director of the Institute for Rural Journalism and Community Issues at the University of Kentucky, told The Daily Signal. Petitions are not uncommon, but nothing usually comes of it, Cross said. “It’s pretty easy to file an impeachment petition around here,” said Cross, formerly a political reporter for The Courier-Journal, a Louisville newspaper and the state’s largest. “There have been a number of these that have been received and referred to a committee and we never heard about because the committee didn’t do anything with them. In this [Beshear] case, the leadership of the House decided a separate impeachment committee.” The speaker’s move to set up the special panel indicates a desire to prevent too much partisanship, since the House Judiciary Committee has a 14-4 Republican majority and likely would face intense pressure to impeach the Democratic governor. Cross said he also doesn’t believe Republicans in Kentucky welcome this. “I don’t think this is going to go anywhere. I don’t think there is any kind of impeachable crime against Beshear,” he said, noting that the governor made “political errors” along the way. Despite the GOP supermajority in both houses, Cross said, he doesn’t think Republicans will engage in a raw power exercise to oust a Democratic governor. “Then the lieutenant governor [Jacqueline Coleman] would succeed Beshear, and they would have to proceed against her,” Cross said of Republicans. “They’re not taking this seriously. They don’t want it to be taken seriously. But they have a number of members who would cause them trouble if they didn’t at least pay it lip service.” After some churches announced they would hold worship services on Easter, which was April 12, Beshear said Kentucky State Police would record license plate numbers of individuals who attended any mass gathering, including church services. Police ordered attendees to self-quarantine for two weeks. Police surveyed only a few churches statewide and issued notices to those attending services at Maryville Baptist Church in Bullitt County. Pastor Jack Roberts sued the state. Opponents occasionally had called earlier for Beshear’s impeachment, but on Jan. 8 four activists drafted a petition that included multiple affidavits accusing the governor of eight counts of violating the Kentucky Constitution. The stated offenses included “imposing lockdown orders that denied Kentuckians the usage of their businesses, their personal freedoms of movement, of conscience, of worship, of the ability to gather and speak in protest.” The petition also accused Beshear of “restricting access to courts and impairing their contracts.” The governor’s lawyers filed a response saying the petition “cites no facts and little law in a last-ditch effort to upend our constitutional separation of powers, hoping the General Assembly will ignore the judgments of the judicial branch as well as the will of the people in electing their chief executive.” The State Journal, a Frankfort-based newspaper, first reported the 45-page response by Beshear’s lawyers. The seven-member Kentucky Supreme Court unanimously ruled that Beshear was within his rights to proceed under a 1998 emergency powers law. “And the petitioners cannot overcome that, unlike in any other impeachment matter in nearly 240 years, here the Supreme Court of Kentucky upheld the governor’s exercise of his executive powers in the COVID-19 public health emergency as lawful and necessary to protect all Kentuckians,” Beshear’s legal team said. On impeachment, the Kentucky Constitution is similar to the procedure laid out in the U.S. Constitution, giving the state House of Representatives the sole power of impeachment and requiring a two-thirds majority in the state Senate to convict. Punishment, the state’s constitution similarly says, “shall not extend further than removal from office, and disqualification to hold any office of honor, trust or profit under this Commonwealth.” On impeachment, Kentucky law stipulates: “Any person may, by written petition to the House of Representatives, signed by himself, verified by his own affidavit and the affidavits of such others as he deems necessary, and setting forth the facts, pray the impeachment of any officer. The House shall refer the petition to a committee, with power to send for persons and papers, to report thereon.” Another impeachment petition targeted state Rep. Robert Goforth, a Republican and former gubernatorial candidate who was indicted for allegedly trying to strangle a woman. Goforth pleaded not guilty. Cross, of the University of Kentucky, said it’s an “open question” whether a state legislator may be impeached. Three grand jurors in the Taylor case are among those who said Cameron recommended charging a single police officer for endangering Taylor’s neighbors. Yet, the petitioners complained, he didn’t tell the grand jury how to charge the officers who fired into Taylor’s home and fatally wounded her. ‘O Allah kill the disbelievers’: Jihadis in Kenya release video of Raid on US base, vow more Attacks on US targets

It then shows the meeting of Al-Shabab leader Abu Ubaydah with the men who subsequently carried out the attack. In his address to his men, Abu Ubaydah rejoices that Al-Shabab is currently “in a direct confrontation with the U.S. He instructs the men to confirm the killing of wounded U.S. soldiers, and states that their top priority is to destroy as many U.S. aircraft as possible at the base. Abu Ubaydah begins his speech by celebrating the fact that his group is fighting the U.S., and speaks about the U.S. base in Manda Bay and its importance. He boasts that in spite of all its intelligence capabilities the U.S. is completely unaware of the impending attack “You are headed towards the American military base in Kenya. Allahu Akbar! Our war has passed through several stages, hasn’t it? … Today, we are engaged in a direct war against the Americans. As you sit here now, do you think that the Americans know that you are about to attack them? No they don’t. They can continue to boast about having intelligence, advanced technology, surveillance cameras and drones but know that you are more powerful than their drones. The U.S. military base is located in Kenya. It is known as Manda Bay base and it is situated in Lamu County. It is a secret military base on which the Mujahideen have conducted extensive reconnaissance and you will soon be shown more information regarding the base. “The base is one of the major military bases belonging to US-AFRICOM in East Africa, particularly in Lamu, Kenya. It is the equivalent of Ballidoogle in Kenya and that is where you are headed. It is a base of evil and disbelief. It is the base from where attacks against innocent Muslims are launched. That is where you are headed. You are going to retaliate on behalf of those innocent Muslims and on behalf of the Mujahideen leaders who were killed by the Americans. They are in an alliance with the Kenya Defence Forces (KDF). The base serves to protect the Kenyan invaders and train their forces. That is where you are headed. Therefore, you will engage the Americans directly in a close combat.” Abu Ubaydah then prioritizes the targets for the attackers after they enter the base: “When you reach the base, know that your mission, which the Muslims are waiting for you to accomplish, is to kill the American forces present there and finish off their wounded. Your mission is to destroy and set ablaze the equipment and military hardware present in the base. There are many military aircraft in the base and you will be shown a visual evidence of them. We will confront the Americans who are flying above us now in their own base. Yes, you will encounter many military aircraft in the base and destroying them should be your primary objective. If you used to hide from those planes under the trees, you will soon target them in their airfield. The blaze of the burning aircraft should be visible to all the people in Lamu and we will watch it through the lens of Al-Kataib Foundation. Beware of leaving anything intact. Target the military aircraft in particular and proceed according to priority. Your first priority is to destroy the aircraft in the base, and then followed by the armored military vehicles and storage facilities.” Abu Ubaydah rallies his fighters, hailing them as “soldiers of Allah” and saying that many other jihad fighters will follow in their path: “I hope that base becomes the place where we hear the defeat of the disbelievers, where you attain your martyrdom and that this operation soothes the hearts of the Muslims. Know that other military detachments will come after you, by the permission of Allah. Your blood will draw other Mujahideen to the cause, like a magnet… Allah will defeeat the enemy and protect the religion through your blood… Are the disbelievers able to penetrate the Wilaayaat [the Somali territories controlled by Al-Shabab] and abduct the teachers? No, they cannot, because there are Mujahideen fighters in front of them…” Abu Ubaydah encourages Muslims, especially those in the Horn of Africa, to join the ranks of his group: “We tell the Muslims living in the lands of Kufr, particularly the youth in East Africa, that it is obligatory upon you to make Hijra [to immigrate to a Muslim land, i.e. to join Al-Shabab] and wage Jihad. On whom do you entrust the responsibility of defending your religion, preserving the honour of Muslim women and fighting the enemies of Islam? How is it acceptable to any Muslim with a conscience that young disbelieving men of your age plunder your wealth, violate your dignity, and send to prison whomever they will among you whenever they will and torture him? It is only through Jihad that you can regain your honour and dignity, as well as a pleasant life in both this world and the hereafter and a justification in front of Allah. Therefore, rise and stand up for Jihad. Emulate your brothers who made Hijra before you and sacrificed their lives for the sake of Allah…” Drone footage of burning aircraft in Camp Simba He concludes his exhortations with a prayer: “O Allah kill the disbelievers who are hindering people from Your path and are belying Your messengers and cast upon them Your punishment and torment. O Allah kill the disbelievers from the people of the Book…” This segment is followed by a scene in which Abu Ubaydah is seen handing the “flag of tawhid”[3] [which symbolizes the Islamic concept of monotheism] to the commander of the operation, Ahmad Al-Muhajir, who states: “By the will of Allah, this banner will not be raised in any other place other than the American base in Manda Bay…” The video then shows original footage of the attack which Al-Shabab filmed with drones, against a backdrop of audio from Al-Qaeda cleric Anwar Al-Awlaki and the commander of the U.S. military’s AFRICOM. The footage shows fire and smoke rising from Camp Simba. This section is followed by a commemoration of each of the five operatives who participated in the attack, including a short biography and each one’s final message. The common themes among all the messages are threats to “Jews and Americans;” the vow that the attacks in the framework of the “Jerusalem Will Never Be Judaized” campaign will continue; and the reassurance to the Palestinians that Al-Qaeda and Al-Shabab are committed to fighting for the “liberation” of Al-Aqsa, and so on. The fighters all wear red headbands bearing the slogan “Jerusalem Will Never Be Judaized.” Commander of the raid, Ahmad Al-Muhajir, wearing a red headband with the slogan “Jerusalem Will Never Be Judaized.” For example, in his final message before embarking on the operation, the leader of the raid, Ahmad Al-Muhajir, declares: “O Jews and Americans! Do not think that we are wearing these headbands for adornment or for exhibition purposes only. Know that Al-Quds [Jerusalem] belongs to the Muslims and it will forever belong to the Muslims. It does not belong to filth like you who spread corruption in the land. O America! If you did not learn anything from the operations in 14 Riverside [in Nairobi] and Ballidoogle,[4] then you will now learn a lesson that you did not expect. What is coming your way is not words, it is action, and not just mere action, but rather a great deal of action. Masha-Allah, Allah made it possible for the brothers to carry out the operations in 14 Riverside and Ballidoogle with success. May Allah accept their martyrdom as they proved that they are the brave ones and you are the cowards. Right now, we are on our way to continue in this series of operations and we will not stop there; many other brothers will come after us. By the will of Allah, we will not stop until the Shari’ah rules over the whole world and the Muslims live in a state of glory while you, the Kufr, live in humiliation. Islam will rule over the whole world. Good morning, NBC News readers.
President Donald Trump’s second impeachment trial will get underway today, two states have surprisingly come out ahead in the Covid-19 vaccine effort and saying goodbye to a “Supreme” trailblazer.
Here is what we’re watching this Tuesday morning.
Trump’s second impeachment trial set to begin Former President Donald Trump’s second impeachment trial starts in the Senate this afternoon.
The proceedings will start at 1 p.m. ET with four hours of argument on the constitutionality of the trial by the House managers and Trump’s lawyers.
House managers rebutted calls by Trump’s legal team in a final pretrial brief filed Monday to dismiss the impeachment case. In response, the House managers wrote that Trump “has no valid excuse or defense for his actions” and that “his efforts to escape accountability are entirely unavailing.”
After this afternoon’s debate, the Senate will hold a vote on whether to proceed — a measure that only needs a simple majority and is expected to pass easily.
From there, House managers are scheduled to begin their opening arguments at 12 p.m. ET Wednesday.
North Dakota and South Dakota set global Covid records. How did they turn the tide? Being mostly rural and far from the coasts didn’t protect North Dakota and South Dakota from Covid-19.
During November, North Dakota had the highest coronavirus infection rate per capita in the world. In South Dakota, the death rate reached a global high.
But since those late fall peaks in cases, both states have emerged as leaders in the country’s vaccination rollout.
Kaitlin Sullivan reports for NBC News on what’s working in the two states, as well as lingering issues — such as misinformation, a false sense of security and the politicization of infection prevention measures — which could stymie their success.

FIRST READ: Yes, the GOP is split over Trump. But the two wings aren’t that different
As the Senate takes up Donald Trump’s impeachment trial — with little optimism among Democrats that the short list of Republicans open to breaking with the former president will grow — our NBC News poll from January showed that there is indeed an even split in the GOP between those more loyal to the party and those more loyal to Trump.
Among Republicans, exactly half (46 percent) said they consider themselves supporters of Trump more than the party, and exactly half (46 percent) said the opposite.
But that doesn’t mean that the party Republicans are raring to see Trump held accountable, either.
Among those who say they consider themselves foremost a supporter of the party rather than of the former president:
- Just 16 percent disapproved of Trump’s job performance
- Just 19 percent said Trump was solely or mainly responsible for the events of January 6
- Just 7 percent say they regretted their vote for Trump
- Just 12 percent supported his impeachment and removal (the NBC poll was taken in his final days in office)
Sure, the Trump wing of the party is far less conflicted about any of this. In fact, more than 4-in-ten of Trump-supporting Republicans say the events of January 6 REINFORCED their vote for him. And just 1 percent said Trump bore any significant responsibility for the attack on the Capitol.
But even the half of the GOP electorate that appears open to skepticism of Trump doesn’t particularly blame him for the offenses outlined in the impeachment case — or think he must be held accountable.

Here’s how the impeachment trial will work
The impeachment trial of former President Donald J. Trump begins in the U.S. Senate at 1:00 pm ET, and the prosecution and defense will spend four hours debating the constitutionality of trying a former president, per NBC’s Capitol Hill team. The trial proceeds if a majority votes in favor of its constitutionality.
If the trial proceeds as is expected, the Senate will reconvene on Wednesday at noon ET and begin up to 16 hours of argument for each side. (Each side is limited to two days of arguments, and each can’t exceed eight hours per day.)
After both sides have presented their arguments, senators get a total of four hours to question both the prosecution and defense.
After the senators’ questions, there will be another four hours to consider subpoenaing witnesses and documents.
Then there will be four hours – in total – for closing arguments.
And finally, there will be the vote on whether to convict or acquit the former president.

Talking policy with Benjy: The minimum wage meets the bean counters
As Democrats debate how to pursue a $15 minimum wage, the nonpartisan Congressional Budget Office released its eagerly-awaited analysis of the policy, and there’s something for everyone in the report.
The topline for critics is that the CBO predicts a $15 wage would lead to 1.4 million fewer jobs over 10 years and add $54 billion to the deficit. On the positive side for supporters, it would raise 0.9 million people out of poverty and raise wages for 17 million workers.
Backers of the $15 wage dispute the CBO’s overall take, pointing to outside research showing less dramatic effects on employment and more significant budget savings. But there’s also good news for them in the score. The $54 billion cost could give Senate Democrats a stronger basis to argue that it fits the rules of reconciliation, which requires provisions to have a significant budget impact, and thus could go in the upcoming COVID-19 relief bill.
How CBO says it impacts the federal budget is complicated. Some new spending would come from higher unemployment claims, some from higher wages for health care aides paid by Medicaid, and there are various shifts elsewhere. On the other side of the calculation, higher wages would bring in more tax revenue and reduce spending on certain anti-poverty programs.
The $54 billion may be a prerequisite to getting a $15 wage past the Senate parliamentarian, who is typically the final word and who President Biden has warned is unlikely to rule in Democrats’ favor. But the change in the budget is not necessarily enough on its own. Senate Democrats will also have to show the change is not “merely incidental” to the wage increase, which has knocked provisions with deficit effects out of previous reconciliation bills. And even if they succeed there, they might lack the votes to pass it, period

President Biden got his seventh Cabinet confirmation on Monday night, when the Senate voted to confirm Denis McDonough to be Veterans Affairs secretary. Like most of Biden’s Cabinet confirmations so far, it was a largely bipartisan vote – an 87-7 tally.
So far, just one Cabinet confirmation vote has been along mostly partisan lines: DHS Secretary Alejandro Mayorkas, who was confirmed with 56 votes – receiving six votes from Republicans.
Six other Cabinet nominees are waiting to receive votes on the Senate floor and have already had committee hearings:

NEED TO KNOWImpeachment Trial BeginsThe second impeachment trial of former President Trump begins in earnest today over charges he incited the Jan. 6 storming of the US Capitol. It marks the first time a president has been impeached after leaving office. The trial is scheduled to open with debates over whether a post-presidency impeachment is constitutional. The Constitution does not provide a clear answer, though many experts have noted it is not expressly forbidden and would apply to future attempts to hold public office. Regardless, 45 of 50 Republican Senators previously supported a symbolic declaration in January calling the trial unconstitutional. Unlike a standard trial, Senators act as both judge and jury, with no uniform burden of proof required. A conviction would require at least 17 Republican senators to side with all 50 Democrats to reach a two-thirds majority. The former president is not currently expected to testify. Beginning Wednesday, each side will have up to 16 hours to present their case. The framework allows for the possibility of a vote to call witnesses—though many Democrats have expressed a desire for a swift trial. Patrick Leahy (D-VT), the Senate’s oldest serving Democrat, will oversee the trial instead of Chief Justice John Roberts. The Supreme Court chief justice is only required to preside if the defendant is the sitting president. The trial is expected to last a week. In related news, the Georgia secretary of state’s office opened a probe into potential election interference by the former president, prompted by complaints from a George Washington University professor over a Jan. 2 call between Trump and Secretary of State Brad Raffensperger. Rep. Ron Wright Dies Rep. Ron Wright (R, TX-6) passed away from complications linked to COVID-19, his family revealed yesterday. The 67-year-old lawmaker had also been battling lung cancer for two years, following a 2019 diagnosis. Wright becomes the first sitting federal elected official to pass away from the illness—Congressman-elect Luke Letlow (R, LA-5) died from the disease after being elected in November but before being seated in January. New York City said it would begin reopening ($$, NYT) its middle schools Feb. 25, a move that would increase the number of children attending in-person classes to 250,000 by the end of the month. Facebook announced four-point guidelines shifting its stance on misinformation around vaccines, most notably modifying its algorithm to return information from credible sources for vaccine-related keywords. The US has reported 465,072 total COVID-19 deaths, with just over 1,500 reported yesterday; see rolling averages here. Kobe Bryant CrashFederal safety inspectors are expected to announce today the long-awaited results of an investigation into the cause of the helicopter crash that killed NBA legend Kobe Bryant, his 13-year-old daughter Gianna, and seven others last January. The crash occurred north of Los Angeles in foggy conditions (see map), as Bryant and guests were headed to his Mamba Sports Academy. Officials from the National Transportation Safety Board previously revealed the aircraft was not outfitted with flight data or cockpit voice recorders, and the recovered engine showed no signs of catastrophic failure. Experts have speculated the pilot, Ara Zobayan, became spatially disoriented in the low visibility conditions—a physiological phenomenon responsible for 5%-10% of all aviation crashes. A preliminary report found the aircraft lacked a terrain warning system, and that Zobayan likely violated visual flight rules by trying to rise through the clouds just before the crash.
