Thursday, May 16, 2019 Trade War With China “China said on Monday it would impose higher tariffs on most U.S. imports on a revised $60 billion target list, hitting back at a tariff hike by Washington on $200 billion of Chinese goods in a further escalation of a bitter trade war.” Reuters From the Left The left criticizes Trump’s tactics and is pessimistic about a favorable resolution. “To make the case for his trade war, and to measure his administration’s success in it, Trump is relying on blatant falsehoods and misconceptions… In his mercantilist, protectionist understanding of the world, trade wars are good, tariffs are a way of hitting the bad guy, and whatever the United States is doing on trade, it is winning. Alas, here in the real world, Trump’s trade war means that consumer goods are about to get more expensive and certain exporting businesses are about to face a much tougher climate, all thanks to the White House.” Annie Lowrey, The Atlantic “The scale of the overall harm here is pretty modest… For every consumer sad about higher prices, there’s a producer who’s excited about them. And for every producer who’s sad about lower prices, there’s a consumer who’s happy. And most of all, the dividing line between who wins and who loses on any given round of tariffs and counter-tariffs has relatively little to do with whether you’re Chinese or American and a lot to do with what your specific role in the global economy is… The problem is it’s a bit hard to say what Trump is trying to achieve here… “America’s official list of demands contains a bunch of items that are somewhat in tension with each other… In an actual negotiation, you tend to need to settle for half a loaf, and it makes a difference which half you really want. There’s one scenario in which the US and China settle on some handshake deals to narrow the trade deficit via larger Chinese purchases of US agricultural commodities. And there’s another scenario in which the US really drives hard to get China to ease up on technology acquisition… nobody is exactly sure… [how this] will end.” Matthew Yglesias, Vox “Both the United States and China seem to be digging into their positions in ways that will be hard to resolve with the mutual face-saving that typically turns high-stakes negotiations into deals… The United States is demanding that China codify rules into law to protect American companies (and their technology) that do business in China. Chinese negotiators now reject that possibility… “‘It looks like there was a level of specificity that China wasn’t willing to accept and a level of ambiguity that the Trump administration wasn’t willing to accept’… Given where things stand, it may take… [a] reset between [the] two top leaders, built on personal relationships, rather than the slow grind of hammering out an agreement that is more typical of economic diplomacy.” Neil Irwin, New York Times Some note that “the market sensitivity to threats and counter-threats in the trade war is quite remarkable… When it appears less likely that a conflict over well-defined and ultimately not-that-difficult commercial issues can be resolved, rational observers conclude that it is also less likely the United States and China can manage issues ranging from 5G wireless technology to North Korea, from the future of Taiwan to global climate change, and from the management of globalization to the security architecture of the Pacific region… “This carries with it an important lesson for both sides: It is risky to turn the pursuit of even vital national objectives into an existential crusade. Rather, even when nations have objectives that are in conflict, it is important to seek compromise, to avoid inflammatory rhetoric and to confine rather than enlarge the areas where demands are being made. Establishing credibility that promises will be kept and surprises will be avoided is as or more important with adversaries as with friends.” Lawrence H. Beijing has been waging economic warfare on the United States for years — stealing our intellectual property, forcing our companies to transfer technology as a price of doing business in China and subsidizing state-owned enterprises to prevent U.S. businesses from competing in dozens of sectors of the Chinese economy. The difference now is Chinese leaders are facing a president who is willing to fight back… [Last week] should have been a wake-up call for Beijing. When Chuck Schumer is tweeting support for Donald Trump, it’s time to cut a deal.” Marc Thiessen, Fox News “The president isn’t playing protectionist here. He’s pushing a single player who needs to be confronted, a cheater and a bully. For decades, China has gotten away with theft of others’ production techniques and other intellectual property, along with technology transfers and mistreatment of US companies. Moreover, it uses its ill-gotten gains to boost its military, adding another threat… “Short-term, US consumers will pay a bit more — on goods that make up less than 2 percent of the nation’s $20.5 trillion economy. But China is at growing risk of losing access to the world’s top market, because Americans can buy from other lower-wage producers if Beijing doesn’t blink… Trump didn’t start this trade war, but he’s well positioned to win it.” Editorial Board, New York Post “We’ve got to suck it up. Individuals in our free society are otherwise empowered by their government to pursue happiness by contracting voluntarily with other people, no matter where they may reside, who offer their legal goods and services for trade in American markets. Any government interference with such voluntarily arranged contracts is a denial of freedom.” Bruce Yandle, Washington Examiner Counterpoint: “after the War of 1812, President Madison, backed by Henry Clay and John Calhoun and ex-Presidents Jefferson and Adams, enacted the Tariff of 1816 to price British textiles out of competition, so Americans would build the new factories and capture the booming U.S. market. It worked. Tariffs [also] financed Mr. Lincoln’s War. The Tariff of 1890 bears the name of Ohio Congressman and future President William McKinley, who said that a foreign manufacturer ‘has no right or claim to equality with our own… He pays no taxes. He performs no civil duties’… [A tariff’s] purpose is not just to raise revenue but to make a nation economically independent of others, and to bring its citizens to rely upon each other rather than foreign entities.” Patrick J. I think they are basically correct, mostly because China is a much poorer country with more fragile political institutions… Next time you hear that the costs of the trade war are simply being borne by Americans, be suspicious. In their zeal to make Trump look completely wrong, on tariffs or other issues, too many commentators pick and choose their arguments. A more fair and complete economic analysis indicates that China is also a big loser from a trade war. ABOUT THIS NEW W.H. IMMIGRATION PLAN — NYT’S MIKE SHEAR on A1: “Trump Immigration Plan Emphasizes Immigrants’ Skills Over Family Ties”: “President Trump on Thursday will unveil a plan to overhaul parts of the nation’s immigration system that would impose new security measures at the border and significantly increase the educational and skills requirements for people allowed to migrate to the United States.
“The proposal … would vastly scale back the system of family-based immigration that for decades has allowed immigrants to bring their spouses and children to live with them, the officials said. In its place, the new plan would provide opportunities for immigrants who have specific skills or job offers to work in the United States, provided they can demonstrate English proficiency and educational attainment, and pass a civics exam.

— JARED’S COMPLETE WHIFF: UNLESS YOU’VE BEEN LIVING IN A CAVE for the last few years, you’d know that Democrats would summarily dismiss any immigration proposal that doesn’t include language to provide some sort of legal status for Dreamers. Kushner’s proposal does not include that.So, he’s lost Democrats. As Shear also points out, this doesn’t bring down immigration into the U.S. — which many Republicans have demanded.
This thing is deader than a doornail. The White House keeps saying it’s supposed to be a conversation-starter. The only conversation this will start in the Capitol is one about how goofy it is to believe this plan was even released in the first place.
OUR FRIENDS at The Washington Post chronicled earlier this week how Senate Republicans were scratching their heads on Tuesday after Jared came to talk to them (the story). On Wednesday, Kushner briefed House GOP leadership and key lawmakers. We spoke to a few House GOP’ers yesterday who had less than zero interest in Jared’s immigration endeavor.
MAYBE THIS IS A CAMPAIGN PLAY, and the strategy is to make Democrats seem intransigent and unreasonable. But Republicans aren’t going to fall in line, either.

Who was he? John Jay, who died MAY 17, 1829. On September 13, 1779, serving as President of the Continental Congress, John Jay approved the “Circular Letter from the Congress of the United States of America to their Constituents”: “Friends and Fellow Citizens … In governments raised on the generous principles of equal liberty … the rulers of the state are the servants of the people, and not the masters of those from whom they derive authority … … The ungrateful despotism and inordinate lust of domination, which marked the unnatural designs of the British king and his venal parliament, to enslave the people of America, reduced you to the necessity of either asserting your rights by arms, or ingloriously passing under the yoke … … Remember we are contending against a kingdom crumbling into pieces; a nation without public virtue … betrayed by their own representatives; against a Prince governed by his passions; … against a government by the most impious violations of the rights of religion, justice, humanity and mankind, courting the vengeance of Heaven and revolting from the protection of Providence … … And can there be any reason to apprehend that the Divine Disposer of human events, after having separated us from the house of bondage, and led us safe through a sea of blood, towards the land of liberty and promise will leave the work of our political redemption unfinished … or suffer us to be carried back in chains to that country of oppression from whose tyranny He hath mercifully delivered us with a outstretched arm?” As Chief Justice of the State of New York, John Jay charged the Grand Jury of Ulster County, September 8, 1777: “The infatuated sovereign of Britain, forgetful that kings were the servants, not the proprietors, and ought to be the fathers, not the incendiaries of their people … What … can appear more unworthy of credit than … a prince should arise who, by the influence of corruption alone … to reduce three million of his most loyal and affectionate subjects to absolute slavery … binding them in all cases whatever, not even excepting cases of conscience and religion? … … Will it not appear extraordinary that thirteen colonies … without funds … without disciplined troops, in the face of their enemies, unanimously determine to be free, and, undaunted by the power of Britain, refer their cause to the justice of the Almighty …” John Jay noted in 1777: “This glorious revolution … is distinguished by so many marks of the Divine favor and interposition … and I may say miraculous, that when future ages shall read its history they will be tempted to consider a great part of it as fabulous (a fable, exaggerated) … The many remarkable … events by which our wants have been supplied and our enemies repelled … are such strong and striking proofs of the interposition of Heaven, that our having been hitherto delivered from the threatened bondage of Britain ought, like the emancipation of the Jews from Egyptian servitude, to be forever ascribed to its true cause … and kindle in them a flame of gratitude and piety which may consume all remains of vice and irreligion. … Blessed be God! The time will now never arrive when the prince of a country in another quarter of the globe will command your obedience, and hold you in vassalage … Nor will you in future be subject to the imperious sway of rulers instructed to sacrifice your happiness whenever it might be inconsistent with the ambitious views of their royal master.” John Jay signed the Treaty of Paris with Franklin and Adams which ended the Revolutionary War. The Treaty began: “In the name of the Most Holy and Undivided Trinity.” The Treacherous World of the 16th Century and How the Pilgrims Escaped It: The Prequel to America’s Freedom Jay , together with Madison and Hamilton, helped ratify the Constitution by writing the Federalist Papers. Jay wrote in 1777: “The Americans are the first people whom Heaven has favored with an opportunity of … choosing the forms of government under which they should live. All other constitutions have derived their existence from violence or accidental circumstances … Your lives, your liberties, your property, will be at the disposal only of your Creator and yourselves. … You will know no power but such as you will create; no authority unless derived from your grant; no laws but such as acquire all their obligation from your consent … Security is also given to the rights of conscience and private judgment. They are by nature subject to no control but that of the Deity … Every man is permitted to consider, to adore, and to worship his Creator in the manner most agreeable to his conscience.” John Jay wrote in Chisholm v. Georgia, 1793: “The people are the sovereign of this country.” With the support of George Washington and Alexander Hamilton, he negotiated the Jay Treaty which resulted in ten years of peaceful trade with Britain while France was going through a bloody Revolution. Who is the King in America? And Who are the Counselors to the King? An Overview of 6,000 Years of History & Why America is Unique When America’s currency was losing value, giving rise to the idiom “not worth a Continental,” John Jay, as President of the Continental Congress, wrote September 13, 1779: “Depreciation of the currency has … swelled the prices of every necessary article … Depreciation is to be removed only by lessening the quantity of money in circulation … A distrust … by the mass of the people … in the ability … of the United States to redeem their bills, is the cause of it … … A bankrupt faithless republic would … appear among reputable nations like a common prostitute among chaste and respectable matrons … It has been already observed, that in order to prevent the further natural depreciation of our bills, we have resolved to stop the press.” Jay stated in 1777: “The constitution, however, has wisely declared, that the ‘liberty of conscience thereby granted shall not be so construed as to excuse acts of licentiousness’ … “Licentiousness” is defined: promiscuous and unprincipled in sexual matters; sexually unrestrained; prone to random sex; disregarding sexual restraints; morally unrestrained; excessive indulgence; debauched, degenerate, decadent, depraved, sinful. He continued: “… The convention by whom that constitution was formed were of opinion that the gospel of Christ, like the ark of God, would not fall, though unsupported by the arm of flesh … … But let it be remembered that whatever marks of wisdom … may be in your constitution, yet like the … forms of our first parents before their Maker breathed into them the breath of life, it is yet to be animated … From the people it must receive its spirit … Vice, ignorance, and want of vigilance will be the only enemies able to destroy it … Every member of the State ought diligently to read and to study the constitution … By knowing their rights, they will sooner perceive when they are violated, and be the better prepared to defend … Hence it becomes the common duty … to unite in repressing the licentious … and thereby diffusing (spreading) the blessings of peace.” On April 15, 1818, John Jay wrote to his Quaker friend, John Murray: “Natural Laws and Morality are given by the Sovereign of the Universe to all mankind … It is true that the Law was given to Moses, not however in his individual or private capacity, but as the agent or instrument, and by the authority of the Almighty. The Law demanded exact obedience, and proclaimed: ‘Cursed is every one that continueth not in all things which are written in the book of the law to do them.’ The Law … by requiring perfect obedience, under a penalty so inevitable and dreadful, operated as a schoolmaster to bring us to Christ for mercy. … Legal punishments are adjusted and inflicted by the law and magistrate, and not by unauthorized individuals. These and all other positive laws or ordinances established by Divine direction, must of necessity be consistent with the moral law. It certainly was not the design of the law … to encourage a spirit of personal or private revenge. On the contrary, there are express injunctions in the Law of Moses which inculcate a very different spirit.” Writing to John Bristed, April 23, 1811, John Jay recounted: “I was at a large party, of which … several … spoke freely and contemptuously of religion … An atheist very abruptly remarked that there was no God, and he hoped the time would come when there would be no religion in the world. I very concisely remarked that if there was no God there could be no moral obligations, and I did not see how society could subsist without them.” John Jay told the New York Convention, December 23, 1776: “Let a general reformation of manners take place … united in preparing for a vigorous defense of your country … When you have done all things, then rely upon the good Providence of Almighty God for success, in full confidence that without his blessings, all our efforts will inevitably fail … The Holy Gospels are yet to be preached to these western regions, and we have the highest reason to believe that the Almighty will not suffer slavery and the gospel to go hand in hand. It cannot, it will not be.” On April 15, 1794, Jay wrote to his wife, Sally, from England: “If it should please God to make me an instrument to the continuation of peace, and in preventing the effusion of blood and other evils and miseries incident to war, we shall both have reason to rejoice … Let us repose unlimited trust in our Maker; it is our business to adore and to obey.” On May 28, 1802, John Jay wrote to his children after his wife’s death: “Now if Christ be preached that he rose from the dead, how say some among you that there is no resurrection of the dead? … Behold I show you a mystery; we shall not all sleep, but we shall all be changed … Death is swallowed up in victory. (I Corinthians 15)” Jay wrote to John Murray, a Representative in the Pennsylvania House, October 12, 1816: “Real Christians will abstain from violating the rights of others, and therefore will not provoke war. Almost all nations have peace or war at the will and pleasure of rulers whom they do not elect, and who are not always wise or virtuous. Providence has given to our people the choice of their rulers, and it is the duty, as well as the privilege and interest, of our Christian nation to select and prefer Christians for their rulers.” On January 1, 1813, he penned a letter to Jedediah Morse: “Whether our Religion permits Christians to vote for infidel rulers is a question which merits more consideration than it seems yet to have generally received, either from the clergy or the laity. It appears to me that what the prophet said to Jehoshaphat about his attachments to Ahab (‘Shouldest thou help the ungodly and love them that hate the Lord?’ 2 Chron. 19:2) affords a salutary lesson … Public measures may not be a proper subject for the pulpit, yet, in my opinion, it is the right and duty of our pastors to press the observance of all moral and religious duties.” Rise of the Tyrant – Volume 2 of Change to Chains John Jay, at the age of 14, was admitted to King’s College in New York (Columbia University), which had as a requirement translating the first ten chapters of the Gospel of John from Greek into Latin. The American Bible Society was founded in 1816, with Jay as the first vice-president. In 1821, though in poor health, John Jay accepted the position as the President of the American Bible Society. He wrote: “They who regard these Societies as deriving their origin and success from the Author and Giver of the Gospel, cannot forbear concluding it to be the duty of Christians, to promote the purposes for which they have been established; and that is particularly incumbent on their officers to be diligent in the business committed to them.” John Jay is attributed with the statement: “No human society has ever been able to maintain both order and freedom, both cohesiveness and liberty apart from the moral precepts of the Christian Religion. Should our Republic ever forget this fundamental precept of governance, we will then, be surely doomed.” The Treacherous World of the 16th Century and How the Pilgrims Escaped It: The Prequel to America’s Freedom On May 13, 1824, Jay addressed the American Bible Society: “By conveying the Bible to people thus circumstanced, we certainly do them a most interesting kindness. We thereby enable them to learn that man was originally created and placed in a state of happiness, but, becoming disobedient, was subjected to the degradation and evils which he and his posterity have since experienced. The Bible will also inform them that our gracious Creator has provided for us a Redeemer, in whom all the nations of the earth shall be blessed; that this Redeemer has made atonement ‘for the sins of the whole world,’ and thereby reconciling the Divine justice with the Divine mercy has opened a way for our redemption and salvation; and that these inestimable benefits are of the free gift and grace of God , not of our deserving, nor in our power to deserve.” John Jay stated: “In forming and settling my belief relative to the doctrines of Christianity, I adopted no articles from creeds but such only as, on careful examination, I found to be confirmed by the Bible … At a party in Paris, once, the question fell on religious matters. In the course of it, one of them asked me if I believed in Christ? I answered that I did, and that I thanked God that I did.” Jay wrote: “God is great, and therefore He will be sought: He is good, and therefore He will be found. If in the day of sorrow we own God’s presence in the cloud, we shall find Him also in the pillar of fire, brightening and cheering our way as the night comes on. In all His dispensations God is at work for our good: in prosperity, He tries our gratitude; in mediocrity, our contentment; in misfortune, our submission; in darkness, our faith; under temptation, our steadfastness, and at all times, our obedience and trust in Him. God governs the world, and we have only to do our duty wisely, and leave the issue to Him.” He received a letter from the Corporation of the City of New York, asking him to join with them in the celebration of America’s 50th anniversary. John Jay, at 82 years of age, replied on June 29, 1826: “Earnest hope that the peace, happiness, and prosperity enjoyed by our beloved country may induce those who direct her national counsels to recommend a general and public return of praise to Him from whose goodness these blessings descend … The most effectual means of securing the continuance of our civil and religious liberties is, always to remember with reverence and gratitude the Source from which they flow.” In his Last Will and Testament, John Jay wrote: “Unto Him who is the Author and Giver of all good, I render sincere and humble thanks for His merciful and unmerited blessings, and especially for our redemption and salvation by his beloved Son. He has been pleased to bless me with excellent parents, with a virtuous wife, and with worthy children. His protection has accompanied me through many eventful years, faithfully employed in the service of my country; and his providence has not only conducted me to this tranquil situation, but also given me abundant reason to be contented and thankful. Blessed be His Holy Name. While my children lament my departure, let them recollect that in doing them good, I was only the agent of their Heavenly Father, and that He never withdraws His care and consolations from those who diligently seek Him.” On MAY 17, 1829, John Jay was drawing near death after a life of serving his country. The lion’s share of Americans believes that respecting the results of elections and the peaceful transfer of power are essential elements of American democracy, according to a new national poll conducted by Ipsos in conjunction with the University of Virginia Center for Politics. By a 77%-16% margin, respondents did not think that the 2020 election should be delayed and President Donald Trump given an extra two years in office. This question was based on a recent tweet by Liberty University President Jerry Falwell suggesting that because of Robert Mueller’s investigation into Russian interference in the 2016 election, the president’s term should be extended two years (Trump retweeted Falwell). There were partisan differences on this question: Democrats said no overwhelmingly, 89%-9%, while Republicans said no by a smaller 62%-31% margin. Just 7% of respondents said that if Trump loses the 2020 election, he should ignore the results and stay in office. Overall, about nine in 10 respondents said that the “peaceful handover of power after elections” and “both parties respecting the results of elections” were essential for the “healthy functioning of American democracy.” A majority of respondents agreed with the statement that “Donald Trump does not respect the customs or traditions of the Presidency” (61% overall, and 86% of Democrats) and that he “does not respect the laws of the United States” (56% overall, and 83% of Democrats). About two-fifths of all respondents (41%) — and over three-quarters of Republicans (77%) — agreed that a “deep state” is “trying to undermine Donald Trump’s presidency.” Also, 30% of all respondents and 60% of Republicans agreed that the “Mueller investigation prevented President Trump from achieving significant portions of his agenda.” Therefore, as we would expect, Democrats were much likelier to agree that Trump does not respect the traditions of the Presidency and the laws of the United States; Republicans were much likelier to agree that the “deep state” and the Mueller investigation have undermined Trump’s presidency. Respondents were split, 41%-39%, as to whether Trump has achieved many of his goals in his first two years in office. Three-quarters (75%) of Republicans strongly or somewhat agreed that Trump has achieved many of his goals, while only about one-fifth (22%) of Democrats said the same. The poll also asked some broader questions about respondents’ views of the power of the federal government and whether or not some of the rules and laws that govern the three branches are essential: — Respondents had mixed opinions about which of the three branches of the federal government was the most powerful. About a third (35%) said that all three branches are equal, while about a fifth of the respondents apiece picked the Supreme Court (22%), Congress (20%), or the presidency (17%) as the most powerful branch. There were not any significant partisan distinctions among responses to this question. — Majorities said the presidential veto (62%) and the two-term limit (79%) were essential to the “healthy functioning of American democracy.” — By a 55%-33% margin, Americans did not agree that lifetime appointments to the Supreme Court were essential to the functioning of democracy. — Respondents also did not deem the filibuster in the U.S. Senate as essential, with 39% indicating it was not essential, 30% indicating it was, and the remaining 30% not expressing an opinion. — Just 33% of respondents agreed with the somewhat authoritarian proposal that to fix the United States, “we need a strong leader willing to break the rules.” Less than a quarter of Democrats (23%) agreed with that statement, but about half of Republicans did (53%). Finally, the poll found support for beliefs that could broadly be described as anti-establishment: — 71% (79% of Democrats, 63% of Republicans) agreed that “America needs a strong leader to take the country back from the rich and powerful.” — 70% (84% Democrats, 49% Republicans) agreed that “the American economy is rigged to advantage the rich and powerful.” — 69% (64% Democrats, 74% Republicans) agreed that “traditional parties and politicians don’t care about people like me.” — 66% (49% Democrats, 87% Republicans) agreed that “the mainstream media is more interested in making money than telling the truth.” — 65% (62% Democrats, 67% Republicans) agreed that “experts in this country don’t understand the lives of people like me.” — 59% (52% Democrats, 67% Republicans) agreed that “politicians should be able to say what’s on their minds regardless of what anyone else thinks about their views.” These are findings from an Ipsos poll conducted May 14-15 on behalf of the University of Virginia Center for Politics. For the survey, a sample of 1,005 adults 18+ from the continental United States, Alaska, and Hawaii were interviewed online in English. The sample includes 376 Democrats, 345 Republicans, and 205 Independents. Alabama’s Female Governor Signs Most Restrictive Abortion Law in the Country Yesterday, Alabama Governor Kay Ivey signed into law the most restrictive pro-life bill in the country, banning abortion for any reason other than danger to the mother’s health and imposing strict sentences on doctors performing them. The left is predictably framing the issue as an attack on women, despite women having a similar distribution of views on the hot-button cultural issue of abortion as men, a fact Meghan McCain bought up on The View in reference to the controversy over the Georgia law in the news earlier in the week. “[Pro-life] women like me are always left out of the conversation,” McCain said. First, some facts about the law itself and its challenge to Roe v. Wade: “According to the text of the bill itself, abortion and attempted abortion are felony offenses, ‘except in cases where abortion is necessary in order to prevent a serious health risk to the unborn child’s mother.’ The doctor performing the abortion would be criminally liable, not the mother. The bill’s sponsor, Republican Alabama State Rep. Terri Collins, said her goal was to challenge the Supreme Court’s 1973 ruling. ‘My goal with this bill, and I think all of our goal[s], is to have Roe v. Wade turned over, and that decision be sent back to the states so that we can come up with our laws that address and include amendments and things that address those issues,’ she said.” Some conservatives and pro-lifers do not support laws like Alabama’s, which they worry are too extreme and may in fact strengthen the legal precedent protecting abortion in being shot down by courts. Prominent Southern Baptist minister Pat Robertson endorsed this view yesterday. Some wise thoughts on how the fight over abortion will develop in the coming years from Dave Marcus: “Since the day that Roe v. Wade was decided in 1973, abortion has been a hot button political topic in the United States. But while it is an emotional issue that has always had inflamed rhetoric surrounding it, over the past 46 years, the abortion question has existed in a kind of stalemate or détente… Today, none of this is true anymore. Pro-lifers for the first time feel that it is possible that the Supreme Court could overturn Roe and allow states to ban abortion, and for abortion advocates, it has been become something to celebrate, to shout, and to be considered an unfettered good. As a result of these changes, we have seen bills from both sides in state legislatures that would have been unthinkable even a decade ago… The détente which has held for 50 years is gone and the fight over abortion has become a total war. What has always been a testy battle in American politics is poised to become very ugly, very fast.” A final note as we contemplate a future without Roe v. Wade: Roe is bad law regardless of what you think about the issue of abortion itself. In thinking that Roe has little legal basis, I’m joined by prominent left-leaning legal scholars like Lawrence Tribe and John Hart Ely: “The Constitution does not bind us to the Founders’ social views or understanding of human sexuality, but rightly leaves those thorny and ever-changing debates to us, the people, and thus to the states… Overturning Roe v. Wade would not make abortion illegal overnight. Instead, it would return debate over a profound moral, philosophical, and cultural question to the people of the United States, exactly as the Founders intended.” Big Moves on Immigration The Trump administration will unveil a plan that reforms many aspects of immigration law, from border security to chain migration, today. On this date in 1912, a horse reared in Washington, D.C., at the corner of 5th Street and Massachusetts Avenue, depositing its rider in the street. The man thrown unceremoniously from his mount was a U.S. senator named Boies Penrose, a Republican from Pennsylvania. Penrose was not seriously injured, but the mishap was a perfect metaphor for both horse and rider: The steed was spooked by a steam roller being used to pave streets; the senator was spooked by something else that year — the spectral return of Theodore Roosevelt to national politics. I’ll have another word on TR and Boies Penrose, whom I’ve written about before, in a moment. In RealClearEnergy, Mark Green debunks the alarmism surrounding offshore oil and gas regulation changes. * * * Boies Penrose comes to my mind occasionally, and not only because the idea of a 6-foot-4, 300-pound politician being thrown by a horse is irresistible, but also because the intra-party turmoil he stoked serves as a reminder that there is really little new in politics. The Tea Party rebellion against the Republican establishment a decade ago; the takeover of the GOP by Donald Trump nearly three years ago; the current insurrection within Democratic Party ranks by mouthy millennials and “Democratic Socialists” — such unnerving upheavals come with the territory. A two-party system may seem stifling to unaffiliated voters and political independents like me, but it would be ever so much more suffocating if the two parties weren’t always evolving, sometimes in multiple directions simultaneously. For establishment types, the Trump phenomenon seems like the end of the world. It isn’t. Most likely, it isn’t even the end of the Grand Old Party. Occasionally, such convulsions do portend a seismic historical shift and even the creation of a replacement party. But that’s all right, too. I don’t miss the Whigs, do you? How about the Know-Nothings? Will Democrats ever get over losing Pennsylvania in 2016? Or, heaven forfend, will it happen again in 2020? The answer is maybe. Then, again, have you noticed how Barry Goldwater’s Arizona is trending Democratic? Republicans dominated Pennsylvania politics from the time of the Civil War to the arrival of Franklin Roosevelt, yet for nearly that entire time the GOP was at war with itself: reformers vs. bosses; the Pittsburgh machine vs. the Philadelphia machine; pro-business interests vs. progressives. Which brings me back to Boies Penrose. An unlikely political boss, he was born in 1860 to a well-connected Main Line family, graduated second in his class at Harvard, and became a Philadelphia lawyer. But appearances, then as now, could be deceiving. As the New York Times noted in its Jan. 1, 1922, obituary of the man: “Although his size made him somewhat ponderous in appearance, Senator Penrose was very quick-witted and was not slow physically.” The same Times obit noted that Penrose cheerfully waded into every one of the many bitter factional squabbles that took place in Pennsylvania’s Republican politics. The biggest of these fights was the one he picked with Theodore Roosevelt in 1912. Teddy Roosevelt was enormously popular in Pennsylvania, however, and Penrose eventually lost control of the state’s delegation at that summer’s Republican convention. The intra-party split between President Taft and TR delivered the White House to Democrat Woodrow Wilson (perhaps a cautionary tale to Sen. Bernie Sanders and his legion of “Bernie Bros”), and Roosevelt also bested Penrose by carrying Pennsylvania that year on the Progressive Party ticket. Boies Penrose remained in the Senate, however, where he was known for opposing Prohibition and supporting tariffs — like our current president on the latter issue. Penrose took ill in 1920, but vowed to attend the Republican convention in Chicago “if it kills me.” He recovered later — although not in time to make the convention — but his warning was prescient. In late 1921, Boies Penrose fell ill again, dying on New Year’s Eve, a little before midnight in his apartment at the Wardman Park Hotel, where revelers were seeing in the New Year. Carl M. Good morning,Fifty-eight percent (58%) of voters favor having the United States impose new tariffs on goods imported from China. A ScottRasmussen.com national survey found that 42% oppose such tariffs. New
tariffs are supported by 61% of Rural voters, 58% of Urban voters, and
56% of Suburban voters. On a partisan basis, they are supported by 82%
of Republicans and 59% of Independents. They are opposed by 62% of
Democrats.Sixty-three percent (63%) believe China has used trade to take advantage of the
United States. Only 13% disagree and 25% are not sure.Interestingly,
while 58% favor higher tariffs, just 31% think they will be good for
the United States. The gap between these numbers suggests that many
voters see this as a matter of fairness rather than economics.My weekly syndicated column suggests that the Democrats may now have a four-person race for
their presidential nomination contest. Biden is the frontrunner and the
race is his to lose. Sanders has a core following from the last time
around, but there are questions about whether he can appeal to a wider
base. Warren and Harris are
making their first run for the White House and appear well positioned to
shake things up when voters begin to pay attention.Citing free speech concerns, the White House rejected a deal brokered between French and New Zealand officials to combat online extremists.
The accord was sought after a shooter in New Zealand city “attacked two
mosques in an attack inspired by online hate and broadcast on
social-media sites.”Last fall, ScottRasmussen.com polling showed that 64% of voters believe it is more dangerous to let government to define hate speech than to allow inappropriate hate speech. FIRST READ: The 2020 Democratic field is now set (we think)
The first significant Democrat to announce a 2020 presidential bid was former Maryland Congressman John Delaney, who threw his hat into the ring back in July 2017.
The last (???) is current New York City Mayor Bill de Blasio, who released this video this morning: “As president, I will take on the wealthy; I will take on the big corporations; I will not rest until this government serves working people.”
And it sets a field – at least for now – of 20 major candidates, including a former vice president, senators, governors, current and ex-congressmen, and big- and small-city mayors.
(Stacey Abrams has said she’s thinking about a 2020 race, but hasn’t made any moves suggesting she might jump in anytime soon.)
The field also includes entrepreneur Andrew Yang (who has no prior experience in elected office), author Marianne Williamson (ditto) and Miramar, Fla. Mayor Wayne Messam (who raised just $43,000 in the first quarter).
All of these folks will be vying to be among the 20 who qualify to make the first debate next month – which means it’s very possible that a sitting member of Congress, or a governor or even the mayor of America’s largest city gets left off that first debate stage.
(To qualify for the debate, the Democratic National Committee says candidates must register at least 1 percent in three recognized polls and/or raise money from at least 65,000 donors, with polling and fundraisers tiebreakers mixed in.)

As for de Blasio,
he can certainly tout his QUALIFICATIONS, given that being New York City mayor is arguably the second-hardest job in American politics.
But what’s TOUGH is being the current mayor of New York running for president with the brutal NYC press corps following you around.
Can you imagine the
coverage if there’s a subway or commuter problem back home – and he’s
out in Des Moines, Iowa or Manchester, N.H.?
That’s a problem that, say, Pete Buttigieg doesn’t have to worry about as much back in South Bend, Ind.
Oh, and the debate cutoff date to qualify in the polls and with the number of donors is June 12 – which is 27 days away.
Trump v. Bolton on Iran
The Washington Post says President Trump and National Security Adviser John Bolton (and others) are in a different place when it comes to Iran.
“Trump grew angry last week and over the weekend about what he sees as warlike planning that is getting ahead of his own thinking, said a senior administration official with knowledge of conversations Trump had regarding national security adviser John Bolton and Secretary of State Mike Pompeo,” the paper writes.
But remember, Trump’s first national security adviser – Michael Flynn – had tough rhetoric towards Iran – in the administration’s first few days.
And a combustible situation with Iran is a direct consequence of the president ripping up the Iran nuclear deal – and failing to replace it with anything.
Beg your pardon
Another day, another Trump pardon for a friend and/or ally.
“President Donald Trump on Wednesday pardoned former newspaper mogul Conrad Black, who was convicted in 2007 on charges that he swindled shareholders in his media empire out of $6 million, the White House announced,” per NBC’s Phil Helsel and wire reports.
In its statement announcing the pardon, the White House “called Black ‘an entrepreneur and scholar’ who has ‘made tremendous contributions to business, as well as to political and historical thought.’”
But: “The White House statement did not mention that Black wrote what was described as a flattering biography of Trump published in 2018, titled ‘Donald J. Trump: A President Like No Other.’”

2020 VISION: Bullock gets his first Iowa endorsement
Montana Gov. Steve Bullock, who announced his 2020 bid earlier this week, picked up an endorsement from Iowa Attorney General Tom Miller.
Bullock campaigns today in the Hawkeye State.

That’s the share of Americans who say that abortion should be illegal in ALL cases, according to a poll last year from PRRI.
The small share illustrates that Alabama’s new near-ban on abortions falls outside the mainstream, even within groups that generally support restrictions on abortion.
Among Republicans, it’s 20 percent who say abortion should be illegal in all cases. And among white evangelicals, it’s 28 percent.
The same poll from PRRI found that a combined 59 percent of Americans say that abortion should be legal in all (24 percent) or most (35 percent) cases.
