The Democrats’ generic ballot edge endures, at least for now, but they shouldn’t get their hopes up on redistricting By Kyle Kondik

See here for a description of the position, information on how to apply, and who to contact if you have questions. — The Editors   KEY POINTS FROM THIS ARTICLE — While it’s very early in the cycle and these polls are not predictive so far in advance, the House generic ballot polling right now looks very similar to what we saw this time two years ago. — Republicans almost certainly will need to lead on the generic ballot to retake the House, but perhaps they won’t need as big of a lead as we’ve seen in the past because of the nature of partisan voting in a presidential year and their abundance of targets in districts President Trump can or will carry. — If new House maps are created in Maryland, Michigan, North Carolina, and Ohio because of various court orders, Democrats would benefit on balance. But it may very well be that no maps end up being changed. The 2019 generic ballot polls: They’re a lot like the ones we saw in 2017 Let’s start here with a caveat: House generic ballot polling from a year and a half before a general election should not be treated as predictive. The 2020 House election depends on a lot of factors that remain unknowable, most importantly the tone-setting effect of the presidential race, which at this point appears to be something of a 50-50 proposition. That said, if you’re looking for signs of a growing backlash against the new Democratic-majority U.S. House of Representatives, you won’t find it in national generic ballot polling so far. Democrats led the House generic ballot the whole way in the 2017-2018 RealClearPolitics average. From Jan. 1, 2017 through April 30, 2017, there were 12 generic ballot polls included. The Democrats led every single one, and by an average of six points. This year, from Jan. 1 through April 30, there are 11 polls in the average, and the Democrats lead in every one… by an average of six points.   It is true that Democrats led the House generic ballot early in both the 2010 and 2014 cycles, too, both of which ended up being great years for Republicans in the House. That’s why we say this polling is not necessarily all that predictive. It may be that a pro-Democratic sentiment on the House generic ballot right now is essentially just a proxy for a preference for a generic Democratic presidential candidate against President Donald Trump. Former Vice President Joe Biden, typically the strongest-polling Democrat against Trump, leads the incumbent by about seven points, on average, in polling so far, pretty similar to the Democratic House ballot lead. If and when polling in the presidential race tightens, the generic may tighten, too. After all, we are in a partisan era where, as congressional scholar Gary Jacobson has documented, the incumbency advantage for members of Congress has diminished to a significant degree. A nationalized election could benefit House Republicans, most notably if Trump wins. Republicans need to flip at least 18 House seats to win the chamber. With 31 Democrats in Trump-won seats, Republicans could win the House back just by sweeping all the Democratic House districts where Trump won by three points or more in 2018. That’s easier said than done. For one thing, we could imagine Trump’s performance weakening in some of these districts because they cover some affluent, highly-educated suburban areas that are trending away from Republicans. Also, and to the extent incumbency matters, Democrats have strong officeholders in some of these districts. Still, the districts are there for the Republicans to retake the House, at least on paper. Typically one would expect a party flipping the House to have a considerable edge on the House generic ballot on Election Day. When the Democrats won the House from the Republicans in 2006 and 2018, their final generic ballot poll average lead in RealClearPolitics was 11.5 and 7.3 points, respectively. When Republicans took control of the House in 2010, their lead was 9.4 points. So the Republicans will need to be leading on the House generic ballot in order to win the House; they just might not need to lead by as much as we’ve seen in past years in order to win it given the characteristics of their best targets and the decline of ticket-splitting and the power of incumbency. As it stands now, we continue to consider the Democrats favorites to hold their House majority, with a Trump reelection victory a necessary but perhaps not sufficient condition for a restoration of unified GOP rule in Washington. Hold your horses on redistricting Democrats’ chances to hold the House would be bolstered if court decisions mandating new districts in several states do in fact produce new maps for 2020. But don’t hold your breath. Despite the 2018 House blue wave that flipped the lower chamber, Democrats came up empty in two big states: Ohio and North Carolina. Republicans maintained a 12-4 edge in the Buckeye State’s House delegation, and in the Tar Heel State, Republicans seemed to hold their 10-3 advantage until credible accusations of fraud prompted a do-over election in NC-9. The GOP primary for that race is next week (veteran Dan McCready, the 2018 nominee, is unopposed for the Democratic nomination). A big part of the reason why Democrats failed to win any new seats in Ohio, and may not in North Carolina, is because both states have House maps gerrymandered by Republicans. The GOP actually gerrymandered North Carolina twice in the 2010s, both in an initial map for the 2012 election and then a re-do in response to a court order in advance of 2016. Still, the North Carolina maps have held for the Republicans throughout the decade, with the possible exception of the unusual NC-9 situation. North Carolina redistricting, along with Maryland (which features a Democratic gerrymander), is at the center of a pending Supreme Court decision in which the justices are once again considering whether to intervene to curb the excesses of partisan gerrymandering. Additionally, federal courts recently ruled that Michigan and Ohio’s House maps are partisan gerrymanders. Both maps were drawn by Republicans but, unlike in Ohio, Democrats picked up a couple of suburban Michigan seats last year despite the GOP gerrymander. So it’s possible that all four of these states will have new House maps in 2020. That combination of outcomes would almost certainly benefit Democrats on balance. While Republicans would almost assuredly pick up a seat in Maryland — MD-6, held by Rep. David Trone (D), would become significantly more Republican in a fair remap — Democrats likely would pick up multiple seats from North Carolina and Ohio. Michigan is harder to figure because the delegation is currently 7-7 and a remap would not necessarily be guaranteed to help Democrats. But it’s also possible, perhaps even likely, that none of the maps in these states actually will change at all this cycle. Republicans in Michigan and Ohio are hoping that the Supreme Court decides not to intervene in the Maryland and North Carolina cases, which might effectively overrule the lower courts’ decisions in Michigan and Ohio, too. It took arguably the most liberal Supreme Court in American history, the Earl Warren court of the 1960s, to issue the landmark decisions that finally ended the malapportionment of congressional and state legislative districts, forcing districts to have equal populations and enshrining the principle of “one person, one vote” into legislative districting jurisprudence. Prior to that, the high court had stayed out of what Justice Felix Frankfurter called “the political thicket” of legislative map-drawing (Frankfurter dissented in Baker v. Carr, the 1962 ruling that in which the Supreme Court decided to enter said “thicket.”). Since those decisions, the Supreme Court has repeatedly declined to intervene in partisan redistricting cases, and the current John Roberts court is very much unlike the Warren Court in terms of ideology. The Supreme Court punted on a gerrymandering decision last year; since then, Brett Kavanaugh has replaced Anthony Kennedy on the court, arguably positioning the court further to the right. In other words, and without knowing what the Supreme Court ultimately will say, we’d be surprised if this ends up being the court that intervenes against partisan redistricting. So while we’d love to speculate in more details about how the maps in these four aforementioned states might specifically change in the event of remaps, such an exercise might very well be a waste of time. POLITICO Playbook: How long can Dems hold back on impeachment?

DRIVING THE DAY

BREAKING … LITTLE ROCKET MAN … AP/SEOUL: “South Korea: North Korea fires an unidentified projectile”: “North Korea on Thursday fired at least one unidentified projectile from the country’s western area, South Korea’s military said, the North’s second weapons launch in the last five days and a possible warning that nuclear disarmament talks with Washington could be in danger. …

“The launch comes as U.S. Special Representative for North Korea Stephen Biegun visits South Korea, and hours after the North described its firing of rocket artillery and an apparent short-range ballistic missile on Saturday as a regular and defensive military exercise.” AP

A LOT OF PEOPLE LIKE TO PUT A PERCENTAGE on the chance of impeachment, but we think that’s silly. HERE’S WHAT WE CAN SAY at this moment: Some extreme action — like launching impeachment proceedings against President DONALD TRUMP — is getting likelier by the day. It’s not overwhelmingly likely, but the vibe on Capitol Hill is getting worse: Democrats are angry that they are getting stonewalled. Republicans are angry that Democrats do not seem willing to let this go.

HOUSE SPEAKER NANCY PELOSI has handled the politics of impeachment well. She’s kept her foot hovering above the brake pedal, cognizant of the risk of immediate acceleration. She has kept her chairmen in line, kept her members mostly calm and her leadership on the same page. She even went to the White House with Senate Minority Leader CHUCK SCHUMER to talk infrastructure, which showed Trump she’s not singularly consumed with oversight, but also interested in governing.

BUT THE WHITE HOUSE is doing practically everything it can to taunt Pelosi. Most administrations slow-walk document production; this White House is flat-out saying, ‘No, your oversight is overzealous, and we won’t participate in it.’ This is going to force Democrats to file lawsuits to obtain documents — lawsuits that even top Republicans privately concede Pelosi will win.

TRUMP SEEMS TO BE DARING DEMOCRATS to take the impeachment road. Talk people in his administration, and you’ll hear that all of this Hill saber-rattling is good for them. Impeachment is unpopular, they believe, and will help Trump in 2020.

IN SOME STRANGE WAY, one person who benefits from this the most isSenate Majority Leader MITCH MCCONNELL, who can tell GOP donors that it’s his Senate Republicans who stand in the way of chaos and a potential Democratic takeover of Washington in 2020.

PELOSI AND DEMOCRATS have a bunch of options before they get to proceedings to remove Trump from office. Judiciary has already held A.G. BILL BARR in contempt, a vote on which will come to the House floor shortly. They can impeachBarr,Treasury Secretary STEVEN MNUCHIN and other officials for being uncooperative. They can exact legislative revenge on the White House, making Trump’s government looking hapless using leverage points like the debt limit and funding bills — unless the White House starts coughing up documents.

EITHER WAY, THE FRUSTRATION is becoming clear. …

… TO WIT: NYT’S SHERYL GAY STOLBERG: “Facing a Trump Stonewall, Democrats Struggle for Options to Compel Cooperation”: “Some who previously urged caution are now saying impeachment may be inevitable ‘If the facts lead us to that objective, so be it,’ Representative Steny H. Hoyer of Maryland, the majority leader, told reporters on Wednesday.

“He said Democratic leaders and the chairmen of six committees are coordinating on what he hopes will be a ‘holistic’ strategy to paint a picture for the public of ‘perhaps the greatest cover-up of any president in American history.’ …

“But with Mr. Trump trying to keep Congress from gathering the facts, the mood in the caucus has shifted, many Democrats say. ‘We get the narrative from our leadership that we all got elected on health care and the economy and all of that,’ said Representative Gerald E. Connolly, Democrat of Virginia, ‘but we also got elected to impose checks and balances on a president who is unchecked and unbalanced.’” NYT

Thursday, May 9, 2019 NYT Scoop and NYS Bill re Trump’s Taxes The New York Times “obtained printouts from [President Trump’s] official Internal Revenue Service tax transcripts [for the years 1985 through 1994], with the figures from his federal tax form, the 1040, from someone who had legal access to them. They represent the fullest and most detailed look to date at the president’s taxes. And they show that during a tumultuous decade of fevered acquisition and spectacular collapse, Mr. Trump’s core businesses — largely casinos, hotels and retail space in apartment buildings — ran up $1.17 billion in losses.” New York Times
 
On Wednesday, the New York State Senate passed a bill that “would authorize state tax officials to release any state returns filed in New York if requested by the leaders of the House Ways and Means Committee, the Senate Finance Committee or the Joint Committee on Taxation… Trump’s home state is New York, where many of his business enterprises are based. Financial information in state returns is likely to mirror much of what is in his federal returns.” AP News
 
Quick reminder: On Monday, Treasury Secretary Steven Mnuchin refused to provide a copy of President Trump’s tax returns to the House Ways and Means Committee, claiming “that the panel’s request ‘lacks a legitimate legislative purpose’ as Supreme Court precedent requires.” AP News From the Left The left focused on the magnitude of Trump’s losses, and his continued efforts to mislead the public. “It turns out that young Trump’s claim to great riches was, at times, completely made up. He was, instead, desperately burdened by debt that topped $1 billion. It seems that his business acumen was at best questionable, at worst fake — as were his vast profits… The man Trump presented in his book ‘The Art of the Deal’ was a fiction.”

He admitted as much on ‘The Apprentice.’ And those losses meant he didn’t pay much in taxes… It may be a scandal and a travesty. But it isn’t Trump’s fault that the means existed for him to pay far less in taxes than the chattering classes think he should have. And it would be stupid of someone like Trump not to minimize his tax burden if he is able to do so.”

Barr Held in Contempt & Trump Exerts Executive Privilege 
After five hours of debate, the House Judiciary Committee voted strictly along party lines to hold Attorney General Barr in contempt yesterday, alleging that he had unreasonably restricted access to the Mueller report and underlying evidence. 
 
The White House is claiming that the move is purely political, pointing to the fact that 95 percent of the report remains un-redacted, that the redactions are required by law, and noting that a less-redacted version is available to select members of the committee who have refused to even come read it.
 
In response, President Trump has invoked executive privilege.

“If approved by the House, where the Democrats hold a solid majority, the contempt resolution would almost certainly move to an unusual, and potentially protracted, multi-pronged court battle with the Trump administration.
 
The contempt finding could be referred to the U.S. attorney for the District of Columbia, a Justice Department official who would be likely to defend rather than oppose Barr. Democratic House leaders could also file a lawsuit, though the case could take months or even years to resolve. Some committee members have suggested they also could fine Barr as he withholds information.
 
Nadler said Wednesday the Trump administration’s refusal to provide the special counsel’s full Russia report to Congress presents a ‘constitutional crisis.’
 
In a letter Wednesday to Trump, Barr explained that the special counsel’s files contain millions of pages of classified and unclassified information. He said it was the committee’s ‘abrupt resort to a contempt vote’ that ‘has not allowed sufficient time for you to consider fully whether to make a conclusive assertion of executive privilege.’”
 
Don Jr. Subpoenaed… by Republicans
Donald Trump’s son, Don Jr., was subpoenaed by the Senate intelligence committee to answer questions about his previous testimony in the light of the Mueller report. The twist: since Republicans hold the Senate, the subpoena was sent by the Republicans who make up the majority of the committee.

The president’s job approval rating has held steady around 46% in more than three months of daily updates. And, the Generic Congressional Ballot has been nearly as stable showing the Democrats with about a six-point advantage.Why hasn’t the stronger economy boosted the president’s numbers?It is possible that opinions about President Trump are so hardened that nothing will change them. However, it often takes time before growing economic confidence translates into political benefits for the party in power. If that’s the case, the president’s ratings should start to inch up this fall.And, a growing economy may have other implications for Election 2020. While Americans are generally upbeat about the economy, Democrats are more likely to believe it is getting worse rather than better. This puts Nancy Pelosi’s party out of synch with the rest of the nation as they are working to select a presidential nominee.On a lighter topic, 63% of those who have seen the latest Avengers’ movie plan on seeing it again. Good morning, it’s Thursday, May 9, 2019. One hundred and 50 years after British troops burned Washington, D.C., the Beatles were torching the American music scene with hit after hit. The year was 1964. In February, “I Want to Hold Your Hand” reached the No. 1 ranking in the Billboard Hot 100 rankings. This was followed by “She Loves You” and “Can’t Buy Me Love,” meaning that the lads from Liverpool held the top spot for three-and-a-half months. At one point in mid-April the Fab Four held the top five slots. Then the month of May brought a most unlikely song from Louie Armstrong. I’ll tell you more about it in a moment. At 62, “Satchmo” was still playing the jazz venues and nightclubs where he’d perfected his art, but this was an era in which the music industry’s stars had begun filling open-air stadiums. The music had changed, too: Rock was supplanting nearly everything else. But in December of 1963, Armstrong’s manager had acted on a hunch. On Broadway, the finishing touches were being put on “Hello, Dolly!,” a musical scored by 32-year-old phenom Jerry Herman. Why not have Satchmo record the title song and release it as a single? In the show, the song appears in Act 2, when Dolly Levi (played in the original production by Carol Channing) returns to her favorite New York restaurant, which she hadn’t visited since the death of her husband. There, she runs into old friends, including her favorite waiters. One of them, as it happens, is named “Louie,” and she sings the soon-to-be-famous number with the entire chorus. It was a stroke of marketing genius to have Louie Armstrong record this song. It gave valuable advance publicity to the show, while reviving Armstrong’s career in a way that allowed him to reprise his own music — all while also being true to “Hello, Dolly!,” which is set in the Dixieland era. And near the beginning of Armstrong’s version, he sings, “This is Louis, Dolly,” which was perhaps the first watermark in the music industry. (Armstrong used the formal version of his name when he performed.) Although Satchmo had Americans going around humming the tune, the victory over the British invaders, if you can call it that, was fleeting. “Hello, Dolly!” lasted as the Billboard No. 1 for only a week. By May 30, the Beatles topped the charts again with “Love Me Do.” In mid-summer, however, “Hello, Dolly!” was reprised and repurposed by the Democrats at their 1964 national convention. There, in Atlantic City, President Lyndon Johnson was coronated as the party’s nominee. “Hello, Lyndon!,” Carol Channing sang to the cheering delegates. “Well, hello, Lyndon.  From NBC’s Chuck Todd, Mark Murray and Carrie Dann FIRST READ: Trump has taken on big risks in foreign policy. But are they paying off? President Trump is increasingly being tested in international affairs. And those tests are largely self-inflicted.

1. North Korea launched two rounds of missiles on Thursday – its second missile firing in a week. This comes after Trump has tried to strike a nuclear deal with the country, and after he’s turned a blind eye to these kinds of provocations.

2. Trump has threatened to prolong his trade war with China, as the two countries are trying to reach a deal. “I am very happy with over $100 Billion a year in Tariffs filling U.S. coffers,” Trump tweeted yesterday. “Great for U.S., not good for China!”

3. The Trump administration and Iran are flexing their muscles – with the United States imposing new sanctions on Iran and sending an aircraft carrier to the Middle East, and with Iran telling its proxy forces and surrogates that it can target U.S. assets in the region, per U.S. intelligence.

4. And oh, in Venezuela, President Nicolas Maduro is still in power, despite the Trump administration’s efforts to topple his regime. And now Trump is questioning his administration’s strategy in the region, the Washington Post writes.

Trump has taken big risks – elevating Kim, imposing tariffs, scuttling the Iran nuclear deal, trying to topple Maduro – to get his desired results.

Sometimes taking risks is rewarded.   And sometimes they cause you even more problems. SAUL LOEB/AFP/Getty Images Republicans turn on Burr after Don Jr. subpoena Just one day after Senate Majority Leader Mitch McConnell declared “case closed” on the Mueller report, we learned that the GOP-controlled Senate Intelligence Committee issued a subpoena for Donald Trump Jr.

And that has some Republicans furious at the committee’s chairman, Republican Sen. Richard Burr.

Here’s Rand Paul: “Apparently the Republican chair of the Senate Intel Committee didn’t get the memo from the Majority Leader that this case was closed…”

Here’s the former communications director of Trump’s 2016 campaign: “Such b.s. that @SenatorBurr (D-NC?) now taking marching orders from Democrats on the Senate Intel Committee & perpetuating Russia hoax.”

And here’s House Minority Leader Kevin McCarthy defending Don Jr: “@DonaldJTrumpJr has already spent dozens of hours testifying in front of Congressional committees. Endless investigations—by either party—won’t change the fact that there was NO collusion. It’s time to move on. It’s time to focus on ISSUES, not investigations.”

The significance of Burr’s action — and remember, the Senate Intel Committee has operated in a bipartisan manner — is that it undermines the GOP talking point that this is a Democratic witch hunt (even though Robert Mueller is a Republican).

Also, the Washington Post reports that the Senate Intel Committee issued its subpoena at least a WEEK AGO, meaning that McConnell likely knew about it before he delivered his “case closed” speech. The governing wing of the Senate GOP is getting smaller Speaking of the Senate… Last Saturday, Republican Sen. Mike Enzi of Wyoming announced he won’t run for re-election in 2020, becoming the third Republican senator to retire this cycle.

(The other two retirements: Lamar Alexander of Tennessee and Pat Roberts of Kansas.  Tom Udall is the Democrats’ only Senate retirement so far.)

What all three men have in common is that they come from the “governing wing” of the Senate GOP.

That doesn’t mean they’re centrists. But on crucial, must-pass legislation, they’re usually among those willing to reach across the aisle.

And it’s possible – if not likely – that the Republicans who might replace them in these red states won’t necessarily be members of the governing wing. 2020 VISION: Buttigieg is only 2020 Dem not offering staffers health care NBC’s Josh Lederman reports that Pete Buttigieg “isn’t providing health care coverage to any of his own campaign workers, an NBC News review of his campaign spending disclosures shows.”

“Instead,” Lederman adds, “Buttigieg is providing a monthly stipend to workers to buy insurance on their own through the Obamacare exchanges, his campaign said, with plans to offer health care in the future.”

More: “The practice stands in contrast to the other leading presidential candidates this year, as Democrats have made a point of aligning their internal practices with the policies and values they are emphasizing on the campaign trail.” On the campaign trail today: Beto O’Rourke and John Delaney both stump in New Hampshire… Pete Buttigieg, in California, attends an SEIU event with LA Mayor Eric Garcetti… And Kamala Harris, also in the Golden State, speaks at a San Francisco Black Newspaper anniversary celebration.    TWEET OF THE DAY: Sacking the Sacklers DATA DOWNLOAD: And the number of the day is … 29 percent. 29 percent.

That’s the share of Americans who say that it would bother them either “some” or “a lot” to hear a foreign language spoken in public, according to a new poll from the Pew Research Center.

The share who say they wouldn’t be bothered at all is 47 percent.

But there are major partisan differences, particularly among whites.

For white Democrats, just 18 percent say that they’d be bothered by hearing a foreign language spoken in a public place. But for white Republicans, it’s nearly half. ICYMI: News clips you shouldn’t miss  A co-founder of Facebook, Chris Hughes, is calling for government antitrust action.
