MORNING NEWS BRIEFING – NOVEMBER 24, 2021

Good morning! Here is your news briefing for Wednesday November 24, 2021

1.) THE DAILY SIGNAL

November 24 2021

Good morning from Washington, where some lawmakers look for ways to coddle criminals. Deaths and injuries along a parade route in Wisconsin spotlight the consequences of letting bad guys off easy, three Heritage Foundation legal experts argue. President Biden’s plan to subsidize electric vehicles will cost more because of son Hunter’s cobalt connection with China, Fred Lucas reports. On the podcast, a pastor’s prescription for keeping our chins up in tough times. Plus: a Virginia trailblazer shows her true grit; a new threat to Social Security; and activists who want to make pedophilia mainstream. On this date in 1979, the Soviet Union invades Afghanistan, which it will occupy amid fierce resistance for nearly 10 years.

*Stock data as of market close, cryptocurrency data as of 7:00pm ET. Here’s what these numbers mean.
  • Markets: Tech stocks continued to stumble, while industrials and banks drove the Dow higher. As for Zoom, turns out that just because you become a verb doesn’t mean you’ve got it all figured out. The software company’s stock tumbled yesterday after it cut its revenue forecast.
  • International: Nothing to see here, just a small currency crisis in Turkey. The lira plunged yesterday to a record low after President Recep Tayyip Erdogan reiterated his belief that cutting interest rates was the right policy to fight spiraling inflation (which is the opposite of what economists say).

TECH

Hook ‘Em, Samsung

It feels like every week, another company is announcing a major project in Texas. Today’s entry: The Korean tech giant Samsung said it’ll build a $17 billion advanced chipmaking plant in Taylor, TX, about 30 miles from Austin.

In dollar amounts and symbolism, it’s a huge deal. You might’ve heard there’s a chip shortage going around? The US never wants to face another one, so it’s going all-in to rebuild its chip industry on American soil.

That’s because a booming chip sector isn’t just a “nice to have.” Given the critical role of chips in everything from cars to smartphones, having homegrown chips is considered a matter of national security.

But right now, the US’ chip supply is as insecure as a person scrolling on Instagram.

  • In 1990, the US accounted for 37% of all semiconductor manufacturing. Last year it was down to 12%, after losing market share to Asian countries like Taiwan and China.

Good thing we have Austin

Lured by favorable taxes and a highly educated workforce, tech companies have descended on Texas’s capital like a group of 26-year-old Lehigh grads for Pat’s bachelor weekend.

  • Tesla is building a $1.1 billion factory in the area, and will also shift its HQ from Silicon Valley to Austin.
  • Oracle made the big move from CA → ATX.
  • Facebook, Apple, Google, and Amazon have all expanded in Central TX.

For Samsung, Taylor makes sense because the company already has a chip plant in Austin. Heaps of tax incentives (equivalent to property tax breaks of up to 92.5% for the first 10 years, according to the WSJ) also played a big role.

Big picture: With more manufacturing heft needed to support digital technologies, a chip factory could be coming to a city near you. Chipmakers Samsung, TSMC, and Intel will pour at least $100 billion each into semiconductor factories over the next few years.—NF

ENERGY

Oil Printer Go Blublublub

Game of Risk, played in oil barrels Francis Scialabba

Like your bougie uncle trying to keep the NYE party going, President Biden is uncorking some of the private collection. On Tuesday, he announced the release of emergency oil reserves—50 million barrels worth—to combat high fuel prices.

According to the White House, the amount is the most released from the Strategic Petroleum Reserve (SPR) in US history and equal to roughly what the US burns through in 2.5 days. China, India, Japan, South Korea, and the UK will join in the coordinated effort.

  • The SPR is a government complex consisting of four sites—two each in Texas and Louisiana—with deep underground caverns storing more than 600 million barrels of oil.

So will it help tame prices? Unclear. The release has been rumored for so long that some traders believe it’s already been priced in. In fact, oil prices had been declining for weeks before yesterday’s announcement.

Looking ahead…OPEC+, the group of large oil-producing nations targeted by Biden’s move, could retaliate by holding back a planned output boost, which would offset the new supply released through the reserves.—MK

RETAIL

Retailers Have a Shoplifting Problem

In Best Buy’s earnings call yesterday, CEO Corie Barry blamed stagnant sales in part on an uptick in theft, pointing to California as a particularly sticky-fingered state.

Retailers in CA have experienced a string of “smash-and-grabs.” Last month, Walgreens announced plans to shut down five stores in San Francisco, claiming that rates of theft in the city had risen to 5x the national average.

What’s going on?

Here are a few theories:

  • Facebook Marketplace and eBay have made it easier to resell stolen goods anonymously.
  • Home Depot connected the dots between the opioid crisis and an increase in thefts at its stores two years ago. Since then fentanyl, a drug that’s 50x stronger than heroin, has pervaded California.
  • Rates of unemployment and homelessness rose sharply last year, and California is home to the largest population of unsheltered persons.

Some argue that Proposition 47, which raised the felony threshold for stolen goods, has increased rates of theft, but its impact is debated.

Zoom out: Organized crime costs retailers 0.07% of sales, according to the National Retail Federation, but the emotional toll it takes on retail workers who experience thefts is downright “traumatizing,” Best Buy’s CEO said.—JW

ECONOMY

The DOJ Gets a Sugar Rush

The Justice Department says it doesn’t matter if you’re related to Elaine Benes or not, you can’t go around making anti-competitive deals. Antitrust officials filed a suit to block Louis Dreyfus Co.’s sale of Imperial Sugar to US Sugar on Tuesday.

According to the DOJ, if the ~$315 million acquisition were to go through, 75% of sugar sales across the Southeast US would be left in the hands of just two firms—a reduction in competition that it argues would increase costs for consumers.

  • US Sugar responded by claiming that the sale would increase sugar supply and production, and ease supply chain issues.

Antitrust DOJ: This marks the fourth major deal challenge from the DOJ in recent months, making good on the Biden administration’s pledge to combat industry consolidation. Recent highlights include:

  • Successfully preventing a $30 billion insurance industry merger in July
  • A lawsuit against American Airlines and JetBlue’s growing alliance
  • A lawsuit to stop the merger of publishers Penguin Random House and Simon & Schuster

Fun fact: Seinfeld and Veep’s Julia Louis-Dreyfus is the great-great-granddaughter of Léopold Louis-Dreyfus, who founded the Louis Dreyfus Group in 1851.—MK

How will the US tapping into its national oil reserve impact gas prices?

The Department of Energy will make available 50 million barrels of oil to lower prices. Of the 50 million barrels, 32 million will be returned to the Strategic Petroleum Reserve over the next three years on the assumption that prices go down in the future, and 18 million will come from a sale approved by Congress in the 2018 budget.

[The Strategic Petroleum Reserve holds] 620 million barrels of crude oil, the world’s largest emergency supply. While the stockpile is typically reserved for emergencies, the administration has broad authority to conduct oil exchanges — releases that are repaid to the stockpile.

The release of the oil reserves should quickly translate into lower prices at the pump, and officials will be watching to make sure energy companies are passing along lower oil prices to consumers, a senior administration official said. The decision was made jointly with other major energy-consuming countries to curb increasing energy prices after oil-rich nations rejected repeated calls to increase production.

Should someone charged with a violent offense be held without bail?

463 votes, 54 comments

Context: Wisconsin parade attacker had recently posted bail for a violent crime.

HIGHLIGHTED COMMENTS

Yes – The purpose of bail is to guarantee the accused person to return to court. It is not an absolute right. You can be denied bail due to being a flight risk or being a potential menace to society. Violent offenders should be held to make sure they are no longer a threat to anyone else in society before being released.

Unsure – As always, a “one size fits all” mentality does not necessarily work. Was it a drunken fist fight in a bar? Probably best to let a person dry out overnight and then go home….

No – I don’t think we should consider any category in a blanket “hold without bail”. Risk to society and flight ri…

(John Hinderaker)How crazy are liberals? Whenever you think you have taken the measure of their nuttiness, you see something like this, from the Women’s March:

We apologize deeply for the email that was sent today. $14.92 was our average donation amount this week. It was an oversight on our part to not make the connection to a year of colonization, conquest, and genocide for Indigenous people, especially before Thanksgiving.

— Women’s March (@womensmarch) November 23, 2021

What is most striking to me, apart from the sheer stupidity of this tweet, is the low opinion that liberals seem to have of other liberals. The Women’s March people evidently assume that their fellow liberals are so fragile that they will be emotionally wounded by the mention of $14.92. Hence the need for an apology. I don’t know, maybe they are right. Maybe liberals really are that pathetic. But I think if I were a liberal, I would be offended.

Gavin Newsom’s sympathies

Posted: 23 Nov 2021 03:38 PM PST

(Paul Mirengoff)The Bay Area of California is now the “Shoplifting Capital of America,” as Rich Lowry dubs it. Things are so bad that Gov. Gavin Newsom paid the area a visit.

Newsom declared that he has “no empathy or sympathy” for the shoplifters. It’s noteworthy, and a little scary, that the governor felt he had to say this. Until recently, it went without saying that elected officials didn’t empathize or sympathize with criminals, and certainly not with organized criminals, which is how Newsom described many of the shoplifters.

But does Newsom’s declaration of “no empathy or sympathy” reflect his true beliefs? It was Newsom who released thousands of prisoners — an estimated 8,000 of them — during the pandemic. Newsom also supported the elimination of cash bail.

Newsome also backed Prop 47 when he was Lieutenant Governor. It converted many offenses from felonies to misdemeanors. Shoplifting was among those offenses so reduced.

These moves demonstrate Newsom’s sympathy for criminals, including many guilty of worse offenses than looting. They also show a disregard for public safety. Indeed, they amount to giving higher priority to helping criminals than to protecting the law-abiding public from them.

To be fair to Newsom, he never advocated defunding the police. However, he did indulge in BS about “reimagining” law enforcement, by which he meant enlisting social and mental health workers. And, as the crime wave gained momentum, Newsom wouldn’t commit to increasing funding for the police.

Newsom’s visit to the Bay Area may have enlightened him, at least a little bit. His team met with retailers and asked them what they needed to stem the shoplifting/looting epidemic. They didn’t respond by asking for social workers or mental health professionals. They asked for “more law enforcement presence at store locations.”

According to this report, Newsom responded by “hint[ing] that there is an ‘exponential’ increase in supporting these local efforts within the state budget, but did not get into detail.” There had better be an exponential increase in police funding, because if the existing police force is diverted into patrolling stores, it will be less able to deal with crime on the street.

Newsom has been mugged by reality, but it’s clear that he realizes it.

Is there life after the playpen?

Posted: 23 Nov 2021 10:09 AM PST

(Paul Mirengoff)Mary Lemanski was the social media director for the DuPage County, Illinois Democrats. She no longer holds that position after a series of deranged tweets about the massacre in Waukesha, Wisconsin that left at least five people dead and dozens injured.

Lemanski viewed this tragedy as “Karma” — just punishment for the acquittal of Kyle Rittenhouse. Here is some of what she tweeted:

The blood of Kyle Rittenhouse’s victims is on the hands of Wisconsin citizens. Even the children.

I just believe in Karma and this came around quick on the citizens of Wisconsin.

You reap what you sow, Wisconsin.

Attempting sarcasm, Lemanski also tweeted:

It was probably just self-defense.

Living in Wisconsin, he probably felt threatened.

I’m sure he didn’t want to hurt anyone. He came to help people.

There was more, but Lemanski’s lunatic tweets about the massacre aren’t the main subject of this post. Sick, bitter people tweet sick, bitter stuff all the time, or so I’m told (I’m not on Twitter), and it’s not surprising that these examples came from a low-level left-wing Democrat functionary/activist.

What interests me is Lemanski’s reaction to the blowback her tweets naturally produced. She responded:

Nobody cared about me like my whole life. My mom used to leave me for hours at a time alone in my play pen. I’ve put out music for 20 years nobody gave a sh*t. Why do people all of a sudden care about a stupid remark? I can’t believe my 15 minutes of fame is for this sh*t.

According to Lenin, “left-wing communism” was “an infantile disorder.” Lemanski’s excuse suggests that her leftism also fits that description.

She isn’t alone in this regard. Or is it just a coincidence that students “triggered” by speech or a presidential candidate they don’t like are provided with rooms where they can relax with stuffed animals, coloring books, and Play-Doh?

Biden Hits the Panic Button As White House Civil War Intensifies

Posted: 23 Nov 2021 08:31 AM PST

(Steven Hayward)All last week the scuttlebutt in the media and in Washington was that President Biden was leaning toward appointing progressive favorite Lael Brainard to replace the “dangerous” (in Lizzie Warren’s words) Jerome Powell as chair of the Federal Reserve, because Brainard pledged to make the Fed a full partner in pushing the climate and “anti-racist” agenda by pressuring financial institutions not to make loans to any fossil fuel companies. Never mind that the legal authority for this kind of thumb-on-the-scale of capital allocation cannot be found in any statute governing the Fed, but who needs statutory authority when you have the Administrative State?

But then yesterday Biden surprised everyone by re-appointing Powell, while elevating Brainard to vice chair as a consolation prize for the progs. I suspect part of this decision is the rising fear about what inflation is doing to the Democratic Party, as Powell is much more likely than Brainard to rein in easy money. Likely, but not certain. Remember that Trump picked Powell over the much superior John Taylor in 2017 because Trump, as a real estate guy, likes easy money and low interest rates, and sure enough when Powell took some mild steps toward normalizing the interest-rate cycle in 2018 Trump attacked him, and Powell let up. Still, Powell is a far better choice than Brainard, though I’d prefer disinterring Paul Volcker at this point, before things get completely out of hand.

Then this morning Biden announced that he’s releasing 50 million barrels of oil from our Strategic Petroleum Reserve, which is meant for use only in national emergencies, though if you’re a Democrat, soaring pump prices and the party’s slumping approval ratings are a a national emergency. I note that oil stocks jumped sharply higher on the news this morning, as this move portends that whatever short-term relief this move may provide (likely not much at all), the trajectory of oil prices over the medium term is likely higher. It is clearly panic time at the White House. If Biden really wanted to do something, he’d reverse his decisions to cancel the Keystone pipeline and block domestic oil production. Less than a year ago, the U.S. was a net exporter of oil and petroleum products, but now we’re dipping into the emergency SPR? Way to go, Brandon!

Even Jimmy Carter finally figured out late in his only term that what he needed to do was decontrol oil and natural gas prices and install a sensible chair at the Federal Reserve. Biden is about a third of the way along the Carter Curve.

Of equal interest is the likelihood that there is a full-scale civil war going on inside the White House between Team Biden and Team Harris. A few days ago we noted the harsh CNN story on Kamala Harris’s dysfunctional and embarrassing performance in office, a story that contained lots of anonymous quotes from people inside the White House. This story has all the invisible ink of a planted story, likely by Biden chief of staff Ron Klain himself, but certainly with his approval and encouragement. Why would Biden’s political guard do this? My theory is that it is a clear warning shot for Harris and her team to get their act together. I suspect—and there are lots of rumors swirling—that Harris’s staff is amateurish, whiney, and demanding (like their boss), and that there is intense friction between the Biden staff and the Harris staff. Keep in mind that Harris has always had a terrible reputation as a boss, and has always had very high staff turnover. (The CNN story reported that her head “comms person” is leaving shortly, though I suspect she is already gone from the building. There’s a strange consistency to liberals when they are in trouble: they always say they have a “communications problem,” with nary a moment’s reflection that perhaps what they are communicating is the problem.) Friction between the vice president’s staff and the president’s staff is not unusual—it happened back in the Bush-Quayle administration, and even in Nixon-Agnew—but Harris likely sets a new low.

But then there is the curious story in the New York Times two days ago:

The president’s son was part owner of a venture involved in the $3.8 billion purchase by a Chinese conglomerate of one of the world’s largest cobalt deposits. The metal is a key ingredient in batteries for electric vehicles.

Hmmm. After watching the Times and other elite media prodigiously guarding Joe Biden against any allegations of scandal or dubious business dealings by Hunter, why this story just now? Theory: Kamala Harris sympathizers planted or encouraged the Times to run it as retaliation for the anti-Harris stories. Though perhaps it is just the beginning of an organized campaign to drive Biden from office early through scandal. It will be interesting to see whether any of the ace “investigative reporters” in the elite media can come up with the identities of the “anonymous” buyers of Hunter Biden’s “art” that has recently gone up for auction. And do any of his pieces contain brush strokes in cobalt blue?

The O’Keefe Project: What’s going on?

Posted: 23 Nov 2021 03:41 AM PST

(Scott Johnson)I am in search of a deeper understanding of the facts underlying the FBI raids on James O’Keefe’s and former Project Veritas associates in the matter of Ashley Biden’s diary. Pending before the court that issued the search warrants authorizing the raids is the motion of Project Veritas for the appointment of a Special Master to review the contents of O’Keefe’s cell phones and protect against the disclosure of otherwise unrelated and/or privileged information. This is an important case in several respects.

Project Veritas is represented in the case by attorney Paul Calli and others. Yesterday Calli filed a 15-page letter and accompanying exhibit supporting the motion for appointment of a Special Master. The letter provides helpful factual background and and legal argument that go to the significance of the case.

Attention must be paid. I thought that Power Line readers trying, like me, to follow the case, would want to have a look at Calli’s letter with their own eyes.

99.) MARK LEVIN

November 23, 2021

November 23, 2021

On Tuesday’s Mark Levin Show, no news is good news when it comes to the elite American media machine, which is similar to state-run media pushing the propaganda of the communist Chinese government on CCTV says Habi Zhang. Then, according to the Tennessee Star, Delaware County, Pennsylvania, election records were destroyed faster than the state law requires. Multiple videos show officials flippantly getting rid of election information. This reinforces an email from Christina Iacono read by this program in November of 2020 highlighting votes that could not be counted and ballots that had chain of custody issues. These issues were ignored by the U.S Attorney of Pennsylvania and the Attorney General’s Office, yet Bill Barr claimed that no such issues were raised or brought to the Department of Justice. So why didn’t the DOJ conduct an investigation? Later, in a massive ruse, NYC moves allow non-citizens to vote. This will eventually open the door for non-citizens to vote in state and federal elections as well. With the democrats pushing for same-day registration and lowering the voting age to 16, Democrats will be unstoppable. Afterward, President Biden has taken 50M barrels of oil from the country’s strategic petroleum reserve. The rising cost of gas is because Biden stopped drilling on federal land, stopped fracking, and closed pipelines, a problem he says is a myth. Fossil fuel is necessary to produce almost everything. Finally, former Watergate Counsel and White House fellow Geoff Shepard joins the show to discuss his new book “The Nixon Conspiracy: Watergate and the Plot to Remove the President.” He reveals that a cabal of anti-Nixon prosecutors and judges created the falsehood that Nixon was part of a Watergate cover-up, however, this wasn’t known for 45 years. Shepard has filed charges against the attorney for their misconduct.
