Middle-income housing across America — particularly in big coastal cities — is growing scarcer than ever, as the wealthy bid up properties that might once have been considered “affordable,” Jennifer A. Kingson writes.
- Why it matters: The pandemic’s effects on the housing market may turn out to be permanent. Renters and buyers alike face rising prices that outstrip income growth and favor people with cash savings.
The median price of a single family home in California crossed the $700,000 mark this summer — a record.
- Nationally, the story is the same: The cost of buying a house was up 7% in September, the Case-Shiller index showed. Phoenix, Seattle and San Diego were the cities with the biggest price leaps, Case-Shiller found.
- Starter homes in cities that attract young people are almost nowhere to be found.
The backdrop: The last five months have seen a real estate frenzy. Even as many Americans have struggled to pay rents and mortgages, the wealthy have paid above-asking prices for homes that used to be worth a lot less.
- From there, a chain reaction keeps low and middle-income people in rentals and leaves fewer financial incentives for developers to build anything but high-end homes.
After this fall’s Supreme Court confirmation hearings, Senate Democratic Leader Chuck Schumer had several “serious and painful talks” with Sen. Dianne Feinstein, 87, who announced Nov. 23 that she won’t seek to continue leading Democrats on the Judiciary Committee next year, Jane Mayer reports in The New Yorker:
Overtures were also made to enlist the help of Feinstein’s husband, Richard Blum. Feinstein, meanwhile, was surprised and upset by Schumer’s message. He had wanted her to step aside on her own terms, with her dignity intact, but “she wasn’t really all that aware of the extent to which she’d been compromised,” one well-informed Senate source told me. …
Compounding the problem, Feinstein seemed to forget about the conversations soon after they talked, so Schumer had to confront her again. “It was like Groundhog Day, but with the pain fresh each time.”

Yesterday’s Facebook lawsuits by the FTC and state attorneys general showed enforcers want to go a lot further than many observers thought, Axios’ Margaret Harding McGill and Ashley Gold write:
- The FTC wants the U.S. District Court in D.C. to require Facebook to provide prior notice and seek approval for future acquisitions, going beyond what’s already required.
- States were united: 48 attorneys general (46 states + D.C., Guam) joined the state suit, including California, which had been cagey about its involvement. (The exceptions: Alabama, Georgia, South Carolina and South Dakota.) By contrast, the Justice Department antitrust case against Google in October won support from only 11 states, all with Republican leadership.
- Privacy, regulators now say, is a competition concern. The state lawsuit mentions privacy dozens of times, arguing that Facebook users have a closely surveilled experience on the platform due to Facebook’s size and scope.
What’s next: Regulators hope the case will deter other companies from similar practices. But the feds will have to win in court for that message to stick.
The landmark lawsuits against Facebook cap four years in which tech companies’ national standing has turned upside-down even as their business fortunes boomed, Kyle Daly and Ashley Gold write.
- When Vice President Joe Biden left office in January 2017, Facebook, Google and other tech giants had the proud luster of American success stories.
- When President Biden takes office next month, his government will be charging Facebook and Google both as harmful monopolists.
Between the lines: The cases are in some sense a rebuke of the Obama administration’s regulatory policy, which broadly looked on tech combinations as part of Silicon Valley’s virtuous cycle of growth and innovation.
- Biden is seeking a return to Obama-era normalcy in many respects, but is unlikely to do so here.
The bottom line: Taking on Big Tech is now mainstream Democratic orthodoxy.
The catch: The FTC and states have to prove that rejecting Facebook’s acquisitions would have made life better for consumers and increased industry competition — a tough case to make, legal experts told Axios.

SpaceX launched its shiny, bullet-shaped, straight-out-of-science fiction Starship several miles into the air from a remote corner of Texas yesterday. The 6½-minute test flight ended in an explosive fireball at touchdown, AP reports.
- Why it matters: It was the highest and most elaborate flight yet for the rocket ship Elon Musk says could carry people to Mars in as little as six years.
Musk tweeted: “Fuel header tank pressure was low during landing burn, causing touchdown velocity to be high & RUD, but we got all the data we needed! Congrats SpaceX team hell yeah!!”
The Justice Department is investigating the finances of President-elect Joe Biden’s son, Hunter Biden, including scrutinizing some of his Chinese business dealings, AP reports.
- Why it matters: The Biden administration will inherit an investigation of the president’s son. Trump folks say the disclosure shows Hunter’s business dealings were worth more pre-election scrutiny.
Hunter Biden said in a statement from the transition yesterday: “I learned yesterday for the first time that the U.S. Attorney’s Office in Delaware advised my legal counsel, also yesterday, that they are investigating my tax affairs.”
- “I take this matter very seriously but I am confident that a professional and objective review of these matters will demonstrate that I handled my affairs legally and appropriately.”
Statement from the Biden-Harris Transition: “President-elect Biden is deeply proud of his son, who has fought through difficult challenges, including the vicious personal attacks of recent months, only to emerge stronger.”

A new renewable-energy trade group has announced its chief executive will be Heather Zichal, a top adviser to former President Obama, Amy Harder writes.
- Why it matters: President-elect Biden has promised to drastically increase clean energy. So this group — the American Clean Power Association — will be at the center of Washington’s biggest debates.
Since the Obama administration, Zichal has worked at The Nature Conservancy and as executive director of another climate-oriented group, the Blue Prosperity Coalition.
- She earlier worked for then-Sen. John Kerry, who is a top climate official in the incoming administration and said in a statement to Axios: “Heather is an extraordinary warrior on climate and she was fighting this fight long before it was cool.”
The American Clean Power Association, which was announced in September and formally launches Jan. 1, is the result of the 46-year-old American Wind Energy Association broadening its mission to include other renewable energy.

There have been many punishing pandemic chapters in 2020 — the beginning, the global spread, mass death in springtime and beyond, lockdowns and economies battered, reopenings and alarming resurgences. This week, the vaccine quantum leap has offered the promise of light at the end of a dark tunnel.
Pfizer’s COVID-19 vaccine, which was co-developed with Germany’s BioNTech, faces one final and critical hurdle before an expected decision to greenlight the shot for use in millions of Americans. Food and Drug Administration advisers meet today to scrutinize the company’s data for any red flags or oversights.
Safety will be the top priority for the panel of medical experts who will vote on whether to endorse the vaccine. They will also address unknowns about the vaccine’s effectiveness in certain groups. A final FDA decision and the first shots could follow within days, Lauran Neergaard and Matthew Perrone report.
U.S. Vaccine Poll: A new survey from The AP-NORC Center for Public Affairs Research has found only about half of Americans are ready to roll up their sleeves for COVID-19 vaccines even as states frantically prepare to begin months of vaccinations that could end the pandemic. The poll shows about a quarter of U.S. adults aren’t sure if they want to get vaccinated when their turn comes. Roughly another quarter say they won’t, Lauran Neergaard and Hannah Fingerhut report.

U.S. Surge: As the death toll soars, with 3,000 virus fatalities recorded in what is a single-day record, arguments over mask requirements have turned ugly in recent days as the surge engulfs small and medium-size cities that once seemed at a safe remove from the pandemic. The crisis is expected to get worse nationwide. But resistance to wearing masks has become more vocal and risks turning violent. Some claim the dangers of the virus are overblown and mask requirements are a violation of their civil liberties. Heather Hollingsworth and Ryan Foley report.
Canada’s Green Light: The country’s health regulator has approved Pfizer and BioNTech’s vaccine. Canada is set to receive up to 249,000 doses this month and 4 million doses by March. The government has purchased 20 million doses of that vaccine, which requires people to receive two doses each, and it has the option to buy 56 million more. Health Canada is reviewing three other vaccine candidates, including one from Moderna, Rob Gillies reports from Toronto.
U.K.’s Warning: As others proceed, Britain’s medical regulator has warned that people with a history of serious allergic reactions to a vaccine, medicine or food shouldn’t receive the vaccine from Pfizer and BioNTech as investigators look into whether two reactions on the first day of the country’s vaccination program were linked to the shot. The advice was issued on a “precautionary basis.” The people who had reactions have recovered. Pfizer and BioNTech say they are working with authorities but that late-stage trials found no serious safety concerns, Danica Kirka reports from London.

Israel: Prime Minister Benjamin Netanyahu said his government will begin administering Pfizer vaccines to the general public on Dec. 27. He said Israel is prepared to vaccinate some 60,000 people a day. There was no immediate word on whether Israel would be providing vaccines to Palestinians in the occupied West Bank or the blockaded Hamas-ruled Gaza Strip.
”Vaccine Nationalism”: U.N. Secretary-General Antonio Guterres has warned that “vaccine nationalism” is moving “at full speed,” leaving poor people around the globe watching preparations for inoculations against the coronavirus in some rich nations and wondering if and when they will be vaccinated. He reiterated his call for vaccines to be treated as “a global public good,” available to everyone, everywhere on the planet. The giant tech companies whose services are woven into the fabric of social life are now the targets of a widening assault by U.S. government competition enforcers.
Regulators filed landmark antitrust lawsuits against Facebook, the second major government offensive this year against once seemingly untouchable tech behemoths.
The Federal Trade Commission and 48 U.S. states and districts sued the social network giant, accusing it of abusing its market power to squash smaller competitors, labelling it ”predatory acquisition,” Marcy Gordon and Michael R. Sisak report.

Remedies are being sought that could include a forced spinoff of Facebook’s prized Instagram and WhatsApp messaging services. The company’s conduct has crimped consumers’ choices and harmed their data privacy, the regulators charged.

Beyond that, federal law enforcement officials are afforded anonymity even after the disciplinary process runs its course, allowing them to land on their feet in the private sector or even remain in law enforcement. China says it is imposing restrictions on travel to Hong Kong by some U.S. officials and others in retaliation for similar measures imposed on Chinese individuals by Washington. U.S. diplomatic passport holders visiting Hong Kong and nearby Macao will temporarily no longer receive visa-free entry privileges. U.S. officials, congressional staffers, employees of non-governmental organizations and their immediate family members will face “reciprocal sanctions.” The U.S. has barred certain Chinese and Hong Kong officials from traveling to the U.S. or having dealings with the U.S. financial system over their roles in enforcing a sweeping National Security Law that ushered in a crackdown on free speech in Hong Kong. A heated debate is underway in Lebanon over the fate of the towering grain silos gutted in the massive explosion at the Beirut port that killed more than 200 people in August. Some argue the silos could collapse at any moment and must be demolished. Others call for the ruins to be preserved as a grim memorial, fearing that officials behind the negligence blamed for the explosion want to erase the memory of what happened. “Thursday’s meeting of the Food and Drug Administration’s vaccine advisory panel is likely the last step before a U.S. decision to begin shipping millions of doses of the shot, which has shown strong protection against the coronavirus.
“The FDA panel functions like a science court that will pick apart the data and debate — in public and live-streamed — whether the shot is safe and effective enough to be cleared for emergency use. “On Wednesday, Hunter Biden said he had been contacted about a tax investigation out of the U.S. Attorney’s Office in Delaware.
“In addition to Delaware, the securities fraud unit in the Southern District of New York also scrutinized Hunter Biden’s finances, according to the person with direct knowledge of the investigation. The person said that, as of early last year, investigators in Delaware and Washington were also probing potential money laundering and Hunter Biden’s foreign ties. The person spoke on the condition of anonymity because they are not authorized to discuss the matter publicly.
“In addition to the probe into Hunter Biden, federal authorities in the Western District of Pennsylvania are conducting a criminal investigation of a hospital business in which Joe Biden’s brother James was involved. Federal officials have asked questions about James Biden’s role in the business, according to a second person with direct knowledge of that investigation, who said it remains ongoing.”

“The roughly 15-minute phone call late Tuesday came shortly before U.S. Sens. Kelly Loeffler and David Perdue issued a joint statement saying they ‘fully support’ the improbable lawsuit asking the U.S. Supreme Court to reject election results in Georgia and three other battleground states that Trump lost.
“Earlier in the day, Carr’s office called the lawsuit by Texas Attorney General Ken Paxton ‘constitutionally, legally and factually wrong.’ The complaint asks the justices to delay the Monday deadline for certification of presidential electors in Georgia, Michigan, Pennsylvania and Wisconsin. … A person on the call between Trump and Carr described it as cordial. Happy Thursday, dear Kruiser Morning Briefing friends. Poor personal choices are what’s for breakfast today.
Let’s talk lockdowns again today, even though we’re not calling them just that anymore.
Stay-at-home orders…curfews…it all ends up the same: freedoms are stripped away and livelihoods are ruined. While all of that is going on, the elites at the Court of Versailles party on without caring one whit for the suffering commoners.
Gavin “French Laundry Bloomers” Newsom is now the worst of the bunch. I’ve long thought that Andrew “Fredo the Elder” Cuomo was the worst, but I’m reassessing that and realizing that it’s been Newsom for a while. They’re probably in a dead heat when it comes to ignorant arrogance but Newsom’s smarm factor is nausea-inducing.
Most of the Democrats who have been issuing tyrannical power flexes have all been pretending that they are going to free things up a few days before Christmas. Given the heathen secular glee most of them have exhibited in shutting down worship services since March it’s difficult to believe they aren’t just waiting to have a go at Christmas.
Naturally, Newsom is the first to make a big move in that direction. Tyler has more:
Last week, Gov. Gavin Newsom (D-Calif.) dictated from on high that if Intensive Care Unit (ICU) capacity in any of California’s five regions falls below 15 percent, he would shut down indoor church services, travel, playgrounds, movie theaters, wineries, and more, for at least three weeks. As of Wednesday, his restrictive orders apply to three-fifths of California. Each of these regions cannot exit lockdown until days after Christmas.
The stay-at-home order essentially cancels Christmas, or at least, it cancels Christmas gatherings involving people from more than one household.
“All gatherings with members of other households are prohibited in the Region except as expressly permitted herein,” the order states. “Nothing in this Order prevents any number of persons from the same household from leaving their residence, lodging, or temporary accommodation, as long as they do not engage in any interaction with (or otherwise gather with) any number of persons from any other household, except as specifically permitted herein.”
What exceptions does the order make? Individuals can leave their homes to maintain “critical infrastructure,” to worship or engage in political expression outdoors, to go to school, or to go to work in “essential” professions. The order does not allow for any in-person indoor Christmas services or any in-person Christmas gatherings for people from more than one household.
There are a couple of things running through my mind here.
First, California has been stricter than most other states while dealing with COVID, so why are things still out of hand there?
Oh yeah, because the lockdowns are useless. All Newsom has accomplished is eradicating the livelihoods of small business owners rather than the threat of the virus.
The other thing that has come up in a lot of conversations lately is whether Newsom and his ilk will face any consequences for all of the anti-science, arbitrary tyranny. My California friends tell me that many of their liberal friends are growing weary of all of this. I’ve been writing for a while that I didn’t believe that the Democrats of California would ultimately punish Newsom at the ballot box. Dems are in a constant state of disconnect about the present state of their lives and what they do when they vote. That’s why they do things like flee California for Arizona and keep voting for the kinds of policies they ran away from.
Maybe that’s changing. There are signs of resistance happening at present:
Business owners are fighting for their lives and being public about it. Anything Newsom does to financially penalize the already downtrodden will make him look even worse.
Perhaps this egomaniac has finally been so awful that even the brain-dead California Dems will turn against him.
Or he’ll be reelected in a landslide because they really are as dumb as we thought.

- West Virginia on Wednesday became the last of the 50 states (plus D.C.) to certify its presidential election results. Joe Biden is expected to win 306 electoral votes when the Electoral College meets on Monday, and Donald Trump is expected to win 232. Biden won 51.3 percent of the popular vote to Trump’s 46.8 percent—a margin of more than 7 million votes.
- The House approved a stopgap spending bill on Wednesday in a 343-67 vote intended to avert government shutdown. If passed by the Senate, the continuing resolution extends the government shutdown deadline from this Friday to December 18, giving Congress more time to approve a spending bill and possibly negotiate a coronavirus relief package.
- Hunter Biden announced yesterday he learned this week that the U.S. attorney’s office in Delaware is investigating his taxes. According to CNN, the investigation into Joe Biden’s son began in 2018 and examines whether he violated tax and money laundering laws amid foreign business dealings in China and elsewhere.
- The Federal Trade Commission and attorneys general in 46 states sued Facebook on Wednesday, accusing the tech company of anti-competitive behavior and seeking to unwind its acquisitions of Instagram and WhatsApp. “The government now wants a do-over, sending a chilling warning to American business that no sale is ever final,” Facebook’s general counsel said in a statement, pointing out that the FTC previously approved those acquisitions.
- President-elect Biden is expected to nominate Katherine Tai—a trade lawyer with experience in U.S.-China relations—to serve as his administration’s U.S. Trade Representative.
- Canada’s health regulator authorized Pfizer and BioNTech’s COVID-19 vaccine on Wednesday and plans to begin a nationwide rollout as early as next week.
- Pennsylvania Gov. Tom Wolf, 72, said on Wednesday he has tested positive for COVID-19 and is isolating at home with his wife. In a statement, he said he is “feeling well” and experiencing no symptoms.
- The United States confirmed 222,457 new cases of COVID-19 yesterday per the Johns Hopkins University COVID-19 Dashboard, with 12.4 percent of the 1,799,629 tests reported coming back positive. An additional 3,168 deaths were attributed to the virus on Wednesday, bringing the pandemic’s American death toll to 289,357. According to the COVID Tracking Project, 106,688 Americans are currently hospitalized with COVID-19.
A Dispatch Analysis of Trump and Friends’ Election Lawsuits
As we’ve covered the post-election craziness here in TMD the past few weeks, we’ve made several references to Democratic lawyer Marc Elias’ running count of how pro-Trump litigants have fared in lawsuits seeking to challenge or overturn or block the election results. As of last night, Elias had them at 1-55, good for a .018 batting average.
Elias is good at what he does—Fox Business’ Lou Dobbs suggested this week the Trump team “put together a half billion dollars and go hire him and get him out of your way”—and his 1-55 tally is generally accurate in conveying just how fruitless of an endeavor Republicans’ efforts to overturn the election results have been. But he is a partisan (his Democracy Docket website lists the Democratic National Committee, the Democratic Congressional Campaign Committee, the Democratic Senatorial Campaign Committee, and progressive activist group Priorities USA as partners/sponsors), and, as such, has an incentive to paint Team Trump’s efforts in the worst possible light.
So we—led by our Advisory Opinions legal eagles David and Sarah—conducted our own analysis. The Elias tally is technically accurate—but it counts virtually every court action, no matter how minor. His count, for example, would include losing a motion for an evidentiary hearing that was denied because the judge wanted to rule on whether she had jurisdiction first, meaning that, in theory, the plaintiff could win that exact same motion at a later time. Instead of counting each successful motion as a win or each failed appeal as a loss, we looked at the cases from start to finish—or where they stand in the process.
Stripping out these more trivial rulings, the pro-Trump litigants’ batting average does not improve, but—to extend the baseball metaphor—their number of at bats drops precipitously. In our count of cases that have been dismissed, appealed, and/or where the temporary relief being requested—like an injunction or a temporary restraining order—has been denied, Team Trump is 0-11, with seven cases outstanding.
You can read a breakdown of all 18 of these cases up on the site today, but we’ve excerpted a few highlights below. The bottom line: Most of these cases are totally meritless—sweeping allegations free of convincing evidence. A few are more reasonable in their content, but their proposed remedy—disenfranchising millions of voters—is completely out of bounds.
ARIZONA
Donald J. Trump for President Inc. v. Hobbs: Dismissed
This suit, often referred to as the Sharpie lawsuit, was filed by the Trump campaign, the Arizona GOP, and the RNC in Maricopa County Superior Court on November 7. It alleged that poll workers encouraged voters to use Sharpies that allowed ink to bleed through the ballot and cause the ballots to be rejected as overvotes. The complaint argued that if ballots were reviewed they would “yield up to thousands of votes for President Trump and for other Republican candidates.” The plaintiffs sought to halt certification of the election.
On November 13, the defendants filed a motion arguing that ongoing ballot tabulation had rendered the case moot. The Trump campaign not objecting, a superior court judge dismissed the case with prejudice (removing the possibility of appeal) that day.
Further, it’s worth noting there is no merit to the claim that Sharpies can invalidate ballots. As noted in a Dispatch Fact Check, Maricopa County tweeted on Election Day that polling locations offered Sharpies because they are less likely to smudge. Also, the ballots used in the election were “offset,” meaning that the circles you fill in on your ballot don’t line up on the front and back of the ballot, so the ink bleeding could not cause overvotes on the other side.
GEORGIA
Trump v. Raffensperger: Pending
Filed in state court last Friday, this suit boils down a sweeping list of electoral grievances—“many thousands of illegal votes were cast, counted, and included in the tabulations” for the presidential election, thus “creating substantial doubt regarding the results of that election”—into one huge ask: for the court to either order a new election or, considering the improbability of pulling that off before the state’s electors must be sent, to provide another form of relief, such as allowing the legislature to appoint electors.
The suit alleges that more than 140,000 people were permitted to vote illegally, for a variety of reasons—they were underage, they had moved out of state, they were dead, etc. It also alleges, among other things, that Georgia officials violated state law by mailing out absentee ballot applications more than 180 days before the election.
Given Biden’s small margin of victory in Georgia, this suit isn’t as tall an order as some similar efforts the campaign has brought in other states—although the factual claims have yet to be adjudicated. The state has asked the court to dismiss the suit, which is ongoing.
MICHIGAN
Costantino v. Detroit: Injunctive relief denied, case pending
The eight filings in this lawsuit alleged that election officials neglected to verify signatures, processed and counted voters whose names did not appear in the voter rolls, produced a batch of unsealed ballots attributed to Democratic candidates after the counting of absentee voting concluded, processed ballots arriving after the election deadline, and locked poll watchers out of the counting room after they raised challenges to the alleged fraud. “It’s a very significant case,” Rudy Giuliani, Trump’s personal attorney, said in a November press conference.
The chief judge of Michigan’s 3rd Judicial Circuit rejected the plaintiffs’ motion for injunctive relief on November 13, stating in a 13-page ruling that they “are unable to meet their burden for the relief sought.”
“It would be an unprecedented exercise of judicial activism for this Court to stop the certification process of the Wayne County Board of Canvassers,” Judge Timothy Kenny elaborated. On December 8, Judge Kenny denied the plaintiffs’ request for an “independent, non-partisan audit” to be completed by December 13. The case is still pending.
PENNSYLVANIA
Trump v. Boockvar: Dismissed
The Trump campaign filed suit against the Pennsylvania secretary Kathy Boockvar alleging a host of election irregularities, including that observers were not permitted to watch the absentee ballot canvassing and counting; that Democratic counties allowed ballots to be “cured” while Republican counties did not; and that the commonwealth’s mail-in voting process “lacked all of the hallmarks of transparency and verifiability.” The campaign sought to block certification of the election results.
The plaintiffs ultimately filed three separate complaints. On November 21, the trial court dismissed the case, finding that the court had been “presented with strained legal arguments without merit and speculative accusations, unpled in the operative complaint and unsupported by evidence.” He noted that “In the United States of America, this cannot justify the disenfranchisement of a single voter, let alone all the voters of its sixth most populated state.”
The campaign appealed on narrow grounds on November 22. On November 27, the 3rd Circuit Court of Appeals upheld the dismissal. There has been no request for the Supreme Court to hear the case.
TEXAS
Texas v. Pennsylvania, Georgia, Michigan and Wisconsin: Pending at the U.S. Supreme Court
Texas Attorney General Ken Paxton filed a 154-page lawsuit on Tuesday against Pennsylvania, Wisconsin, Michigan and Georgia, alleging that these four battleground states implemented unlawful statutory changes to their election rules prior to November 3. Given the Supreme Court’s original jurisdiction on cases involving inter-state disputes, Paxton asked the highest court to “enjoin the use of unlawful election results without review and ratification by the Defendant States’ legislatures” and allow all four states’ legislatures to appoint new presidential electors despite federal law’s December 14 deadline for electoral certification. President Trump announced Wednesday that his campaign will join Texas in the lawsuit. Missouri Attorney General Eric Schmitt, a Republican, and 16 other states have also said they will file a brief in support of the lawsuit.
University of California-Irvine law professor Richard Hasen summarized the defects with the suit in a December 8 blog post: “Texas doesn’t have standing to raise these claims as it has no say over how other states choose electors; it could raise these issues in other cases and does not need to go straight to the Supreme Court; it waited too late to sue; the remedy Texas suggests of disenfranchising tens of millions of voters after the fact is unconstitutional; there’s no reason to believe the voting conducted in any of the states was done unconstitutionally; it’s too late for the Supreme Court to grant a remedy even if the claims were meritorious (they are not).”
WISCONSIN
Feehan vs. Wisconsin Elections Commission: Pending
This federal suit was brought by Sidney Powell, formerly associated with the Trump campaign. One of the two plaintiffs, former congressional candidate Derrick Van Orden, later said his name was used without his permission by Powell.
Powell is asking the court to decertify Wisconsin’s election results and for Gov. Tony Evers to certify a Trump victory. The suit alleges that software in voting machines made by the Dominion Voting Systems Corporation was constructed to allow former Venezuelan dictator Hugo Chavez to rig elections, a ploy that was then adapted by “Dominion, domestic third parties or hostile foreign actors” to alter vote records without a trace. The software in question, Smartmatic, is not used in Dominion voting machines and was only used in voting machines made by a different company in one U.S. county in 2020, Los Angeles.
In order to substantiate these claims, Powell asked for security video from rooms used for voting in the TCF Center, a facility which is actually in Michigan.
This week, U.S. District Judge Pamela Pepper, denied the plaintiff’s request for an evidentiary hearing, noting that asking for such a hearing before the judge had ruled whether her court had jurisdiction to hear the case at all was “bass-ackward.”

- Throughout November, many public officials and media personalities engaged in a weeks-long offensive berating Americans who planned to travel during the week of Thanksgiving. But all of this public shaming proved futile, considering millions of Americans gathered with their families over the holiday anyway. How might officials amend their public health message leading up to Christmas and New Years? “Instead of yelling even louder about Christmas than about Thanksgiving, government officials, health professionals, and ordinary Americans alike might try this: Stop all the chastising,” Harvard epidemiologist Julia Marcus writes in the Atlantic. “Remember that the public is fraying. And consider the possibility that when huge numbers of people indicate through their actions that seeing loved ones in person is nonnegotiable, they need practical ways to reduce risk that go beyond ‘Just say no.’”
- The pandemic is raging out of control in pretty much every state, but few are experiencing as acute an outbreak as South Dakota is right now. As of last night, about one in every 770 South Dakota residents at the beginning of the pandemic has died from COVID-19, and one in 178 have been hospitalized with the virus. In the Washington Post, Annie Gowen tells the tragic story of one town—Mitchell—that has been hit especially hard. “People started dying. The wife of the former bank president. A state legislator. The guy whose family has owned the bike shop since 1959. Then [Buck] Timmins, a mild-spoken 72-year-old who had worked with hundreds of local kids during six decades as a Little League and high school coach and referee,” Gowen writes. South Dakota is one of the few remaining states without mask mandates, but Timmins’ death is sparking a change of heart in Mitchell. Susan Tjarks, a conservative Republican on the city council, became convinced more action was necessary. “What we have been doing isn’t working,” she said. “I don’t want to lose any more friends. I don’t want to lose any more neighbors. We have to do what we need to do to step up and prevent these cases from rising.”

The entire town of Mossyrock, WA, will be defying Governor Inslee’s lockdown orders
Posted: 09 Dec 2020 11:42 PM PST MOSSYROCK, WA – A town whose leaders voted unanimously to ignore Washington Governor Jay Inslee’s lockdown orders is holding a rally this weekend to demonstrate solidarity and to send a message to the rest of the state, perhaps even the country. Mossyrock, WA, with a population of just under 1000, is the small town with the big heart. That heart will be put to the test against the authoritarian rule of the state government as their defiance will likely be met by some sort of rebuke from the Governor’s office. They’re calling for help from patriots who still believe in the U.S. Constitution and the rights therein. According to Seattle journalist Katie Daviscourt:
Last month, leaders voted to defy Inslee’s COVID-19 restrictions on indoor bar and restaurant service. According to the new city ordinance, the city “will not recognize” Inslee’s orders to temporarily prohibit indoor dining, limiting service to outdoor seating or takeout. A “Freedom Mossyrock Rally” is will be held on Saturday, Dec. 12, at Mossyrock City Hall. According to King5, the Mayor is aware that he technically does not have the authority to overrule the Governor. “No, we don’t have the authority,” Mossyrock Mayor Randall Sasser said. “It gets the word out, it gets people thinking about really, what is happening?” Sasser said restrictions should be determined by local health officials, much like local school districts in the state have determined if students return to campuses for in-person learning. He said limiting Mossyrock’s restaurants and bars could put them out of business. “For businesses to shut down who have given their life savings to open up a business in a small community and then be ordered to shut down and not have any restitution to help them survive, that’s a shame,” Sasser said. It really comes down to whether state or county officials are willing to go to the small town to enforce the lockdown order since local officials will not. This is why the rally on Saturday is so important. By showing solidarity and getting the word out about strong support for non-compliance, they hope the Governor will avoid a showdown that will bring him bad optics regardless of the results. If enough people can make their voices heard on Saturday, it’s possible the Governor will pick a different hill upon which to die, politically speaking. As lockdowns continue across the nation over a disease that has over a 99.5% recovery rate, cities like Mossyrock, Washington, represent the true power of the people to resist through non-compliance. Michigan Attorney General says being wished a Merry Christmas ‘devastated’ her son
Posted: 09 Dec 2020 11:22 PM PST Attorney General Dana Nessel of Michigan tweeted her concern over President Trump’s use of “Merry Christmas” this weekend, according to CBN News. Article originally published at Christian Headlines. While campaigning in Georgia in an attempt to secure Republican Senator’s seats, the President told the crowd: “Let me begin by wishing you all a very Merry Christmas. Remember the word? Remember we started five years ago and I said, ‘You’re going to be saying Christmas again,’ and we say it proudly again. Although they’ll be trying to take that word again out of the vocabulary. We’re not going to let them do that.” Nessel later told her Twitter followers in response to Trump’s speech, “I remember the first time I was at a store with my son and an employee said ‘Merry Christmas’ to us. My son looked devastated and asked, ‘Are we the only people who don’t celebrate Christmas?’ I answered ‘No, and we are just as American as everyone else.’ Glad @JoeBiden knows that.” But the now-deleted tweet brought an onslaught of responses chiding the AG for her disparagement of “Merry Christmas.” She later tweeted, “Saying ‘Happy Holidays’ this time of year does not denigrate Christianity. It simply acknowledges and respects the great diversity of our nation and includes each and every one of us who call ourselves proud Americans.” A follower told Nessel in response: “Being offended is a choice. If you’re offended by an expression of goodwill, that’s a you problem. If someone wishes me Happy Hanukkah or Ramadan I just say thanks as it’s said with good intentions. Asking people of faith to not use these is telling them to hide their faith. Nope.” Another was confused how the greetings could cause such harm. “There are only 2 holidays in December. I say Happy Hanukah to my Jewish friends and Merry Christmas to my Christian friends. Dr. Lehr provided the two old colonels with a clear, detailed, and easily understandable explanation about the absolute falsity of the concept that humans are responsible for negatively impacting the climate. Dr, Lehr noted that it is incorrect to claim that man has even a minimal impact on the earth’s climate, because the human impact on that climate is precisely zero. Just as the so-called pandemic has been a terror-inducing and deceitful power-and-money grab by doctors, scientists, media, and politicians, Dr. Lehr plainly explains that the climate-change fanatics are also liars who are out to terrorize people and cheat them out of their money and liberties in the name of creating a despotic one-world government.

Maybe it’s time to go from the Red, White, and Blue to the Red and White, and the Blue and White. But can it be?
Posted: 09 Dec 2020 09:47 PM PST The red and the blue—states that is—are as different as the colorless black and white landscapes absent from the color spectrum. The concept of separate states for separate cultures is as old as Canaan and Egypt. The concept of separation for moral law is as old as these two, as well. Today on any given “news” outlet, maps are displayed of the 50 United states with some states colored red and some colored blue. The distinction is usually drawn that the blue are democrats, the red Republicans. The blue, supposedly, are more liberal (not literally), the red more conservative (again not literally). But each a conglomeration of each of the other with the color running anywhere from 55-45% to 65-35%, the majority number determining the color of the state. And that majority is generally a fixture of the wants and needs of that state and often its culture. Once, the original states (formerly colonies) were drawn into a confederated union for defense in their efforts to secede from their covenant host in Europe—The British Empire. Their secession was not from a tyrannical king, though such nonsense is perpetrated constantly by the socialistic-styled Eric Foner historical mischief i.e. that the colonies declared a single unilateral declaration of independence as a single state. This is ahistorical and therefore rubbish. In fact, they seceded from the British Empire which was controlled by its parliament which, in fact, was controlled by The East India Company. This was, in its time, a corporate welfare beast that was (again in its time) probably more powerful than Google and Amazon combined, today. The Boston Tea party took place due to the East India Company’s arm twisting of parliament which allowed, through corrupt legislation, the EIC a monopoly on tea from The British Empire into the colonies. The colonists were not going to pay a tax that was designed around corruption. The colonies became THESE United States and not THE United States—the former being the factual truth. Five states had singularly seceded via each’s declaration of independence prior to the now-famous July 4th Declaration of Independence: Virginia, New Hampshire, New Jersey, Rhode Island, and South Carolina. The entirety of 13 signed the single document in July 1776 (following the Jefferson-Virginia styled document) purely as a show of strength. At the time there was no body of a single colonial government other than a Continental Congress, which had no authority other than suggestive influence through mutual consent among the independent colonies. The Articles of Confederation came five years later and the U.S. Constitution 11 years later. But both of these were confederated republics and NOT a national state. More Eric Foner et al ahistorical foolishness. A pure reading of the July 4th Declaration of Independence states that the colonies seceded and were assuming their places as independent states (not a state) among the nations of the world. From Declaration of Independence: That these united Colonies are, and of Right ought to be Free and Independent states; that they are Absolved from all Allegiance to the British Crown, and that all political connection between them and the State of Great Britain, is and ought to be totally dissolved; and that as Free and Independent States, they have full Power to levy War, conclude Peace, contract Alliances, establish Commerce, and to do all other Acts and Things which Independent States may of right do. And for the support of this Declaration, with a firm reliance on the protection of divine Providence, we mutually pledge to each other our Lives, our Fortunes and our sacred Honor.” The constant tug of war between the Federalists and Anti-Federalists from the 1787-1790 U.S. Constitution and subsequent Bill of Rights amendments, up unto the Kansas-Nebraska Act, at least, left the generally Agrarian South and Industrial/Navigation North so far apart as to offer no choice but secession for one culture or the other. Even at that, the upper Southern states were willing to remain in union with the Northern Industrialists and attempt a go of it. Seventy years after the Constitution (not “four score and seven” hogwash) had been ratified, the 8th secession impulse had arisen, the recent being the first in the South. The Confederate States of America (C.S.A.) seceded and formed a confederated republic in Montgomery, Alabama. Previous secession considerations were as follows:
However, when Lincoln called for troops to invade the South in order to drag them back into the old union, Virginia, North Carolina, Arkansas, Tennessee, Kentucky, and Missouri declared independence and themselves seceded. Lincoln, now completely determined to unlawfully (unconstitutionally) use troops, invaded Kentucky and Missouri, captured their legislatures, and occupied them. The battle flag of the Confederacy, however, has always retained its 13 stars. After the war, the conquered South forced back into a single national state, created by Lincoln and the Republicans remained loyal to its belief that secession was legal and proper. But they joined with honor. As a final insult, in 1869, in Supreme Court Ruling, 5-3, in Texas vs White, the court ruled by Salmon Chase—the John Roberts of the day-that the South had no right to secede (though the 13 colonies apparently had such a right). Chase’s opinion was not based on anything other than as a Lincoln appointee (as were the other concurring justices) he had to make a slaughter (erroneously called a Civil War) of over 600,000 Americans seem acceptable, if not legal. Also, it was to renege on bearer bonds due to people in the state of Texas. In other words, the ruling was so much political bilge. So much for the past. Now for the prologue: Today, much of the old South retains its view of secession as well as its large agrarian culture. The South is mostly a red area politically. And even the extension of red areas into the mountain states and mid-west is a culture of landowners, independent business owners, and generally devotees of small limited governance. Such governance desires absence from lockdowns, mandatory masks, endless government foreign wars, high taxes for social tinkering, and pseudo-scientific green nonsense. Further the idea that though they have fallen from a republic (a government with limited voters who necessarily follows the law) to a democracy where the mob grows larger and larger, hardly holds for them. Finally, a system where dead people vote and imaginary people vote in order to defraud the people of their choice of president, and governors who lock them up might be too much. Political thugs demand of them that which these thugs are themselves unwilling to do. These same blue-governments foist a dishonest system on the people where certain taxpayers are not allowed to work but still must pay taxes so these political thugs can get their “essential” paychecks. Many people (me, for one, in Texas) will stand up and state categorically that they have no desire to remain under a government where what has become known as the Washington “Deep State” rules via bureaucrats and corrupt state-like police such as the F.B.I., C.I.A. and the I.R.S. In my view these are no more protective of the people and their rights than The Center for Disease Control or any number of M.D.s who act more like political hooligans than Hippocrates students of healing. However, spitting into two areas, red and blue still has problems. The un-structuring of the two monstrous beasts of the Federal Reserve (not even constitutional) and the IRS need immediate attention. This second beast is technically constitutional in its creation but has destroyed much of the rest of the constitution by its own high-handed (see Lois Lerner as one of a myriad of examples) practices over its history. And not the least of the problems is the split in political character in the red zone. Many so-called conservatives simply abide the traditional Southern conservativism for the gain of the Republican party. The Republican party was founded in nationalism and warfare and remains tied to it through its RINOs and its own Washington “Deep Staters.” These are the same people who have tied the world-wide caste and 5000 years of what has been generally called “slavery” to the American South. This is the same South where only 5% of these slaves brought to the western Hemisphere ended up in the American South. But today, the South and its red block of determinative conservatives are damned constantly with the ubiquitous and so-called ambiguous epithet—RACIST. Therefore, the biggest block of conservatives is the biggest block of red-staters—the South. But they are condemned to pay for slavery although they had the least criminal intent and the least responsibility in it insofar as slavery being transported to the New World. So, two reds and a blue are the splits to be had. The only way of a successful secession would be for the truth to be told historically. That truth? That the republic was destroyed in 1865. A national government was formed and has grown into a nearly complete socialist-Marxist leviathan. Voters have no say. The unelected Washington Deep State has all to say. The red states need to understand what freedom is. But they can only understand this if they understand what secession is. They can only understand if they truly understand what a declaration of independence means. If they can ever listen to historians who know what it meant. Media hypocrites size up U.S.-Venezuela elections differently

These nations were known as the United States and Venezuela. The two races had much in common: In both elections, the stakes were high, and each involved no small amount of controversy. In the United States, there existed several left-wing activist organizations responsible for telling Americans what was going on in their country, especially when it concerned the election. Members of these organizations referred to themselves as “journalists” to fool the public into thinking that they were reporters of facts when, in reality, they were far-left operatives pushing an agenda. Leftist Outlets Focus On Venezuela, Ignore AmericaWhile both elections were rife with allegations of fraud, these activist groups decided to focus on only Venezuela’s race, even though any sensible person would expect corruption because its government, led by strongman Nicolás Maduro, is authoritarian and socialist. The left-wing activist organizations poorly disguised as journalistic outlets seemed to be very much invested in the goings-on in the country. CNN reported:
The Associated Press noted that “opposition groups led by Juan Guaidó launched a risky referendum on Monday [Dec. 7], betting some of their prestige on hopes they can reignite a campaign to oust Maduro in a nation suffering unprecedented economic and political crises that have spurred millions to flee abroad.” ABC News pointed out that other nations criticized Maduro for his handling of the election. “The U.S., Panama, Canada and Germany have repeated their condemnation of the election by Maduro’s government following announcement of the results,” the activist group observed. Reuters reported that “the opposition in 2015 won control of the National Assembly in a landslide, but the pro-Maduro Supreme Court blocked even the most basic legislation. In 2017, Maduro supplanted parliament with the creation of an all-powerful parallel body known as the National Constituent Assembly.” What About America’s Elections?America’s elections, while not nearly as corrupt as Venezuela’s, were still problematic. President Donald Trump’s legal team has filed several lawsuits in battleground states alleging voting irregularities. The president himself has contested the result of the election, claiming that it was rigged in favor of former Vice President Joe Biden. Stories of questionable conduct at the polls have been surfacing since Election Day. Hundreds of affidavits have been submitted under penalty of perjury alleging instances of election fraud. While it’s not certain that there were enough fraudulent votes to hand the election to Biden, it seems clear that the race wasn’t entirely kosher. Unfortunately, left-wing news outlets have shown a remarkable lack of curiosity about the U.S. election. Indeed, they seem more concerned about corruption taking place in a foreign country than about what’s happening in America. The corporate press has been intent on distracting the nation from issues with the U.S. election. Indeed, when they bother to cover a story involving Trump’s legal challenges, they attempt to convince Americans not to look too closely at what is happening in states like Georgia, Michigan, and Arizona. The US Supreme Court is ignoring the election and in the process also the law
Posted: 09 Dec 2020 09:00 PM PST The president continues to fight against voter fraud and election malfeasance and is being encouraged by millions of supporters not to concede the election. The recent United States Supreme Court’s decision to reject a case brought by Pennsylvania Republicans to stop the state’s election certification is a cowardly response by the justices. It is the strongest signal yet that the Court has no intention of becoming enmeshed in the election outcome despite evidence of fundamental fraud. In a positive development for the state of Texas filed a suit against four key states including Georgia, Pennsylvania, Wisconsin, and Michigan claiming that these states conducted “unlawful elections” and arguing that the results are “unconstitutional.” The Court will likely consider that case and decision this week since cases brought forth by individual states are permitted to avoid lower court entanglements and be reviewed directly to the U.S. Supreme Court. The President has two additional strategies he is pursuing that are gaining traction. The first is the electoral college vote scheduled to take place on December 14th. If the president can convince enough electors from the states that fraud irrevocably impacted the race, he could prevent Joe Biden from securing the necessary 270 votes, and thus halting the election. A second path for the president to challenge the result occurs on January 6th when Congress takes up the electoral college vote and must certify it. If the president convinces enough state delegations that the election was marred by fraud, then the Congress will not certify the election. If he can favorably succeed in either instance, the president can still find a path to win the election. Hunter Biden reveals he is facing tax fraud investigation

Investigators are said to have been examining multiple financial crimes involving Hunter, including whether he and/or his associates violated tax and money laundering laws in business dealings in foreign countries, principally China. According to reports, the DoJ probe is said to have started in 2018. Was the Pennsylvania case dismissed to open the door for the Texas case?
Posted: 09 Dec 2020 02:54 PM PST For the last week, I’ve been telling people on my shows that I was annoyed by the Pennsylvania case hitting the Supreme Court first. It was the weakest case that I’ve seen, in my non-attorney opinion, but in being right about it I may have been proven very wrong. I assumed it would get kicked over timing, not merits. The merits of the case were strong but there’s no reason it should have been brought up after the election. Some have countered that you can’t file a complaint until the crime is committed, but this particular piece of legislation was constitutionally flawed from the start. There was no need to wait for the election to declare it unconstitutional. Now, I’ve been going down a different path. It seems I may have been right for the wrong reasons. It’s conspicuous that the emergency injunction request was kicked without accompanying comments from SCOTUS. They justify pretty much everything they rule for or against, so the fact they simply said no is interesting. That usually only happens when they have a future ruling possible that they do not want prejudiced by previous judgments. In other words, if you don’t want your words to come back to bite you, say nothing. Enter the Texas case. It’s a doozy. It essentially says the same thing, but from a national perspective that includes three other states. That’s big. Is it possible that the Supreme Court, having seen the upcoming case already docketed for Texas, chose to push the Pennsylvania case aside for the larger case to come forward? Yes, that seems very possible. I’m not saying that’s what happened, but it could make a whole lot of sense, as I detailed in the latest episode of NOQ Report. Whether the Pennsylvania injunction relief was denied to make room for the Texas case or not, many Trump supporters turn to the Supreme Court to get it right this time around. We wait with bated breath.

Violence-inciter Rep. Cynthia A. Johnson rebuked by legislature, stripped of committees

Johnson, who posted a viral video in which she called on “soldiers” to go after Trump supporters, has been stripped of all committee assignments. Speaker of the State House of Representatives Lee Chatfield also announced they were looking into further disciplinary action.
According to the press release, Speaker of the House Lee Chatfield and Speaker-elect Jason Wentworth today released the following statement on the video released last night by state Rep. Cynthia Johnson on social media: “Threats to either Democrats or Republicans are unacceptable and un-American. They’re even more unbecoming of an elected official. Rep. Johnson has been removed from her committee assignments, and we are looking into further disciplinary action as the proper authorities conduct their own investigations. “We have been consistent in our position on this—violence and intimidation is never appropriate in politics. We have said that about threats made against Gov. Whitmer, Secretary Benson, Rep. Johnson herself, and others. That applies to threats made toward public officials, and it must also apply when the threats come from public officials. American media ignores two deaths caused by Pfizer’s COVID-19 vaccine

And as to be expected, the American mainstream media is completely ignoring the inconvenient news and refusing to report on it. Article originally published at Natural News. It took The Jerusalem Post from halfway around the world to get the word out about the deaths, which were caused by Pfizer’s experimental mRNA jab – you know, the same one the company insists is very safe and effective. mRNA technology, by the way, is capable of reprogramming the human genome through DNA modification. It has never been used in humans until now. You can learn more about how it all works at this link. In an FDA Briefing Document entitled, “Vaccines and Related Biological Products Advisory Committee Meeting December 10, 2020,” the federal agency revealed that Pfizer’s experimental Chinese Virus vaccine, which was developed in partnership with the German company BioNTech, caused multiple “serious adverse events” in test participants. Both of the victims were over the age of 55, the reports explains. One suffered cardiac arrest 62 days after receiving vaccination #2, and died three days later. The other suffered atherosclerosis three days after vaccination #1, resulting in almost immediate death. Only one of these individuals was considered to be “immunocompromised,” suggesting that Pfizer’s experimental WuFlu vaccine is dangerous even for people who are considered to be healthy. The document was released ahead of an upcoming meeting among outside experts who will debate whether or not emergency authorization should be granted by the FDA to Pfizer and BioNTech for the “warp speed” release of the jab. According to the FDA, deaths resulting from COVID-19 vaccination serve as proof that the jab “works,” and will be considered as such when the agency grants emergency approval to the “Operation Warp Speed” medical intervention. The only types of people who may not be able to “safely” receive the vaccine are pregnant women, children and other “immunocompromised groups,” though this could change once more “research” is released to justify administering the jab to them, too. As it turns out, death is just one of many “serious adverse events” that can result from getting vaccinated with Pfizer’s Chinese Virus vaccine. There are 21 other potentially life-threatening conditions that can also result from getting jabbed, so beware. According to the company’s CEO, her boycott of the brand was the gift no one saw coming. When the House socialist vowed to stop buying Goya because Robert Unanue visited the Trump White House, he said his sales increased 1,000-percent! It was such a boon to business, Unanue chuckled, that the company gave her an honorary “Employee of the Month” award. Take that cancel culture! Of course, now that the joke is on her, AOC is trying to claim that she never led a boycott in the first place. Either way, her influence obviously isn’t as big as Democrats want to think is. As for Unanue, despite all of the media’s hounding, he’s never apologized for the work he did with the president or backed away from the positive comments he made about Trump. He had partnered with Barack Obama, he told reporters at the time, and never heard an unkind word. He had no intentions of letting anyone get under his skin for doing the same thing with his successor. “You’re allowed to talk good or talk praise to one president but… you make a positive comment, all the sudden that’s not acceptable,” Unanue shook his head. “If you’re called by the president of the United States, you’re going to say, ‘No, I’m sorry, I’m busy, no thank you?’ I didn’t say that to the Obamas, and I didn’t say that to President Trump.” The real winner of this standoff, though, isn’t just Goya Foods — it’s the American consumer. While Big Business is on its liberal high horse, embracing all kinds of social radicalism, the people of this country are sending a powerful message: their politics don’t sell. And if companies are foolish enough to keep pushing this extremism, shoppers will push back. As loud as they seem with their gang of Hollywood, Big Tech, the press, and Fortune 500, the far-Left is no match for millions of everyday Americans with conviction. The left, with their mobs in the streets and their media allies, stole the election and we all know it! Donald Trump and Mike Pence are fighting to stop the steal, just as they have fought so valiantly on everything that matters. I am sick and tired of hearing that millions of votes would have to be changed to change the results. Wrong! Changing a relatively small number of votes in Arizona, Georgia and Wisconsin would make it a tied election, which would be decided by the House of Representatives. It is disgusting to see Mitt Romney, Pat Toomey and others joining the left-wing mob that so desperately wants to end the Trump presidency. The Wall Street Journal recently gave part of its editorial page to the CEO of Dominion Voting Systems to spout his lies about how voting machines cannot be manipulated when expert after expert has demonstrated they can be. And that’s not even getting into the issue of whether Chinese financial interests in the company may be involved. I am doing everything I can to expose the fraud in this election and to stand with the president and vice president in this epic battle. I know you are too. Keep praying and don’t give up hope! Chinese Spies & California Democrats Fang frequently attended civic events, volunteered and worked for several California Democrats, including Rep. Eric Swalwell. She also used every trick in the book, including sexual relationships, to gather intelligence for her communist masters. According to Axios, the FBI “became so alarmed” by Fang’s connections with Swalwell that it gave him a “defensive briefing” to warn him that he was being compromised by a communist Chinese honeypot. And yet Swalwell was among the loudest voices on the left declaring that Donald Trump had been compromised by Russia, which was a total lie. But wait. . . It gets worse. Swalwell sits on the House Intelligence Committee. In 2015, he became the ranking Democrat on the subcommittee with oversight of the CIA. And he’s connected to a communist Chinese spy who placed interns in his office! Did Speaker Nancy Pelosi know about Swalwell’s “rsituation“? Did the FBI bother to tell her? And what is it about California Democrats and Chinese spies? Sen. rDianne Feinstein, who chaired the Senate Intelligence Committee during the Obama era, had a Chinese spy working in her San Francisco office for ten years! Leftist politicians like Nancy Pelosi, Chuck Schumer and Eric Swalwell have been tougher on President Trump for the COVID pandemic than they have been on communist China, which refuses to fully cooperate with international investigators seeking to learn more about the origins of the virus. Multiple attempts by congressional conservatives (here, here and here) to crack down on China have been blocked by Pelosi and the House leadership. Why? This I know with certainty: Swalwell and Feinstein are only the tip of the iceberg. (See next item.) China’s Friends It never seemed to matter which party was in power in Washington. The policy was always the same: China always got what it wanted. Of course, we know why: Our corporate and political elites were always on the same page. But thanks to recent comments by Di Dongsheng, vice dean of the School of International Relations at Renmin University, the extent of this sellout is crystal clear. Here’s how Di explained U.S./China relations in recent years: “The Trump Administration is in a trade war with us, so why can’t we fix the Trump Administration? Why, between 1992 and 2016, did China and the U.S., use to be able to settle all kinds of issues? No matter what kind of crises we encountered . . . We fixed everything in two months. What is the reason? “I’m going to throw out something maybe a little bit explosive here. It’s just because we have people at the top. At the top of America’s core inner circle of power and influence, we have our old friends. . . “For the past 30 years, 40 years, we have been utilizing the core power of the United States. . . Since the 1970s, Wall Street had a very strong influence on the domestic and foreign affairs of the United States, so we had a channel to rely on. But the problem is that after 2008, the status of Wall Street has declined, and more importantly, after 2016, Wall Street can’t fix Trump. . . “So during the U.S.-China trade war they [Wall Street] tried to help. And I know that, my friends on the U.S. side told me that they tried to help, but they couldn’t do much. . . “But now we’re seeing Biden was elected [laughter]. The traditional elite, the political elite, the establishment, they’re very close to Wall Street. So you see that, right? Trump has been saying that Biden’s son has some sort of global foundation. Have you noticed that? Who helped him [Biden’s son] build the foundations? Got it? There are a lot of deals in all these.” If you doubt Di’s comments for any reason, check out this recent Wall Street Journal article titled, “China Has One Powerful Friend Left In The U.S.: Wall Street.” It confirms that China’s vice premier went to Wall Street in February of 2018 seeking help from America’s corporate titans to rein in Donald Trump. Di’s comments also underscore the urgency of continuing the investigations into Hunter Biden’s dealings with communist China. Rep. Chuck Yeager: An American Original

by Newt Gingrich: The death of Chuck Yeager at 97 is a good time to reflect on his remarkable life – and on the nature of American Exceptionalism at the individual level. Yeager was much more than the test pilot who flew faster than sound for the first time. Yeager was an American patriot who graduated from high school and joined the US Army at the beginning of World War II. He worked hard and became an enlisted pilot trainee and then ended up flying in three wars. In World War II, Yeager was shot down and escaped from France into Spain (earning a Bronze Star for helping a fellow airman escape across the Pyrenees). After this heroic escape, he then appealed directly to Gen. Dwight Eisenhower – the Supreme Allied Commander and future President of the United States – for permission to go back into the war over Europe. Upon his return, he became an ace pilot, shooting down 11 1/2 planes (he shot one plane down with another American airman). There is one report in which Yeager shot down five enemy aircraft in one day on his way to becoming an ace. After World War II, he became a test pilot – which is arguably as dangerous as flying in war. But when war broke out in Korea and Vietnam, Yeager took to the skies and fought. In his career, Yeager went from high school to brigadier general. He was a product of an America which rewarded achievements over diplomas. Sadly, even in his lifetime this tradition was waning. When the astronaut program came along, Yeager was not eligible because he was not a college graduate. He could train them – but he couldn’t be them. By the 1960s, the triumph of academics over achievement was already beginning.
As an example of Yeager’s toughness and determination, the day he broke the sound barrier he was flying with broken ribs from a fall several days earlier. He had gone to a civilian doctor to avoid being grounded by the military. He was in such pain he could not close the hatch of the experimental jet (the Bell X-1) without help. A more timid person would have reported in unfit, and someone else would have broken the record. Somehow it is fitting that this high school educated West Virginian should be remembered forever as the first man to fly faster than the speed of sound. Yeager should be an inspiration to younger Americans. If you have the courage and the determination, you can accomplish many things – and you can have an amazing life doing it. Yeager exemplifies American Exceptionalism at the individual citizen level. We all owe him a lifetime of gratitude for his lifetime of service and courage on behalf of our country. Chinese Spy Story Shows Danger Of Beijing Gaining Influence

by Mike Huckabee: There’s so much developing news today, it’s hard to know where to begin. But one emerging story ties in with something we’ve mentioned, that video of the Chinese lecturer explaining that, were it not for Trump, they would be having their way via their friends at the highest levels in Washington. That story falls into the “shocking but not surprising” category. It’s chilling, if only because it seems so plausible at this time in our history. And today, we have another report , from AXIOS, about a political intelligence operation run by China’s main civilian spy agency between 2011 and 2015, during which they established and exploited “extensive ties” with local and national politicians, including Democrat Rep. Eric Swalwell of California, who sits on the House Intelligence Committee. AXIOS has been investigating this story for over a year. Of course, you remember Swalwell, the shill for the Democrat Party who repeatedly lied and accused President Trump of collaborating with Russia. Swalwell was about on par with Adam Schiff, in that he could always be depended on to go before the TV cameras and say ANYTHING, no matter how outrageous or demonstrably false. It got to the point where whenever his face appeared on the screen, I had to scramble for the remote and press “mute.” Life is too short. Beijing has obviously focused for years on gaining influence in U.S. political circles, and apparently has enjoyed quite a bit. As we see from the Chinese video, the election of President Trump was seen as their one big bump in the road. Things were going oh-so-well until he got elected. But they say that now, once again, they have someone in office that they can control—I mean, work with. I imagine the ChiComms were really depressed the night of November 3, when they saw Trump was easily ahead. But then, the next morning, after the vote had been suspended in several states and the count suddenly favored Biden, they were popping the champagne corks for a lovely celebratory brunch. (In related, breaking news, Rep. Ken Buck of Colorado, a member of the House Judiciary Committee, is calling for a special counsel to investigate Hunter Biden’s ties with China and the access this might have given China to the Obama-Biden administration.) As for this specific operative (SPY), a Chinese national whose name is either Fang Fang or Christine Fang, it appears her operation ended during the Obama administration, though China’s influence-expanding activities continue and are “a core focus for U.S. counterintelligence” (as they had better be). Fang reportedly targeted “up-and-coming” local politicians in the Bay Area and around the country, men who had “the potential to make it big on the national stage.” It’s easy to see why she might have targeted Swalwell, who doesn’t exactly come off as a rocket scientist but would relish the lights and cameras as a career launchpad. According to AXIOS, Fang gained proximity to power through “campaign fundraising, extensive networking, personal charisma, and romantic or sexual relationships,” including with two Midwestern mayors. A current U.S. intelligence official said that “there were some really, really sensitive people” caught up in this. I would presume this was a reference at least in part to Swalwell, as, again, he became a member of the House Intelligence Committee. Fang took part in fundraising activities for Swalwell’s 2014 re-election campaign, although, as a foreign national, she did not –– could not –- contribute herself. After that, she reportedly helped place at least one intern in Swalwell’s office. She also interacted with him at various events over several years. Swalwell wouldn’t participate in the AXIOS story; his office said he hadn’t seen Fang in “nearly six years” but had provided information about her to the FBI. This must be because around 2015, the FBI became alarmed at Fang’s activities and gave Swalwell a defensive briefing. He immediately cut all ties to her. She abruptly left the country in mid-2015, leaving acquaintances puzzled. We don’t know how involved Swalwell was with this woman. But what we do see from this story is how China –- like all governments that spy –- spends years cultivating relationships that might pay off even decades later. That appears to be the case here, as Fang first got to know Swalwell when he was a council member for Dublin, California. As AXIOS says, “The Chinese Communist Party knows that today’s mayors and city council members are tomorrow’s governors and members of Congress.” They play the long game. Even FBI Director Chris Wray, in July 2020, said Beijing “is engaged in a highly sophisticated malign foreign influence campaign.” These efforts involve “subversive, undeclared, criminal, or coercive attempts to sway our government’s policies, distort our country’s public discourse and undermine our confidence in our democratic processes and values.” As if that could get any worse. It would appear they’ve done their job, or at least are happy with what they see. But they’re just getting started. U.S. officials believe Fang was in the U.S. to gather intelligence and also “to influence rising U.S. officials on China-related issues.” China wants to be able “to sway the opinion of key decision-makers.” Fang apparently was being directed by China’s Ministry of State Security (MSS), the country’s primary civilian spy agency. Her main handlers are thought to have been in China. She was put under surveillance by the FBI’s San Francisco Division after being seen traveling around the country getting close to U.S. politicians. Around 2015, the FBI started giving “multiple defensive briefings” to warn local and national politicians who had been targeted by Fang. That’s when Swalwell cut off ties. “She was just one of lots of agents,” said a current senior U.S. intelligence official. AXIOS goes through numerous reasons why the Bay Area is such a good place for the Chinese to spy. One is that it’s the home of one of our nation’s oldest and largest Chinese American communities. They want to indoctrinate Chinese Americans just as they do the Chinese. Another reason that might not be so obvious is that Democrats run it. Those seeking power generally have to be from those circles. “Notice all the D’s next to their names,” says Jeff Dunetz for Lidblog. One Bay Area political operative noted that Fang positioned herself “to be the connector between the Asian American community and members of Congress.” Some described her as “charismatic” and “well liked,” while others thought her “secretive” and “suspicious.” Predictably, few professed to know her well, saying she didn’t talk about her family or hometown. But her Facebook friends list “is a virtual ‘who’s who’ of local Bay Area politicos, and includes city council members, current and former mayors, [California Rep. Ro] Khanna, and Swalwell’s father and brothers.” Again, all Democrats. Fang is gone, but there’s no telling how many Chinese nationals are in this country for the same purposes of spying and intelligence gathering, every one as singleminded as she was. But news is getting around now about Swalwell’s association with a Chinese “honeypot.” Considering his repeated lies about Trump and Russia long after those allegations were known to be false, any bad press Swalwell gets now, deserved or not, I chalk up to karma. Why We Can’t Let COVID-19 Lockdowns Become a Permanent Political Power Grab

by Ben Shipiro: This week, as Los Angeles County announced it would lock down all outdoor dining, a video went viral. That video featured restaurant owner Angela Marsden, proprietor of the Pineapple Hill Saloon and Grill, decrying the lockdown policy while pointing to the erection of production catering set up for a Hollywood shoot just a few feet away. “Everything I own is being taken away from me, and they set up a movie company right next to my outdoor patio,” Marsden said, adding that she has spent approximately $80,000 complying with the requirements of Los Angeles County, only to see it shut down her business completely. There is no scientific policy justifying Los Angeles County’s outdoor dining shutdown. In fact, during a Board of Supervisors meeting, a community member quizzed county health officer Dr. Muntu Davis on the evidence to support such a ban. Muntu provided no such evidence, likely because there is none. But those who want to run their businesses in a safe and secure fashion are being targeted nonetheless by a political class incentivized to pursue tyranny rather than rational policy. Los Angeles Mayor Eric Garcetti—who told police to stand down as rioters tore through his city during a pandemic—said that his “heart goes out to Ms. Marsden” and then added, “No one likes these restrictions, but I do support them as our hospital [intensive care unit] beds fill to capacity.” He explained, “We must stop this virus before it kills thousands of more Angelenos.” He did not explain why, if outdoor dining was so dangerous, Hollywood is still allowed to engage in it. That’s no surprise. Throughout the pandemic, one set of rules has applied to America’s most ardent lockdown advocates, and another set of rules has applied to everyone else. Los Angeles County Supervisor Sheila Kuehl voted to ban outdoor dining—and then went to an outdoor restaurant later that evening. California Gov. Gavin Newsom is currently locking down some 33 million residents, but had no problem eating indoors with members of the California Medical Association at the French Laundry restaurant. Mayor London Breed of San Francisco ate at that same posh restaurant the next day. Austin, Texas, Mayor Steve Adler told his constituents to “stay home if you can” in a Facebook video filmed from his vacation timeshare in Cabo San Lucas, Mexico, where he’d just headed with seven others after a wedding in Austin. Mayor Lori Lightfoot of Chicago got her hair cut and called it an “essential” business activity while promoting lockdowns. New York Gov. Andrew Cuomo told everybody to stay home for Thanksgiving and then announced he would be getting together with his daughters and his 89-year-old mother, only to then reverse himself. The message is obvious: Our intellectual and moral betters in politics are free to make their own rational calculations on COVID-19 risk. The rest of us are to be locked in our homes until further notice. When these political actors suggest that we must act out of an abundance of caution, they mean that they ought to enjoy abundance while benefiting from our caution. You and your family are capable of making the same decisions Cuomo, Garcetti, Newsom, Lightfoot, and Adler do. You should be careful. You should engage in social distancing, mask up when in close proximity with others, and generally avoid social gatherings involving those with preexisting conditions. But you can do all of these things and still live in a free society. Our politicians don’t believe that, because our politicians have seen how easily so many Americans were willing to indefinitely suspend their freedoms out of trust in our authorities. Until the incentive structures change, our freedoms will continue to be throttled by people who have no problem exercising their own. One need not be a COVID-19 skeptic in order to question whether the enthusiastic authoritarian streak revealed by those politicians can be curbed. The longer we tolerate it, the more our politicians will normalize their power grabs. Biden/ChiCom Collusion Is Threat Number 1

by Mark Alexander: “Enlightened statesmen will not always be at the helm.” —James Madison (1787) U.S. Director of National Intelligence John Ratcliffe has issued a dire warning for our nation and the future of American Liberty. And there is nothing hyperbolic about that warning.Beyond the devastation of the China virus, Ratcliffe outlined a Red China threat assessment I first heard in national security briefings dating back to the Clinton years. As our nation’s Cold War with the tyranny and terror of the failed Soviet communist regime waned, a new and equally ominous threat availed itself.Unlike the threat posed by Russia, however, which has countless nuclear weapons but a total economy smaller than that of Texas, the ChiCom threat is predominately economic — for the moment. Our national security and military planners have been ramping up our defenses against the ChiComs for decades, but the threat now is much better defined and much more formidable. And it’s closing in.Notably, that threat has been contained and in some instances set back by the economic gauntlet established by President Donald Trump. The administration’s policies have hit Xi Jinping’s communist regime, and that of his North Korean puppet dictator Kim Jong-un, hard.According to DNI Ratcliffe: “The intelligence is clear: Beijing intends to dominate the U.S. and the rest of the planet economically, militarily and technologically. Many of China’s major public initiatives and prominent companies offer only a layer of camouflage to the activities of the Chinese Communist Party. I call its approach of economic espionage ‘rob, replicate and replace.’ China robs U.S. companies of their intellectual property, replicates the technology, and then replaces the U.S. firms in the global marketplace.”Ratcliffe continued, “China also steals sensitive U.S. defense technology to fuel President Xi Jinping’s aggressive plan to make China the world’s foremost military power. U.S. intelligence shows that China has even conducted human testing on members of the People’s Liberation Army in hope of developing soldiers with biologically enhanced capabilities. There are no ethical boundaries to Beijing’s pursuit of power. … The FBI frequently arrests Chinese nationals for stealing research-and-development secrets. … The U.S. government estimates that China’s intellectual-property theft costs America as much as $500 billion a year, or between $4,000 and $6,000 per U.S. household.”Furthermore, as the DNI advised Congress, “This year China engaged in a massive influence campaign that included targeting several dozen members of Congress and congressional aides.”Indeed, just this week, details emerged of a sordid ChiCom affair between Demo House Intelligence Committee member Eric Swalwell and a Chinese honey-trap, Fang Fang. And, as we noted earlier this week, more than 1,000 ChiCom “researchers” have fled the U.S. since the FBI arrested a handful of Chinese spies last summer. The DNI concluded: “Beijing is preparing for an open-ended period of confrontation with the U.S. Washington should also be prepared. Leaders must work across partisan divides to understand the threat, speak about it openly, and take action to address it. This is our once-in-a-generation challenge. Americans have always risen to the moment, from defeating the scourge of fascism to bringing down the Iron Curtain. This generation will be judged by its response to China’s effort to reshape the world in its own image and replace America as the dominant superpower. The intelligence is clear. Our response must be as well.” The question, of course, is this: Will a government headed by Joe Biden and Kamala Harris be up to that challenge? Or will they dismantle the strong national security foundations laid by the Trump administration with China — as they will likely do in the Middle East? The answer: Of course Biden will fold. In the weeks before the 2020 election, one of the greatest frauds on the American electorate was the massive media cover-up of Biden’s ChiCom influence-peddling-for-profit scheme. It was the biggest corruption cover-up in election history, a clear case of collusion between the mainstream and social media, and their Democrat Party brethren. Despite three years of fake allegations that Trump was in the Kremlin’s pocket, the October revelations about the ChiCom links to Joe Biden, via Hunter Biden, are direct, and the allegations are verifiable. The evidence affirms that the “Big Guy” was picking Beijing’s pocket — but with its full knowledge and complicity, and an understanding that he would thus end up in China’s pocket. As Wall Street Journal editor James Freeman concluded ahead of the election, “Now the corruption story is about Joe, not Hunter.” But the story was subject to a media blackout like no other in American political history. To ensure that a Biden regime can’t completely put a lid on the rest of the Demos’ deep-state corruption over the last four years, Attorney General William Barr notified Congress that he has appointed U.S. Attorney John Durham as special counsel. This enhanced status will give Durham additional powers and protections, which will make it far more politically difficult for Biden to simply make the investigation disappear. But it remains to be seen if that investigation will advance into Biden’s ChiCom corruption. Make no mistake: The most forbidding existential threat to U.S. national security and our economy is Red China. Clearly, the ChiComs got the presidential candidate they bid on. Joe Biden and his leftist cadres of elitist pantywaists are not going to defend our nation against the greatest threat to Liberty in modern history. Gordon Chang, a noted legal and national security analyst specializing on the ChiCom threat, notes that the Red Chinese “are going to push a President Biden around. They’re going to do things which are dangerous because we are going to have to push back. Under President Trump the Chinese did not try this because they were afraid of him.” We’re on a kinetic-warfare collision course with China, because Biden is going to put us back on a course to lose the economic war with China. Becerra’s Catholicity Poses A Problem

by Bill Donohue: As pointed out in detail, it is indisputable that Xavier Becerra is a threat to life—at its beginning and at its natural ending—and to religious liberty. This alone is enough for practicing Catholics to be outraged, but given that he claims Catholic status, it spells grave danger.Like many Catholic politicians who rail against the most serious public policy positions of the Catholic Church, Becerra does not flag his Catholic identity, though he does roll it out when it suits him. For example, in 2013, when speaking in support of illegal aliens obtaining American citizenship, he said he was a “proud Latino of Catholic heritage.” In 2018, he sported his brilliance when he concluded that “maybe you don’t have to be Catholic to be a good person.”In other words, in the few times when Becerra has spoken about his religion, it has been done either to showcase his identity politics or to prove the banality of his thinking. There is no public record of him ever reflecting on how his Catholic upbringing shaped his life.If Becerra were to be confirmed by the Senate, he will surely do what he can to promote abortion-on-demand, with public funding, and to undermine religious exemptions.This raises a question about his boss: Why would Biden, another self-professed Catholic, want to appoint an enemy of the Catholic Church to the one cabinet post where he can do the most damage? The obvious answer is because Biden himself is at war with these Church teachings.This is nothing new for Biden. Consider who was the first HHS Secretary under the Obama-Biden administration: Kathleen Sebelius. She is responsible for the HHS mandate that sought to force Catholic non-profits to pay for abortion-inducing drugs in their healthcare plans. In short, she was the single most important person to crusade against the Little Sisters of the Poor, nuns whom Biden pledges to crush again (they won in the Supreme Court this past summer).Sebelius was never conflicted about abortion. Indeed, she was best friends with Dr. George—the Killer—Tiller, the man who, by his own admission, performed over 60,000 abortions, specializing in partial-birth abortions. He contributed mightily to her campaign when she ran for governor of Kansas. Moreover, Associated Press reported that Gov. Sebelius lied about the amount of money she received from him. Tiller knew that if he greased her, she would not interfere with his “profession.” He was right about that.In 2002, Sebelius described herself as “a practicing Catholic.” Four years later she said, “My Catholic faith teaches me that life is sacred. Personally, I believe abortion is wrong.” She said this immediately after she vetoed a bill that would have strengthened her state’s ban on late-term abortions. In 1992, when Sebelius was a state legislator, Archbishop Ignatius Strecker rebuked her for leading what he dubbed as a “death-march of the unborn.” When she became governor of Kansas in 2003, Archbishop James Keleher asked her to move her inauguration interfaith service from Topeka’s Assumption Catholic Church. She refused. Then Archbishop Joseph Naumann called her out, challenging her to name one instance in her long legislative career where she supported limiting abortion rights. She could not. He subsequently asked her not to go to Communion. Biden has been asked by some members of the Catholic clergy not to go to Communion. That was before he became even more extreme in his defense of publicly funded abortion-on-demand. Los Angeles Archbishop José Gomez, president of the United States Conference of Catholic Bishops, recently expressed his concerns about Biden’s views and his religious identity. He asked Detroit Archbishop Alan Vigneron to chair a special committee to deal with this issue. Now that Biden has picked Becerra to be his new HHS Secretary, continuing the legacy of the Obama-Biden administration’s record of choosing Catholics who are at war with the Church for this post, Vigneron, and all the bishops, have their work cut out for them. Biden has made his move. It is up to the bishops to make theirs—they are now in the Catholic equivalent of the Situation Room. President Trump is Defending the People, Democrats are Attacking Them

Daniel Greenfield: Democrats claimed that the 2016 election was stolen, Republicans say that the 2020 election is being stolen. But there is a fundamental difference in how they say the theft happened. The Democrats and their media have spent four years claiming that the 2016 election was tampered with through “disinformation”. Disinformation has become the latest media buzzword whose meaning is both ambiguous and menacing. Every opposing point of view, on any issue, is now labeled “disinformation” and falsely described as being a “threat to democracy”. Strip away the Orwellian buzzwords and what they are really saying is that the election was stolen because the voters had access to wrongthink and accordingly voted the wrong way. Ignore the actual merits of the proposition and compare it to the Republican argument. Republicans are saying that the 2020 election was stolen through systematic election fraud. They’re not saying that the election was stolen because people.had the wrong views. The proposed Republican solution to the election fraud is to verify the legitimacy of the vote while the Democrat solution to their claim of election theft was and is massive censorship. Republicans want to empower voters while Democrats want to disempower them. Democrats reversed the basic meanings of words and ideas. Hillary Clinton accused Facebook CEO Mark Zuckerberg of being “authoritarian” and “Trumpian” for saying, “our users can make up their own minds” when refusing to remove an unflattering Pelosi video. That’s the opposite of authoritarian. Legally, there are no such things as illegitimate ideas, but there are illegitimate votes. Republicans are addressing an election fraud by sorting legitimate votes from illegitimate ones, while Democrats want to fight what they say is election theft by sorting legitimate from illegitimate ideas. This censorship venture actually is authoritarian and unconstitutional. Republicans want to count every legal vote, while Democrats want to count every illegal opinion. When President Trump calls for counting all legal votes, he’s defending the rights of the voters, but when Hillary Clinton and Democrats attack speech, they’re attacking the Bill of Rights. Distinguishing between legitimate and illegitimate votes is fundamental to representative government. When ballot harvesters hand out gift cards, as they allegedly did in Nevada, when massive amounts of ballots appear in the dead of night and are never properly verified, when drop boxes and voting machines vulnerable to fraud are used, then the power of the voters to choose their representatives is undermined, not by other voters, but by Democrats. That’s not an election: it’s an authoritarian system that elects its own leaders. Verifying the integrity of the vote is a fundamental function of government because its legitimacy rests on free and honest elections. When one party or another challenges the integrity of an election, it’s not attacking the people, but holding the system that serves them accountable. Democrats and their media have responded to President Trump’s claims of election fraud by describing it as “disinformation” and an “attack on democracy”. Media outlets have cut off speeches and statements by President Trump and his associates about the election fraud, and tech monopolies have censored claims by President Trump and other conservatives. This is not a “defense of democracy”. It’s the response of an authoritarian system to political dissent. A free system doesn’t fear verifying the integrity of an election because it has nothing to hide. It doesn’t seek to disbar lawyers who sue over election results, and it doesn’t censor elected officials and private citizens who raise questions about it, let alone call for their arrests. Verifying ideas is an illegitimate and unconstitutional function of government. It is so entirely unconstitutional that the First Amendment was designed as a rebuttal to that entire notion. “It’s imperative that leaders from the private sector and the public sector step up to protect our democracy and innocent lives,” Hillary Clinton ranted, urging a fight against “disinformation”. Our republic, and for that matter no democracy, is threatened by disinformation. It can be threatened by bad and evil ideas, but free societies don’t police ideas, they police crimes. The Democrats have endorsed police defunding and no longer want to police crimes, just ideas. George Orwell’s Ministry of Truth in 1984 was based on the real Ministry of Information whose goal was to dispense propaganda and enforce censorship. The modern UK set up the National Security Communications Unit to combat disinformation in “an era of fake news and competing narratives”. Treating “competing narratives” as a national security threat is how you get 1984. Or the Democrat claims that the 2016 election was stolen because they lost the argument. Democrats or Republicans have every right to challenge the integrity of an election because elections are a legitimate function of government. They have no right to regulate ideas, as Senator Elizabeth Warren and Hillary Clinton have urged, because ideas are not a legitimate function of government. Governments serve the people through elections, not ideas. There’s no room for a Ministry of Information or a Ministry of Truth in America. In the fight for the last two presidential elections, as in all things, Republicans and Democrats have maintained their respective polar philosophical differences over the role of government. Democrats responded to losing in 2016 by trying to police the people, while Republicans are fighting in 2020 to police the government. Republicans believe that elections are undermined by the government, while Democrats believe that elections are undermined by the people. At the heart of the question is the same debate over the relationship between the people and the government. The Democrats run for office to reaffirm the central role of the government and attribute their losses to an unruly public that needs to learn its place, while Republicans run for office to affirm the central role of the people in limiting the power of the government. And they blame their losses on the government, whether it’s the ‘deep state’ or corrupt officials. President Trump is right to question the role of the government in this election. And, more importantly, whether he’s right or wrong, he is within his rights to do so. As are we all. But Hillary Clinton and Democrats were never within their rights to question the role of ideas in elections. When President Trump challenges the integrity of an election, he’s fighting for the rights of the voters to have their votes legitimately counted. But when Hillary Clinton or Elizabeth Warren call for a crackdown on ideas, they are proposing to have the government repress the people. Those are the ultimate stakes in this election fight and in our political system. People elect governments. Governments do not elect people. The public has the right to question, challenge, and denounce the government. But the government has no right to tell the people what to think. It is a dangerous thing for the government and its allies to tell the people that they have no right to question an election or that they have no right to their opinions. But in 2016 and 2020, that was and is the Democrat position. In 2016, when the Democrats lost, they said that the people had no right to have the wrong sort of opinions. In 2020, they insist that the people have no right to question an election. And that is why it must be questioned. Free countries remain free when people challenge the government. When they don’t, elections and opinions stop mattering. President Trump’s ongoing campaign for the integrity of the election upholds our nation’s highest principles of freedom and helps keep us all free. Chaos Upon Chaos

Therefore, it’s not surprising that Victor Davis Hanson wrote about “A Time of Chaos Upon Chaos atop Chaos.” And he wasn’t even talking about the chaos of the pandemic and lockdowns. He focused merely on the political chaos we have endured for months. He is more optimistic about our future than most of us might be. He opens with the statement, “America will weather its current hysterias.” I’m not so sure. The political landscape has given us the Steele dossier, charges of Russian collusion, an impeachment of a sitting president, weaponization of FISA courts and the FBI, CIA, and Justice Department. And all of that happened before the election and the current claims and counterclaims about election interference. He also talks about the media that “poorly prepared the nation for their envisioned Biden presidency. To foster that agenda, journalists have done enormous damage to the country.” Just looking at the bias now being uncovered from social media platforms in Silicon Valley should be enough to understand his concern about how this bias will affect our future. He also notes that “Joe Biden was never fully vetted. Rather, he was protected and sheltered by the media.” We will now see “whether he is cognitively up to impromptu press conferences, 18-hour days, tough negotiations with opportunistic foreign leaders, and the demands of traversing the country to rally both the country and his party adherents.” I might also add that since he was never fully vetted, even people who voted for him aren’t exactly sure what his agenda will be next year. Many are already expressing surprise at some of his proposed cabinet picks. How will he deal with China? Will he try to ban fracking and embrace the Green New Deal? We really don’t have good answers to such questions, because the media failed to do its job in this last election. Will Biden Give in to the Hydroxy Effect?

by Dr. Victor Davis Hanson: There is as yet no known, easily accessible cure for COVID-19.Over the past year, lots of old and new drugs and supplements — Ivermectin, azithromycin, Remdesivir, hydroxychloroquine, vitamin D, vitamin C, zinc, aspirin, Pepcid and others — have shown at least some anecdotal value in ameliorating the effects of early-stage COVID-19. Clinical physicians treating patients in hospitals often disagree with the research scientists conducting trials on the efficacy of all these treatments.Yet only hydroxychloroquine has prompted furious partisan debate over its possible usefulness. Why?Probably because Donald Trump endorsed its usage months ago.Almost immediately, the media, the university and government medical community, and the progressive political opposition declared hydroxychloroquine useless and dangerous. A recent media study from the National Bureau of Economic Research found that positive news stories about the research and development of COVID-19 vaccines barely outnumbered negative stories about Trump and hydroxychloroquine.Trump’s presidential endorsement was apparent proof of rank quackery. Yet a few recent second-look studies, especially abroad, suggest that hydroxychloroquine, a dirt-cheap, time-tested anti-malarial drug, can in fact offer help in treating some cases of COVID-19.This “Hydroxy Effect” — hysterical disavowal of anything Trump has endorsed — is dangerous to the country at large.Trump was reviled for his early condemnation of China’s role in the COVID-19 pandemic. He railed against the “China virus” — a traditional eponymous branding of a virus by its place of origin, and in this case one used by other media before Trump’s adoption of the sobriquet. Trump alleged that Chinese officials knew for months about SARS-CoV-2, the virus that causes COVID-19, before letting on about the dangers the disease posed to the world at large. No matter. Anything Trump said had to be resisted. The Trump travel ban, the Trump accusations of China’s corruption of the World Health Organization, and other Trump criticisms of China were all ridiculed as proof of his racism or intellectual puerility. Now, after the 2020 election and the apparent victory of Joe Biden, we learn from the media that in fact the virus had spread much earlier than China had admitted. The utility of travel bans is now a part of scientific consensus. And the leadership of the WHO remains under criticism. Before 2016, the consensus on China was that it was destined to take over the world. This was the establishment’s de facto defense of profiting-making by outsourcing to China. The conventional wisdom ignored Chinese violations of commercial trade norms and theft of technology and intellectual property. It largely dismissed the complaints of human rights activists who were appalled by China’s re-education camps, its suppression of political and religious freedom, and its extermination of Islamic and Tibetan culture. Now, pushback against Chinese imperialism, authoritarianism and global bullying is a bipartisan consensus — as long as Trump is not cited as the voice-in-the-wilderness stimulus for such a reset. This Pavlovian Hydroxy Effect poses a challenge to Biden. Logic dictates that Biden would not scrap the framework of an effective containment policy of expansionist China. Pacific nations such as Australia, Japan, South Korea and Taiwan appreciated Trump’s efforts to corral China. America’s empty “Asian Pivot” of the past has become real in leading resistance to Chinese bullying. Logic suggests that Biden would appreciate inheriting a more stable Middle East, with Arab states and Israel increasingly united against the theocracy in Iran. The emerging alliances seem tailor-made to allow Biden to take credit for still more Arab nations recognizing Israel — with both parties investing in the West Bank to offer Palestinians economic parity with surrounding states. Logic dictates that Biden would recapture the lost Democratic working class by mouthing Trump economic agendas without mentioning Trump’s creation of them. Fair (rather than just free) trade, border security, deregulation, tax incentives, and unprecedented gas and oil production all created near-record middle-class wage growth — a formerly Democratic staple issue. So Biden has two choices. One, he can appropriate many of the Trump successes. He can rebrand them as his own and quibble over particulars. Do that, and Biden would likely see a huge post-COVID-19 economic recovery, a stable Middle East, a world united against China’s commercial abuses and human rights travesties, beefed-up U.S. defenses and a refreshed NATO. Or two, Biden can suffer the Hydroxy Effect. Anything Trump was for, Biden and the left will be automatically against. That would mean a decision to allow unchecked immigration. Freeze construction of, or even tear down, the border wall. Lift tariffs on China. Let NATO members pay as little as they like. Ban or cut back on fracking. Rejoin the Iran nuclear deal. Rejoin the Paris Climate Agreement. Polarize Israel and its new Arab allies. Fast-track the Green New Deal. Raise taxes sky-high. Let the Rust Belt rust. Allow Big Tech to do as it pleases. Adopting the Hydroxy Effect and junking anything with a Trump fingerprint on it will please the hard-left Biden base. Rejecting it will benefit the country. Arizona Voters Continue to Fight
Posted: 09 Dec 2020 03:13 PM PST Rick Manning: I visited America on Monday, attending a rally at the state capitol in Arizona featuring well over a dozen currently and newly elected state legislators. It was awesome. In the Washington, D.C. area, everything is so locked up and buttoned down that it is almost as if people speak in hushed tones, the acquiescent silence only broken by the never ending media outrage that President Trump expects an honest examination of the past election. An election where the laws were arbitrarily changed to benefit Joe Biden in Pennsylvania, Michigan, Wisconsin and Georgia. Where voters in rural and suburban areas were subjected to significantly more restrictive rules than those in urban areas when it came to the treatment of their mail-in ballots. Where election observers were not allowed into counting facilities, thrown out when they objected to clearly illegal activity by election officials. Where observers were sent home under false pretenses only to discover that the non-observed counting resulted in a massive vote swing to Biden. I don’t know about the rest of the country, but in Phoenix, Arizona, the people are, shall we say, more than a little bit irritated. In fact, Joe Biden was not the most unpopular man to the crowd. That distinction goes to Arizona Gov. Doug Ducey, who has failed time after time to push for an honest count in the state. Ducey refused to acknowledge and sufficiently respond to the results of a ten-hour hearing held by legislators looking into election abuses in the state acting as if the mountain of evidence didn’t exist. The incredible part of the event were the state legislators. They were on fire – time after time referencing the voting irregularities particularly in Maricopa County which accounts for 60 percent of the registered voters in the state. Men and women from all over the state providing impassioned, patriotic speeches simply demanding answers and for the Governor and Speaker of the House to take action to ensure that the wrong electors were not certified to vote in the Electoral College. Honest people just trying to represent their constituents who are demanding that Arizona’s voter count be fair and honest. One legislator put it very succinctly when he pointed out that Gov. Ducey was at one time the CEO of Coldstone Creamery and if he found that the most important store, which the company depended upon for survival, suddenly had a glitch which caused it to give away thousands of scoops of ice cream for free, he would have certainly forced an audit on that store to find out what happened. He pointed out that irregularities with the counts in Maricopa County demand the same kind of forensic audit that a company would conduct to find out what went wrong. And this might surprise some readers, but the crowd and legislators were not necessarily pushing for Arizona’s eleven Trump electors to be certified, but instead for the decertification of the Biden electors. With the inability to determine who won the state, the general consensus was that the state should not certify electors at all, out of fairness to voters on both sides The crowd itself was loud and some of the non-legislator speakers did not engage in polite speech, and the opportunity to be a small part of the rally was invigorating One speaker’s family had escaped China when the communists took over. At first to Taiwan and then to the United States, until he landed in Arizona after more than 30 years in a rapidly deteriorating San Francisco. He issued a clarion cry for liberty directly from the mouth of someone who’s family escaped oppression. One woman who was hanging toward the back of the crowd holding her American flag admitted that she feared for her country because if the election could be stolen, and the politicians and courts would not do anything about it, what was left. In that short conversation, she laid out why we still fight. Why I got on a plane to go to Phoenix for an afternoon. Why so many state legislators are putting their careers on the line, why the Attorney General of Texas is suing states whose state officials changed their election laws without going through the normal legislative process. At this point it matters less who won or lost, than for the votes to have been tallied and counted fairly. If hard working American taxpayers lose faith in the legitimacy of the government, America fails. In Phoenix, Arizona, citizens and state legislators continue to battle for the precious concept that the consent of the governed matters. An American Education in Freedom

If you had gone on to tell me that I would possess a concealed-carry permit, that I would own an AR-15—actually, make that three AR-15s, all of which I built myself—and that I would be a steadfast champion of the Second Amendment to the United States Constitution, I would have thought you had lost your marbles. I grew up in England, where such things were not only prohibited but considered extremely strange. Even though I loved America, I, too, thought its attachment to the right to bear arms was a relic and a curiosity, driven by eccentrics. And then two things happened. While studying the issue in college, I learned that the claim that the Second Amendment protected a “collective right”—a claim that was much repeated in England—was an outright lie that was contradicted by all the available history. And then, while visiting the United States in 2005, I was taken to a gun range by a friend and taught how to use a pistol. Together, these experiences changed everything. Having spent some time around people who understood firearms, and who were determined to treat them appropriately, I could see how wrong I had been. Contrary to the stereotypes I had been sold, the friend who took me to the range was entirely normal. And so was everyone else there. They were white, black, Hispanic, Asian and more—from both major political parties—and all of them were helpful. The image in England was of Yosemite Sam. But these were responsible people from all walks of life who were keen not only to teach me what they knew, but also to convey to me the awesome responsibility that comes with picking up a gun. “This is not a toy,” one guy said. I didn’t think it was, but his seriousness impressed me nevertheless. My friend only had one firearm with him, but that didn’t matter, because, having learned that it was my first time shooting a handgun, everyone else there let me shoot theirs, too. By the end, I had tried 10 or 11 different models. I shot at neon targets and pictures of zombies. I was shown how to hold the guns, how to load them, aim them and control them, and, later on, how to clean them. It was an education. Silly as it may sound, until that day, I had absorbed as if by osmosis the idea that guns had a life of their own—especially handguns, which were uniformly banned in Britain. Having spent some time around people who understood firearms, and who were determined to treat them appropriately, I could see how wrong I had been. In the car on the way back from the range, my friend explained to me how frustrated he was with the rules in the state in which he lived, which, at the time, prohibited him from carrying in most circumstances. “As you can see,” he told me, “I train with my gun and know how to use it. I’m happy to apply for a license. I have no criminal record. Why am I denied the chance to protect myself?” At most points in my life, this would have sounded ridiculous to me. But it didn’t sound ridiculous anymore. Back in England, I had already accepted that the Second Amendment applied to my friend, not to some abstract government-led “militia.” Now, I could see why. What ill could come from the people I had just met owning or carrying their guns? They were not the problem. And neither was I. The Night the Rights Went out in Georgia

A lot of people don’t remember, but the seeds for this election mess were planted way back in 2018 when Democrats won the House. The coronavirus didn’t hurt, of course, but the cheat was on long before Joe Biden was nominated. Why does that matter? Because — the president’s attorneys warn — if Republicans don’t keep fighting, the damage to our democracy is here to stay. Liberals are getting restless. The media is impatient. Even some Republicans, men and women who believe there was legitimate fraud, want the White House to throw in the towel and move on. Why don’t they? Because at the end of the day, this isn’t about the presidential election. It’s about the sanctity of American law. We aren’t just talking about Pennsylvania’s law or Georgia’s law — but the power of every state legislature to pass laws with the expectation that they will be upheld. Right now, elected leaders in state legislatures can’t even perform their most basic function without other state officials and courts overruling them. That’s not how democracy works. So when the Left tells everyone to “move on,” they aren’t pressuring us to give up on Donald Trump — but our entire constitutional system. Americans have laws for a reason, and when they’re violated or ignored, it should concern everyone. Trump attorney Cleta Mitchell, who’s had her eyes on the Left for two years, knows the game plan. As far as she’s concerned, the 2020 election has been a coordinated sabotage since the earliest days of the new Congress. “Don’t forget,” she said on “Washington Watch,” “H.R. 1 — the first bill taken up by Nancy Pelosi when the Democrats won control of the House in 2018, was a massive election bill that would have provided for [this mail-in balloting] everywhere in the country.” Of course, as usual, the Democrats couldn’t accomplish any of their radical election plans democratically. So they started filing lawsuits to sue their way to an absentee system that would open up new avenues for manipulation. “Even in 2019,” Cleta points out, “they started [suing]… in Mississippi, Louisiana, cases in practically every state… [They] spent literally hundreds of millions of dollars (it might not surprise you to learn that George Soros funded it, [and] Marc Elias [of Russia-gate fame] managed it.” The strategy was to get judges to “adopt laws — quote unquote — or orders that basically threw out the duly enacted laws of the state legislatures,” Cleta explained. Then the coronavirus hit, and it was the perfect storm for the Left’s stalking horse: rewriting election laws that would undermine the election safeguards and ballot integrity the states have in place. Even Georgia Secretary of State Brad Raffensperger (R), Cleta said, when he was sued by Stacey Abrams (D) capitulated. “Instead of fighting them, saying, ‘I have no authority, and the judge has no authority to change the law — that’s the legislature’s responsibility,’ he ended up settling with them and entering a consent decree.” And you and I both know, she shook her head, “what happens to Republican officeholders when they decide that they like to be loved by the media and the Left. It’s not good for conservatives.” And, as we’ve seen, it’s not good for the process. For the time being, there’s at least a very compelling case in Georgia. When it comes to fraud, people keep asking, “Where’s the evidence?” Well, as the Trump campaign said in its filing on Friday: here it is. Their court petition has more than 1,000 pages of sworn testimony and nearly 100 affidavits — signed under penalty of perjury. “There’s nothing in this lawsuit that is not backed up by either a sworn affidavit by an eyewitness as to a violation of a Georgia election code or a declaration by an expert who has analyzed the Georgia state election and voting records.” It would be difficult for Raffensperger to read the petition and not understand that there are tens of thousands of illegal votes — “more than enough [to make up the margin of victory] that should be thrown out,” Cleta argues. “That’s what’s so remarkable here…” Cleta went on. “Several of these violations — just taken by themselves — would be three to four times the number required to invalidate the election. [It’s] all in there. So… I will guarantee that the secretary of state, the number one defendant, has not read the analysis of his own data.” But whatever anyone says, she argued, “this election was not valid. Those results are not valid. And the secretary of state has a lot to answer for in my opinion.” Her concern, like a lot of voters, is that these issues need to be cleaned up before the Senate runoff elections. The courts and certain state officials helped the Left undermine election laws, and the legislature needs to assert itself to make sure that a) that doesn’t happen again, and b) that it doesn’t affect January 5th. When almost 40 percent of the country thinks November 3rd was a rigged election, the last thing Americans need is to have the Senate thrown into the same limbo. ‘Gravely Disappointed:’ 14 Fort Hood Leaders Fired, Suspended in Wake of Vanessa Guillen Murder

by Matthew Cox: In one of the most sweeping responses to command climate problems in recent memory, Army Secretary Ryan McCarthy announced today that he has relieved or suspended 14 leaders at Fort Hood, Texas, in the aftermath of Spc. Vanessa Guillen’s disappearance and murder earlier this year. Maj. Gen. Scott L. Efflandt, deputy commanding general for Support at III Corps, Col. Ralph Overland and Command Sgt. Maj. Bradley Knapp, the 3rd Cavalry Regiment commander and command sergeant major, have been relieved of command, according to a separate Army statement. All were among the leaders identified in an independent review launched after Guillen’s death and made public today. The review included nine findings and 70 recommendations addressing major flaws in the Army’s Sexual Harassment and Assault Response Prevention (SHARP) program at Hood, as well as a “command climate at Fort Hood that that was permissive of sexual harassment and sexual assault,” McCarthy told defense reporters at the Pentagon. “I have determined the issues at Fort Hood are directly related to leadership failures,” McCarthy said. “Leaders drive culture and are responsible for everything the unit does or does not happen to do. “I am gravely disappointed that leaders failed to create a climate that treated all soldiers with dignity and respect.” Following Guillen’s murder, which family members have said came after she was sexually harassed at her workplace, Army leaders have had to appear before Congress multiple times to answer for the tragedy. Many have expressed outrage, and some Army recruiters in Texas have reported encountering hostility and anger from those who’ve heard Guillen’s story. by Dr. Victor Davis Hanson: America traditionally has not reinvented reality after an election, although prior presidential winners have often tried, as in the fashion of our politics. But the new powers of social media, Silicon Valley, and a woke media have made reality-changing now a reality. Suddenly Antifa and BLM have all but disappeared from their heroic barricades. Where and why did they go? Did they ever really exist? Mysteriously, a week or two before the election, the flood of violence in our major cities began downsizing to a tiny trickle. How strange that former angry throngs are now in nearly suspended animation. Are all those black kneepads, helmets, and umbrellas now in closets? Are all those whiny Pajama Boys on the barricades back teaching in their Zoom classrooms, or taking their college Zoom classes in their parents’ basements? What changed? What in the world convinced committed revolutionaries to cease their long march to revolutionary justice? Did COVID-19 suddenly remind them that shouting in the faces of others, mocking social distancing, marching in tight phalanxes, shunning hand cleansers and mass mask-wearing were dangerous — although such activities had apparently been safe and even good for civic health while protesting a few weeks before? Was newly found social responsibility the reason that the looting, arson, destruction, and defacement went into hiatus? Is the calm — along with the 90–95 percent “turnout” in the major swing-state cities — the bargaining chips by which the Left claims responsibility for the Biden “win”? And just as suddenly, the evil elixir hydroxychloroquine is in the news again — but this time not as more proof that Trump indulges in conspiracist quackery to force down your throat everything from bleach to lethal, heart-stopping, antimalarial drugs. Abruptly, a few studies, especially from abroad, in the past month “suggest” that hydroxychloroquine could be efficacious in treating and ameliorating the symptoms of early COVID-19 illnesses—and at the egalitarian cost of about 7 cents a pill. Who knew that the destitute of India and Africa suddenly are attesting that the cheap and available medication has somewhat slowed some of the lethal manifestations of the coronavirus? What happened to rehabilitate this old drug — whose advocacy recently had become synonymous with career destruction and that “science” condemned as worthless in treating COVID-19? Was there worry this December that thousands worldwide might have been sickened or might have died from not considering its medical efficacy in early stages of the disease? A media study just released from the National Bureau of Economic Research found that over the past year news stories about Trump and hydroxychloroquine (overwhelmingly negative in tone) were more numerous than all stories combined that reported on the research and development of all the COVID-19 vaccines. Speaking of COVID-19, has CNN had a sudden change of heart about “China bashing”? Why are the media now reporting that the Chinese were duplicitous in misleading the world about the much earlier origins of the virus and its contagiousness? Does this new post-election realism mark another mysterious change from the old edict of “Trump bashing the Chinese” to “President Biden soberly and judiciously cracking down on egregious Chinese behavior”? Why a few days after November 3 were vaccines suddenly in the news, with praise that they are now safe and efficacious, and that even Joe Biden and Kamala Harris have dropped their pre-election suspicions of the jabs? Was news of their safety and utility a late-breaking discovery of the first week of November? We, of course, had been winked and nodded by Pfizer that in early September important announcements would be coming in late October — in part because Pfizer was becoming afraid that the denigration of the vaccine by Kamala Harris and Joe Biden (who wished to discredit the efforts of Operation Warp Speed) might harm its rollout? And yet, Pfizer, this past summer, told neither the media nor the president of the United States about its ongoing progress with the vaccine but instead, strangely, contacted the Biden campaign. A few days before the election, Pfizer announced it would not announce any success pre-election, so as to avoid playing Election Day politics — all so that it could play politics a few days afterwards by boasting that indeed millions of doses were soon on the way to the American people. How miraculous that a vaccine that was the culmination of nine months of nonstop work was abruptly declared still experimental, with no specific date in sight for its approved roll-out; and yet, about three weeks later, it was transmogrified into a safe, effective, and life-saving remedy. It was almost as if Pfizer were claiming — after taking millions in Trump-administration funding guarantees for logistics, and exemptions from legal liability for their multibillion-dollar risk — that they, well, had never been a part of Operation Warp Speed after all. Or were they? Sort of? It depends? Lockdowns? Amid a late-fall spike that has hit the Western world hard, why suddenly is there renewed national dialogue about the damage done by closing schools, businesses, and commerce? Did the national consciousness in early November abruptly decide that COVID-19 versus quarantines was a lose/lose situation, or is it that President-elect Biden will single-handedly soon be responsible for every COVID-19 fatality? Is it now in retrospect wrong to tag any president with 100 percent culpability, since others might begin in late January blaming a Typhoid Joe for each coronavirus death, a Hoover Joe for each closed business, and a Bull Connor Joe for each accusation of local police excess? Hold on: Perhaps in late January we will learn that COVID-19 deaths were in the past somehow improperly calculated, given lethal comorbidities — suggesting perhaps that many patients die with the coronavirus rather than solely because of it? Will we learn that case numbers are, well, subject to interpretation, given that the better indicator of lethality rates suggests that people younger than 70 who catch the virus have a 99 percent-plus survival rate? And will our late-January COVID death tolls be more or less similar to those in Europe, suggesting an effective, collective, and unifying Biden amelioration? Will our new Biden-approved COVID-19 advisers now come from a range of disciplines, rather than being faulted for not strictly being a virologist or an epidemiologist? After all, oncologist Ezekiel Emanuel, a Biden pandemic consultant who will be advising the nation on a contagious disease that is most lethal to those over 65, in the past had declared that people older than 75 were mostly superfluous. He has vowed to skip his own medical care when he reaches that nearly terminal age, given the comorbidities that make mid-septuagenarians marginalized. Are these perfect credentials to adjudicate COVID-19 care for our vulnerable elderly? Unity and brotherhood have magically sprouted. What happened to Biden’s condemnation of Trump supporters as “ugly folk” and “chumps” and “dregs”? On November 4, did we suddenly realize that these pejorative terms were really ones of endearment, part of Joe’s ecumenical calls for “unity” that is to end the nasty “divisiveness” for those who for years have tossed around the repugnant slur of “Nazi” and worse? Who knew that unproven voting machines, early voting, and mail-in voting were vital proofs of our confidence in democracy? Were we not told by Elizabeth Warren and warned by foundations and universities in 2019, after the “hacked” 2016 election, that computers would be unsecured, and that valid ballots required signatures and addresses and witnesses? And then suddenly in November 2020 — not so much? Is Jill Stein now a saint or demon to have sued — into December 2016 — Michigan, Wisconsin, and Pennsylvania to overturn their recorded votes? Was it still legitimate, à la Hillary Clinton’s recent advice to Biden to “never” concede a presidential election “under any circumstances” — or was Hillary too a threat to the republic? Will the Trump “recession” and “depression” suddenly in a few more weeks become an astounding “recovery” or even the “Biden boom” after the “Biden vaccine” ends the “Trump lockdown”? And can we return to media normality again, when reporters cease attacking the president but instead legitimately question the commander in chief about the existential issues of the day, such as Joe Biden’s favorite socks or milk shake, or why is he not showing even more anger at — Donald J. Trump? Or why and how he controlled his temper so masterfully when provoked by — Donald J. Trump? Or can he repair the global damage wrought by — Donald J. Trump? Or what does Biden think about the future of the soul — of Donald J. Trump? When did special counsel go from deified to expendable? Sometime in early December 2020, when John Durham was rebranded as such? Is all praise of the idea of a Mueller special counsel erased, replaced by new slogans on the barnyard wall to the effect that special counsels are merely highfalutin hired partisan guns who should be summarily dismissed? Given Joe Biden’s mental robustness and sharp-as-a-tack repartee, it will be nice again to have no more conspiracy theories floating about the cognitive disabilities of the commander in chief — no demands for the president to take the Montreal Cognitive Assessment Test, no Ivy League psychiatrists diagnosing as nuts a person whom they have never met or talking about interventions to remove the demented president by force. It will be nice not to have to guess what remedies the non-transparent president is taking for his infection, or his cholesterol, once the new chief executive is an open book about his medications. Likewise, it will be a relief to hear no #MeToo accusations about our president, no stories of prior sexual assaults, no fights over whether “every survivor” has the “right to be believed,” no female alleging a past presidential sexual “incident.” As the world turns post-November, so do policy realities. Did Donald Trump really make a mess of the Middle East — one that can be cured by lifting sanctions on Iran, reentering the Iran deal, and resuscitating the funding of Hezbollah terrorism? Or will we hear that the Biden plan alone has enticed Saudi Arabia to recognize Israel? And will the Biden plan subsidize, refresh, and re-empower Hamas and the Palestinian Authority to ensure they are central to a Mideast peace? Or will Biden’s team shrug that the Palestinians are “essential” and then more or less do what Trump did? Is Vladimir Putin still the evil colluder, enemy of all human decency, or is he to be rehabilitated by a liberal reset 2.0, given that Joe Biden “understands Putin” and thus forges a new “correct” partnership for peace with Russia? Do we now have sudden “allies” and a new “multilateral framework” in which NATO partners finally — either in fear of Mighty Joe Biden, or in reference to his Old Joe from Scranton decency — pony up their 2 percent of GDP contributions to NATO defenses? Or will it be wiser to accept that it is our sacred duty to protect rich NATO allies and let them worry about what they wish to contribute to their own defense? In our brave new media/Silicon Valley world, we are rebirthing post-November realities and truths. The past is being erased or refabricated. A 2020 Election Redo in 4 States? Here Are the Details About Texas Lawsuit

by Hans von Spakovsky: If Texas has its way, the 2020 presidential election won’t be over soon. The state of Texas has filed an unprecedented motion with the U.S. Supreme Court, asking for leave to file a complaint with the court against the states of Pennsylvania, Georgia, Michigan, and Wisconsin over the 2020 presidential election. The motion alleges that changes made in election rules governing absentee ballots in those states by “non-legislative actors” violated the Constitution and “cumulatively preclude knowing who legitimately won the 2020 election and threaten to cloud all future elections.” In a nutshell, Texas is saying these four states’ elections were unconstitutional—and therefore, invalid. The Lone Star State’s complaint, filed by state Attorney General Ken Paxton, asks that Georgia, Pennsylvania, Michigan, and Wisconsin conduct new elections to determine their electors for the Electoral College. The motion filed by Texas includes the 41-page complaint and a 35-page brief making the legal arguments for why the Supreme Court should grant approval of the filing of the lawsuit, since Article III, Section 2 of the Constitution gives the Supreme Court—not lower federal courts—original jurisdiction over “controversies between two or more States.” The complaint goes into great detail describing what happened in each state.
The complaint catalogues these and numerous other changes made in all four states by government officials, not the state legislatures. According to Texas, these “amendments to States’ duly enacted election laws” violated the Electors Clause of the Constitution, Art. II, § 1, Cl. 2, which vests “state legislatures with plenary authority regarding the appointment of presidential electors.” In other words, while the state legislatures have the authority to set the rules for presidential elections in their states—and thus could have made all of these changes if they had wanted to—other government officials in those states, including judges, did not have the constitutional authority to make these changes. Second, the complaint describes how voters in different parts of these states were treated differently. For example, election officials in Philadelphia and Allegheny Counties in Pennsylvania set up a “cure process” for voters in those jurisdictions whose absentee ballots did not comply with state legal requirements. Those noncompliant ballots should have been rejected because state law does not allow such a procedure. As a result of this behavior and similar behavior in other states, there was “more favorable treatment allotted to votes” in areas “administered by local government under Democrat control.” This differential treatment, says Texas, violates the Equal Protection Clause of the 14th Amendment. It cites the Supreme Court’s 2000 decisions in Bush v. Gore, which “prohibits the use of differential standards in the treatment and tabulation of ballots within a state.” Additionally, the one-person, one-vote principle “requires counting valid votes and not counting invalid votes.” This damaged Texas because in “the shared enterprise of the entire nation electing the president and vice president, equal protection violations in one state can and do adversely affect and diminish the weight of votes cast in states that lawfully abide by the election structure set forth in the Constitution.” Finally, Texas argues that these states violated “substantive due process” requirements because their election practices—through both “intentional failure to follow election law as enacted by” their state legislatures as well as “unauthorized acts by state election officials and their designees in local government”—reached “the point of patent and fundamental unfairness.” The states “acted unconstitutionally to lower their election standards … with the express intent to favor their candidate for president.” Texas argues that all of these unconstitutional actions changed the outcome of the presidential election, citing the actual vote totals in each state and the number of ballots affected. The state is asking for a declaratory judgement that the administration of the election by Pennsylvania, Georgia, Michigan, and Wisconsin violated the Constitution; that their Electoral College votes cannot be counted; and to order that these states “conduct a special election to appoint presidential electors.” If the states have already appointed their presidential electors, Texas asks that their legislatures be directed “to appoint a new set of presidential electors in a manner that does not violate the Electors Clause and the Fourteenth Amendment, or to appoint no presidential electors at all.” This is an unprecedented lawsuit, and the Supreme Court may be extremely leery and disinclined to take any actions regardless of the merits that could upset the results of a presidential election. Texas does a good job of describing what happened in each state and why the actions of government officials making unauthorized, unilateral changes in the rules may have violated the Constitution and affected the outcome of the election. But by almost any measure, this is the legal equivalent of a Hail Mary pass. While the questions raised are serious ones, it is unlikely that the Supreme Court will address them at this time. As Texas points out, these issues will likely be repeated in future elections. If the Supreme Court does not take up these issues now, it may well have another opportunity in the future. Good morning, NBC News readers.
A worrying new record in Covid-19 deaths, some expected good news about vaccines, and controversy over President-elect Joe Biden’s pick for secretary of defense.
Here is what’s happening this Thursday morning.
More than 3,000 Covid deaths confirmed in a day, as FDA vaccine decision looms In a year of unwelcome records, here is another: Wednesday marked the first time the U.S. recorded more than 3,000 Covid-related deaths in a 24-hour period.
The previous high, set in the pandemic’s first wave in April, was 2,861. But infections are now increasing at an alarming rate: In the seven days to Wednesday, the U.S. averaged more than 205,000 cases per day and 2,260 deaths.
Just four weeks ago the average was just over 158,000 cases and 2,260 deaths per day. So far, more than 290,000 people have died in the U.S. as a result of Covid.
There cause for hope, however: The experimental vaccine from Pfizer and Germany’s BioNTech could be one step closer to being offered in the U.S. after a panel of advisers to the Food and Drug Administration gives its verdict on Thursday.
The panel is expected to recommend its use, NBC News reports, meaning the FDA could green light its use in the coming days. The United Kingdom has been giving elderly, vulnerable people and frontline health care workers the vaccine since Tuesday.
And anyone who gets the vaccine sometime soon is unlikely to be able to prove it with a so-called vaccine passport stored digitally. It’s more likely the confirmation will be written on old-fashioned paper.

Lawmakers divided over whether to back Biden’s historic secretary of defense pick Congress faces quite a choice: confirm the first Black secretary of defense, or enforce a 73-year-old law designed to stop recently-retired military leaders from running the Pentagon.
Lawmakers on both sides of the aisle are divided over whether to back retired four-star general Lloyd Austin, President-elect Joe Biden’s choice for defense secretary.
Some harbor concerns that under the Trump administration, high-level decisions were left to military to brass, rather than civilian leaders, and there are calls for the post to go to a non-military candidate.
The 1947 law requires a seven-year cooling off period before military leaders can take office. It has been waived just twice: for Harry Truman’s pick of George Marshall in 1950, and President Donald Trump’s choice of James Mattis in 2017.

FIRST READ: Trump touts a false narrative — and forces allies to come along for the lie
Donald Trump’s presidency began with a lie about the size of his inauguration crowd.
And it’s ending with an even bigger lie – that the 2020 election was stolen from him (when in fact it wasn’t really that close), that there was widespread fraud (courts haven’t found a single instance of it), and that there’s still a chance he might win (he won’t).

Just look at the Texas lawsuit – which 17 other states, including Trump himself, have joined – seeking to invalidate Joe Biden’s victory at the U.S. Supreme Court, and asking the court to delay the electoral vote in Georgia, Michigan, Pennsylvania and Wisconsin.
For one thing, that ask is unconstitutional, Ohio State law professor Ed Foley tells NBC’s Pete Williams. “He points out that Article II, Section 4, says that Congress can choose the day the electors meet to vote but that it also says the day ‘shall be the same throughout the United States.’ This year, it’s Dec. 14, five days from now.”
In addition, a state like Texas doesn’t have a legal right to challenge how OTHER states conduct their elections. “This case is hopeless. Texas has no right to bring a lawsuit over election procedures in other states,” SCOTUSblog publisher Tom Goldstein adds to NBC’s Williams.
And then there’s Trump’s own legal filing in the case.
It begins by citing a Rasmussen poll (“Indeed, a recent poll by the reputable Rasmussen polling firm…”).
It claims that no presidential candidate in history has won both Florida and Ohio but lost the overall election (well, Richard Nixon did in 1960).
And the filing touts the 74 million votes that Trump won (but doesn’t mention Biden’s 81 million).
It’s one thing for Trump to make this Big Lie about the 2020 election.
It’s another to have 18 states – Texas, plus 17 other states – join him.

In our newsletter yesterday, presidential historian Michael Beschloss argued that it was important to hold Joe Biden’s incoming presidency to a high bar, especially when it comes to ethics and transparency.
So it’s important to note that Biden is breaking a norm – civilian control over the Pentagon – by tapping Gen. (ret.) Lloyd Austin to be his Defense secretary.
Sure, Trump did the same with James Mattis.
But it’s still breaking a norm.
Rep. Elissa Slotkin, D-Mich., summed it up well.
“I have deep respect for Gen. Lloyd Austin. We worked together when he commanded U.S. forces in Iraq, when he was vice chief of the Army, and when he was the CENTCOM commander. But choosing another recently retired general to serve in a role designed for a civilian just feels off,” she tweeted.
“And after the last 4 years, civil-military relations at the Pentagon definitely need to be rebalanced. Gen. Austin has had an incredible career––but I’ll need to understand what he and the Biden Administration plan to do to address these concerns before I can vote for his waiver.”

Georgia Runoff Watch by Ben Kamisar
Today’s Runoff Watch takes a look at a brand-new ad featuring Donald Trump Jr. in Georgia.
Evocative of much of the other GOP attack ads in the race, Trump Jr. tries to tie the Democrats to defunding police departments, eliminating private health insurance and adding justices to the Supreme Court.
“On Jan. 5, the U.S. Senate is on the line and my father’s accomplishments are on your ballot,” Trump Jr. declares.
First reported by Fox News and Axios, the spot is being run by Save the U.S. Senate PAC, a group with ties to Trump Jr. And the group says its spending $500,000 on the spot to run on statewide digital and Fox News, as well as nationally on Newsmax.
It’s the latest group to hop into the Georgia runoff free-for-all. And as the president and his allies continue call to “overturn” the certified results in states like Georgia, the ad represents another big name Republican in Trump World lending a hand to the effort aimed at shoring up GOP control of the Senate.

Talking policy with Benjy: Restaurants on the brink
The bipartisan group of senators working on a Covid relief deal released an outline of their plan yesterday, and while it contained $300 billion in proposed aid for businesses, one major industry is worried they’re being left out: restaurants.
The Independent Restaurant Coalition, a coalition of prominent restaurateurs advocating for owners and chefs in the pandemic, is criticizing the emerging deal for not including targeted relief for the industry.
“They have an airline cutout and a live music venue cutout, but for some reason they don’t understand restaurant-specific issues,” Tom Colicchio, the “Top Chef” judge, restaurant owner, and IRC co-founder, told First Read.
While the bipartisan bill would fund new PPP loans, restaurant owners have complained that the program is badly tuned to their needs, despite some tweaks, requiring them to spend too much on payroll and not offering enough help to deal with fixed costs like rent and utilities.
Instead they’ve been pushing for the RESTAURANTS Act, a bipartisan bill that would provide $120 billion in grants to make up lost revenue. It has 50 co-sponsors in the Senate and over 200 in the House, yet has not figured so far in relief talks, which are already straining to stay at a self-imposed $900 billion limit.
“In New York City we’re expecting indoor dining to close on Monday,” Colicchio said. “I think right now owners are in deep trouble. They’re coming to the realization they may lose their life’s work.”
