Monday, September 30, 2019 Whistleblower Complaint Released On Thursday, the House Intelligence Committee released the whistleblower complaint regarding President Donald Trump and Ukraine. House Intelligence Committee

The Flip Side From the Left The left finds the whistleblower complaint credible, and argues that Trump should be impeached for abusing the power of the Oval Office. “What is striking is the tone of the whistleblower’s complaint: This is a savvy Washington bureaucrat. This person is quite familiar with the law as it applies to whistleblowers and savvy enough to have presented his/her complaint at an unclassified level (with some classified material in an appendix) so that when it publicly surfaced… the public could make its own judgments about the nature of the whistleblower’s complaints against President Trump and his enablers.”

“White House officials ordered information about President Trump’s phone call with President Volodymyr Zelensky to be removed from the classified server typically used to store such information and placed on a hyper-secure ‘code word’ server. Such special protections are typically reserved for material of the gravest sensitivity: detailed information about covert operations, for example, where exposure can get people killed… It is difficult to overstate just how abnormal and suspicious treating the call in that manner would be. It strongly suggests White House staff knew of serious wrongdoing by the president and attempted to bury it — a profound abuse of classified systems for political, and possibly criminal, purposes.”

“As the whistleblower notes, the intent was to ‘lock down’ evidence of the conversation. This move shows us that Trump’s closest advisers recognized quickly that the call posed a major problem and bucked normal protocol to try to hide it. Lawyers call this ‘consciousness of guilt’ — meaning that when people try to hide evidence or influence witnesses or otherwise obstruct justice, they typically do so for a reason. This kind of proof can be devastating in court

“[Moreover] Giuliani’s involvement in Trump’s efforts to have Ukraine gather dirt on political opponents is itself a major problem for Trump: why on earth was Giuliani — a private citizen and not an employee of the US government — involved in any of this at all? The answer, it seems, is that Trump’s dealings with Ukraine were intended for his own personal and political benefit and not for (or perhaps at the expense of) the best interests of the United States.”

“Trump has never recognized any distinction between his public and private life. Extraordinarily, he didn’t divest from his businesses even while serving as president. Even worse, he treated the government as if it were his property. The Ukraine scandal is another case of Trump treating the executive branch as though it had been acquired by the Trump Organization…

“[Representative Mark Meadows] observed in the president’s defense, ‘He didn’t see anything wrong with the conversation he had with a foreign leader.’ That is probably accurate. Trump has a finely honed antenna for assessing winner versus loser, or loyal versus disloyal. But the formulation of moral concepts is not a function he can perform… No American president has more richly deserved impeachment.”

Regarding the Bidens, “There are no indications that Hunter’s activities swayed any decision his father made as vice president. Joe Biden did pressure Ukraine’s fledgling post-Yanukovych president to remove a public prosecutor—as part of concerted U.S. policy. So did every other Western government and dozens of Ukrainian and international pro-democracy activists. The problem was not that the prosecutor was too aggressive with corrupt businessman-politicians like Hunter Biden’s boss; it was that he was too lenient… 

“And Hunter Biden was hardly the only prominent American who did well for himself during Ukraine’s transition. Another Burisma director was Cofer Black, George W. Bush’s CIA counterterrorism chief. The Republican operative and future Trump campaign chair Paul Manafort worked for Yanukovych. So did Obama White House Counsel Gregory Craig… All too often, the scandal isn’t that the conduct in question is forbidden by federal law, but rather, how much scandalous conduct is perfectly legal—and broadly accepted… Impeachment alone will not end our national calamity. If we want to help our country heal, we must start holding ourselves, our friends, and our allies—and not just our enemies—to its highest standards.”

Finally, “While Trump’s ‘spy’ comments were certainly shocking, in reality, they are actually not that far off from official justice department policy when dealing with whistleblowers who go to the press with classified information. For years, many of these brave people – who have exposed CIA torture, drone strikes, unprecedented cyber attacks and mass surveillance – have been prosecuted by administrations from both parties under the Espionage Act… It’s long past time that [Congress] passed robust whistleblower protections for all intelligence community members so they don’t have to constantly worry about retaliation or worse for exposing illegal or corrupt actions.”
Trevor Timm, The Guardian From the Right The right is skeptical of the whistleblower complaint and impeachment in general, and argues that further investigation of Hunter Biden is warranted. “‘I was not a direct witness to most of the events’ characterized in the document, the complainant confesses on the first page. Instead, the complainant notes, the document is based on conversations with ‘more than half a dozen U.S. officials.’ Those officials are not named, and their positions are not identified anywhere in the letter… A review of the entire complaint shows it is not so much an example of whistle-blowing, an act that can only be done by the individual holding the whistle, but an elaborate gossipy game of telephone between unnamed individuals whose motives and credibility are impossible to ascertain.”

“Remember when Democrats insisted that President Trump was ‘working on behalf of the Russians,’ only to have special counsel Robert S. Mueller III declare he ‘did not establish that members of the Trump Campaign conspired or coordinated with the Russian government in its election interference activities’? Well, we now have the rough transcript for Trump’s call with Ukrainian President Volodymyr Zelensky and it’s clear that, once again, Democrats got ahead of the evidence… The reality of this call is a far cry from overheated charges that Trump used U.S. aid to repeatedly pressure Zelensky to investigate Hunter Biden… 

“In the complaint, the whistleblower alleges that efforts by White House officials to ‘lock down’ the transcript are evidence of presidential wrongdoing. Or maybe they are evidence officials did not want yet another presidential conversation to leak. No president in modern times has seen more of his conversations with foreign leaders leak than Trump, including calls with Australian then-Prime Minister Malcolm Turnbull, Philippine President Rodrigo Duterte, British then-Prime Minister Theresa May, and Russian President Vladimir Putin. Little wonder the administration takes measures to restrict access to transcripts of those conversations.”

“Long before the conversation came around to the Biden topic, the ‘favor’ that Trump asked for was Zelensky’s assistance in Barr’s ongoing investigation of the genesis of the Trump-Russia investigation. No matter how much Democrats seek to discredit that probe and the AG overseeing it, it is a legitimate investigation conducted by the United States Department of Justice, which has prosecutors assigned and grand jury subpoena power… 

“It is a commonplace for the government to seek assistance from foreign counterparts for ongoing federal investigations… And the president is never conflicted out of executive branch business due to his political interests. There is no legal or ethical requirement that the Justice Department be denied potentially probative evidence because obtaining it might affect the president’s political fortunes.”

“Were Trump to pass documents to his campaign, that would blend his official powers with his electioneering apparatus, which is against campaign-finance law. Were Trump to tell Zelensky to leak whatever damaging information he might find about Biden, that too would constitute election interference. Obviously, if Trump asked Zelensky to target Biden or his campaign with hacking, it would be a crime. If he asked Zelensky to fabricate information and leak it to the public, this impeachment talk would be completely justified. Yet Trump did not do these things. He asked for information that might help him serve the national interest in his capacity as president.”

“If Trump is impeached, he will follow the precedent set by Bill Clinton and ignore calls to resign. Then he’ll follow the second precedent set by Clinton and win in the Senate, which will set up the third precedent, a claim that his tormentors wasted the people’s time and money. Clinton’s approval rating rose by double digits as the process played out and Americans decided he was being needlessly put through a wringer. The lesson we all should have learned is: If you can’t make your impeachment bipartisan, don’t bother.”

Many argue that “whatever one may think of President Trump’s actions on Ukraine, it should not preclude the media from pressing Joe Biden on the shady dealings that his son Hunter had while Biden was vice president… There’s simply no plausible explanation as to why Hunter, despite a lack of energy experience and a recent discharge from the U.S. Naval Reserve after a positive cocaine test, would be put on the board of Ukrainian energy company Burisma and paid up to $50,000 a month other than the fact that his father was vice president at the time and the company was hoping to curry favor and bolster its prestige… 

There are plenty of important lines of inquiry for Biden. For instance: Was he aware of Hunter’s deal? Did he think it was OK? Did he raise any concerns within the Obama administration about potential conflicts of interest, especially if he was being made the messenger on Ukraine policy?”

It’s not about President DONALD TRUMP; it’s about the Constitution. That’s the message Speaker NANCY PELOSI wants House Democrats to remember as they gear up for what will be a key week in their march to impeachment. “We have to proceed with our hearts full of love for America and our hearts full of love for the Constitution. And not with negative attitudes towards him, but a positive attitude towards our responsibility,” she saidon a conference call with House Democrats on Sunday.

“The polls have changed drastically about this,” Pelosi added, pointing to numbers showing that support for impeachment has surged since her announcement.

THE CALL underscored the tricky position Democrats, particularly those in districts that Trump won in 2016, are in as they move to sell the impeachment inquiry over the two-week recess. It also comes amid growing frustration among many Democrats over inconsistent messaging about how to talk about impeachment.

THE DEM STRATEGY … SARAH FERRIS and ANDREW DESIDERIO: “Illinois Rep. Cheri Bustos, who leads House Democrats’ campaign arm, advised the caucus’s most vulnerable members to gauge support and test their message through the use of polling in their respective districts — surveys that the Democratic Congressional Campaign Committee would help fund, according to multiple people on the call. She also said the campaign arm could deploy digital ads in the future.

“Bustos also shared the results of the DCCC’s first poll focused on impeachment since Pelosi formalized an inquiry last week. The poll found that 54 percent of likely voters support the Democrats’ inquiry, according to a summary obtained by POLITICO.

“Top Democrats used Sunday’s conference call to formalize their caucus’s messaging operation on impeachment with more focused talking points. It came after leaders faced blowback from some lawmakers, particularly those from swing districts, over past messaging stumbles.

“Democratic Caucus Chairman Hakeem Jeffries (D-N.Y.) outlined a plan to message the issue with ‘repetition,’ according to multiple people on the call. He named six words that Democrats will use — ‘betrayal, abuse of power, national security’ — as they make the case that Trump abused his office when he pressured Ukrainian President Volodymyr Zelensky to investigate Joe Biden.” POLITICO

— CASE IN POINT: “Back Home, House Democrats Tread Carefully on Impeachment and 2020,” by NYT’s Jonathan Martin and Catie Edmonson in Anaheim, Calif.: “Orange County was the epicenter of the 2018 House Democratic takeover, where Republicans lost four seats in what was once the heart of Ronald Reagan conservatism in California. On Saturday night, as three of the victorious Democrats were honored at an annual political dinner, a new battle was on everyone’s minds: How to protect those gains in 2020 by selling voters on the impeachment inquiry of President Trump.

“At the dinner, Representative Harley Rouda warned Democrats not to ‘sit on our laurels.’ Representative Mike Levin solemnly said ‘the times have found us.’ And Representative Gil Cisneros, who came out for the inquiry only last week, plugged his campaign website twice to ask for donations and noted, ‘The Republicans are coming after me now.’” NYT

TRUMP’S MONDAY — The president will leave the White House at 10:35 a.m. en route to Joint Base Myer-Henderson Hall in Virginia, where he will participate in a welcome ceremony in honor of the chairman of the Joint Chiefs of Staff. At 12:05 p.m., Trump will return to the White House for lunch with VP Mike Pence at 12:45 p.m. in the private dining room. House Democrats want an impeachment inquiry that moves swiftly, but they say they have no timeline. They say they want to narrowly focus the investigation on President Trump and his alleged efforts to get a foreign government to dig up dirt on a political rival. Yet the potential witness list and lines of inquiry grow by the hour. Speaker Nancy Pelosi (D-Calif.) says impeaching Trump is not political while describing the importance of public opinion, which she and her colleagues are working overtime to shape.   Would articles of impeachment hinge on alleged abuses of power by Trump related to Ukraine, as House Intelligence Committee Chairman Adam Schiff (D-Calif.) argued over the weekend? Might evidence support allegations of a cover-up and withholding of evidence by the White House, or even violations of the Whistleblower Protection Act, all of which interest Pelosi?   “Some argue the cover-up is the bigger crime,” Schiff said on NBC’s “Meet the Press” on Sunday. The more serious offense, he argued, is that “the president is once again not just inviting but coercing a foreign nation to get involved to try to help him with yet another presidential election.”   Action this week — while most House Democrats are back in their districts and some committees call witnesses and gather information — will send a strong signal about whether Congress squeezes impeachment from start to finish into calendar year 2019, or the drama becomes an exhausting, confused inquiry that bleeds into next year and leaves America’s politics more deeply divided, if that’s even possible.   The Hill: House liberals support speed and a clear-cut narrative about Trump’s actions.   Here’s what to watch in Congress this week:   > Three House committees on Thursday will depose Kurt Volker, the former U.S. special envoy to Ukraine who resigned last week, seeking to learn about his dealings with Ukrainian officials and Trump lawyer Rudy Giuliani, who says he spent months investigating Joe Biden’s and Hunter Biden’s past actions in search of evidence of misdeeds in Ukraine suspected by the president but debunked within the government, denied by the Bidens and unsupported by multiple investigations by news outlets. Volker is among five State Department officials scheduled to give depositions to three congressional panels;   > Secretary of State Mike Pompeo faces a Friday deadline to respond to three House committees requesting a tranche of documents under threat of subpoena;   > The House Intelligence Committee on Friday will glean closed-door information from Michael Atkinson, the inspector general for the intelligence community, who in August received a “credible” whistleblower account of Trump’s July 25 phone call with Ukrainian President Volodymyr Zelensky as well as Trump’s temporary blockade of U.S. military aid to Ukraine as possible leverage to influence Zelensky’s cooperation. The whistleblower also described unusual White House steps to bury the notes of Trump’s phone call in a super-secret digital vault;   > The House Intelligence Committee on Sunday indicated it will likely call Attorney General William Barr, whom Trump told Zelensky to contact, as well as Giuliani and senior White House officials;   > Giuliani on Sunday refused to retreat from his tangle of accusations against the Bidens. “If I’m wrong, I’m wrong,” he told ABC News’s “This Week.” “I support everything I say with affidavits.” The ex-prosecutor and former New York City mayor said he would “consider” cooperating with the House Intelligence Committee. “I have to be guided by my client,” he said. Giuliani added that he thought Pelosi should remove Schiff as chairman, calling him “illegitimate”;   > House Democrats’ interest in talking with senior White House officials is rooted in the information provided by the whistleblower within his official complaint, as well as reports that Trump instructed acting chief of staff Mick Mulvaney and the Office of Management and Budget to hold back on the military aid to Ukraine. The White House’s classification and archiving of records about the president’s communications with foreign officials also is part of the impeachment inquiry (The Washington Post and CNN); > The unnamed intelligence official who filed the complaint that fueled impeachment momentum last week is consulting with members of the House and Senate to cooperate with Congress while also protecting his identity, one of his lawyers tweeted on Sunday. “No date/time has yet been set,” wrote Mark Zaid. CBS News’s “60 Minutes” reported Sunday that the whistleblower is under federal protection because of fears for his safety. Trump on Sunday demanded to meet the whistleblower and expose officials who gave the intelligence official information, some of which the president has confirmed. He warned of “big consequences” in a series of irate tweets (The Hill).   > Senate Majority Leader Mitch McConnell (R-Ky.) will be asked again this week to clarify whether the Senate is committed to holding a trial if the House votes for articles of impeachment. McConnell in March told NPR the Senate would indeed hold a trial, if it got to that point, and his spokesmen has said as much, but questions linger. LEADING THE DAY
POLITICS: With the announcement of the inquiry in the rearview mirror, House Democrats are moving forward and looking to take their argument to the voters with a little more than a year to go until the 2020 elections.    As Scott Wong and Mike Lillis report, Democrats believe the electorate will be more responsive to the ongoing situation involving the president and Ukraine. They argue that it is more digestible than the 448-page report by former special counsel Robert Mueller and that it involves Trump as president, not as a candidate.    “It’s explainable: It’s betrayal. People can understand betrayal, engaging with a foreign power to interfere in our democracy,” said Rep. Dean Phillips (D-Minn.), a vulnerable freshman who announced support for an inquiry last Monday.   For months, Pelosi has said that public sentiment would be the key in any impeachment push, and the polls are starting to trickle in now a week after she announced the official inquiry. According to a new CBS News poll, 55 percent approve of the decision to open the inquiry, with almost 87 percent of Democrats backing the move. 45 disapprove of the decision.    Impeachment is also expected to create a new test for a highly polarized voting electorate, as Niall Stanage writes in his latest memo:     “In almost three years since President Trump was elected, the nation has seen its schisms grow deeper and more jagged. It’s a change that has been propelled mainly by the president’s words and actions but also by the fervor of his critics.     Now, the question is whether there is any possibility of impeachment inquiries revealing new information so damning that it transcends partisan allegiances and creates the beginnings of consensus — or whether the battle lines will be drawn more boldly.      “Some political insiders respond to the suggestion that impeachment could cause a worsening of polarization with a sardonic question of their own: How much worse could it get?”   Despite questions on how the public will react, the president’s team has been intent on taking a two-by-four to attack Democrats, the whistleblower and all other comers as it looks to protect him heading into his reelection fight, as Morgan Chalfant writes.    Among other barbs, the president suggested on Friday that the whistleblower may be a “partisan operative” and told the United Nations General Assembly last week that he was engaged in a “war.” He upped the ante late Sunday, claiming that the possible removal of a president would spark a “civil war,” which Rep. Adam Kinzinger (R-Ill.) rebuked him for. Trump’s team has consistently slammed Democrats for opening the formal inquiry, including calling for Schiff’s resignation and bashing Pelosi for opening the inquiry without first seeing the transcript of the July call.   “We have an impeachment inquiry based on nothing,” White House counselor Kellyanne Conway told reporters.   Reuters: Trump does not plan to add firepower to his existing legal team.   Politico: President Pence? © Getty Images     While general election polling has not emerged since last Monday, Trump’s job approval numbers have remained largely staid, or even improved in some surveys. According to an NPR-PBS Newshour-Marist poll released late last week, Trump’s approval numbers jumped 3 points in two weeks to 44 percent.   NBC News: Top White House aides planning impeachment response effort.   Biden’s campaign is putting pressure on members of the media and are calling on them to refrain from talking to Giuliani.   In a letter addressed the leaders of news and cable networks and some anchors, two top Biden campaign advisers called on them to stop booking the former New York City mayor. They contended that Giuliani’s appearances on news networks are giving the lawyer and his “false, debunked conspiracy theories” undeserved credibility (The Daily Beast).    More broadly, the impeachment inquiry of Trump has shaken up the Democratic race for the White House, as Amie Parnes reports. The House’s rapid push toward impeachment forced candidates and their campaigns to strategize on how to contend with the development.    Democratic consultants and strategists say the impeachment inquiry could help some candidates such as Sen. Elizabeth Warren (D-Mass.), who got on the impeachment train early and has been climbing steadily in the polls.      “This is a complicated issue from a political point of view,” Sen. Bernie Sanders (I-Vt.) acknowledged at a news conference last week.   But it is unlikely to boost those in the lower rungs of the Democratic primary, most of whom have struggled to garner any attention. This only complicates their efforts.    “Talk about the ultimate political earthquake for the 2020 candidates,” said one Democratic strategist. “The impeachment chatter soaked up most of the oxygen this week, and only a couple of candidates really got any airtime. You heard some chatter about Biden because he is at the heart of all of this. And you heard a little from Warren and Bernie Sanders and [Sen.] Kamala Harris [D-Calif.]. And that’s all she wrote.”   The Associated Press: Democrats in South’s governor races hit hurdle: Impeachment.   > Fundraising: For the rest of today, inboxes will be flooded as 2020 candidates look to squeeze every last dollar out of their supporters ahead of the end of the third fundraising quarter, which ends at midnight tonight.    The last-ditch effort to raise campaign funds could play a crucial role in the coming weeks, along with the upcoming rounds of debates.   While it gives top tier candidates another chance to flex their political and financial muscles, the situation remains more pressing for some of their lower-tier opponents. Some are expected to reexamine their campaigns after multiple former competitors decided to close up shop in recent weeks and months (The Hill).   Politico: Bernie Sanders is in trouble.   New York Magazine: Is impeachment the end of the road for most of the 2020 field?   > Massachusetts Senate: Environmental advocacy groups are going all in to back Sen. Ed Markey (D-Mass.) shortly after Rep. Joe Kennedy III (D-Mass.) announced his primary bid against the incumbent senator and longtime lawmaker.    Markey, the original sponsor of the Green New Deal in the upper chamber, has garnered quite a bit of good will in the environmental community. His support for the progressive proposal also led Rep. Alexandria Ocasio-Cortez (D-N.Y.) to endorse him as he looks to fend of Kennedy’s challenge and retain support from key pockets of the Democratic coalitions (The Hill).

INTERNATIONAL: Political turmoil and suspense are seemingly everywhere.   > Afghanistan: In a low-turnout election on Saturday, Afghans voted to choose a president for a country suffering through one of the most violent periods in its recent history. The vote has turned into a battle between two bitter rivals who have sparred for half a decade: the incumbent president, Ashraf Ghani, and his government’s chief executive, Abdullah Abdullah. Preliminary results may not be determined until Oct. 17 at the earliest, and final results are expected on Nov. 7 or later (The New York Times).    > China: The second-largest economy in the world will celebrate the 70th anniversary of communism on National Day on Tuesday (The New York Times). Meanwhile, the Trump administration rattled markets on Friday with news it is weighing options to impose limits on U.S. capital flows into China following years in which U.S. businesses and investors worked to gain entry to China’s lucrative markets (Bloomberg). Here’s what that might mean, if implemented (MarketWatch). The People’s Bank of China (PBOC), in a Sunday statement on China’s social network, Weibo, said China will “continue to implement a prudent monetary policy and increase the strength of counter-cyclical measures.” The PBOC’s pledge came as the Chinese vice commerce minister, Wang Shouwen, said Beijing would open up more sectors of the economy to foreign investors. Wang also announced that Beijing will send its top negotiator, vice premier Liu He, to lead negotiations with the U.S. in early October (The Guardian). There’s plenty of speculation about whether Trump’s impeachment pressures make it more likely he will settle for a trade agreement with China (The Associated Press).   > Hong Kong: Young protesters, with support from older citizens in the former British colony, want to spoil China’s National Day on Tuesday and are pulling out the stops to do it (The Associated Press).   > Canada: Prime Minister Justin Trudeau, seeking reelection, is struggling among young voters in Canada, who are considered critical to the Oct. 21 election results (The New York Times).    > Great Britain: Prime Minister Boris Johnson, under investigation for his business dealings with a U.S. businesswoman and on the precipice of the United Kingdom’s dramatic split from the rest of Europe, vowed on Sunday to stay on as Britain’s prime minister even if he fails to secure a transition deal to leave the European Union, arguing his Conservative government can deliver Brexit on Oct. 31 no matter what (Reuters).   > Russia: Moscow streets filled on Sunday with an estimated 9,000 people at a rally to demand the release of other protesters who have been detained by authorities since the summer (Reuters).

This afternoon, the president speaks at the ceremonial swearing-in of Eugene Scalia as secretary of Labor.  The president is scheduled to meet with Pompeo at 4 p.m.
Pence participates in the president’s public schedule throughout the day. Then at 3:30 p.m., the vice president meets in his office with Jamaican Prime Minister Andrew Holness.

Migration — the deadliest county in America: At least 650 migrants have died in one rural Texas county since 2009 in their failed attempts to cross the U.S. southern border illegally and skirt U.S. checkpoints beyond. Stephanie Leutert, director of the Mexico Security Initiative at the University of Texas at Austin, obtained records from the sheriff of Brooks County, Texas, created a database, and is presenting an intriguing, heart-rending series about the information for Beyond the Border, a collaboration of the Strauss Center for International Security and Law and Lawfare.
  Leutert’s introduction, “In the Brush in Brooks County,” is HERE. “I hadn’t expected to see so many women in the case files — certainly not women who carried lipgloss, beaded bracelets and fanny packs. I hadn’t expected to see so many older crossers in their late 50s and 60s, people who were found with reading glasses and who had children and grandchildren already in the United States.” 
  Part II: Who’s dying in South Texas? “A major theme of these death reports is that poor preparations — from a lack of knowledge about the trek or an inability to obtain better gear — become deadly in the face of the unrelenting natural elements. …In 2018, Central Americans made up two-thirds of all bodies or human remains recovered in Brooks County.”   ➔ Migration — Afghanistan: While fleeing with his family from Afghanistan and eventually landing in Hungary, Hassan Fazili made a film using his cell-phone about his family’s hardship. The resulting documentary, “Midnight Traveler,” shows both misery and determination as the refugee family wanders “to the edge of hell” through Iran, Turkey, Bulgaria, Serbia and on to Hungary to build a better life (The New Yorker). The New York Times’s Ruth Fremson traveled to Glacier Peak Wilderness in Washington to profile Russ Dalton, 72, one of the nation’s last fire lookouts, an unpaid volunteer for the past four summers who holes up and maintains a remote cabin with no running water, decorated by some spectacular views. 

In their heyday, there were more than 8,000 fire lookouts across the country. Today, the U.S. Forest Service manages 153 lookout posts in Washington and Oregon, but only about 50 are staffed by humans full or part time.

Rudy Brought Receipts
Congress may have taken a break, but the impeachment debate still raged on yesterday on the morning political shows. Former New York Mayor and President Trump’s personal lawyer, Rudy Giuliani, appeared on ABC’s This Week and as Bravo housewives say, he brought receipts, including affidavits regarding Vice President and Democratic presidential primary frontrunner Joe Biden’s involvement in a Ukrainian prosecutor’s investigation and resignation. Watch it go down here. Giuliani must have hit a nerve because the New York Times reported that the Biden campaign called all the major working demanding them not to have Giuliani as a guest. 

Over on Fox News Sunday, White House Senior Adviser Stephen Miller said the President is the real whistleblower: “The president of the United States is the whistleblower and this individual is a saboteur trying to undermine a democratically elected government,” Miller said, during a contentious interview on “Fox News Sunday.”  Miller said that the whistleblower complaint “drips with condemnation, condescension and contempt for the president” and claimed that the intelligence community’s Inspector General had found evidence of political bias in the complaint. Miller also bucked when host Chris Wallace countered that the IG had found the report “credible and a matter of urgent concern.” “They’re wrong,” Miller said.

Rep. Adam Schiff, chairman of the House Inteligence Committee, appeared on NBC’s Meet the Press and said he hopes that the whistleblower will testify “very soon.”

If you’re wondering what makes a “whistleblower,” this is a must-read by Sean Davis because the requirements to file a complaint were amended between May 2018 and August 2019 to not have to include first-hand knowledge.

UN Climate Action Summit’s Carbon Footprint
Straight out of the parody book, The Social Justice Warrior Handbook, it turns out the carbon cost of complaining about other people’s carbon use was pretty high. Paulina Enck at The Federalist wrote: 

“To reduce the massive carbon footprint of flying out hundreds, the entire summit could have been just as effective if held remotely. Telecommunication has become so advanced that the conference could have been a massive video call, which would have halted the flights. There is no practical reason that everyone had to be in the same room. If planes and cars are so deadly to the environment, this summit did more harm than good.”

Of course there’s a reason — to get all the cameras in one place! Let’s look at the bright side and consider the carbon emissions saved from New York media having to travel to multiple locations to fawn over eco-celebrities

“This protest led to countless blocks of backed up, idling traffic. Thousands of cars were left idling for hours, leading to excessive carbon emissions, the same thing the protestors were convening to protest. Cars are responsible for approximately one-fifth of the United States’ carbon emissions, with each gallon of gas driven resulting in around 24 pounds of carbon dioxide and other greenhouse gasses. In their quest to combat carbon emissions, these climate activists dramatically increased them.”

The Most Ridiculous Headline of the Week
“What ‘Hustlers’ tells us about our politics and the American Dream” from CNN is the winner. If shoehorning politics into entertainment was an Olympic sport, this guy would get the gold:

“In the mind of President Donald Trump, the notion of writing your own destiny is something like a no-holds-barred “Hunger Games” scenario: pitting people — such as immigrants and the poor — against one another to scrap over the same small piece of pie as the rich enjoy their own bounty.

On the left, Elizabeth Warren and Bernie Sanders seek to radically re-imagine what a structurally lopsided country owes its poorest. This approach is also adversarial — ostensibly taking from the rich and giving to the poor. But it’s a corrective, moored in the acknowledgment that things have been rigged largely in favor of the privileged few from the start.”


Reminder: this is a movie about strippers getting men on Wall Street drunk and high so they can steal from them. It may be wildly entertaining on its own merits, so why the insistence on making it politically relevant?

What I’m Reading This Week
New on my list this week is How Happiness Happens: Finding Lasting Joy in a World of Comparison, Disappointment, and Unmet Expectations by Max Lucado. Only a couple years ago I was not a person who gravitated toward these types of books. I started reading self-help/motivational books for an article and suddenly I began enjoying them! From the description of How Happiness Happens: 

“Worldwide, people profess that happiness is their most cherished goal. Marketers get this. “Want to be happy?” they ask. Eat at this restaurant, drive this car, wear this dress. Happiness happens when you lose the weight, get the date, find the mate, or discover your fate. It’s wide, this way to happiness. Yet, for all its promise, it delivers a fragile joy; here one day, tomorrow scattered by the winds of comparison, disappointment, or unmet expectations.

Max writes, “There is another option. It requires no credit card, monthly mortgage, or stroke of fortune. Age and ethnicity aren’t factors…an unexpected door to joy.”

FIRST READ: The GOP’s defense of Trump on Ukraine isn’t convincing

Maybe the most telling aspect of this Ukraine story have been the Republican defenses/explanations of President Trump.

When you add them all up, it becomes pretty clear the GOP is playing a weak hand.

Here’s what we heard from Republican lawmakers over the weekend:

It’s all hearsay

“It’s all hearsay. You can’t get a parking ticket conviction based on hearsay. The whistleblower didn’t hear the phone call,” said Sen. Lindsey Graham on CBS.

In fact, we have the transcription memo of Trump’s call with Ukraine’s new president, which pretty much matches the whistleblower’s complaint.

What’s in the transcript really isn’t in the transcript

From “60 Minutes” last night:

SCOTT PELLEY: And President Trump replies, “I would like you to do us a favor though.”

KEVIN MCCARTHY: You just added another word.

PELLEY: No, it’s in the transcript.

MCCARTHY: He said-“I’d like you to do a favor though”?

PELLEY: Yes, it’s in the White House transcript.

In fact, here’s what Trump said per the transcription memo: “I would like you to do us a favor though because our country has been through a lot and Ukraine knows a lot about it.”

When Trump was talking about “Crowdstrike” and 2016, he was trying to investigate Russian interference

“President Trump is trying to look into the interference by Russia so it doesn’t happen again. I thought you would want to be concerned about making sure that doesn’t happen again,” House Minority Whip Steve Scalise said on “Meet the Press” yesterday.

In fact, former Trump homeland security adviser Tom Bossert said Trump was referring to a debunked “conspiracy theory” that Ukraine – not Russia – hacked the DNC emails in 2016.

If anyone should be investigated, it’s Joe Biden

“The vice president’s son gets paid $50,000 a month and gets hired by a company,” Rep. Jim Jordan, R-Ohio, said on CNN. “And then when the company that’s paying him that money is under investigation, guess what? Daddy comes running to the rescue, the vice president of United States come running…”

In fact, the investigation into the Ukrainian firm Hunter Biden worked for was ALREADY DORMANT when Biden, the Obama administration, and most western countries demanded the ouster of Ukraine’s general prosecutor – because of corruption concerns.

In a political debate, you can usually tell who’s winning and losing – just by looking at the arguments and counterarguments.

And right now, the GOP isn’t winning.

The latest updates on the Trump-Ukraine story

Outside of the GOP defenses, here’s what we’ve learned about the Ukraine story and the impeachment inquiry over the last 24 hours:

  • Trump threatened the whistleblower: “Like every American, I deserve to meet my accuser, especially when this accuser, the so-called ‘Whistleblower,’ represented a perfect conversation with a foreign leader in a totally inaccurate and fraudulent way,” the president tweeted.
     
  • Trump also tweeted that his impeachment could bring about “Civil War”: “‘…If the Democrats are successful in removing the President from office (which they will never be), it will cause a Civil War like fracture in this Nation from which our Country will never heal.’ Pastor Robert Jeffress, @FoxNews”
     
  • The whistleblower’s lawyer believes the president’s comments are putting his client in danger.
     
  • House Intelligence Committee Chairman Adam Schiff said he’ll treat Trump administration NOT testifying on this matter as “evidence of obstruction of justice.”

DATA DOWNLOAD: And the number of the day is … 55 percent. 

That’s the share of Americans who say they approve of the fact that Congress has opened an impeachment inquiry into President Trump, according to a new online CBS/YouGov poll.

But the poll also finds a smaller share — 42 percent — saying that Trump deserves to be impeached now, while 36 percent disagree and 22 percent say it’s too soon to say.

The poll was conducted September 26-27.

It’s worth noting that polling in the middle of this fast-developing story is likely to show volatility and variability based on question wording and the nature of the sample.  

2020 VISION: Biden leads in South Carolina, tied in Nevada

A CNN poll of South Carolina released yesterday: Joe Biden 37 percent, Elizabeth Warren 16 percent, Bernie Sanders 11 percent, Pete Buttigieg 4 percent, Kamala Harris 3 percent, Tom Steyer 3 percent.

On the campaign trail today: Bernie Sanders stumps in New Hampshire, including a discussion on Medicare for All in Manchester and a rally in Durham at the University of New Hampshire… Amy Klobuchar is in Seattle… Tulsi Gabbard is in Nevada… And Andrew Yang holds a rally in Los Angeles. 

Dispatches from NBC’s embeds: Kamala Harris went back to her hometown in Oakland, Calif., where NBC’s Deepa Shivaram noted a difference between when Harris was in Oakland for her campaign launch: “The campaign said a few hundred people RSVPed, and about 200 people were in attendance – but it wasn’t packed wall-to-wall. For it having been an event in her hometown, and after having drawn 22,000+ people here in January, it’s worth pointing out that many more folks could have packed the space.” Harris discussed electability in her speech saying the word has, “come up in every campaign that I have, operative word: won.”

And if Elizabeth Warren could wake up tomorrow and be president, her first act would be … pass her anti-corruption plan, per NBC’s Benjamin Pu. While at the United Food and Commercial Workers town hall in Wisconsin, Warren said if she could pass one thing as president it would be to end the influence of money through her plan, “It would be to fight back against the influence of big money. Because they’re breaking everything. We’re not going to be able to fix this with one offs. Am I in there and fight for 15? You bet I am. Am I in there in the belief that one job should be enough for everyone, yes, I am and am I in there for health care for all of us? You bet I am.”  

Talking policy with Benjy

Bernie Sanders has taken credit this cycle for introducing ideas “that once seemed so very radical” in his 2016 run, but are now ordinary in 2020, NBC’s Benjy Sarlin writes.

But this dynamic has also made it harder to distinguish himself on policy, especially with the rise of Elizabeth Warren, whose “I have a plan for that” platform includes Medicare For All and tuition-free public college.

To that end, Sanders seems to be in a policy arms race lately to redefine the party’s left flank with plans that are several times larger than any existing plans from his rivals. 

In the last few weeks alone, he’s proposed (among other items):

It’s an open question how much importance voters put on the wonky details and how much they believe either candidates’ plans are likely to pass, Sarlin says.

But it’s worth keeping an eye on the growing policy gap between Warren and Sanders, which could form the basis for future debates as the field winnows down.

Good morning,
We are currently in the field wrapping up our weekly survey on support for the impeachment of President Trump. Updated numbers will be released tomorrow morning.Throughout the year, support has remained steady with 40% to 45% believing the president should be impeached and removed from office.

On a different topic, 20% of voters nationwide that capitalism must be eliminated to protect the environment. A ScottRasmussen.com national survey found that 46% of voters disagree and 33% are not sure.

Voters under 35 are fairly evenly divided on this question. Twenty-eight percent (28%) believe capitalism must be eliminated while 36% disagree. However, senior citizens reject the view that capitalism must go by a 65% to 10% margin.

White voters strongly reject the idea that capitalism must be eliminated (53% to 17%). However black voters (28% say yes, 36% no) and Hispanic voters (32% yes, 33% no) are evenly divided.Our full-week update of the Democratic race shows Joe Biden with 33% of the vote, Elizabeth Warren at 19%, and Bernie Sanders at 15%. Warren has been gaining ground in recent weeks.

Our next daily update of the Democratic race is scheduled for tonight at 5:00 p.m. Eastern. Later in the week, we will also see if public opinion about Joe Biden and his relations with the Ukrainian government have shifted.  Currently, 33% of voters nationwide believe former he behaved inappropriately while 31% disagree. Just 41% of all voters know that while Biden was Vice President his son received a multi-million dollar contract from the Ukraine.

At a time when many Democratic activists see former President Obama as a political moderate, 68% of voters view him as politically liberal. Fifty-nine percent (59%) also believe former President Clinton was politically liberal.

On the Republican side, President Reagan and both Presidents Bush are seen as conservative by 58% to 60% of voters.

Finally, 42% of voters are Very Concerned that tech companies might regularly abuse their power while using facial recognition technology. A ScottRasmussen.com national survey found that 34% have the same fear about local law enforcement agencies. Twenty-seven percent (27%) are Very Concerned about FBI abuse and 26% about CIA abuse
.Despite these concerns, 71% of voters believe the FBI should be allowed to use facial recognition technologies. Nearly as many– 69%– said the same about the CIA and 59% think local law enforcement should be able to use that technology.
