Friday, September 27, 2019 UK Supreme Court Rules Against Boris Johnson “The UK Supreme Court ruled [unanimously] on Tuesday that Boris Johnson’s decision to shut down parliament in the run-up to Brexit was unlawful.” Reuters From the Left The left supports the UK Supreme Court’s decision and believes a no-deal Brexit must be avoided. “It is one of the ironies of the rise of authoritarian movements in Western democracies that politicians who claim to be strengthening the foundations of democracy work so assiduously to undermine those foundations. So it was especially satisfying on Tuesday when Britain’s Supreme Court soundly and unanimously slapped down Prime Minister Boris Johnson’s brazen attempt at an end-run around Parliament to pull Britain out of the European Union… 

“Unlike the United States Supreme Court, the British court is not normally an arbiter on political or constitutional matters, on which Parliament is the highest authority. That led to concern in Britain, especially among proponents of Brexit, that the judiciary was trespassing into politics. The high court in England used that argument when it declined to intervene… 

“But the unanimous judgment of the 11 justices of the Supreme Court, which covers the whole of Britain, was that it was Mr. Johnson who violated the established order

[through]

the brazen misuse of the [prorogue], including the lies fed to the queen that the reason for shutting Parliament down was to prepare for the start of a new legislative agenda… Given his history, Mr. Johnson is bound to try other ways of preventing another extension of the deadline. But at least his preferred route around constitutional barriers is closed for now.”

“The high court’s position is rather murkier in a parliamentary sovereignty such as the United Kingdom [than in the US]… The courts are bound to apply Parliament’s legislation, whether or not the judges believe it to be consistent with the Constitution or with earlier laws… 

“So how did this poor relation in the branches of British government give the prime minister such a bloody nose, and did it overreach itself in doing so? The answer lies in another British constitutional principle: Parliamentary accountability, which follows from the sanctity of parliamentary sovereignty. As the Supreme Court put it, ‘The longer that Parliament stands prorogued, the greater the risk that responsible government may be replaced by unaccountable government.’ Put another way, the law requires a very good reason for Parliament to be suspended, especially while it is hell-bent on holding the executive to account.”

Brexit is becoming a religion in the Tory party, the fundamental tenet of which is that no deal will do no harm, so no safety net is required. For its adherents, the prize of remaking Britain in a reactionary mould was worth dispensing with legislative scrutiny altogether… [Tory] Ministers toy with underhand political devices such as recommending the Queen does not enact legislation, or questioning why ministers need to abide by the law… The supreme court’s decision is the culmination of a long and socially useful process of judicial review.”

Some note that “The decision is the product of a judicial system that does far more to insulate its highest judges from partisan politics than the Constitution of the United States. Americans who wish to avoid the partisan drama that surrounded the Supreme Court nominations of Merrick Garland, Neil Gorsuch, and Brett Kavanaugh could learn a great deal from the British system of choosing justices… In the American system, a partisan president names a judge whose political views are well known to key members of that president’s party, and then the judge is confirmed (or denied a confirmation vote altogether) by a partisan Senate… 

“The British system, by contrast, largely relies on senior members of the judiciary and other people who are intimately familiar with the judiciary to choose justices — with the added caveat that ‘selection must be on merit.’ The American system, in other words, seems designed to turn the Supreme Court into a political football because it places judicial selection in the hands of politicians. The British system, while not perfect, is far better designed to depoliticize the judiciary.”

The possibility of a populist insurrection that changes the nature of one of the world’s most politically stable countries has also risen greatly. Among many more important consequences, these outcomes would be bad for the currency.”

From the Right The right is critical of the UK Supreme Court’s decision and believes a general election is necessary. “Unlike its American cousin, the British Supreme Court is not interpreting a written constitution. It is there, at least in theory, to uphold a system based on the supremacy of Parliament… [The 1689 British Bill of Rights] elevates Parliament over the judiciary, laying down that ‘proceedings in Parliament ought not to be impeached or questioned in any court’… 

“In their determination to stop Brexit, the British establishment has ripped aside norms, violated precedent, and politicized previously impartial bodies — all in order to overturn a referendum result that MPs had solemnly promised to uphold.”

“Johnson publicly argued and maintained in the Miller case that the reason for the prorogation was simply to make way for introduction of his government’s new legislative program in a Queen’s Speech on October 14, not to evade accountability to or scrutiny of Parliament. This is not fully convincing, but it is important to note that the five-week period included the traditional three-week recess in September for party conferences… 

“Parliament remained in session for two weeks after the prorogation announcement, and the new session would begin about two weeks before the current exit date of October 31. That left time for accountability to Parliament in the form of a vote of no confidence. In the end, it also left time, though barely, for Parliament to legislate… 

“When political tempers run high, judges are tempted to see themselves as the constitution’s last guardians, with a historical duty to step in and save the day. But the U.K. constitution has always been political in character rather than legal. The current Parliament retained the capacity to hold Johnson to account, notwithstanding the prorogation. The Miller case represents an importation of American-style political litigation, where interest groups attempt to use the courts to win victories that are properly won only through political action.”

“Anti-Brexit MPs had two alternatives to relying on the Supreme Court’s intervention. They could, and did, pass legislation in the time allowed forcing Johnson to ask Brussels for an extension of the Brexit deadline. Or they could bring down the government, which would have dissolved Parliament and brought about a general election. Either would have been more constitutionally appropriate than what has just occurred… 

“Yes, the Johnson government had a naked political motivation in proroguing Parliament. But so, too, did the Supreme Court in unanimously deciding that the matter was justiciable, where the English High Court had deemed that it was not… if anti-Brexit MPs are so upset with the Johnson government, why not follow parliamentary and constitutional procedure and bring it down, so that the country can have a general election? The answer is obvious: They’re worried they’ll lose.”

They fear the Tories would come back from [an] election with a mandate and a majority for their Brexit policy…

[Britain’s] political system cannot function right now because it is based on the idea that the executive can command a majority in parliament, which it currently can’t. Until there is a government that can, the constitutional crises will continue to mount up.”

I’ll See Your Clinton Conspiracy and Raise You My CIA Conspiracy I have some very smart friends peddling what I think is a not very credible conspiracy. The claim being circulated around is that this impeachment gambit and the whistleblower letter are all to undermine or overshadow an investigation into the Clintons and Joe Biden. Any day now the Inspector General will reveal all. It boggles my mind how Hillary Clinton is still the great bad boogeyman. Like Elvis Presley, Hillary Clinton will be sighted in Burger Kings in Kalamazoo long after she is dead. She will be the Baba Yaga that conservatives threaten to send after their misbehaving children. Mysterious deaths will be blamed on her a hundred years from now. I absolutely do not take this seriously. But just wait. We will get a FISA reveal and an McCabe indictment any day now. I think it is more likely that the impeachment investigation and whistleblower complaint are to distract from the Jeffrey Epstein investigation than to distract from a Clinton related conspiracy. And I don’t believe this is a distraction from Epstein. Let me posit a different kooky theory of my own — one I think has more merit. A BREAK FROM IMPEACHMENT … TODAY’S NRCC … A FEW WEEKS AGO, Democratic South Carolina Rep. JOE CUNNINGHAM’S wife, Amanda, complained on Instagram that the couple’s health care — which Cunningham gets through the government — did not cover “mental-health therapy” and marriage counseling. The Post and Courier wrote a story and so did the Free Beacon, which has the video

THE NRCC — which, as the NYT pointed out, has punched frequently this cycle — pounced. The NRCC initially jumped on Cunningham’s video (which, to be fair, many Republicans thought was a bit tone-deaf, given the generous health benefits afforded to members of Congress).

BUT THAT WASN’T ENOUGH for the folks on First Street SE. NRCC staffers decided to rib Amanda Cunningham for apparently being in marriage counseling. After she posted on Instagram that she appreciated Beto O’Rourke “getting bolder,” the NRCC went to town. Their broadside had nothing to do with insurance.

— @NRCC, at 12:45 p.m. Thursday: “Looks like Mrs. Cunningham likes a man who supports baseless impeachment…wonder if this will come up in @RepCunningham’s marriage counseling?” The accompanying news release: “Will impeachment be discussed in Cunningham’s marriage counseling?”

CHRIS PACK, the spokesman for the NRCC, said Cunningham gave them the opening for this attack: “A few weeks ago, multiple outlets ran a story about Joe Cunningham’s wife publicly complaining that her husband’s taxpayer-funded health care plan doesn’t cover her marriage counseling. We referenced that tone deaf complaint when she publicly praised Beto’s support of impeachment. She is the one who first publicly brought up these issues, not us. NYT: “White House Knew of Whistle-Blower’s Allegations Soon After Trump’s Call With Ukraine Leader,” by Julian Barnes, Mike Schmidt, Adam Goldman and Katie Benner: “The White House learned that a C.I.A. officer had lodged allegations against President Trump’s dealings with Ukraine even as the officer’s whistle-blower complaint was moving through a process meant to protect him against reprisals, people familiar with the matter said on Thursday.

“The officer first shared information about potential abuse of power and a White House cover-up with the C.I.A.’s top lawyer through an anonymous process, some of the people said. The lawyer shared the officer’s concerns with White House and Justice Department officials, following policy. Around the same time, the officer separately filed the whistle-blower complaint.” NYT

— KNIVES OUT FOR DOJ … AP: “How the White House, DOJ learned about the whistleblower”: “[O]n Aug. 14, White House counsel John Eisenberg and a CIA official alerted the head of DOJ’s national security division about the original complaint to the CIA.

“John Demers, who leads the national security division, went to the White House the next day to review materials associated with the call. He then alerted people within the Justice Department, but it was unclear specifically who he told.

“In the following weeks, Demers had discussions with other Justice Department officials about how to handle the CIA complaint, according to the person familiar with the matter. It was during that period that the Justice Department also received a notification from the intelligence community’s inspector general about a whistleblower complaint.” AP

— HMM … NYT’S PETER BAKER: “[O]ther officials amplified the narrative on Thursday with details that were not in the complaint. For instance, they said, at one point an order was given to not distribute the reconstructed transcript of Mr. Trump’s call electronically, as would be typical. Let us preview how Republican groups like the NRCC and Congressional Leadership Fund will take that into campaign season in every competitive district in America: “Congressman X wanted to impeach Donald Trump without holding hearings. Impeach the president? Without hearings? Congressman X is too extreme for us.”

An explosive impeachment investigation intensified on Thursday with the release of a whistleblower’s assertions that President Trump used the leverage of his office to enlist his Ukrainian counterpart to help him dig up dirt on a political rival while the White House later tried to hide the president’s actions.    The detailed, unclassified version of the complaint made public on Thursday left a complicated trail of new questions and a long list of potential witnesses.    The whistleblower, later identified by The New York Times as a CIA employee, asserted that Trump may have abused his authority with Ukraine’s new president, Volodymyr Zelensky, to bolster his reelection by trying to establish that former Vice President Joe Biden and his son Hunter Biden had exploited their positions in Ukraine for personal gain. Within the allegations are detailed accounts of executive branch discussions questioning why Trump this summer held up the release of $400 million in U.S. military aid to Ukraine.   ABC News: Ukrainians understood Biden probe was a condition for Trump-Zelensky talks, according to former Ukrainian adviser.     The Washington Post: Former Ukrainian prosecutor says Hunter Biden “did not violate anything.”   Additional officials mentioned in the complaint, whose roles were of interest to House Democrats on Thursday, are Attorney General William Barr, Trump lawyer Rudy Giuliani, who served as Trump’s private liaison to Ukrainian officials, and White House advisers, including acting chief of staff Mick Mulvaney.   Speaker Nancy Pelosi (D-Calif.), a veteran former member of the House Intelligence Committee who helped revise the Whistleblower Protection Act, said information brought to Congress by the unnamed intelligence official described “a cover-up” by the White House and an effort to “lock down” a verbatim transcript of Trump’s conversation with Zelensky in July when West Wing advisers recognized the jeopardy the president put himself in.   The Hill: Whistleblower complaint says Trump sought to enlist Ukraine’s help in 2020 election.   The Hill: Some House Democrats view the whistleblower complaint as a smoking gun against the president.   The New York Times: House Democrats aim for a fast, focused impeachment process.   The New York Times: Phone call showed only a slice of Trump’s intense interest in Ukraine.   The Washington Post: White House effort to shield contents of Trump’s conversation with Ukraine’s president was part of a broader secrecy effort.   Joseph Maguire, the acting director of National Intelligence, told the House Intelligence Committee — which has now seized the reins of the impeachment inquiry — that he had no information to back up the whistleblower’s nine-page complaint, but believed the intelligence official “did the right thing and followed the law every step of the way.”   Trump, who has bristled at the independence of previous intelligence and national security chiefs, reacted to his accuser far differently than did Maguire, likening the case presented against him to “treason.”    Maguire, who has been the nation’s spy chief since mid-August, attempted to persuade lawmakers that while it took him a month rather than a week to provide the whistleblower’s information to Congress, as required by law, the delay was created by the “unprecedented” nature of the allegations rather than an intention to stonewall.   “It may have taken more time than I would have liked, or you would have liked, but you have the information,” Maguire said.   The New York Times: Maguire holds his ground during Capitol Hill testimony.   The Hill: Five takeaways from the hearing.   Trump on Thursday fumed that the whistleblower’s information was secondhand and false. The New York Times reported that the White House learned of the whistleblower’s concerns during the summer — soon after Trump’s call with Zelensky — from the CIA’s general counsel, Courtney Simmons Elwood.   Before leaving New York on Thursday to return to Washington, the president suggested the officials and witnesses from whom the whistleblower derived information were like government moles, and deserving of punishment. “This is war,” the president said (Bloomberg video of Trump’s comments).   The Hill: Trump: Official who furnished information to the whistleblower is “close to a spy.”   The New York Times: Trump attacks the whistleblower and alludes to punishment for spies (transcript of the president’s remarks).   Reuters: White House scrambles to prepare for impeachment fight.   The Associated Press: Short-staffed White House dusts off Mueller playbook as pressure mounts.    Giuliani defended his actions and those of the president, but without refuting any specifics: The complaint of the so-called whistleblower, tells you on the first page his information is questionable. He says `I was not a direct witness…’ and additionally states over 20 times `I was told’, `I am concerned’, `I learned’, and not once did he say `I know,’” the former New York mayor and prosecturor tweeted. “Under Anglo-American law, that is described as hearsay. Inadmissible because it is inherently unreliable. CONGRESS: The Senate on Thursday voted to keep the government funded at current levels through Nov. 21, following in the footsteps of the House as the clock counted down toward a Sept. 30 deadline to prevent federal operations from screeching to a halt. The vote was 82-15. The Senate has failed to clear any of a dozen fiscal year 2020 appropriations bills, which means senators kicked big decisions off to November. The next stop for the continuing resolution is Trump’s desk (The Hill). The next big hurdle is a solution to break the impasses between the House and Senate, with time running out to do it (The Hill).   > Confirmed: The Senate voted on Thursday along party lines to make Eugene Scalia the next Labor secretary. The son of the late Supreme Court Justice Antonin Scalia, the newcomer to the Trump Cabinet will succeed Alexander Acosta, who resigned amid questions over a plea deal he brokered when he was a U.S. prosecutor in Florida for the now-deceased sex offender Jeffrey Epstein (The Hill).    > Election security: Senate Democrats believe more can be done legislatively to increase U.S. election security, an argument that could be strengthened in Congress by the Thursday release of a whistleblower complaint alleging the president sought Ukraine’s help in defeating one of his U.S. political rivals. The whistleblower said in the complaint that Trump’s actions regarding Ukraine could pose a risk to the U.S. government’s efforts to bolster election security in 2020. Maguire, during his House testimony, said protection of U.S. election systems is “the most important job” of the intelligence community, while cyber threats are the most significant risks facing the United States (The Hill).

INTERNATIONAL: The Defense Department will deploy about 200 U.S. troops, one Patriot missile battery and four ground-based radar systems to Saudi Arabia, the Pentagon said Thursday. Two more Patriot batteries and a THAAD missile defense system may be sent later, if needed. Trump announced last week the United States would send military aid to the region in response to what the administration says was Iran’s attack on Saudi oil facilities on Sept. 14 using a cruise missile and drones. Iran has denied responsibility. The administration this week at the United Nations repeated the United States does not want war with Iran and will continue to intensify economic sanctions (The Associated Press).    > Iran: Following a U.N. visit this week, Tehran faces diminishing choices, reports Aya Batrawy in an analysis for The Associated Press. Iranian President Hassan Rouhani urged the United States on Thursday to “cease this policy of maximum pressure,” saying it diminished the potential for negotiations. Rouhani repeated that U.S. sanctions must be lifted before Iran would talk with Trump, although he did not totally rule out such a meeting (The Associated Press).   > Syria: The United States on Thursday announced its conclusion that President Bashar al-Assad and the Syrian government used chlorine as a chemical weapon in an attack on May 19 during a battle with insurgents in Idlib. “The Assad regime is responsible for innumerable atrocities some of which rise to the level of war crimes and crimes against humanity,” Secretary of State Mike Pompeo said in New York. The Trump administration, which has bombed Syria twice following Assad’s suspected use of chemical weapons, did not announce a response. However, the Treasury Department applied new sanctions to two Russian entities as punishment for providing fuel to Syria (CNBC).   > United Kingdom: Prime Minister Boris Johnson, who has said he will refuse to seek a delay in the Oct. 31 Brexit deadline to withdraw from the European Union, has raised fears he could try to exploit a specific loophole in the legislation (Reuters).

Experts believe the dramatic change — a net increase of just 200,000 people, according to 2018 data — is likely linked to the Trump administration’s restrictive migration policies (The New York Times). Separately on Thursday, the administration proposed slashing refugee admissions to 18,000 for fiscal year 2020, down from a cap of 30,000 in 2018. And finally …   The 25th anniversary of “Friends” inspired our quiz this week and resulted in some smart guesses from readers about the award-winning NBC sitcom that ran for 10 seasons.   Kudos to the trivia masters who sent us five correct answers: Patrick Kavanagh, Lorraine Lindberg, Candi Cee, John Donato, William Chittam, Jerrica Mathis, Allyson Foster and Luther Berg.    “Friends” made the most of celebrity guest performances over the years. Although a musical appreciation for David Bowie was written into several episodes, the late singer, songwriter and actor never made an appearance on the show.   Sweetly loopy character Phoebe Buffay, played by Lisa Kudrow in all 236 “Friends” episodes, worked as a masseuse and musician.   Character Ross Geller’s first wife (part of a running gag about his marriages) was Carol Willick.   Character Joey Tribbiani had seven sisters.   Phoebe gave birth to triplets on “Friends” and named one of them after character Chandler Bing, portrayed by Matthew Perry.

When #MeToo Backfires
This week, the woman considered to be the pioneer of the #MeToo movement in France was ordered by a court in Paris to pay over $20,000 in damages to the man she accused. Sandra Muller, a journalist, accused Eric Brion of harassment during the firestorm of #MeToo in 2017. She started a hashtag of her own, #balancetonporc, or “expose your pig, which quickly caught fire and turned Brion’s world upside down. The story, as it turns out, was that Brion made some inappropriate comments about Muller’s appearance during a party.
 
In an emotional defense of himself, Brion claimed he even sent an apology text to Muller the day after the incident, to which she never responded. “Muller’s violence against me has never stopped,” he said. “The violence of people hiding behind their phones.”
 
The story brings up the inevitable question in the wake of online cancel culture: “Can men never make a mistake again?”

In a related incident this week, a female reporter doing a live broadcast to report on the Bourbon and Beyond Festival in Kentucky was surprised when a young man jumped into the shot and attempted to kiss her on the cheek before running off. She appeared to laugh it off on camera, but just a few days later she appeared in a studio segment where she characterized the flirtatious encounter as “assault.”
 
The term “assault” applied to a man who barely grazed your cheek while attempting to be funny and flirtatious should raise eyebrows, particularly to the scores of people across the world, including children, who are actually abused and assaulted every day.

I’ve been missing my days as a sommelier and have rediscovered my love of cooking in an effort to get healthy, so starting today, Friday BRIGHT will feature food and beverage recommendations that should be accessible to all our readers, no matter where you are!  

SIP: It is supposed to be fall, but as we are experiencing a late summer, I’m not quite ready to give up crisp refreshing cocktails in favor Manhattans and Sidecars just yet. 

The Aviation is a perennial favorite of mine and is easy to make but does need a few non-staple ingredients. Just a hint of florality and a zip of fresh lemon, it is easy to have one too many. But they are oh-so delicious and not at all sweet. Classic and sophisticated.
·      2 oz London style dry gin
·      ½ oz Luxardo Maraschino Liqeuer
·      ¼ oz Crème de Violette
·      ¾ oz fresh squeezed lemon juice
Combine all ingredients in cocktail tin and shake for one full minute. Serve in martini glass with brandied cherry or lemon peel. (Liquor.com for photos and more details)

POUR: The very best wine pairing for watching the International Space Station wiz by this evening is a glass of bubbly. Here, I make my case for Spanish Cava. I find it hard to make specific producer recommendations not knowing which wine shops readers will have ready access to, but Cava is everywhere, and it’s cost effective to boot. Dry, yeasty, and creamy on the palette like Champagne but unlike Prosecco, which should only be consumed when combined with peach nectar or orange juice. Be sure to by ‘Brut,’ and chuck your flutes. Drink Cava out of a normal wine glass. (Cava recommendations under $15 from VinePair)
 
NIBBLE: I recently perfected my Dijon baked Chicken recipe: easy, healthy, and delicious.

Heat oven to 450, then pat dry, salt and pepper chicken breasts on both sides, and place them on an aluminum lined baking sheet. Coat top of breasts with a thin layer of Dijon mustard. Combine 1/8thcup Parmesan and 1/8thcup breadcrumbs in a bowl with a teaspoon of salt, dash of pepper, and teaspoon of olive oil (for 2 breasts, multiply for larger portions); whisk until well combined. Using a spoon, scoop the mixture onto the breasts and press gently to form the crust. Bake for 24-26 minutes and allow to cool. I usually serve with potatoes and a green veg, or slice and eat with salad, but that is chef’s choice! (Best Dijon mustards you can buy on Amazon!)

Click here   Good morning,Forty-three percent (43%) of voters nationwide believe President Trump behaved inappropriately in his now infamous phone call with the Ukrainian president. A ScottRasmussen.com national survey found that 31% disagree and believe the president behaved appropriately. Twenty-five percent (25%) are not sure.Democrats, by a 66% to 18% margin, believe the president acted inappropriately. Republicans, by a 58% to 15% margin, hold the opposite view. Among Independent voters, 20% say the behavior was appropriate, 45% inappropriate, and 34% are not sure.Twenty-eight percent (28%) believe the president committed treason on that call. That includes 46% of Democrats, 24% of Independents, and 11% of Republicans. By way of comparison, that’s lower than the number who believe President Trump committed treason in his dealings with the Russians.When asked which Democratic presidential candidate had been accused of inappropriate dealings with Ukraine, 56% selected Joe Biden and 29% were not sure. Five percent (5%) said no Democrats had been accused, 4% thought it was Bernie Sanders, and 3% named Beto O’Rourke. Two percent (2%) thought that Elizabeth Warren or Andrew Yang had been accused of such dealings.Sixty-six percent (66%) of Republicans were able to identify Biden as the candidate who has been accused. So were 52% of Democrats and 50% of Independent voters.So far, there has been no measurable impact on the president’s job approval ratings.On Tuesday, we will release our next weekly update on support for impeachment. Last Tuesday, we reported that 44% of voters nationwide believe President Trump should be impeached and removed from office. 1.) Chicago Teachers Union vote to authorize strike; walkout could begin Oct. 7 FRIDAY, SEPT 27 Chicago Teachers Union members have voted by a huge margin to authorize a strike, setting the stage for about 25,000 educators to walk off the job as early as Oct. 7.
Though an actual strike remains uncertain, Thursday’s vote results mark a big step toward what would be the first teacher walkout in Chicago Public Schools since 2012 and represents a major challenge for Mayor Lori Lightfoot early in her first term in office.

But Mayor Lightfoot shows up and calls his comments ‘nonsense.’ FRIDAY, SEPT 27 The new director of ICE in Chicago pushed back against the city and state policies that aim to protect immigrants, but he was met with even more opposition from Mayor Lori Lightfoot, who sought to upstage the federal agency’s news conference.

FIRST READ: The Ukraine story has been playing out for a lot longer than you might think

One misperception of this Ukraine-Trump-whistleblower story is that it came out of nowhere.
 
In fact, it’s been playing out for months — in plain sight.

Ring a bell? Allegations of misusing a highly classified database

Here’s the big news from yesterday’s release of the whistleblower’s complaint to Congress, per NBC’s Carol E. Lee.

“Allegations by a whistleblower that White House officials misused a highly-classified database to shield President Donald Trump’s quest for information against a political opponent have raised alarm among national security experts and former government officials familiar with the secret, electronic system,” Lee writes.

More: “Former and current intelligence officers who spoke on the condition of anonymity said that, if true, such misuse should spark an investigation into the potential mishandling of a classified system.”

And: “‘The only reason to use classification to limit who sees a transcript is if the conversation is classified,’ said Ben Rhodes, a deputy national security adviser in the Obama administration. ‘We know from the transcript that the conversation wasn’t classified so the only reason to restrict access is to protect the president’s corruption.’”

2020 VISION: Bennet urges caution about the march toward impeachment

Democratic presidential Michael Bennet, who didn’t qualify for the third Dem debate, told Politico that Democrats need to be cautious when it comes to impeachment over this whistleblower story.
 
“I think that we need to let this investigation take its course before anybody makes that judgment and I’ve got responsibilities on the Intelligence Committee to do oversight; I’ve not reached a conclusion. I do think that it would be nice for us to have a president who didn’t behave the way this president did on that telephone call,” he said.
 
Bennet added, “Look, I’ve said I think that he’s committed impeachable offenses. I said that about the Mueller Report. I think it’s clear from the Mueller report that he obstructed justice, and I think that’s an impeachable offense. [But] what I think and what the American people think are two different things. And you can’t remove a president unless there’s public sentiment. I suppose you could try, but it seems to me that there would be a debacle in the country.”

On the campaign trail today: Joe Biden is in Las Vegas… Elizabeth Warren holds a town hall in New Hampshire… Andrew Yang also stumps in the Granite State… And Pete Buttigieg has a one-on-one interview with MSNBC’s Stephanie Ruhle at the Texas Tribune Festival.

Dispatches from NBC’s embeds: Andrew Yang campaigned yesterday in New Hampshire, where he emphasized the economy and took questions on the climate, the Department of Education Budget and supporting veterans. NBC’s Julia Jester spoke with a few voters after the event who gave Yang mixed reviews. One undecided voter said the primary race is a “moving target”, but when it came to national Democrats and impeachment said, “even if the Democrats legitimately hurt themselves doing this, I believe that they think it’s the right thing to do.”Another voter who supports Julian Castro said he was surprised by Yang’s sole focus on the economy, “I’m finally getting a little tired about it being about the economy” rather than the environment, he told Jester.

And in Biden world, Joe Biden told California donors that President Trump is trying to “hijack an election”, according to the pool report. While at the event, Biden mimicked Trump and said Trump was aiming at him given his lead in many polls.

That’s the number of Democratic House members who have NOT come out in favor of some kind of impeachment proceedings against Trump.

What’s more, all but one of those 11 represent districts that voted for Trump in 2016.

The exception? Tulsi Gabbard.

My first book was on that topic.
