Inside the Democrats’ impeachment schism

IT’S IMPOSSIBLE to truly make an informed judgment or assessment about how HOUSE DEMOCRATS’ JUDICIARY hearing with COREY LEWANDOWSKI went Tuesday. Because no one has any idea what the party’s end goal is.

YOU HAVE ONE CAMP OF PEOPLE — the Democratic leadership — holding out against impeachment, saying that the party would pay a political price for proceedings to remove the president, almost no matter what the evidence shows. And another camp — House Judiciary Chairman JERRY NADLER (D-N.Y.) chief among them — that believes the committee and the public have the information they need to begin the process of getting rid of President DONALD TRUMP.

THE FOLLOWING THINGS came out Tuesday: Lewandowski testified under oath that the president asked him to pass a message along to JEFF SESSIONS about ending the Mueller investigation — something we knew from the Mueller report, but is nonetheless significant when coming from Lewandowski’s mouth. Lewandowski also offered a master class in declining to answer questions from Congress — raising the specter of obstruction.

NADLER also accused Lewandowski and the White House of a cover-up. Barry Berke — an outside Democratic counsel — skillfully painted Lewandowski as dishonest, and tripped him up repeatedly during a staff questioning segment tucked at the end of the hearing.

IF DEMOCRATS WERE LOOKING TO IMPEACH THE PRESIDENT, or were clear-eyed in what they were trying to accomplish, Tuesday would have gone a long way in helping build a case. Some Democrats privately told us that Lewandowski’s stonewalling was certainly enough to hold him in contempt. But the party is so deeply divided on what they should do next that, to many Dems, it all seemed like a circus without a clear purpose.

THE QUESTION IS THIS: Will any of these moments have a crystallizing effect in either direction? Right now, Democratic insiders say 175 of their members would vote for impeachment today on the House floor. Will that ever tick up, in the face of a leadership that’s looking to tamp it all down? Remember: Dems would need 218 votes on the floor to impeach the president.

RIGHT NOW, DEMOCRATIC LAWMAKERS continue to work at cross-purposes. So, at the moment, many Democrats feel listless, hapless and lost on this subject.

TRUMP, meanwhile, has found a strategy with little immediate downside: His aides and former aides are either not showing up for congressional hearings or, in Lewandowski’s case, stonewalling and appealing directly to Trump, because, why not? Democrats are not beginning impeachment, or otherwise punishing the administration.

HOW IT PLAYED … ‘POSSIBLY OBSTRUCTING JUSTICE’ IN THE LEDE! … NYT’S NICK FANDOS on A15: “Corey Lewandowski, one of President Trump’s most loyal political confidants, confirmed in congressional testimony on Tuesday that the president had once asked him to help curtail the scope of the Russia investigation, possibly obstructing justice.” NYT

— WAPO’S RACHAEL BADE, COLBY ITKOWITZ and JOHN WAGNER: “Democrats on the House Judiciary Committee subpoenaed Trump’s former campaign manager, hoping to learn more about his testimony to special counsel Robert S. Mueller III in the probe of Russian interference in the 2016 election. Instead, they got a front-row seat Tuesday to the Lewandowski Show — a performance aimed at an audience of one: his former boss.” WaPo

— ANDREW DESIDERIO and KYLE CHENEY: “House Judiciary Committee Jerry Nadler (D-N.Y.) suggested that Lewandowski’s refusal to answer questions about his conversations with Trump — at the behest of the White House — bolsters Democrats’ case to impeach the president, even as Speaker Nancy Pelosi remains opposed to the idea.

“‘When you refuse to answer these questions, you are obstructing the work of our committee. You are also proving our point for the American people to see: The president is intent on obstructing our legitimate oversight. You are aiding him in that obstruction,’ Nadler told Lewandowski. ‘And I will remind you that Article 3 of the impeachment against President [Richard] Nixon was based on obstruction of Congress,’ Nadler added.” POLITICO

THE NEXT FIGHT — “Schiff: Top intel official has refused to turn over ‘urgent’ whistleblower complaint,” by Kyle Cheney: “The nation’s top intelligence official has refused to comply with a House Intelligence Committee subpoena to provide the contents of a whistleblower complaint that a government watchdog deemed ‘urgent’ and credible, Chairman Adam Schiff said late Tuesday, warning that the agency may be acting to conceal high-level wrongdoing by President Donald Trump or his immediate advisers.

“‘The Committee’s position is clear – the acting DNI can either provide the complaint as required under the law, or he will be required to come before the committee to tell the public why he is not following the clear letter of the law, including whether the White House or the attorney general are directing him to do so,’ Schiff said.

“‘He has yet to provide the complaint in response to the committee’s subpoena, so I expect him to appear on Thursday, under subpoena if necessary,’ he added.” POLITICO

— WSJ’S WARREN STROBEL and SIOBHAN HUGHES: “In a letter reviewed by The Wall Street Journal, the DNI’s general counsel told Mr. Schiff the agency ‘has complied fully with all applicable law’ in handling the whistleblower’s complaint, adding ‘we are disappointed’ by the subpoena and demands for Mr. Maguire to testify.

“The general counsel, Jason Klitenic, wrote that it would be premature, at this juncture, for Mr. Maguire to appear at a congressional hearing Thursday, as Mr. Schiff demanded. He also wrote that the DNI wouldn’t be able to turn over documents to the panel by Mr. Schiff’s Tuesday deadline because the office needed to consult with other parts of the executive branch.

“The Office of the Director of National Intelligence ‘remains committed to working with the Committee to reach an acceptable accommodation,’ he wrote.” WSJThe letter

IN MEMORIAM — “Veteran television newsman Sander Vanocur dies at 91,” by AP’s Andrew Dalton: “Sander Vanocur, a television newsman who for decades covered momentous events from political campaigns to assassinations, the Vietnam War to the civil rights movement, has died, his son said Tuesday. Vanocur died Monday night in Santa Barbara, California, said Chris Vanocur. He was 91. He had been dealing with dementia in recent years.

Wednesday, September 18, 2019 Corey Lewandowski Testifies “President Donald Trump’s former campaign manager on Tuesday acknowledged that his former boss enlisted him to try to limit the Russia election interference inquiry but defended Trump and tangled with Democrats during pugnacious testimony to a U.S. congressional panel mulling whether to impeach the president… [The White House had instructed] Lewandowski on Monday not to discuss conversations with Trump after he became president by invoking a doctrine called executive privilege.” Reuters From the Left The left is critical of Trump’s attempt to claim executive privilege, Lewandowski’s behavior, and the seeming lack of strategy on the part of Democrats. “To be clear, the president has no authority to tell a witness not to show up. The president has no absolute immunity to prevent ex-aides from testifying. And he really has no basis for instructing a private citizen who never served in the White House to obstruct an investigation.”

Lewandowski’s testimony simply confirms that Mueller got it right — contrary to the repeated claims of Lewandowski’s chief benefactor Trump, who has repeatedly attacked Mueller’s impartiality and veracity… 

House Democrats need to address this question squarely: Is the conduct in the Mueller report enough to impeach? If so, then why are we wasting time with the kind of absurd hearing we saw on Tuesday? (Note: they don’t need more — the House impeached President Bill Clinton based on the written report of Independent Counsel Ken Starr, without calling live witnesses). And if not, they’re not going to magically get some brand new, previously unknown smoking gun, especially not from partisan, dishonest favor-seekers like Lewandowski.”

Editorial Board, New York Times From the Right The right is generally skeptical about executive privilege applying to Lewandowski’s testimony but condemns the overall investigation as political theater. “Trump wants to shut down Nadler’s endless investigations and will play the executive privilege card for as long as it works. This looks like one play too many… Lewandowski is, strictly speaking, a civilian when it comes to privilege. Traditionally, executive privilege has been extended to formal advisers to a president. Lewandowski might have been a friend, but he’s never been appointed to a post in the White House, nor did he serve any official role in the transition. Usually, one has to be in the executive branch to qualify for a claim of executive privilege.”

Some, however, counter that “we want the president to be able to have candid conversations with worthy advisers in and out of government in order to make the best decisions for the country. Moreover, our system is based on separation of powers, so Congress should not intrude on communications the president has in furtherance of exercising his legitimate authority… If some future Democratic president phoned Henry Kissinger to consult on China policy or the most efficient structure of the State Department, I believe those communications would be covered by executive privilege even though Dr. Kissinger is not a government official…

We also know the Democrats are not going to impeach the president over it — regardless of where we come out on whether it comes close to an impeachable offense.”

President Trump, faced with rising tensions in the Middle East, worked on Tuesday to balance international diplomacy with potential punishment, including military action, aimed at Iran following Saturday’s sophisticated missile and drone strikes against oil facilities in Saudi Arabia. The president on Tuesday received a menu of possible actions against Iran, and asked for additional ideas, NBC News reported. Trump is interested in a narrowly focused response that would not draw the United States into a military conflict with Iran. One option is a strike by Saudi Arabia, supported by U.S. intelligence. The administration is weighing a range of options for a retaliatory response against Iran, including a cyberattack or physical strike on Iranian oil facilities or Revolutionary Guard assets, according to NBC News. U.S military action did not appear imminent, and officials stressed that no decisions had been made about next steps. However, the Defense Department is working through options to increase its presence in the region, officials said. Iran has denied its involvement in Saturday’s strikes. 
Reuters: U.S. believes Saudi oil attacks came from southwestern Iran.  
USA Today: Secretary of State Mike Pompeo travels to Saudi Arabia to discuss attacks blamed on Iran. 
Reuters: The Saudi Defense Ministry will present “material evidence and Iranian weapons proving the Iranian regime’s involvement in the terrorist attack” today at a news conference, officials said. Preliminary results showed the attack did not come from Yemen, Saudi officials maintain. 
Trump said he would prefer not to meet with Iranian President Hassan Rouhani on the sidelines of the United Nations General Assembly next week, amending his interest in such a meeting in the days prior to the attacks, which took place deep into Saudi Arabia (The Hill).  
“I never rule anything out, but I prefer not meeting him,” Trump said aboard Air Force One on Tuesday. Iran had said such a meeting would not take place during the U.N. gathering of world leaders in New York, and it’s now possible Iran may skip the assembly entirely. Iran today warned of an “immediate” response to any action taken against it (The Associated Press). 
On Capitol Hill, the Senate Republican Conference received a briefing on Tuesday from Vice President Pence about Saturday’s attacks and Iran’s suspected involvement. Sen. Lindsey Graham (R-S.C.), who is up for reelection, tweeted that he is persuaded “such a sophisticated attack could not have occurred without Iran’s blessing and direct involvement.”Graham, who said Iran saw the “measured response” by the United States as “weakness,” urged the administration to “take decisive action to deter further aggression by the Ayatollah and his henchman.” Trump, who plays golf with Graham and has sought his advice on a number of topics, tweeted a barbed reply: “No Lindsey, it was a sign of strength that some people just don’t understand!” Meanwhile, the outcome of Israel’s election on Tuesday pitting Prime Minister Benjamin Netanyahu, who faced voters for the second time this year, against former Gen. Benny Gantz and the Blue and White party, remains deadlocked today as results continue to be tallied, signaling serious trouble for Netanyahu’s decade of conservative rule.  Parliamentary kingmaker Avigdor Lieberman said today he’ll demand a secular “liberal” unity government between the Likud and Blue and White parties, devoid of the religious and ultra-Orthodox allies Netanyahu leans on. Without Lieberman’s endorsement, both parties appear to have fallen well short of securing a parliamentary majority. “There is one and only option,” Lieberman said, “a national unity government that is broad and liberal and we will not join any other option.” His comments signaled a roadblock for the continuation of Netanyahu’s rule (The Associated Press). 
On Iran policy, Trump and Netanyahu have been largely on the same page in public. The president earlier this year sought to help the prime minister win reelection, but this time, the White House has seemed determined to stand on the sidelines while Trump has appeared preoccupied with U.S. responses to Iran (Reuters).

 In other administration news … Faced with a thinned national security staff and increasingly complex foreign policy challenges, Trump on Tuesday identified five current or former members of his administration he says are candidates to succeed John Bolton as White House national security adviser. The list includes Robert O’Brien, Maj. Gen. Ricky Waddell, Lisa E. Gordon-Hagerty, Fred Fleitz and retired Lt. Gen. Keith Kellogg (The New York Times). … The president is expected to nominate Stephen Biegun, the State Department’s special representative for North Korea, to be the next deputy secretary of state, according to reporting by Washington Post columnist Josh Rogin. … Trump plans today while traveling in California to revoke the state’s authority to set stricter auto emissions standards than those set at the federal level, a slap at liberal West Coast challenges to his administration and a rebuke of former President Obama’s efforts to curb greenhouse gases that contribute to climate change (The New York Times). … Trump says homeless people damage the “prestige” of Los Angeles, San Francisco and other populous cities and vows unspecified federal action. Secretary of Housing and Urban Development Ben Carson traveled to Los Angeles on Tuesday (The Washington Post).
 
 
LEADING THE DAY
CONGRESS: An appearance by Corey Lewandowski, the former campaign manager for the Trump campaign, before the House Judiciary Committee on Tuesday quickly devolved into a chaotic scene as he largely refused to answer questions on a number of topics, including references to his account of events to former special counsel Robert Mueller and conversations with the president. From the outset, Democrats attempted to confront the witness about references to his recollections in Mueller’s report, especially regarding the president’s request that Lewandowski deliver a 2017 letter to then-Attorney General Jeff Sessions asking that Sessions set new limits on Mueller’s probe. Lewandowski told Mueller that he did not want to deliver the message to Sessions and asked former White House aide Rick Dearborn to do it. Dearborn did not.  Rep. Steve Cohen (D-Tenn.) told the former Trump campaign hand that he “chickened out” by not delivering Trump’s message to Sessions, while Rep. Hank Johnson (D-Ga.) compared the panel’s questioning of Lewandowski to the cleaning of a fish. “Lewandowski, you are like a fish being cleaned with a spoon — very hard to get a clean answer from you,” Johnson said. Throughout, Lewandowski asserted executive privilege despite having not worked in the White House. He repeatedly defended Trump, saying the president “never asked me to do anything illegal.” Trump lauded Lewandowski’s appearance, tweeting at one point that he delivered a “beautiful Opening Statement.”  While he stonewalled lawmakers, Lewandowski had trouble answering questions from Barry Berke, the committee’s counsel, who tripped him up repeatedly and forced Lewandowski to acknowledge that he has been dishonest to members of the media (The Hill). 
Lewandowski also told Berke that he did not deliver the message to Sessions because it wasn’t “a priority” in his mind.    Lewandowski is among three witnesses the committee has sought to question, including Dearborn and Rob Porter, the former White House staff secretary. Multiple Democrats on the panel called on House Judiciary Committee Chairman Jerrold Nadler (D-N.Y.) to hold Lewandowski in contempt. “Mr. Lewandowski, your behavior in this hearing room has been completely unacceptable. It is part of a pattern of a White House desperate for the American people not to hear the truth,” Nadler said after committee members concluded their questioning.   “I’ve been asked several times today whether the committee will hold you in contempt. It is certainly under consideration,” Nadler said. 
Lewandowski also tried to make the most out of his appearance. During a mid-afternoon break, the former Trump aide announced the launch of a new website promoting a possible Senate bid in New Hampshire that featured pictures of Lewandowski and the president. “President Trump said Corey will be a ‘fantastic’ Senator … ‘great for New Hampshire’ and ‘great for America.’ Add your support for Corey to run for U.S. Senate,” the site reads. Jonathan Allen: Lewandowski pumps life into assertions of obstruction of justice by Trump.

 > Retirements galore: Another House Republican announced his planned exit from Congress on Tuesday, adding to the party’s recent wave of retirements fresh off an annual GOP retreat, which focused on a path to clawing back the majority next year.  Rep. Paul Cook (R-Calif.) announced he will leave Congress next year, making him the 18th House Republican to announce a decision to forfeit a run for reelection in 2020. Instead, Cook said he would run for a seat on the San Bernardino County Board of Supervisors, underscoring the challenges for GOP leaders to convince rank-and-file members to stay in the House as members of the minority.  Cook’s decision to run for local office instead of reelection to Congress isn’t without precedent. Former Rep. Janice Hahn (D-Calif.) chose to run for the Los Angeles County Board of Supervisors instead of another term in the minority in 2016, while ex-Rep. Candice Miller (R-Mich.) opted for a stint as Macomb County public works Commissioner the same year.  Hours before Cook’s announcement, House Minority Leader Kevin McCarthy (R-Calif.) downplayed the pile-up of GOP lawmakers who plan to depart Congress (The Hill). 
“All the retirements except one this cycle [are] in a safe seat,” McCarthy told “Fox & Friends.“ “I think it’s healthy. I had one member come to me who’s been on the ballot since 1988 and he says, ‘I can’t give you a hundred percent to go win the majority. So let’s bring some new people in at the same time.’” Five GOP open seats in 2020 are seen as toss-ups, leaning Republican, or leaning Democratic according to the Cook Political Report (no relation to Rep. Cook). > Kavanaugh: An aggressive push by progressives to impeach Associate Justice Brett Kavanaugh is falling flat on Capitol Hill as top Democrats continue to oppose it and argue about whether it’s a politically prudent move. While Rep. Ayanna Pressley (D-Mass.) introduced a resolution Tuesday calling for an impeachment inquiry, Democratic leaders are signaling they want nothing to do with it as they try to juggle the already perilous fight over impeaching the president with their party agenda. Some Democrats warned on Tuesday that it’s time to move on, noting that an impeachment effort would face a GOP buzzsaw even if it got through the House. “We should be focused on making sure this never, ever happens again. We need a functional background investigation process from the FBI,” said Sen. Chris Murphy (D-Conn. “I think it’s highly unlikely you’re going to get an impeachment vote through the United States Senate, so our best remedy may just be trying to make sure this doesn’t happen again.”    Sen. Sheldon Whitehouse (D-R.I.), a member of the Senate Judiciary Committee, echoed Murphy and argued that those pushing for impeachment are over their skis.  “We seem to have a habit of wanting to get to the verdict before we’ve gathered the evidence. I don’t, as a former prosecutor, approve of that habit,” Whitehouse said (The Hill).

POLITICS: Most Senate Democrats are staying neutral in the race for the  Democratic presidential nod. However, there’s a growing sense in the caucus that life would be easier if former Vice President Joe Biden takes home the party’s nomination instead of his closest competitors and two of their colleagues, Sens. Elizabeth Warren (D-Mass.) and Bernie Sanders (I-Vt.).   
According to a report by Alexander Bolton, Democrats acknowledge that if the nomination goes to Warren or Sanders — both of whom are far to the left of most Senate Democrats — it will create immediate tensions within the party.  Many don’t want to take sides in a battle that is pitting colleagues against one another, and senators obviously don’t want to create bad blood with any contenders — who will either return to the Senate or end up at 1600 Pennsylvania Ave.  Yet a number of Democrats privately acknowledge that if Warren or Sanders wins the nomination, it will create immediate tension within the party as their best-known proposals, such as Medicare for All and free college education, have scant support within their caucus.  “The senators have a great confidence in their own ability with a friendly White House to say, ‘We like a lot of that, but we don’t like all of it,’” one Democratic senator said. “We’re not going to just do what they ask because they ask.” Senate Democrats also acknowledge that it will be easier to win Senate races in conservative-leaning states such as Alabama, North Carolina, Iowa and Georgia if Biden is on top of the Democratic ticket rather than Warren or Sanders against Trump next year.

 > Voter suppression: During a speech at George Washington University on Tuesday, Hillary Clinton argued that the United States faces a “crisis in democracy” as a result of voter suppression aimed at keeping women and people of color from the polls.  In her address, Clinton accused the GOP of rolling back voter protections and employing tactics aimed at keeping racial minorities from casting ballots. The former secretary of State said that she has been counseling Democratic White House hopefuls specifically to warn them about voter suppression, hacking, fake news stories and a lack of election security in 2016, all of which she believes played a role in her election loss to the president, adding that failing to address those issues could lead to defeat for the party once again next year.   “This is one of those moments we stand at a crossroads of our own a crisis in democracy,” Clinton said. “Racists and white supremacist views are lifted up in the media and the White House. Hard fought for civil rights are stripped back. Rule of law is being undermined, our norms and institutions … are under assault, and that includes the single most important fight of our times … the fight to protect the right to vote” (The Hill).

Journalism: Renowned and admired Washington journalist Cokie Roberts, a veteran of NPR and ABC News and a longtime contributor to PBS’s “The MacNeil/Lehrer NewsHour,” died at age 75 on Tuesday after complications from breast cancer, her family said in a statement. Roberts, considered a pioneer among female journalists who joined NPR in 1978, became a bestselling author and Emmy Award winner, known for her distinctive coverage of politics and Congress. She was a member of a well-known political family. Her father, the late Rep. Thomas Hale Boggs Sr., a former Democratic House majority leader from Louisiana who was a member of the Warren Commission, disappeared in a plane over Alaska in 1972. Her mother, Lindy Boggs, served in the House for 17 years and later became U.S. ambassador to the Vatican. Roberts married veteran journalist Steven Roberts in 1966 (NPR).

And finally … Baseball reached a new milestone a week ago, for better or worse, when Baltimore Orioles infielder Jonathan Villar rounded the bases, marking the 6,106th home run of 2019, breaking a record set two years ago.  While a lot has been made of the ball Major League Baseball has used in 2019, FiveThirtyEight delves deep into what else is behind the home run surge: backspin. As Travis Sawchik writes: “Backspin often works in favor of the hitter, as it creates a Magnus effect, which pushes up on the baseball to create lift. But there can also be too much of a rise effect. When studying golf balls, researchers have found that when too much spin is added at certain launch angles, there is a “ballooning” effect. For baseball hitters, that means that excessive spin might lead to batted balls traveling higher, but not farther.”   “Alan Nathan, physics professor emeritus at the University of Illinois and MLB consultant, says there are optimum spin levels in baseball for batters. “Not only does the lift increase with the spin, but it’s really only been in the last few years that we’ve realized that the air drag also increases with the spin,” Nathan told FiveThirtyEight. “So that slows the ball down.”

Media Smears that Trivialize Sexual Assault Continue Against Kavanaugh
New York Times reporters Robin Pogrebin and Kate Kelly blamed their editors for their piece’s omission of the obviously-relevant fact that the latest Kavanaugh assault allegation victim does not remember the incident. But the pair omitted the same critical detail in other interviews about their reporting.
 
“…In a length and wide-ranging interview, the authors went out of their way to omit the key detail in response to a question…
 
The authors also go out of their way to avoid mentioning that the supposed victim does not claim any such thing occurred and, in fact, has told several friends that she remembers no such incident as the one described by Stier…
 
In fact, the omission was so significant that [NPR’s Terry] Gross recorded an update and inserted it into the show immediately thereafter, noting the omission and how it also had to be corrected at the New York Times.”
 
The indomitable Mollie Hemingway, who has to do the mainstream media’s real journalisming for them, in addition to the above column, calls out another error in the reporting, where she notes that while the authors say key witnesses were “silent,” the reality is that they actually defended Kavanaugh. 
 
I find this whole debacle enraging, as the political trivialization of sexual assault continues apace on the anniversary of the Kavanaugh hearings. 
 
And Then There Were Three
Three candidates appear to be pulling away from the pack, according to a new NBC News/WSJ poll. Joe Biden at 31, Elizabeth Warren at 25, and Bernie Sanders at 14, with the rest of the field trailing in single digits, including Kamala Harris, who seems to have really fallen back. 

Internet favorite Andrew Yang, who said some controversially sane things about cancel culture and forgiveness earlier this week, is actually up in the second tier, and another poll actually has him beating Harris.

Beto O’Rourke reiterated his intention to forcibly grab your guns. Julian Castro stood on a box and botched an attack on Joe Biden. Elizabeth Warren and Bernie Sanders disappeared for long periods. Marianne Williamson was missed. Jorge Ramos was embarrassing. Nothing changed.

FIRST READ: NBC/WSJ poll shows that both Biden and Warren are building formidable Democratic coalitions

The latest NBC News/Wall Street Journal survey is a good poll for only two 2020 Democrats.

Joe Biden and Elizabeth Warren.

Want evidence that Biden is more durable than the conventional wisdom suggests? Well, he’s leading the Democratic horserace at 31 percent – up 5 points since July.

He also has a substantial lead with African-American Democratic primary voters. And he’s dominating the party’s moderate/conservative/smaller change lane, which he has pretty much all to himself.

Want evidence that Warren has the momentum and could very well be the nominee next year? Well, she’s on Biden’s heels at 26 percent – up 6 points since two months ago.

She has the most enthusiasm around her: 35 percent of Dem primary voters say they’re enthusiastic about voting her, versus Biden’s 23 percent.

And she gets the most second-choice support in the poll, suggesting that she has crossover appeal in the race.

Maybe most important of all, the NBC/WSJ poll shows that both Biden and Warren have potentially winning coalitions.

Biden enjoys significant advantages with African Americans, older Dem primary voters (those traditionally most likely to show up), and moderates and conservatives.

Warren, on the other hand, has the strong edge with liberal Democrats, women with college degrees and those who want large-scale change.

Bottom line: You can make the case that EITHER is the frontrunner – right now – to win the Dem nomination.

Now it would be a mistake to call it a two-person race (or even a three-person race when you add Bernie Sanders and his 14 percent support).

As our poll shows, only 9 percent of Dem primary voters have definitely made up their minds about their choice, so these numbers aren’t set in stone.

But we are seeing the beginning of a sorting process in the Dem race – with older, more moderate, and African Americans voters flocking to Biden, and with liberals, women and the college educated increasingly breaking Warren’s way.

Even with 138 days until Iowa, that sorting process is hard to ignore.

The Greatest Generation(al) Divide

Want to see how divided Democratic primary voters are by age?

Well, Joe Biden is the first choice among just 10 percent of Democratic primary voters ages 18-34 (versus his overall 31 percent).

Conversely, he gets 39 percent among those 50-64, and a whopping 46 percent among those 65 and older.

Meanwhile, Bernie Sanders is at 33 percent support among those 18-34 (compared with his overall 14 percent), but he’s at just 3 percent (!!!) among those 50-64 and 2 percent (!!!) among those 65 and older.

The good news for Warren in this poll is that she straddles this divide, getting 25 percent among those 18-34; 24 percent among those 35-49; 25 percent among those 50-64; and another 25 percent among those 65-plus.

No matter the eventual Democratic nominee, however, a fight over the direction of the party between younger and older voters is already here.

And it likely will only intensify. 

Netanyahu refuses to concede

It’s striking that what’s playing out after Israel’s election yesterday could also occur in November 2020.

“Prime Minister Benjamin Netanyahu appeared to fall short of a governing majority in Israel’s election Wednesday, raising doubts over whether he could maintain his decade-long grip on power,” per NBC News.

“Early Wednesday morning, Netanyahu refused to concede defeat and vowed to form a new government that excludes Arab parties… Facing the end of his political career, and potentially even jail, Netanyahu pulled out all the stops throughout the campaign.”

“‘War to the last minute,’ he said on Twitter on Tuesday in a late attempt to get supporters to the polls. ‘We will lose if you do not wake up.’”

Of course, don’t count out Netanyahu until all of the votes have been counted.

But if he loses, it’s a reminder that political gravity eventually catches up to everyone.

2020 VISION: Kamala Harris’ campaign mulls its next steps

The other big finding from the NBC/WSJ poll was Kamala Harris’ 8-point drop to fifth place in the Dem contest – just 1 point above Andrew Yang.

NBC’s Deepa Shivaram, Vaughn Hillyard and Beth Fouhy write about the campaign’s next steps.

“Harris advisers say the candidate will continue to prioritize fundraising ahead of the Sept. 30 third-quarter fundraising deadline. The California senator raised $12 million in the second quarter, less than Biden, Warren, Sanders and Buttigieg.”

“We’re not playing to win a summer news cycle in the off-year,” Harris spokesman Ian Sams tells NBC News. “We’re playing to win an election. We’re aiming to peak at the turn of the year when we’re approaching votes – and we’re built to do that.”

On the campaign trail today: Beto O’Rourke, in California, visits San Quentin prison… And Amy Klobuchar, in Pennsylvania, stumps in Philadelphia and Pittsburgh. 

Dispatches from NBC’s embeds: Six presidential candidates spoke at the 2019 AFL-CIO convention yesterday, per NBC’s Gary Grumbach and Marianna Sotomayor.

“Sen. Bernie Sanders received the warmest welcome by far – a standing ovation, and chants of ‘Bernie! Bernie’ throughout his remarks.” And Andrew Yang seemed to miss the mark when he “mentioned UAW a number of times, as if to build a relationship with people in the crowd – however there are no UAW members here, as AFL-CIO and UAW are totally separate entities.”

Joe Biden made light of the scrutiny of his career, especially about the length of his political career. Biden said, “The bad news is I’ve been around a long time. The good news is I’ve been around a long time. You all know me, I’ve never not been with you. I’ve never not taken the risk of being with you.”

Bill de Blasio, Tom Steyer and Amy Klobuchar also spoke at the event.  

DATA DOWNLOAD: And the number of the day is … 90 percent and 64 percent.

That’s the share of Democratic primary voters who say they have a positive opinion of former presidents Barack Obama and Bill Clinton, respectively, according to our new NBC News/Wall Street Journal poll.

For Obama, nearly seven-in-10 say their view is VERY positive, while just 4 percent have a negative view.

But Clinton – whose presidency is now being viewed through more modern lenses, including the #MeToo movement and the fallout from his anti-crime reforms – hasn’t fared as well.

Just 29 percent of Democratic primary voters say they have a VERY positive view of Bill Clinton, while another 35 percent say it is SOMEWHAT positive.

Fifteen percent now say they have a negative view of the former president.

Good morning, it’s Wednesday, Sept. 18, 2019. In one of his famous debates with Stephen A. Douglas, Abraham Lincoln offered a brief description of the most prevalent type of what we’d now call “fake news” — the counterfeit quotation attributed to a politician by his opponents. This bane of political discourse isn’t new to our time, in other words. It wasn’t new in 1858.
“What is a forgery? It is the bringing forward something in writing or in print purporting to be of certain effect when it is altogether untrue,” Lincoln told the audience in Charleston, Ill., 161 years ago today. “If you come forward with a letter purporting to be written by me which I never wrote, there is forgery.”
As presidential scholars and presidents themselves know, when it comes to White House history, forgeries come in many forms. Some are innocuous enough, such as the signs on rustic inns boasting “George Washington slept here” — even if the establishment asserting this claim wasn’t built until the 19th century. My favorite in this category is National Public Radio’s April Fools’ Day prank in which a Richard Nixon impersonator announced his 1992 presidential campaign.
“I never did anything wrong,” intoned the ersatz Nixon, “and I won’t do it again.”
Not all spoofs are harmless, however, as we’ll see a moment. Attributing dubious quotes, actions, or attitudes to popular presidents to serve partisan purposes is as American as apple pie. But that doesn’t make it acceptable. And although no one relishes the role of being a scold, it’s the job of honest journalists to call out the perpetrators.
I understand that it comforts religiously devout conservatives to be told that George Washington himself said, “It is impossible to rightly govern a nation without God and the Bible.” Yet it’s my job to let you know that the Father of Our Country said no such thing.
Likewise, National Rifle Association supporters are heartened by another supposed George Washington quote: “A free people ought not only be armed and disciplined, but they should have sufficient arms and ammunition to maintain a status of independence from any who might attempt to abuse them, which would include their own government.” Sorry, Washington never said that, either.
For their part, progressives love to bolster their arguments about reining in capitalism by invoking Lincoln’s warning that corporations are “more despotic than monarchy.” That purported Lincoln quote continues: “As a result of the war, corporations have been enthroned and an era of corruption in high places will follow, and the money power of the country will endeavor to prolong its reign…until all wealth is aggregated in a few hands.”
In 1999, while publicly contemplating entering elective politics, actor Warren Beatty used these lines in a speech to liberal Democrats. Many other liberals have used them as well. There are a couple of problems here. For one thing, the words sound nothing like Lincoln. Also, this phony quotation has been debunked, decade after decade, as far back as the 1890s. Lincoln’s secretary John Nicolay denounced it as a “bold, unblushing forgery.”
Oddly, Al Gore reprises the fake Lincoln lines in the recently updated paperback version of his book “The Assault on Reason.” Why is that odd? Because Gore’s book takes aim at those who contribute to voter cynicism by spreading misinformation.
Some modern journalists, including Andrew Ferguson, did their duty and pointed out that the “corporations have been enthroned” sentiment is a sham, at least when it comes to Lincoln. Many other journalists, however, merely repeated the spurious quote uncritically.
The Gore example underscores another barrier to getting it right. It’s often presidents and vice presidents who peddle phony Lincoln quotes. Ronald Reagan liked to attribute questionable conservative sentiments to Honest Abe by quoting Lincoln as saying, “You cannot help the poor by destroying the rich.”
This is not Lincoln. Nor is this line, passed off to Democratic members of Congress by President Obama as they prepared to vote on the Affordable Care Act: “I am not bound to win, but I’m bound to be true. I’m not bound to succeed, but I’m bound to live up to what light I have.”
Obama may have fooled his former Capitol Hill comrades with this awkward prose (and Lincoln was never awkward), but he didn’t fool me. You see, I remember Ronald Reagan’s penchant for the apocryphal anecdote, and I covered Bill Clinton for eight years.
Come to think of it, I was there in 1994 when Clinton said this: “The greatest Republican president — some of us think the greatest president we ever had — Mr. Lincoln, once said that you can fool all of the people some of the time, and you can fool some of the people all of the time, but you cannot fool all of the people all the time.”
As historian Jack Pitney noted to NPR, it’s a nice line, but it ain’t Lincoln.  Carl M. Cannon
