President Donald Trump believes that China has no choice but to make a trade deal. China, however, may think differently, because trade isn’t its No. 1 concern. China is rather open about its ambitions for world dominance. Unlike other presidents, Trump is taking those ambitions head-on instead of funding them with weak trade deals. In response, China is doing what it can to throw the 2020 election to anyone but Trump. Read more Inspector General Horowitz Is Coming

President Trump will rally supporters in New Mexico tonight as he kicks off a West Coast swing where he will look to line his campaign coffers and make an ambitious push to expand the 2020 map past the Midwest firewall that delivered his 2016 victory. Trump’s rally in Rio Rancho, N.M., a suburb of Albuquerque, will be his first campaign rally in the state since his 2016 victory, having made two stops there prior to his victory, and it comes as he makes a renewed push to expand the 2020 map. Along with New Mexico, the campaign is targeting New Hampshire, Minnesota and Nevada.  However, compared to those three states, the climb is steeper in New Mexico. While Trump lost the three other states by a total of roughly 4.5 percentage points, he dropped New Mexico by more than 8 points. New Mexico has also trended blue in years past.  Democrats control the governorship, both Senate seats, all three House seats and the state legislature, presenting a steep climb for the Trump campaign and its ambitions to flip the state. “New Mexico is a blue state and getting bluer, and it’s always going to be uphill sledding for any Republican presidential candidate, including President Trump,” said Colin Reed, a GOP strategist. “While there are other states he has a better chance of flipping, trying to expand the electoral college map keeps his opponents guessing and denies them valuable news oxygen.”   However, the president’s team senses an opportunity. According to a campaign aide, the president’s rally in El Paso, Texas, in February saw “a significant number of registrants” from the Land of Enchantment. The state has also seen a more progressive shift recently on which the GOP believes it can capitalize. As Alex Leary of The Wall Street Journal writes:  “Republicans hope to capitalize on Democrats’ pursuit of environmental policies that could hurt the state’s oil-and-gas industry. In March, Gov. Michelle Lujan Grisham signed into law landmark energy legislation mandating emission-free electricity by 2045. Several leading Democratic presidential candidates have outlined their own proposals, including bans on fracking, which has been a boon to New Mexico’s economy.” The Associated Press: Trump’s rally in New Mexico a bid for an upset next year. The Associated Press: New Mexico preps for Trump after past rallies sparked unrest. A few months ago, Oregon was the Trump campaign’s expand-the-map flirtation, CNN reported in June. In 2016, Hillary Clinton won Oregon by 11 points, and the last time the state voted for a GOP presidential candidate was 1984. Trump’s campaign has the finances to make long-shot plays, and to make the eventual Democratic nominee spend money in blue states.    After the president’s New Mexico stop, he is slated to make a fundraising swing through California where he’ll hold four campaign events. While Trump has no chance of winning the state, it’s an opportunity to continue his prolific fundraising. The Trump campaign and the Republican National Committee raised $105 million through the end of June. At the same time, they reported having $123 million in the bank.  McKay Coppins, The Atlantic: The heir? Ivanka Trump was always Trump’s favorite. But Donald Trump Jr. is emerging as his natural successor. The Washington Post: Trump’s proposals to tackle California homelessness face local, legal obstacles. On the Democratic side, Sens. Elizabeth Warren (D-Mass.) and Kamala Harris (D-Calif.) both came out in favor of impeaching Associate Justice Brett Kavanaugh on Sunday after The New York Times reported another allegation of sexual misconduct against the newest member of the Supreme Court.  According to the report, one of Kavanaugh’s former Yale classmates, Max Stier, notified senators and the FBI of the allegations, but the FBI did not investigate and Stier refused to confirm or discuss the information publicly. Since the report emerged, Warren and Harris called for Kavanaugh’s removal. Harris emailed supporters asking them to sign a petition supporting his impeachment (The Hill). “I sat through those hearings. Brett Kavanaugh lied to the U.S. Senate and most importantly to the American people,” Harris wrote. “He was put on the Court through a sham process and his place on the Court is an insult to the pursuit of truth and justice. He must be impeached.” As of this morning, 2020 Democratic candidates who support impeaching the justice include Warren, Harris, former Rep. Beto O’Rourke (D-Texas), former Housing and Urban Development Secretary Julián Castro and South Bend, Ind., Mayor Pete Buttigieg (The Hill).  Speaker Nancy Pelosi (D-Calif.) will be asked this week if she supports impeaching Kavanaugh. Among those who has not called for impeachment is former Vice President Joe Biden. Biden called for an investigation in a statement late Monday, but stopped short of calling for Kavanaugh’s impeachment (Axios).  “We must follow the evidence to wherever it leads,” Biden said. “Doing this the right way is critically important in getting the truth and restoring the American people’s faith in their government.” Another candidate who stopped short of calling for the associate justice’s impeachment is Sen. Amy Klobuchar (D-Minn.), a member of the Judiciary Committee. When asked on Sunday about the new allegation, she told ABC’s “This Week” on Sunday that Kavanaugh’s vetting process was “a sham.” “My concern here is that the process was a sham. I don’t think you can look at impeachment hearings without getting the documents … and the attorney general is shielding documents,” she said. The president, however, lambasted the report, tweeting that Kavanaugh should sue The New York Times for libel or that the Department of Justice should have his back. “Brett Kavanaugh should start suing people for libel, or the Justice Department should come to his rescue. The lies being told about him are unbelievable,” Trump wrote. “False Accusations without recrimination. When does it stop? They are trying to influence his opinions. Can’t let that happen!”

LEADING THE DAY
CONGRESS: As the White House prepares to release its plan to combat gun violence, chatter continues to emanate through the Senate about a possible solution to expand background checks. However, it’s a long road for supporters of expanded background checks. They need 13 Republicans to break ranks.  Alexander Bolton took a look at the Senate Republicans who are crucial to passing gun violence legislation of any kind, including on background checks. Headlining the group is Sen. Pat Toomey (R-Pa.), who was the GOP lead sponsor of the Manchin-Toomey bill in the aftermath of the 2012 mass shooting at Sandy Hook Elementary School in Newtown, Conn. Toomey is one of two Senate Republicans still in the chamber to vote for the bill, along with Sen. Susan Collins (R-Maine).  Others include a group of Senate Republicans up for reelection in 2020, led by Senate Majority Leader Mitch McConnell (R-Ky.), who is involved in talks and has expressed interest in putting legislation on the floor as long as it has a stamp of approval from the president. Among those also viewed as crucial are Senate Judiciary Committee Chairman Lindsey Graham (R-S.C.), a top Trump ally who is at the center of talks, and Sen. Mitt Romney (R-Utah), who expressed interest in supporting a bill along the lines of Toomey-Manchin and is involved in talks along with Sen. Rob Portman (R-Ohio).

In the latest turn of events, Pelosi and Senate Minority Leader Charles Schumer (D-N.Y.) offered a warning shot on Sunday during a conversation with the president, telling him that anything short of action on universal background checks “will not get the job done” (Politico). While lawmakers await Trump’s recommendations, members of Congress look to colleagues who have experienced gun violence. Two Democrats on the House Judiciary Committee have lost family members to guns, while three others represent districts in which constituents were gunned down in recent high-profile mass shootings.  This dynamic came into full view last week as the House Judiciary Committee engaged in emotional debate over legislation to ban high-capacity magazines and encourage states to adopt “red flag” laws as a response to mass shootings this summer.  Lawmakers with personal experience can argue how such proposals could have made a difference in their own situations. Conversely, a handful of GOP members of the committee who also represent districts where mass shootings occurred have used their cases as examples of why Democrats’ bills wouldn’t deter such tragedies (The Hill). > Spending slog: Government funding talks in the Senate are off to a rough start with less than two weeks to go until the deadline to prevent the second government shutdown this year.  The impasse raises doubts about whether senators will be able to move fiscal year 2020 bills through the chamber this month, a setback for Republicans who wanted to clear a major package before October.  However, senators are at a stalemate over major provisions, namely topline spending figures and a mammoth defense bill that cleared the committee along party lines that is unable to pass on the floor, along with a homeland security bill that Republicans say is so controversial they are considering not bringing it up at all (The Hill).  Politico: Moderate Democrats warn Pelosi of impeachment obsession. ****** MORE POLITICS: Democrats competing for the chance to challenge the president next year in 2020 are trying to thread the needle when it comes to discussing the ongoing trade war with China.   2020 Democratic presidential candidates are promising to ramp down the economically painful trade war while also vowing to be tough on China, as exhibited during Thursday’s debate in Houston when myriad candidates bashed the president for what they consider a non-strategic plan. “The president clearly has no strategy,” said Buttigieg. Castro called Trump’s approach to trade “erratic” and “haphazard,” while Harris compared the president’s trade policy to the man behind the curtain in “The Wizard of Oz.”  More tellingly, though, none of the candidates said they would immediately scrap Trump’s tariffs if they took office. Instead, they pledged to seek a negotiated solution with China — the same thing Trump says is needed to eliminate the tariffs. The Associated Press: Biden’s “record player” just one of his vintage references. > Medicare for All: The Democratic clash over “Medicare for All” is highlighting perhaps the biggest question for 2020 primaries: Who has the best chance of beating Trump? Some top Democrats are warning that the full-scale version of Medicare for All pushed by Sen. Bernie Sanders (I-Vt.) and Warren would be a liability in the general election, a turn off to swing voters worried about losing their private health insurance under the proposal or seeing their taxes rise in order to pay for it. “I just biked around Lake Michigan, nearly 1,000 miles, through Michigan and Wisconsin, two really important states. Nobody at a diner ran at me and said, ‘Take my health care away,’” said former Chicago Mayor Rahm Emanuel on ABC’s “This Week.” However, progressives continue to argue that playing it “safe” and using the approach supported by longtime Democrats has failed in the past, most notably in 2016 with Hillary Clinton, and that bold proposals are needed to energize voters and, ultimately, defeat the president. The Associated Press: Warren has own plan for everything, though not health care. Politico: Sanders shakes up campaign leadership in New Hampshire.

IN FOCUS/SHARP TAKES
WHITE HOUSE & ADMINISTRATION: The Saturday attack on Saudi Arabia’s oil facilities originated from a direction indicating that Iran was behind it, and cruise missiles may have been the weapon of choice, according to a senior U.S. official on Sunday. Initial reports were that Yemen’s Houthi rebels had launched drone attacks, a claim of responsibility strongly disputed by the Trump administration. The strike on Saudi Arabia’s oil industry, which included damage to the world’s biggest petroleum-processing facility, was expected to send oil prices up $5 to $10 per barrel today and escalate tensions across the Middle East (Reuters). Trump tweeted on Sunday that “there is reason to believe we know the culprit, are locked and loaded depending on verification.”  Iran denied blame and said it was ready for a “full-fledged war” (Reuters). Secretary of State Mike Pompeo on Saturday asserted that Iran was behind what he called “an unprecedented attack on the world’s energy supply” and asserted there was “no evidence the attacks came from Yemen” (The New York Times). The president on Saturday condemned the attack in a statement and offered Crown Prince Mohammed bin Salmansupport for Saudi Arabia’s self-defense.” The Associated Press: Oil prices jumped today following damage to Saudi plant. The Washington Post: Trump administration on Sunday contemplated what U.S. officials characterized as a serious military response. The New York Times: The attack on Saudi oil facilities is seen as a short-term disruption. Separately, Energy Secretary Rick Perry today is expected to meet with Saudi energy officials to discuss an agreement to build nuclear reactors there (Bloomberg).           Before the attacks on Saudi Arabia’s energy facilities, U.S. analysts said they expected Trump’s “extreme pressure” policy toward Iran to shift in the wake of the White House departure of national security adviser John Bolton. But what comes next is unclear. Critics say Trump’s goals for any new nuclear deal with Tehran remain murky. The president’s supporters, meanwhile, are invested in seeing that Trump maintains a hard line against Iran (The Hill).  Prior to the weekend attacks, Pompeo floated the potential of a meeting between Trump and President Hassan Rouhani of Iran. The president in a Sunday tweet denied there was ever such a possibility in the absence of verifiable conditions.

 > Strike: In the first national strike against General Motors since 2007, roughly 49,000 workers voted to go on strike just before midnight Sunday, although talks between the United Auto Workers and the automaker are to resume this morning. Union leaders in Detroit said the sides were still far apart on several major issues. Workers say they want “fair” wages, affordable health care, profit sharing, job security and a path to permanent employment for temporary workers. GM offered $7 billion in U.S. factory investments, “best in class wages and benefits,” improved profit sharing and a payment of $8,000 to each worker upon ratification. The offer included wage or lump sum increases in all four years of a proposed contract deal, plus “nationally leading” health benefits (The Associated Press). > China: Beijing’s refusal to bend too far in trade and intellectual property negotiations with the United States leaves the administration with limited leverage as Trump seeks a trade victory to present to voters during his reelection campaign. President Xi Jinping and top Chinese officials have signaled their willingness to accept some pain at home under U.S. tariffs rather than agree to major concessions. China experts say the political cost to Xi of yielding to Trump could be more damaging than living with the tariffs as Xi seeks to solidify his power in the Communist Party while expanding influence over the world economy (The Hill). Last week, however, a modest thaw between the two major economies emerged as Trump postponed by two weeks a start date for more tariffs on Chinese goods and China announced it would lift punitive tariffs on U.S. pork and soybeans (The Associated Press). U.S. and Chinese negotiators plan to meet again in early October. > Vaping: The Trump administration’s planned ban on flavored e-cigarette products is aimed at protecting young people from damaging health effects of vaping, but it could have unintended consequences for adult smokers. The debate about the administration’s new regulatory policy includes a discussion about e-cigarettes’ role in smoking cessation and whether the Trump ban could inadvertently send smokers back to traditional tobacco products. “While banning things sounds like a good idea on the surface, there’s always trade-offs,” said Raymond Niaura, a psychologist and expert on tobacco treatment at New York University. “That may solve some problems but create others” (The Hill). Trump is aware of concerns and criticisms. “While I like the Vaping alternative to Cigarettes, we need to make sure this alternative is SAFE for ALL! Let’s get counterfeits off the market, and keep young children from Vaping!” he tweeted on Friday.

Antitrust & tech: Nearly every state attorney general in the country announced last week plans to investigate Google and Facebook for potential antitrust law violations, alleging the internet giants have amassed too much power, potentially harming consumers and competitors. But as the states and territories move forward, they face decades-old, pre-internet antitrust statutes that pose legal hurdles (The Hill).   ➔ State Watch & guns: In Texas, site of a recent mass shooting in El Paso, Republican Gov. Greg Abbott last week issued gun safety recommendations but stopped short of calling for lawmakers to require background checks for all private gun sales. A 13-page Texas Safety Action Report recommends improving information sharing and reporting among law enforcement, improved enforcement of current laws and tougher punishment for those who break them. It recommends making straw weapons purchases illegal in Texas, as they already are under federal law, and urges passage of laws “to crack down on criminals who try to illegally buy or possess guns” (The Dallas Morning News). … In Ohio, where a mass shooting also took place this summer, a bipartisan group of mayors in the state last week announced they’re on board with Republican Gov. Mike DeWine’s gun violence proposals, which include expanded background checks (The Columbus Dispatch).  ➔ Science from seas to space: Heat wave “blobs,” which have been detected over the years in oceans and long studied by scientists, are again emerging in the seas to pose threats to marine life (The Hill). Meanwhile, NASA and the European Space Agency report a newly discovered comet that is speeding toward the sun, likely from another star outside our solar system. Traveling at a brisk 93,000 mph, according to astronomers, it’s 260 million miles from the sun and drawing closer. It’s expected to bypass Earth and remain beyond Mars’s orbit, scientists said last week (The Associated Press).  ➔ Supreme Court: Justices on the high court have repeatedly come to Trump’s aid in rulings to legal challenges involving the U.S. southern border, bolstering the president’s efforts to build a wall and to reduce the number of migrants seeking asylum in the United States (The Hill).

POLITICO Playbook: Will Trump strike Iran?

DRIVING THE DAY

THE PRESIDENT at 7:02 p.m.: “The Fake News is saying that I am willing to meet with Iran, ‘No Conditions.’ That is an incorrect statement (as usual!).”

… THE PRESIDENT in June to NBC’s Chuck Todd: “No pre-conditions.” NBC

… Secretary of State MIKE POMPEO, on Tuesday: “He is prepared to meet with no preconditions.”

WOMP WOMP … NYT: “Iran has dismissed the possibility of a meeting between the country’s president, Hassan Rouhani, and President Trump on the sidelines of the United Nations General Assembly next week, Iran’s state-run news media reported.

“‘Neither is such a plan on our agenda nor will such a thing happen,’ Seyed Abbas Mousavi, a spokesman for the Iranian Foreign Ministry, said at a news conference on Monday, according to Fars, a state-run outlet. ‘This meeting will not be held.’” NYT

MEANWHILE — “Saudi Oil Attack Photos Implicate Iran, U.S. Says; Trump Hints at Military Action,” by NYT’s Eric Schmitt, Farnaz Fassihi and David Kirkpatrick: “The government released satellite photographs showing what officials said were at least 17 points of impact at several Saudi energy facilities from strikes they said came from the north or northwest. That would be consistent with an attack coming from the direction of the northern Persian Gulf, Iran or Iraq, rather than from Yemen, where the Iranian-backed Houthi militia that claimed responsibility for the strikes operates.

“Administration officials, in a background briefing for reporters as well as in separate interviews on Sunday, also said a combination of drones and cruise missiles — ‘both and a lot of them,’ as one senior United States official put it — might have been used. That would indicate a degree of scope, precision and sophistication beyond the ability of the Houthi rebels alone.” NYT

— WAPO: “His administration was contemplating what U.S. officials characterized as a serious military response, though some in the Pentagon were said to be urging restraint. The officials spoke on the condition of anonymity to discuss internal deliberations. Trump met with Defense Secretary Mark T. Esper on Sunday afternoon.” WaPo

— WSJ: “Supply Shock Sends Oil Prices Soaring,” by Benoit Faucon in London, Summer Said in Dubai and Amrith Ramkumar: “The loss of nearly 6% of global oil output in weekend strikes in Saudi Arabia sent crude prices soaring as officials said the kingdom was racing to restore roughly one-third of the disrupted production by day’s end Monday.”

JOE BIDEN on Sunday night at a fundraiser in Miami, per Miami Herald’s David Smiley: “His embrace of [North Korean leader] Kim Jong Un — he’s a thug. There is no other answer. This is a guy who had his uncle’s brains blown out sitting across the table. … And he’s writing love letters to him, talking about love letters.”

ROAD SHOW … THE PRESIDENT will travel to Houston with Indian PM NARENDRA MODI and Wapakoneta, Ohio, with Australian PM SCOTT MORRISON on Sunday. The Houston event is called “Howdy, Modi! Shared Dreams, Bright Futures.” Both are in the U.S. ahead of the U.N. General Assembly. WaPo’s Anne Gearan has more details

BURGESS EVERETT: “Pelosi and Schumer take hard line with Trump on gun background checks”: “Democratic leaders Nancy Pelosi and Chuck Schumer warned President Donald Trump on Sunday that any firearm legislation that falls short of universal background checks for gun sales ‘will not get the job done,’ complicating delicate negotiations between the president and a group of senators.

“Trump has been discussing potential legislation with senators in both parties that would expand background checks but would not go as far as House-passed legislation that would apply them to all gun sales with limited exceptions. Trump issued a veto threat on the House’s background-checks bill earlier this year, and few Republicans in Congress support it.

“But in a conversation with Trump on Sunday morning, the House speaker and Senate minority leader indicated to Trump that they were taking a much harder line than rank-and-file senators involved in the talks.

“‘This morning, we made it clear to the president that any proposal he endorses that does not include the House-passed universal background checks legislation will not get the job done, as dangerous loopholes will still exist and people who shouldn’t have guns will still have access,’ Pelosi (D-Calif.) and Schumer (D-N.Y.) said in a joint statement.

“The two leaders said they promised to join Trump ‘for a historic signing ceremony at the Rose Garden’ if the president would endorse the legislation and lean on Senate Majority Leader Mitch McConnell (R-Ky.) to pass it ‘to save as many lives as possible.’” POLITICO

ELECTION TOMORROW … AP/JERUSALEM: “Israeli PM vows to annex ‘all the settlements’ in West Bank”: “Israeli Prime Minister Benjamin Netanyahu vowed Monday to annex ‘all the settlements’ in the West Bank, including an enclave deep in the heart of the largest Palestinian city, in a last-ditch move that appeared aimed at shoring up nationalist support the day before a do-over election.

“Locked in a razor tight race and with legal woes hanging over him, Netanyahu is fighting for his political survival. In the final weeks of his campaign he has been doling out hard-line promises meant to draw more voters to his Likud party and re-elect him in Tuesday’s unprecedented repeat vote.” AP

BIG IN DETROIT — “No Deal: Auto workers strike against GM in contract dispute,” by AP’s Tom Krisher and Mike Householder: “More than 49,000 members of the United Auto Workers walked off General Motors factory floors or set up picket lines early Monday as contract talks with the company deteriorated into a strike.

“Workers shut down 33 manufacturing plants in nine states across the U.S., as well as 22 parts distribution warehouses. It wasn’t clear how long the walkout would last, with the union saying GM has budged little in months of talks while GM said it made substantial offers including higher wages and factory investments.” AP

2020 WATCH — “Biden Has Deep Connection to Black Voters. Will It Translate Into Votes?” by NYT’s Katie Glueck in Birmingham: “At the Democratic primary debate last week, Joseph R. Biden Jr. prompted some distress within the party with a rambling, discordant answer to a question about the legacy of slavery, a moment that highlighted his unsteady instincts, and mixed record, on matters of race. Three days later, a heavily African-American crowd gave Mr. Biden a warm welcome as he delivered a passionate address at the 16th Street Baptist Church, a symbol of the civil rights struggle, where he denounced institutional racism to mark the 56th anniversary of the bombing that killed four young black girls here in 1963.

“The divergent responses underscore the uncertainty surrounding whether Mr. Biden can translate his longstanding connection to black voters into votes next year. His deep ties to black leaders, his service as Barack Obama’s vice president and his popularity among older, more conservative African Americans have given him a commanding lead in the polls among a constituency that is crucial to any Democratic candidate seeking the nomination.

“But that support has never been rigorously tested at the ballot box outside of his home state of Delaware, and missteps like his meandering debate answer on slavery, as well as his legislative record on issues like busing and criminal justice, have intensified questions among progressive activists, and some party leaders, about whether he is the best standard-bearer for African-American priorities.” NYT

BEHIND THE SCENES IN BIRMINGHAM … NYT: “All Was Quiet at the Birmingham Weather Office. Until a Trump Forecast Brought a Storm,” by Nicholas Bogel-Burroughs and Steve Eder in Calera, Ala.: “It had been a sleepy Sunday morning in the National Weather Service’s office outside of Birmingham. The hot temperatures in the forecast were not out of the ordinary for the waning days of summer. There was a faraway tropical storm that the office was keeping an eye on — one with the name of Dorian — but with each passing day, it seemed more likely to veer in a different direction.

“Then, out of nowhere, there came a flurry.

“It was incoming phone calls from Alabamians energized about Hurricane Dorian, suddenly confused and worried about whether they were in the path of the giant Caribbean storm. At one point, the few people on duty were all answering calls at the same time. In response to the alarm, one employee dashed off a short message to the office’s 50,000 Twitter followers that reaffirmed what the latest models were saying: Alabama had little to worry about. …

“Several forecasters said the employee who sent the tweet hadn’t even been aware of Mr. Trump’s post and had simply reacted to an influx of calls from the public. ‘We don’t monitor the president’s tweets,’ said Michael Garrison, who manages the office’s data on rainfall and temperatures and is the local steward for the National Weather Service Employees Organization. ‘Up until this point, it has nothing to do with what we do.’” NYT

Monday, September 16, 2019 SCOTUS Allows Asylum Limits On Wednesday, The Supreme Court “gave the government the go-ahead to enforce a new rule that would bar most immigrants from applying for asylum if they pass through another country – such as Mexico – without seeking asylum there before arriving in the United States. The U.S. Court of Appeals for the 9th Circuit had blocked the government from implementing the new rule in Arizona and California, but now the government can enforce it nationwide while it appeals a decision by a federal judge in California to the 9th Circuit and, if necessary, the Supreme Court. Tonight’s order drew a dissent from Justice Sonia Sotomayor (joined by Justice Ruth Bader Ginsburg); there were no other recorded dissents.” SCOTUS Blog From the Left The left opposes the decision, arguing that the new policy has dubious legal standing and will harm asylum seekers. It also warns against the Supreme Court being overly deferential to the Trump administration. “President Donald Trump can’t get his border wall built, but he’s been creating policies so that he doesn’t need to, building an invisible wall to foreclose upon the possibility of migration from Central America… every day that Trump’s asylum ban is imposed is another day of flouting the government’s responsibility under international humanitarian law, and another day of ignoring the historical debt that Washington owes to Central America after decades of destabilizing and intervening in the region.”
Michelle Chen, NBC News

“U.S. law states explicitly that people can arrive anywhere along the border — not just at official ports of entry — and ask for asylum. Is that a good policy? That’s a question for congressional debate and resolution. But it is the law… It’s unclear that the Trump administration has the legal authority to [enact the new policy], which is part of the legal challenge, but in typical fashion the administration is bulling ahead and daring anyone to stop it… it’s disturbing, and disheartening, that the U.S. government and the nation’s highest court so willingly disregard the health, safety and legal rights of people in desperate need.”
Editorial Board, Los Angeles Times

“President Donald Trump has seen rising numbers of border arrests, generally considered a proxy for levels of unauthorized immigration, as a crisis worthy of declaring a national emergency in February. But while he characterizes the crisis as one of national security, immigrant advocates argue it is instead a matter of humanitarian concern…

The Supreme Court’s decision will likely deepen the crisis by pushing more asylum seekers into Mexico, which is ill-equipped to offer humanitarian aid. In Mexico, asylum seekers face dangers of kidnapping and sexual assault, overcrowded shelters, and slim employment prospects. They have difficulty finding lawyers, without which their asylum cases are almost surely doomed to fail…

“Mexico has neither the infrastructure to absorb tens of thousands of asylum seekers nor a legally robust asylum process. [Jorge Luis Vasquez, an attorney at the immigrant advocacy group Latino Justice] said that individuals fleeing persecution in Central America — for example, on account of sexual orientation — are not likely to find protection in Mexico. The US regularly accepts asylum seekers from Mexico who have suffered from the same kinds of persecution, he added.”
Nicole Narea, Vox

“[The] decision was both premature and unnecessary, and it is part of a troubling pattern of deference to Trump’s wishes… Until recently, such ‘emergency’ action—proceedings in which the Supreme Court reaches down to abort or alter ongoing litigation—was pretty unusual. Now, Justice Sonia Sotomayor wrote in a dissent to the asylum order, ‘it appears as if the mechanism is a new normal. Historically, the Government has made this kind of request rarely; now it does so reflexively’…

“One common response [from the right] is that the Court’s aggressiveness has been spurred by an increase in so-called nationwide injunctions issued by district judges… Although there has been an increase in such injunctions (it began in the Obama years), many emergency stays have been issued in cases where no nationwide injunction is at stake, or in more or less routine disputes over ‘discovery,’ the information the government must provide when it is sued.”
Garrett Epps, The Atlantic From the Right The right supports the decision on the merits as necessary to reduce illegal immigration, and also criticizes the use of “national injunctions” in which district court judges block policies nationwide. “The high court ruling is a matter of common sense. Asylum is meant for relief for persecution – not for the purpose of picking a country solely because it is more desirable and can provide migrants with better-paying jobs and a higher standard of living.”
Brandon Judd, Fox News

“This case shows how a single judge in a ‘resistance’ court like the San Francisco federal district court can bring the entire U.S. government to a grinding halt – even when the judge is wrong on the law… Judges like Tigar have produced a system of legal roulette, where any opponent of a president can simply shop around for the friendliest courts from which to challenge all of the federal government’s policies…

“Neither Republicans nor Democrats should want a single district judge to have the power to block a policy that is legal and produced by our elected leaders while a case is tied up in appeals in the federal courts for years. Nationwide injunctions like the one issued by Tigar short-circuit our political system, blocking Congress and the president from carrying out their legitimate functions.”
John Yoo, Fox News

“This is no way to run a judiciary. In seven weeks, federal officials got five different directives: implement, stay, implement, stay, implement… Nationwide injunctions are supposed to be extraordinary measures to prevent irreparable harm. Judge Tigar couldn’t make a convincing argument. The plaintiffs are aid groups that help migrants. If the asylum rules took effect in Texas and New Mexico, what permanent injury would befall them? Judge Tigar’s first example was that one of the nonprofits would have to ‘redesign its workshops and templates.’…

“The Supreme Court’s intercession isn’t about Mr. Trump’s policy choices. It’s about the proper operation of the lower courts… the Supreme Court is right to rein in a judge who blocks the policy nationwide, with little evidence of irreparable harm and no respect for the President’s authority or duty to protect the border.”
Editorial Board, Wall Street Journal

What is Sotomayor actually objecting to? Her comments about the Trump administration rushing the rule through without having a period for public comment speak to normal practices. But the President has declared an emergency on the southern border, so some of the usual rules won’t apply… Her other objection was in response to the fact that the White House asked the Supremes to let them jump to the head of the line and rule on this before the question had finished making its way through the lower courts where the policy had been blocked. As with the previous point, is she suggesting that the White House can’t (or shouldn’t) make such a request under the law? The fact is that such requests may come along infrequently, but it does happen. And the court has agreed to them in the past.”
Jazz Shaw, Hot Air

Worth noting: “While no one expects Mexico to pay for Trump’s wall, it is doing something more important: using its resources to stop its people from crossing over into the United States illegally. It has, for example, reinforced security on its southern border and set up checkpoints on highways leading north, dispatching 21,600 police and troops across the nation in the effort… With the courts recognizing Trump’s right to use his power to protect the border and with Mexico now cooperating with the United States, perhaps there’s a chance to break the long deadlock over immigration in Washington.”
Jonathan S. Tobin, New York Post On the bright side…

Here They Go Again This new effort to attack Brett Kavanaugh has everything to do with settling scores and nothing to do with truth. For a portion of those zealously trying to destroy Brett Kavanaugh, this is about repenting for their own roles or lack of effort during the Anita Hill or Monica Lewinsky matters. What is clear is that the left will keep refighting old fights trying always to change outcomes and delegitimize outcomes they do not like. Voices We’d Be Better Off Ignoring: Bishop Talbert Swan It’s fair to say that justice was anything but served recently in Warren County, Ohio.  There, just days ago, a 20-year-old woman named Brooke Skylar Richardson was cleared of murder and manslaughter charges brought against her for the death of her newborn baby that she secretly buried in her parents’ backyard. A Question for Beto O’Rourke: Why Gun Confiscation? I have a question for Beto O’Rourke. He said over the weekend he thinks people will cooperate with the government and hand over their AR-15s. Gun Legislation Coming This Week
CBS News reported that the White House is expected to release a proposal to combat gun violence this week. The legislation is a mystery. Given the President’s recent comments, the proposal is expected to be related to mental health. No news on whether the proposal will include language on federal “red flag” laws that allow law enforcement and family members to petition the court to have guns taken away from someone they believe to do harm to others or is mentally unfit. Red flag laws have some bipartisan support, but libertarians and Second Amendment supporters are dubious. From Mises.org:

“Anti-gun family members, friends, or acquaintances can levy dubious accusations to justify the confiscation of law-abiding gun owners’ guns. They can take these accusations to a court of law, even if the individual in question was not charged or convicted of a crime. In turn, due process rights are turned upside down, as gun owners are presumed to be guilty and must then prove their innocence.”

Back in April, Jim Geraghty at National Review wrote about the NRA’s complicated support of the idea of red flag laws:

“The NRA grumbles that its position gets misconstrued and mischaracterized by both sides — gun-control groups paint the organization as being unwilling to take guns away from dangerous people, and other gun-rights organizations, eager to draw distinctions with the NRA, portray the association as sellouts who are amenable to gun confiscation. The NRA sees its position as simple: They support extreme risk-protection orders, as long as the process involved strongly protects both Second Amendment rights and due-process rights at the same time.”

Stay tuned to see what comes out of the White House, Second Amendment supporters, the groups on both sides of the debate, and, of course, tough-talking Beto.

High Gas Prices Could Follow Attack on Saudi Oil Facility
On Saturday, an oil facility in Saudi Arabia was attacked by drones. Houthi rebels in Yemen claimed credit for the attack, but many suspect Iran was behind it. Iran denies it. Fox Business reported, “The attack Saturday on Saudi Arabia’s Abqaiq plant and its Khurais oil field led to the interruption of an estimated 5.7 million barrels of the kingdom’s crude oil production per day, equivalent to more than 5% of the world’s daily supply.”

Analysts say the price per barrel could be in the $70s, about $20 more than the price closed at on Friday. Fox Business also reported, “White House counselor Kellyanne Conway said on “Fox News Sunday” that the U.S. is ready to tap its Strategic Petroleum Reserve, used only for emergencies, to stabilize supply in the oil market. The Strategic Petroleum Reserve held 644.8 million barrels of crude in Texas and Louisiana as of Friday, according to the Department of Energy.”

The New Late Night War
The new late night wars aren’t about ratings, but about whether fat shaming is ok. During his show on Friday night, Bill Maher said, “Fat-shaming doesn’t need to end, it needs to make a comeback.” CBS late night host James Corden responded in a nearly eight-minute monologue. He said, “There’s a common and insulting misconception that fat people are stupid and lazy, and we’re not. We get it, we know. We know that being overweight isn’t good for us and I’ve struggled my entire life trying to manage my weight and I suck at it. I’ve had good days and bad months. I’ve basically been off and on diets since as long as I can remember and, well, this is how it’s going.”

Corden’s response hit the right note. He was funny, self-effacing, and sympathetic. He didn’t fall into the “fat acceptance” or “healthy at any size” mantra that others might have. I disagree with some of his comments at the end on the causes, but it’s always a good conversation to have. Watch the video here.

Following the President and First Lady’s attendance at the Pentagon for the 9/11 Memorial Ceremony, the craziest conspiracy theory has emerged from a handful of trolls and reported in USA Today. The claim is that she wore a dress that depicted a plane flying into the Washington Monument or one of the towers. White House spokeswoman and former press secretary for the First Lady, Stephanie Grisham, said, “It’s ridiculous.”

Photos from the ceremony at the Pentagon can be seen here.

A POINTLESS DEBATE
Last night’s Democratic debate achieved absolutely nothing. It did not change the state of the race in any way. Andrew Yang made it rain. Beto O’Rourke reiterated his intention to forcibly grab your guns. Julian Castro stood on a box and botched an attack on Joe Biden. Elizabeth Warren and Bernie Sanders disappeared for long periods. Marianne Williamson was missed. Jorge Ramos was embarrassing. Nothing changed.

SCOTT RASMUSSEN

ScottRasmussen.com Launch – Check Out My All New Website No Images? Click here Good morning,Fifty-nine percent (59%) of voters nationwide believe that America’s best days are in the future while 41% believe they have already come and gone. A ScottRasmussen.com national survey found this optimism in every measured demographic group.Sixty percent (60%) of both liberals and conservatives believe the nation’s best days are still to come. So do 57% of political moderates. This optimism exists despite the fact that just 35% believe the federal government does a good job living up to the ideal of being a government of the people, by the people, and for the people. Not only that, 71% believe America’s political system is badly broken. For many politically obsessed Americans, these results seem inconsistent. How can we have a bright future with a broken political system? But most Americans believe that positive change in America generally comes from outside of the political system. At the same time, however, 54% of voters believe race relations are getting worse these days. Just 24% believe they are getting better. Sixty-eight percent (68%) of Hispanic voters believe things are getting worse. So do 60% of black voters and 51% of white voters.Among those who Strongly Approve of President Trump, 55% believe race relations are getting better while 29% say worse. Among those who Strongly Disapprove of the president, 78% say things are getting worse while just 6% believe race relations are improving. Those with softer opinions of the president tend to believe race relations are getting worse (44% worse, 23% better). The survey also found that 23% believe most white Americans are racist. Twenty-seven percent (27%) say the same about most persons of color. There is an interesting generational dynamic on this point. When it comes to persons of color, there is little generational difference of opinion. Twenty-five percent (25%) of voters under 35 believe most persons of color are racist. Among those 35-50, 30% share that view. So do 27% of voters over 50.Finally, our polling has consistently shown Joe Biden leading the race for the Democratic presidential nomination. Tonight, at 5:00 p.m. Eastern, we will release our first results based entirely upon interviews conducted following last Thursday’s debate.Thank you for your interest in our work,Scott Stay Informed Up To The Minute and Share ContentDeeper CurrentsScott Rasmussen offers his personal insight, analysis, and opinion on current political races, issues, and controversy. FIRST READ: Here are the times – under oath – when Justice Brett Kavanaugh denied Deborah Ramirez’s allegations against him

A year ago, the New Yorker reported on Deborah Ramirez’s claim that Supreme Court Justice Brett Kavanaugh – when they were students at Yale – exposed himself to her at a drunken party and thrust his penis in her face.

Over the weekend, two New York Times reporters corroborated Ramirez’s claim.

At least seven people, including Ms. Ramirez’s mother, heard about the Yale incident long before Mr. Kavanaugh was a federal judge. Two of those people were classmates who learned of it just days after the party occurred, suggesting that it was discussed among students at the time,” the reporters write.

This is significant due to the denials that Kavanaugh made under oath about the allegation before his confirmation to the U.S. Supreme Court, as well as to Republicans’ insistence that there was no corroboration.

SEN. JOHN KENNEDY: Are Ms. Ramirez’s allegations about you true?

KAVANAUGH: Those are not. She — no — no — none of the witnesses in the room support that. The — if that — that had happened, that would have been the talk of campus in our freshman dorm. The New York Times reported that as recently as last week, she was calling other classmates seeking to — well, I’m not going to characterize it — but calling classmates last week and just seemed very — I’ll just stop there. But that’s not true. That’s not true.

&

SEN. DIANNE FEINSTEIN: … And — and what you’re saying, if — if I understand it, is that the allegations by Dr. Ford, Ms. Ramirez and Ms. Swetnick are — are wrong?

KAVANAUGH: Yes, that — that is emphatically what I’m saying; emphatically. The Swetnick thing is a joke. That is a farce.

&

KAVANAUGH: I’m — I’m painfully aware, for my family and me to read about this breathless reporting.

SEN. JOHN CORNYN: Of course, the — the sexual assault that Dr. Ford claims that you’ve denied. Then the claims of Ms. Ramirez, that not even The New York Times would report because it couldn’t corroborate it.

The two New York Times reporters also uncovered another story similar to Ramirez’s – that Kavanaugh, at another drunken Yale party, pushed his penis into the hands of another female student, according to fellow classmate Max Stier.

The Times says it corroborated the story with others, but the female student in question says she doesn’t remember the episode.

Yet NBC’s Heidi Przbyla and Leigh Ann Caldwell confirm that the FBI was notified of Stier’s claim during the Kavanaugh confirmation process.

Some 2020 Dems call for Kavanaugh’s impeachment; others don’t go that far

On Sunday, after the reporting, Kamala Harris called for Kavanaugh’s impeachment.

“I sat through those hearings. Brett Kavanaugh lied to the U.S. Senate and most importantly to the American people. He was put on the Court through a sham process and his place on the Court is an insult to the pursuit of truth and justice,” she tweeted. “He must be impeached.”

Elizabeth Warren joined her – as did Bernie Sanders and Beto O’Rourke.

But other 2020 Dems didn’t go that far.

“The most important thing to do first is to get the documents so that you can actually look at them to make a decision about impeachment,” Amy Klobuchar said, per NBC’s Priscilla Thompson. “You can’t make that decision just on news reports, you have to actually get those documents.”

And here was Michael Bennet on MSNBC yesterday: “Well, I don’t think he should have been on the court in the first place, I voted against him. But I do think we need to have due process here; we can’t give up on that. And we know that there are number of people that were not interviewed, and I think they should be interviewed. The Senate and the House should see what the results of that investigation are.”

“Locked and loaded”: Trump responds to attack on Saudi oil facilities

“Oil prices spiked shortly after trading began Monday after an attack on Saudi Arabia’s oil facilities Saturday that knocked out more than five percent of global oil supply and halted output of more than half of Saudi Arabia’s daily exports,” per NBC News.

President Trump responded to the attack in a series of tweets.

“Based on the attack on Saudi Arabia, which may have an impact on oil prices, I have authorized the release of oil from the Strategic Petroleum Reserve, if needed, in a to-be-determined amount….” he said.

And: “Saudi Arabia oil supply was attacked. There is reason to believe that we know the culprit, are locked and loaded depending on verification, but are waiting to hear from the Kingdom as to who they believe was the cause of this attack, and under what terms we would proceed!”

2020 VISION: Beto versus Pete on mandatory buy-backs

On “Meet the Press” yesterday, Beto O’Rourke doubled down on his claim that there should be a mandatory buyback for weapons like AR-15s – especially with Dem and GOP senators saying O’Rourke’s position doesn’t help their current negotiations.

“I think this just shows you how screwed up the priorities in Washington, DC are. I think what’s truly awful is a 17-month-old baby shot in the face with an AR-15, as happened in Odessa. What’s truly awful is 22 people killed in a Walmart the Saturday before school starts that next Monday, buying their school supplies, innocent of any crime or any threat to this country,” he said.

On CNN, Pete Buttigieg said that O’Rourke’s call was playing into GOP hands.

CNN: Did Beto O’Rourke say something that’s playing into the hands of Republicans?

BUTTIGIEG: Yes. Look, right now, we have an amazing moment on our hands. We have agreement among the American people for not just universal background checks, but we have a majority in favor of red flag laws, high- capacity magazines, banning the new sale of assault weapons. This is a golden moment to finally do something, because we have been arguing about this for as long as I have been alive. When even this president and even Mitch McConnell are at least pretending to be open to reforms, we know that we have a moment on our hands.

And then O’Rourke responded to Buttigieg on Twitter: “Leaving millions of weapons of war on the streets because Trump and McConnell are ‘at least pretending to be open to reforms’? That calculation and fear is what got us here in the first place. Let’s have the courage to say what we believe and fight for it.”

On the campaign trail today: President Trump holds a rally in New Mexico at 9:00 pm ET… Joe Biden, Pete Buttigieg, Amy Klobuchar and Bill de Blasio all speak at Galivants Ferry Stump in South Carolina, with Buttigieg and Klobuchar holding events in the state… Elizabeth Warren holds a rally in New York City… Andrew Yang rallies in Cambridge, Mass…. And Michael Bennet does the 92nd Street Y in New York City.

Dispatches from NBC’s embeds: Joe Biden courted Latino voters in Miami’s historic Cuban district, per NBC’s Marianna Sotomayor, where voters told NBC they were “enthusiastic, but not necessarily committed to Biden. They are interested in him given his experience, conservative family values and electability, but many cited Mayor Pete Buttigieg as a second choice. Notably, the most enthusiastic Biden supporters were registered Republicans or independents who voted for Trump.”

Amy Klobuchar distanced herself from Beto O’Rourke’s viral debate moment when he called for a mandatory buyback of assault rifles like AR-15s. NBC’s Priscilla Thompson reports in Iowa, “Klobuchar said she doesn’t look at the issue ‘politically,’ noting, ‘none of that would even matter if we don’t have an assault weapons ban.’ The senator would however support a voluntary buyback program.”

DATA DOWNLOAD: And the number of the day is … 50,000

50,000.

That’s roughly the number of United Auto Workers who went on strike last night after negotiations faltered between their union and General Motors.

It’s the first such walkout since 2007. Negotiations are set to resume this morning.

09/16/2019 Share: Carl Cannon’s Morning Note Also-Ran Advice; Obama-Trump Nexus; Woman of Letters By Carl M. Cannon on Sep 16, 2019 09:17 am
Good morning, it’s Monday, Sept. 16, 2019. On this date three-and-a-half centuries ago, a woman who came to these shores at 18 and found her voice passed away of tuberculosis at age 60. In those intervening years she made her mark — as so many other immigrants have done. She was, as far as I know, the New World’s first feminist writer. Her name is Anne Bradstreet and she is largely forgotten now, except by scholars of early American poetry, or the occasional Harvard undergrad (or tourist) who actually stops to read the plaque featuring her verse at the Harvard Yard Bradstreet Gate. “I came into this Country,” it says, “where I found a new World and new manners at which my heart rose.” I’ll have more on this pioneering pilgrim in a moment. First, I’d point you to RealClearPolitics’ front page, which presents our poll averages, videos, breaking news stories, and aggregated opinion columns spanning the political spectrum. We also offer original material from our own reporters and contributors, including the following: * * * What Past Also-Rans Can Teach GOP Challengers to Trump. With three Republicans having launched campaigns, Phil Wegmann interviews Pat Buchanan and others with experience taking on an incumbent president from their own party. Why Trump Will Win: “The Evidence of Things Unseen.” Frank Miele argues that the topics Democrats chose not to mention during last week’s debate reflect weaknesses likely to end their White House dreams. Obama Could Be Trump’s Reelection Role Model. Myra Adams points out similarities in the two presidents’ campaign strategies. “Inequality”: 2020 Dem Buzzword Has Yet to Get Media Play. Kalev Leetaru lays out the numbers. Vaping Scare: Unhealthy Actions From Health Officials. Brad Rodu asserts that FDA, CDC and White House officials are overreacting to concerns about vaping-related illnesses and a handful of deaths. Bankruptcy: Pain With Gain for Chicago. Richard Porter explains why declaring bankruptcy is the only way the city can put itself on a sustainable financial path. Criticisms Illustrate Need for State Dept. Human Rights Panel. Peter Berkowitz addresses the confusion and controversy surrounding the newly formed Commission on Unalienable Rights. Both Trump and Warren Are Stuck in the Past. In RealClearMarkets, Allan Golombek cites their parallel views of America’s centrality in world trade. Crypto Needs Reasonable Rules From the SEC. In RealClearPolicy, J.W. Verret warns that digital currency requires rethinking of time-worn standards set long ago by federal regulators.  * * * You’ll notice that when referring to Anne Bradstreet as a “pilgrim” a moment ago, I didn’t capitalize the first letter. That’s because, technically, she wasn’t one of the Pilgrims who came over on the Mayflower in 1620. She was part of a larger group, the Puritans, who arrived in Massachusetts 10 years later. In her case, the distinction seems trivial: Let’s just say that when it came to the theological differences between Pilgrims and Puritans — and the differences in their attitude toward the Church of England — young Mrs. Bradstreet had bigger fish to fry. Born in England in 1612, Anne Dudley Bradstreet sailed to the New World with her husband, her parents, and her husband’s parents aboard the Arabella, the ship that also carried Puritan leader John Winthrop. Although she had been raised in comfortable conditions in the bosom of a family that valued female education, at age 18 she found herself in a wild new country, where starvation was a real threat. Anne Bradstreet began having children in Massachusetts, even as she and her husband moved from town to town searching for a safe and livable place to settle. In this midst of this quest — and notwithstanding domestic duties that would overwhelm any modern American couple — Anne began to pen her first verses. Her initial volume, “The Tenth Muse Lately Sprung Up in America,” was published in England in 1650 by a brother-in-law. It contains caveats from the publisher to the effect that the poet, though female, is nonetheless a virtuous woman. The author herself includes disclaimers that the poems are “home-spun” — and hardly worthy of the male equivalent. To paraphrase language that would become famous more than a century later, this was self-evidently untrue. Moreover, as Anne Bradstreet continued writing, she found a voice that was decidedly unapologetic: I am obnoxious to each carping tongue,Who sayes, my hand a needle better fits,
A Poets Pen, all scorne, I should thus wrong;
For such despighte they cast on female wits:
If what i doe prove well, it wo’nt advance,
They’l say its stolen, or else, it was by chance. Reading such lines, the thought occurs that feminism is less a political movement than part of the natural human condition, arising organically and given expression in any society that allows women to speak or write freely. In Anne Bradstreet’s case, the harsh New England soil proved fertile ground for such attitudes. When a discerning reader starts entertaining such subversive thoughts, the consumer of her poetry will notice that defiance to the male-centric status quo was present from the beginning. “The Tenth Muse,” for example includes a pretty bold tip of the cap to Queen Elizabeth — and her gender: Nay Masculines, you have thus taxt us long,
But she, though dead, will vindicate our wrong,
Let such as say our Sex is void of Reason,
Know tis a Slander now, but once was Treason.  Carl M. Cannon
