Tuesday, July 23, 2019 Iran Seizes British Tanker “Britain called on Monday for a European-led naval mission to ensure safe shipping through the Strait of Hormuz, days after Iran seized a British-flagged tanker in what London described as an act of ‘state piracy’ in the strategic waterway… In a separate development that could generate more tensions, Iran said it had arrested 17 spies working for the CIA and sentenced some of them to death, an announcement Trump called ‘totally false.’” Reuters From the Left The left is worried about the potential for escalation and urges the Trump administration to engage in diplomatic talks. “Iran’s actions are understandable, though not forgivable, in response to the unilateral rejection of the nuclear deal by the U.S. and, more importantly, President Donald Trump’s decision to force everybody else to toe his line. Although the other parties to the Iran nuclear deal – the European Union, Russia and China – want to keep it alive, they have been almost powerless to preserve it in any meaningful way. By imposing extra-territorial sanctions on all buyers of Iranian crude with the threat of denying them access to U.S. dollars and the American banking system on which international trade depends, Trump has effectively forced everyone else to stop buying Iran’s oil. To expect Iran to abide by its side of the nuclear deal without receiving any of the benefits of trade and investment that it was due to receive in return is naive… “[Yet] should Iran’s harassment of tankers escalate, the oil importing and shipping countries may have little option other than to align themselves with the Americans, at least as far as protecting vessels is concerned. But if they’re going to use naval ships to protect tankers, they’ll have to be prepared to use their weapons, and that is an escalation that everyone wants to avoid. With nearly 15 million barrels a day of crude flows at risk, it is a step that may have to be taken, unless both sides step back from the brink and work to find a diplomatic solution.” Julian Lee, Bloomberg “Forcing crisis after crisis is a tactic, one that the Trump administration deploys on fronts both foreign and domestic. But the tactic is in service of a dangerous strategy of brinkmanship. The last crisis with Iran, which centered on the downed American drone, was averted only after Mr. Trump said he had called off a military strike at the last minute… Mr. Trump, like Mr. Obama before him, has been right in recognizing the value of talking directly with one’s adversaries. His administration long ago jettisoned the diplomatic protocol against direct talks with North Korea and the Taliban, and it now has the chance to make another grand overture.” Editorial Board, New York Times “The problem in Washington is that Trump has neither a strategy nor any strategists at his side—or at least none whom he’s keen to hear. He’s particularly disenchanted with his national security adviser, John Bolton; in recent weeks, he’s bad-mouthed Bolton for his war-happy ways to several of his friends… Last month, when Trump sent Bolton off to Mongolia instead of bringing him along to Japan for the G-20 summit, that seemed a clear sign that his days were numbered… [Meanwhile] there is no secretary of defense and hasn’t been a confirmed one since January. The chairman of the Joint Chiefs of Staff, whose formal job description is chief military adviser to the president, is for the most part out of the loop… Trump is drifting toward conflict and has no idea how to stop it.” Fred Kaplan, Slate “The President initially said he knew nothing about Kentucky Sen. Rand Paul’s engagement with [Iranian Foreign Minister Mohammad Javad] Zarif. However, a day later, Trump confirmed that Paul is involved in diplomatic talks with Iran. Paul is not known for his diplomacy within the US government, let alone with hostile foreign powers, and he has no known history with or special knowledge of Iran. The State Department has taken the lead in past negotiations with Iran, and it’s unclear with whom Paul is coordinating within the executive branch, other than perhaps Trump… “The confusing cacophony of other US government voices on Iran may leave the Iranians wary of engaging with anyone but Trump, if they really do want to de-escalate. Other Trump allies in Congress, like South Carolina Sen. Lindsey Graham, have warned about an overwhelming US military response against Iran. Within the executive branch, it’s hard to keep track of who has the latest instructions from the President. National Security Adviser John Bolton has made policy statements on Iran that have differed from the President’s, including when he said the US would stay in Syria and fight Iran… [the President needs to] clearly identify someone to speak on his behalf publicly and, more important, behind the scenes, where the real action happens.” Samantha Vinograd, CNN From the Right The right argues that Iran’s latest behavior will backfire and result in Europe moving closer to the Trump administration. “A major reason Trump hates the 2015 nuclear deal is that despite the huge concessions the Obama administration offered Iran in the agreement – including over $150 billion in sanctions relief – Iran’s behavior significantly worsened after the deal was announced. Iran’s harmful actions included sending troops to Syria to fight in support of dictator Bashar Assad in a civil war, stepping up support for terrorism, and increasing military spending. Iran also ramped up its ballistic missile program… “Iran’s new provocation… will drive European and other states closer to President Trump’s Iran policy. Hold-outs to U.S. Iran sanctions could soon drop their opposition. There also could be new European sanctions. Most importantly, President Trump’s restraint in avoiding using military force against Iran – coupled with dangerous Iranian provocations like the seizure of the two oil tankers Friday – may mean that if President Trump decides to attack Iran in the future, he may do so with Europe’s support.” Fred Fleitz, Fox News “Iran has made a strategic miscalculation here. Acting against the British while the U.K. and Iranian foreign ministers were seeking compromise over Britain’s recent seizure of an Iranian tanker, the Islamic Revolutionary Guard Corps have further isolated Iran on the international stage. With a multinational naval task force for tanker escorts likely to be announced next week, the Iranians are increasingly outgunned and diplomatically isolated… Iran is heading for more economic damage. These seizures might make the hard-liners feel good, but they’ve made a big mistake.” Tom Rogan, Washington Examiner Some, however, advocate a less confrontational approach. “A maximum pressure policy that was sold by its advocates inside the administration as a sledgehammer that would compel Iranian subservience to American demands has proven to be a deeply misguided approach… Iran has met sanctions and diplomatic isolation with resistance and aggression… [Trump] should go in a drastically different direction. Instead [of] responding to Iranian retaliation by doubling down with more sanctions, export restrictions, offensive arms sales, and threats of military force, he should provide the Iranians with an opportunity to pursue a diplomatic off-ramp. The current strategy, where Iranian officials are being expected to wave the white flag before even reaching the negotiating table, is about as likely to succeed as a climber scaling Mount Everest without a coat.” Daniel R. DePetris, Military Times “Whether the Iranian military could defeat U.S. or allied task forces is an open question. [But] it is beyond question that Tehran can impose heavy opportunity costs on Washington. It’s already doing so. After all, every gray hull facing down the [Iranians] is a gray hull not facing down Chinese or Russian fleets or pursuing other worthwhile endeavors such as training, scraping rust, or relaxing in home port.” James Holmes, The National Interest Regarding Rand Paul’s diplomatic efforts, many argue that “Iran’s interest in negotiations is open to question… In 2015, former Senator and then-Secretary of State John Kerry said that Zarif had assured him that he was empowered to negotiate with the U.S. on regional issues like Syria following the nuclear deal. But that promise was empty. Iran ended up working out an arrangement with Russia to escalate the war on behalf of Syrian dictator Bashar al-Assad. More recently, Zarif has suggested that Iran would be open to negotiations over its missile program… [then] backtracked from those comments… “[Zarif] has frequently attacked National Security Adviser John Bolton on social media. Meanwhile, Iran’s operatives have escalated attacks on U.S. allies… There’s no doubt that Paul, a libertarian who has opposed U.S. interventions since he became a senator, is sincere when he talks about trying to prevent a war with Iran. His interlocutor, however, has a reputation for insincerity. POLITICO Playbook: Deal or no deal?

DRIVING THE DAY
CAPITOL HILL has reached a budget deal. We say it like that because we do not yet have definitive evidence that President DONALD TRUMP is supporting this agreement. He tweeted that he was “pleased to announce that a deal has been struck” and said it was a “real compromise in order to give another big victory to our Great Military and Vets!”
BUT THE TWEETS FROM TRUMP did not explicitly say he supported it — and in this era of governing, that matters, because one person speaks for the president, and that’s him. (You might notice that press releases from folks like House Minority Leader KEVIN MCCARTHY did not say they would support the bill — a nod to the fact that Trump could change his mind.) The leadership in both parties had expected a more forceful endorsement from Trump, several sources told us.
WE ASKED THE WHITE HOUSE for clarification Monday — was the president in favor of this bill? They didn’t answer, but many others in the White House conceded to us that, indeed, the president needed to see how this all played in the public sphere.
AS OF MONDAY NIGHT, there wasn’t a ton of consternation on the right. Sean Hannity’s Fox News program, which often sways the president, focused on ROBERT MUELLER at the top of the show — not this budget deal. Make no mistake: The lawmakers that Trump considers his base on the Hill are against this bill, but no one is lighting their hair on fire yet.
THERE ISN’T MUCH ALARM ON CAPITOL HILL. Leaders are convinced they’ll get this across the finish line quickly and easily, and Trump will sign it, delivering a massive win for Speaker NANCY PELOSI, and the first substantive legislative achievement for Treasury Secretary STEVEN MNUCHIN, who was the administration’s point man here. (Although, if people sour on it, Mnuchin will have to answer for that, too.)
EVERYONE WE SPOKE TO INSIDE THE WHITE HOUSE said the president has made the point internally that he wants to minimize legislative drama in the lead-up to the 2020 election. This package would achieve that end. It sets spending levels for two fiscal years, hiking federal spending by $320 billion, and suspends the nation’s borrowing limit until July 2021.
HOW IT’S PLAYING …
— TRUMP HIKES SPENDING MORE THAN OBAMA! … NYT’S EMILY COCHRANE, ALAN RAPPEPORT and JIM TANKERSLEY: “In
[the]
first Obama term, which included a large government stimulus package to jump-start job creation in the depths of the recession, discretionary spending on military and domestic items rose by about 3 percent per year, on average. In his second term, such spending declined by an annual average of nearly 2 percent.
“Mr. Trump is currently on pace to increase discretionary spending by an average of nearly 4 percent per year.” NYT
— TRUMP SAYS HE’LL CUT SPENDING NEXT TERM … WAPO’S DAMIAN PALETTA and ERICA WERNER: “[N]egotiators agreed to $77 billion in accounting changes that probably wouldn’t constrain any future spending. But the deal locked in more spending for the military, something Trump has tried to make a hallmark of his first 30 months as president. He has told advisers that if he is reelected, he wants to focus on spending cuts beginning in 2021, and he has largely cast aside the budget-slashing goals some of his aides have advocated since his inauguration in 2017.” WaPo
— WHAT DEMOCRATS ARE GOING TO HATE … SARAH FERRIS, JOHN BRESNAHAN and HEATHER CAYGLE: “Under the agreement, Democrats won’t be able to push for policy priorities, like scrapping the so-called Hyde Amendment prohibition on using federal funds for abortion, or further restricting Trump’s use of Pentagon money for his border wall project until legal challenges on the issue are resolved.” POLITICO … Note: this is a handshake agreement. It’s not in statute.
HERE’S WHAT YOU NEED TO PAY ATTENTION TO OVER THE NEXT FEW DAYS …
— CAN TRUMP WITHSTAND THE INCOMING? … The earliest this bill will get a vote in the House is Thursday. How comfortable will TRUMP be as most of his staunch conservative House allies come out against this bill?
Rep. CHIP ROY (R-Texas) — a man who has caught the eye of many in the White House over the past few months– tweeted this: “To the best of my knowledge, the current spending ‘deal’ fails in virtually all respects, setting aside more support for defense. It busts caps (further), increases debt, funds Planned Parenthood… yet, does not fund ICE & border security fully. So, it does NOT #DoWhatWeSaid.” Rep. MARK WALKER (R-N.C.) posted an image of the Joker from “The Dark Knight” standing next to a fire.
WE HAVE TO IMAGINE folks like Reps. MARK MEADOWS and JIM JORDAN will be against this bill. How will the president react when he’s told that this bill will pass the House with mostly Democrats?
— WATCH THE FLOOR FOR THIS: How do McCarthy, House Minority Whip STEVE SCALISE (R-La.) and House GOP Conference Chair LIZ CHENEY (R-Wyo.) vote? It’s feasible that they all vote for the package, but it’s also feasible that one of them votes against it. It’s an opportunity to slide a bit to the right.
— IT’S UP TO SPEAKER NANCY PELOSI to convince a huge number of her Democratic colleagues to carry this package across the finish line. Will the big increase in spending/no big cuts get them to support the package? Will there be a revolt of some size over the agreement to not pursue policy riders?

AAN, which does not report its donors, has raised $14.5 million.

After weeks of negotiations, the White House and congressional leaders announced a deal that will raise budget caps and the debt ceiling for two years, giving both parties victories and allowing lawmakers to pass a bill before leaving Washington for the August recess. President Trump was the first to announce the accord between the sides, which he touted as “another big victory to our Great Military and Vets,” calling the agreement “a real compromise.” The deal also puts off another government shutdown after the 35-day partial closure earlier this year and the pending risk of default on U.S. debt. According to Jordain Carney, funding for the Pentagon — long a priority for GOP defense hawks — is boosted to $738 billion, which doesn’t match the president’s requested total, but is north of what Democrats pushed for. Meanwhile, Democrats won an increase in funding for nondefense spending to $632 billion —- a $27 billion increase over the previous package, something Speaker Nancy Pelosi (D-Calif.) and Senate Minority Leader Charles Schumer (D-N.Y.) were elated with. “Democrats are also pleased to have secured robust funding for critical domestic priorities in this agreement,” the Democratic leaders said in a statement. “Democrats have always insisted on parity in increases between defense and non-defense [spending], and we are pleased that our increase in non-defense budget authority exceeds the defense number by $10 billion over the next two years.” Pelosi and Schumer added that they have secured more than $100 billion in funding for domestic projects since Trump took office. Pelosi said in the statement that the House will “move swiftly” on the legislation so it will come up for a vote on the floor “as soon as possible.” Due to the need to have a bill posted for 72 hours, the vote is expected to take place on Friday before the House breaks for a six-week recess. The Senate, which breaks for recess on August 2, will be able to pass the bill next week. Senate Majority Leader Mitch McConnell (R-Ky.) said in a statement that the agreement “secures the resources we need to keep rebuilding our armed forces.” In a statement, House Minority Leader Kevin McCarthy (R-Calif.) said, “While this deal is not perfect, compromise is necessary in divided government.” Treasury Secretary Steven Mnuchin, who led negotiations for the White House, had been in constant contact with Pelosi in recent weeks as they worked toward an agreement. Mnuchin had urged congressional leaders to pass a separate debt ceiling bill if they were unable to strike a budget agreement prior to the recess, saying that raising the debt limit would need to be done by early September. Senators are expected to vote to confirm Army Secretary Mark Esper to lead the Pentagon. Esper was nominated after former acting Secretary of Defense Patrick Shanahan’s nomination to serve in the full-time role was withdrawn. The permanent position has been vacant since James Mattis resigned in January. The upper chamber also is expected to approve the September 11th Victims Compensation Fund, which passed the House by a vote of 402-12 nearly two weeks ago. The package would reauthorize funding through fiscal 2092, with the Senate expected to vote on amendments by Sen. Mike Lee (R-Utah) and Sen. Rand Paul (R-Ky.), who objected to the bill’s passage by unanimous consent last week. Looking ahead to after the August recess, House Democrats are expected to release their bill to lower drug prices. According to Peter Sullivan, Wendell Primus, Pelosi’s top health care adviser, said House leadership is almost ready to release the proposal but is opting to wait and not give drug companies the opportunity to attack the bill during the congressional recess next month. “Pharma will argue very hard against drug negotiation of the kind we’re talking about,” Primus said at a Brookings Institution event on Monday. |

2020 POLITICS: Sen. Elizabeth Warren (D-Mass.) and Sen. Bernie Sanders (I-Vt.) will take center stage together for the first time at next Tuesday’s Democratic debate in Detroit, putting two of the party’s brightest liberal stars in the spotlight as they look to stake their claim as the preeminent progressive in the 2020 race. As Jonathan Easley and Miranda Green write, while Warren has seen her star shine in the past two months, Sanders’s has dimmed amid questions about whether his time has passed him by after his 2016 bid electrified progressives and as voters survey the 25-candidate field. Despite Warren’s rise in the Democratic field and in polls, Sanders has polled better in head-to-head matchups against the president, raising questions in some circles about Warren’s electability in a general election matchup. Duggan told The Associated Press in an interview that Biden was a “great friend of Detroit” during his time as vice president, noting that he plans to campaign for Biden. “He visited multiple times,” Duggan said of Biden. “He cares deeply about the city and auto industry and auto workers. WHITE HOUSE & ADMINISTRATION: Trump will use a new Department of Homeland Security rule today to implement fast-track deportation authority over immigrants who cross the U.S. border illegally and are caught anywhere in the United States. The rule, set to be published in the Federal Register today, applies “expedited removal” to any illegal crossers who cannot prove to immigration agents that they have been living in the country for two years. Legal experts say it is an expansion of a program that eliminates review by an immigration judge. Previously, only those immigrants caught within 100 miles of the border who had been in the country two weeks or less could be quickly ordered deported (Reuters). The rule would prevent asylum seekers from applying for refuge in the United States before they are deported (The New York Times). Separately on Monday, the 9th Circuit Court of Appeals ruled against the Trump administration’s policy allowing for the indefinite detention of certain asylum-seekers, saying a lower court ruling temporarily blocking it can remain in place (The Hill). > The Hill: Trump answered reporters’ questions for 40 minutes in the Oval Office on Monday, discussing everything from Afghanistan and Iran, to China and Hong Kong. > Tech: The president met with chief executives of seven technology companies on Monday and agreed with their request for “timely” licensing decisions from the Commerce Department on blacklisted Chinese tech giant Huawei Technologies, the White House said. Pompeo, during an interview with WFTV in Florida on Monday, said, “What we want is Iran to behave like a normal nation, like Norway, like any country that doesn’t conduct a terror campaign around the world.” ➔ Opioid crisis: The Washington Post — which on Sunday published a massive national database mapping the flow between 2006 and 2012 of opioids into pharmacies, towns and states — described national responses to its extensive report and the continuing crisis. The report used federal data obtained by court order to track the shipment of 76 billion pills. In that seven-year period, 100,000 people died from overdoses while seeking relief from pain (The Washington Post). ➔ Equifax settlement: Credit-reporting company Equifax Inc. will pay up to $700 million to settle claims it broke the law with a massive 2017 data breach and to repay harmed consumers in a landmark settlement that could spur new consumer data rules. On Monday, the people of Puerto Rico held the largest demonstration seen on the island in nearly two decades, demanding the resignation of Gov. Ricardo Rosselló in a crisis sparked by offensive, obscenity-laden chat messages between the governor and his advisers (The Associated Press). Former New York City Council Speaker Melissa Mark-Viverito (D), who was mentioned in the chat messages, told CNN that Rosselló’s words were “an attack on all women” (The Hill). Trump, asked by reporters about Monday’s massive protests in Puerto Rico, called Rosselló “a terrible governor” and added that San Juan Mayor Carmen Yulín Cruz is “even worse … a horror show. Tuesday, July 23, 2019 Rashida Tlaib Argues for $20 per Hour Minimum Wage At an event in Detroit on Sunday, Rep. Rashida Tlaib (D-MI) called for a federal hourly minimum wage of $20, sparking alarm and ridicule from conservatives, as well as some Democrats. The remark was delivered to the Restaurant Opportunities Center of Michigan and the labor rights group One Fair Wage. Recently, the House of Representatives, currently controlled by Democrats, passed a $15 minimum wage bill, which is expected to fail in the GOP-controlled Senate. But as Fox News points out, this proposal could pose some thorny repercussions for Democrat 2020 hopefuls, some of whom have struggled to present themselves as more moderate: “Democrat presidential contenders are set to debate again on July 30 and 31, and could be asked about Tlaib’s now-viral proposal. The party’s embrace of once-radical proposals — including Medicare-for-all, health care for illegal immigrants, and decriminalization of border crossings — has alienated moderates, some analysts contend… But her minimum wage proposal has her farther afield on the issue than virtually all other prominent Democrats. The nonpartisan Congressional Budget Office (CBO) recently concluded that a $15 federal minimum wage could result in 3.7 million people becoming unemployed — far higher than House Democrats’ estimates — as employers struggle to make payroll and respond by slashing jobs and hours.” Bernie Sanders’ Cutting Staff Hours Highlights the Problem with Minimum Wage Hikes Last week, The Washington Post reported that some Bernie Sanders staffers were upset with their wages on the campaign trail, which failed to match candidate Sanders’ $15-minimum wage demands. Pointing out this hypocrisy has led to some shakeups in Sanders campaign, including the unionization of his staffers, revealing precisely the pitfalls of minimum wage laws that fail to account for market prices. From Noah Rothman of Commentary Magazine: “Last week, the Washington Post received a cache of documents from union organizers and Sanders campaign employees that signaled the start of a new, more public phase of labor negotiations. Of particular note was a letter addressed to campaign manager Faiz Shakir shaming the [Sanders] campaign for failing to live up to the candidate’s ideals. It accused the campaign of overworking field organizers—an entry-level role that is usually occupied by unpaid volunteers, but which the Sanders campaign compensates with a $36,000 annual salary—and failing to pay them the equivalent of a $15-per-hour rate. Theirs were “poverty wages,” the letter alleged. In response, the Sanders campaign did what any self-respecting employer would do: It capped employees hours. Problem solved!… Sanders is now in a unique bind. He cannot simply go the route taken by McDonald’s, which has responded to the tight labor market and increasing state-level minimum-wage statutes by automating drive-throughs, replacing order-takers with touchscreen kiosks, and installing robotic fryolators. The job of the campaign canvasser will always require a human touch. Moreover, he’s operating an enterprise in an especially competitive sector—the race for the presidency—in which he’s facing competition from several other equally well-heeled and nimble concerns. My pal Craig Shirley reminds me — well, to tell the truth, he reminded all his Facebook friends — that 35 years ago President Reagan designated July 1984 as “National Ice Cream Month.” The Gipper even decreed that ice cream should have its own day that year. He chose July 15, which is the birthday of my brother David, may he rest in peace. Craig included an arresting photo of Ron and Nancy Reagan eating ice cream cones when he was governor of California, which made me nostalgic. Eighty years earlier, on this very date in 1904, a turn-of-the-century foodie named Charles E. Menches invented the ice cream cone — or so he said. We’ll examine that historic claim in a moment. RealClearMarkets editor John Tamny argues that a Mercedes in Pyongyang, despite a U.N. ban on exporting luxury goods to North Korea, is easily explained by economic principles. * * * On July 23, 1904, Charles Menches and his brother Frank were operating an ice cream stand at the St. Louis World’s Fair when he noticed girls placing the ice cream they ordered in the holes of small cakes they’d purchased at another shop. According to an obituary that went out over the news wires when Charles Menches died in 1931 — and picked up by newspapers around the world — here is what happened next: “He watched for a short time and suddenly leaped from his chair and ran to a confectioner’s booth. Rolling a cake around on his finger, he filled it with ice cream. The result was a revolution.” Did it really happen that way? Could be. Or perhaps there was more to it. The booth the Menches brothers raided for the pastries used to make the first ice cream cones in St. Louis belonged to a Syrian immigrant named Ernest A. Hamwi, whose recollection differed in one important regard. In Hamwi’s telling, the Menches ran out of the dishes they were using to serve ice cream. He helped them by fashioning a thin Persian pastry into a conical shape to accommodate the frozen confection. So Ernie Hamwi was the true inventor of the ice cream cone? Well, at a minimum he certainly capitalized on it. After the 1904 “invention,” he became manager of the Cornucopia Waffle Co. in St. Louis and later started the Missouri Cone Co. In 1928, Hamwi related his story to an industry publication called Ice Cream Trade Journal, which vouched for his account. Hold on a moment, say the descendants of another enterprising immigrant, Italo Marchiony, who’d come from Italy through Ellis Island in the waning days of the 19th century. If Hamwi and the Menches brothers invented the ice cream cone in St. Louis in 1904, what was Signore Marchiony doing selling them on the streets of New York in 1896? Evidence for this claim comes from more than Marchiony’s relatives. The U.S. Patent Office issued a patent for a waffle cone in December 1903, months before the World’s Fair began. It sounds like a strong case. Yet others have traced the concoction to an even earlier time — and back across the Atlantic Ocean. In “Mrs. A.B. Marshall’s Cookery Book,” the author (an Englishwoman) includes a recipe for a “coronet with cream.” That was in 1888. But pump the brakes! Five years earlier, another best-selling cookbook, “The Epicurean” by Charles Ranhofer, had specific recipes for such cones. Ranhofer was the iconic chef at Delmonico’s, which was a New York City establishment. Yet that might not be the last word. Charles Ranhofer, you see, was also an immigrant. by his intuition and experience as to what works. But I also think she
makes an important point about President Barack Obama, “his overall
style was to give at least the appearance of being lofty, intellectual,
polished. Nevertheless he was more than willing to fight dirty…” And
the media folks loved the “lofty, intellectual, polished” Obama and
forgave him when he fought dirty. (See nuclear deal with Iran, for
example.) Obama is very much a creature of the political media culture
of this country and Trump is antithetical. In the end, I really think it
comes down to style.”

virulently anti-Israel scholar-activists are trying to get a pro-BDS
academic boycott resolution passed at its annual meeting next month. The
resolution is pure propaganda from sketchy groups that are providing

outdated. As the new Executive Director of the Academic Engagement Network,

By: William Murchison ______________________ Emoluments Out of a Molehill On July 10, the Fourth Circuit Court of Appeals concluded that the District of Columbia and Maryland could not bring Emoluments Clauses claims against President Trump because they hadn’t suffered an injury sufficiently actual and immediate as to give them the right to file the lawsuit. As the court said, the claims of injury were “so attenuated and abstract that their prosecution of this case readily provokes the question whether this action against the president is an appropriate use of the courts, which were created to resolve real cases and controversies between the parties.” The Fourth Circuit sent the case back to the district court and told it to dismiss it. former Special Counsel Robert Mueller prepares for public testimony
before Congress this week, a ScottRasmussen.com national survey found
that he is viewed favorably by 39% of voters and unfavorably by 28%.As
with just about everything in contemporary politics, the results
include a wide partisan gap. Democrats, by a 57% to 16% margin, offer a
favorable assessment of Mueller. Republicans, by a 45% to 23% margin,
take the opposite view. Among Independent voters, 37% have a favorable
opinion of Mueller while 26% have an unfavorable view.Forty-two percent (42%) of voters nationwide now believe President Trump should be impeached and removed from office. Forty-four percent (44%) disagree and 14% are not sure.Eighty-two
percent (82%) of Republicans oppose impeachment while 74% of Democrats
favor it. Among Independent voters, 38% believe the president should be
impeached while 44% disagree.Fifty-three percent (53%) of voters
nationwide consider President Trump’s rhetoric to be polarizing and divisive. Another 24% find it uplifting and unifying while 23% say neither.Forty-three
percent (43%) say the rhetoric of both House Speaker Nancy Pelosi and
Congresswoman Alexandria Ocasio-Cortez (AOC) is polarizing and divisive.
Just 23% find Pelosi’s rhetoric to be uplifting and unifying while 21%
say that about Ocasio-Cortez. Given the lower level of visibility, it is
not surprising that both women have larger numbers of people with no
opinion either way.The
rhetoric of former President Obama was found to be uplifting and
unifying by 48% while 32% consider it polarizing and divisive.Once
again, the partisan divide is massive. Republicans find Pelosi and
AOC as divisive as Democrats see Trump. By a 57% to 18% margin, they
also find Obama’s rhetoric to be polarizing rather than unifying.
Independent voters are more comfortable with Obama’s rhetoric, but not
with that of Pelosi and AOC.Finally, it’s important to remember just how stable the overall political environment remains. The president’s job approval rating (46%) has barely budged over the past six months. We also update the Generic Congressional Ballot daily and it
consistently shows Democrats with about a six-point advantage (today it’s D 42% R 36%).This
stability suggests that most voters are tuning out the political
battles in official Washington. Presumably, they are waiting for
candidates to focus on issues that seem more relevant to the lives of

FIRST READ: How Mueller’s testimony might (and might not) reverberate in 2020
Robert Mueller’s congressional testimony on Wednesday could very well turn out to be a dud for Democrats.
But it also represents their last best chance at selling the middle of the electorate that Mueller’s report contains damaging information about President Trump and his team.
“While America’s political class has been obsessively following the two-year investigation into Russia’s efforts to help Trump win the presidency, most of the country has not,” NBC’s Ken Dilanian writes.
“Polls show that as few as 10 percent of Americans have read any part of special counsel Robert Mueller’s 448-page report — and that the news coverage of the report’s release did not change what has long been a partisan split verdict on Trump and Russia.”
The April/May 2019 NBC/WSJ poll – conducted after Mueller’s full report became public – found 29 percent of Americans saying it cleared the president of wrongdoing, while 42 percent disagreed, saying it did NOT clear him.
But another 29 percent said they were unsure.

So there is a good chunk of the electorate that hasn’t necessarily made up their minds here.
Yet Dilanian also reminds us that Republican members will have the opportunity to muddy the waters during Mueller’s testimony.
“Republicans plan to spend their half of the two hearings attacking the premise of the investigation and highlighting what they and their base have come to believe, without evidence, is FBI misconduct at the heart of the probe,” he says.
But if Mueller is REMOTELY damning against Trump & Co., will Democrats be able to resist the impeachment question, especially what’s transpired over the last week (“Send her back”)?
Dems, White House reach budget deal
White House and congressional leaders on Monday night announced they struck a deal that “would suspend the debt limit until July 31, 2021, and put an end to automatic spending cuts that would have kicked in without a deal,” per NBC’s Capitol Hill team.
President Trump tweeted his endorsement (at least we think it was an endorsement):
But as some observers have pointed out, a deal that suspends the debt limit until July 2021 means it’s conceivable that a Dem president would have to work with Republicans to raise it during his/her first few months in office.

2020 VISION: A Warren/Bernie win means a Senate loss – at least temporarily
The two Democratic presidential contenders with the boldest plans – Elizabeth Warren and Bernie Sanders – share this potential situation:
If they win the White House, their party loses a Senate seat. At least in the short run.
As one of us writes, both Massachusetts and Vermont have Republican governors, who would get to appoint someone (even from their party) to temporarily fill a Senate vacancy.
Then there’s the delay: Both states would have special elections that take place months after vacancy, which means a President Warren or Sanders could be down one Senate Dem during their honeymoon phase.
And then there’s the worst-case scenario: Could a Republican, a la Scott Brown, win a special in Massachusetts or Vermont?
On the campaign trail today: John Hickenlooper remains in Iowa… Joe Biden is in New Orleans… Elizabeth Warren attends a union rally at Reagan National Airport outside of DC… And Jay Inslee campaigns in California.
Dispatches from NBC’s embeds: Kirsten Gillibrand spoke Monday at a town hall in New York City, where she addressed the New Yorker article about former Sen. Al Franken, and her decision to support his resignation.
NBC’s Benjamin Pu reports Gillibrand’s response:
“Senator Franken wasn’t denied anything. It’s his decision and his
alone whether to wait out
his ethics committee hearing, whether to wait for his next election.
The decision I made was whether or not to carry his water and stay
silent. And given eight allegations, two since he was senator, and the
eighth one being a Congressional staffer, I couldn’t
stay silent.”
And John Hickenlooper said
that he would not immediately grant citizenship to undocumented immigrants.
NBC’s
Priscilla Thompson reports: “There has to be some punishment and delay,
significant delay on that,” he said – acknowledging he does support a
path to citizenship. He also came down hard
on businesses that employ undocumented immigrants. “We are a country of
laws,” Hickenlooper said. “The conservative right and the liberal left
don’t want to hold businesses accountable.”
Speaking of Hickenlooper, he’s up with
a new digital ad introducing himself (and that debate over hazy IPAs versus pastry stouts).
DATA DOWNLOAD: And the number of the day is… 66 percent.
66 percent.
That’s the share of Americans who say that it’s a BAD idea to decriminalize illegal border crossings — a policy proposal backed by many of the 2020 Democratic candidates — according to a new NPR/NewsHour/Marist poll.
Another 62 percent say it’s a bad idea for a national health insurance program to be made available to people who are in the U.S. illegally.
