Monday, July 8, 2019 Citizenship Back in the Census? “The Justice Department said Friday it will press its search for legal grounds to force the inclusion of a citizenship question on the 2020 Census, hours after President Donald Trump said he is ‘very seriously’ considering an executive order to get the question on the form.” AP News

The Flip Side From the Left The left opposes adding a citizenship question due to the risk that minorities will be undercounted, and criticizes the administration for offering the courts inconsistent justifications. “Trump has shown himself to be ignorant of what is at stake here. ‘I think it’s very important to find out if somebody is a citizen as opposed to an illegal,’ he said on Monday. ‘There’s a big difference to me between being a citizen of the United States and being an illegal.’ In fact, the proposed citizenship question on the census does not inquire about immigration status. It only asks if a person is a US citizen. A person who answered ‘no’ is not necessarily an undocumented immigrant — he or she could be a green card holder or a foreign national on a work or student visa. How telling it is that Trump apparently equates all non-US citizens present in the country as ‘illegal’… The 2020 census is not Trump’s census, it is our census. It is by and for the American people, and it must be carried out without further delay.”

The Justice Department is not being helped by Trump, who acknowledged on Friday that the ‘number one’ reason for a citizenship question is ‘for districting.’ Presumably, Trump means that he wants to let states draw districts by counting only citizens of voting age, not all persons—a scheme that would dramatically boost white voting power. (It has been neither permitted or prohibited by SCOTUS.) That’s a troubling concession, because Solicitor General Noel Francisco told the Supreme Court that using citizenship data for redistricting was not the purpose of the census citizenship question. Once again, Trump is telling a very different story from the narrative carefully crafted by DOJ attorneys… With every reversal and misrepresentation, the Trump administration is making it more difficult for Roberts to uphold the question under a new rationale.”

The question now is whether those fighting the citizenship question in court can use these comments to argue that Trump has revealed the administration’s and the Republican Party’s true goals. The administration has not yet signaled what its new rationale will be, but Trump’s comments certainly point in a different direction than before — and a potentially partisan one, at that.”

“No one knows how the Supreme Court will look on a hypothetical new rationale. On the one hand, Roberts invited the administration to return with its genuine motivation. On the other, the justices would have to overlook the dance the government is attempting. Furthermore, the administration can’t very well admit that it wants to undercount the population for political advantage—as Trump’s remarks today imply—because it would have to tell the courts that it is aiming for a less accurate census… 
 
“Trump also says he’s considering an executive order to add the citizenship question as some sort of addendum to the main questionnaire. It’s unclear how this would work. First, it would seem to run afoul of existing injunctions. And second, even if it succeeded legally… [one former congressional staffer and a census expert doubts] it would work logistically… There are many critiques of the Trump administration’s legal strategy in its quest to ask about citizenship on the 2020 census, but one cannot fault its chutzpah.”

University of California Irvine law Prof. Rick Hasen wrote in a blog post that an executive order from the president is pointless when the issue at hand is whether there is a logical reason behind adding the question, not whether or not the president has the authority to include it.”
Catherine Kim, Vox From the Right The right supports adding a citizenship question in order to understand how many non-citizens are present in the country and where they are located. “How does one determine whether a person is an alien, or a U.S. citizen, with the entitlements and benefits that go with citizenship? By asking the question, of course… 

“Proof of citizenship is required when applying for most jobs in the country. When I travel internationally and return home, there are two lines at Immigration and Customs. One is for noncitizens and the other for citizens. A form requires me to state my citizenship and show my U.S. passport. To apply for a U.S. passport I must provide proof of citizenship. In other countries, a stamp on my passport not only limits the amount of time I am allowed to stay, but also prohibits me from employment. In the UK, I can’t use the National Health Service because I am not a citizen. Other nations have a right to pass and enforce such laws. Only in America do we pass laws and then allow people to get away with ignoring them.”

Chip Roy (R-TX) writes, “getting an accurate counting of persons, and citizens, is important for re-districting, for allocation of federal dollars, for setting up voting locations, for making decisions about the impact of illegal immigration on American communities, and for, yes, administering the laws in accordance with the Voting Rights Act, among other reasons… 

“The Supreme Court expressly held that ‘[t]he evidence before the Secretary supported that decision’ to include the citizenship question on the Census… But it held there was a ‘mismatch’ between the Secretary’s decision ‘and the rationale he provided,’… So if the Secretary gives a proper explanation, it would be completely lawful for the federal government to include a citizenship question on the Census.”

Some argue that “Section 2 of the 14th Amendment provides that if a state denies the franchise to anyone eligible to vote, its allotment of House seats shall be ‘reduced in the proportion which the number of such… citizens shall bear to the whole number of… citizens… in such state.’ This language is absolute and mandatory. Compliance is impossible without counting how many citizens live in each state.”

Others, however, counter that “Section 2 of the Fourteenth Amendment has never been enforced. It would be both complicated and unpleasant to attempt it… A little over a week ago, Chief Justice Roberts rejected the Trump administration’s stated reason for the citizenship question as pretextual. Whether that decision was right or wrong, the Rivkin-Gray gambit looks like a dubious new pretext for adding a citizenship question to the census.”

“This citizenship question already appears on the longer and more detailed American Community Survey given to millions of people by the Census Bureau, and there is no evidence that it underperforms or does not get filled out. Many polls regularly include this question and there is no lack of response as a result… Legally, it should be a no-brainer that the commerce secretary can add a question that was on the census for scores of years, appears on the census of many other countries, and is recommended even by the United Nations in its guide to conducting a census… 

“[The] Census fight is really about politics… [by asking about citizenship] the Trump administration will be able to document block by block and congressional district by congressional district how many voters and non- voters live there and also to pinpoint how much in taxpayer dollars goes to citizens versus non- citizens… On the other side, the last thing that advocates of a more liberal immigration policy want is to document the full extent of the issue and its concentrated impact in certain areas of the country… The real battle over the citizenship question on the 2020 census has nothing to do with any of the arguments advanced by either side before the Supreme Court.”
Mark Penn, Fox News A libertarian’s takeNot asking about citizenship seems to signify an attitude toward immigrants something like this: Get them in and across the border, their status may be mixed and their existence may be furtive, and let’s not talk too openly about what is going on, and later we will try to get all of them citizenship… Countries that do let in especially high percentages of legal immigrants, such as Canada and Australia, take pretty tough stances in controlling their borders. Both of those countries ask about citizenship on their censuses. When citizens feel in control of the process, they may be more generous in terms of opening the border… as long as [we keep] taking in immigrants in torturous and not entirely legal ways, the debate over higher legal immigration will continue to founder.”

POLITICO Playbook: New swing-district polling illustrates impeachment peril

DRIVING THE DAY

MUCH OF THE ATTENTION over the next two weeks will be focused on July 17, when ROBERT MUELLER comes to Capitol Hill for public testimony in front of the House Judiciary and Intelligence committees. It’s inevitable Mueller’s appearance will amp up the conversation around impeachment, which had quieted down somewhat amid various other controversies.

IT’S WELL DOCUMENTED that Speaker NANCY PELOSI does not believe impeaching the president is smart politics. People around Pelosi have argued that it places vulnerable Democrats in a tough spot, and puts the House in jeopardy. She repeated her broader argument to Maureen Dowd in a column published in Sunday’s New York Times.

WELL, PER NEW GOP POLLING, SHE’S GOT A POINT … The National Republican Congressional Committeepolled five battleground districts, and found impeaching President DONALD TRUMP to be exceedingly unpopular.

THE DISTRICTS: California 21, where Rep. T.J. COX (D-Calif.) beat David Valadao; California 39, which Rep. GIL CISNEROS (D-Calif.) took in an open race; California 45, where Rep. KATIE PORTER (D-Calif.) toppled Mimi Walters; Georgia 6, where Rep. LUCY MCBATH (D-Ga.) beat Karen Handel; and New Jersey 7, where Rep. TOM MALINOWSKI (D-N.J.) knocked off Leonard Lance.

HERE ARE THE DEETS … The NRCC asked this question between June 30 and July 2: “Do you support or oppose impeaching President Trump?” In these five districts, impeachment support is somewhere between 29% and 35%, and opposition is in the high 50s and 60s.. The NRCC, which polled 400 people in each district, concludes: “Impeachment is not popular in suburban battleground districts carried by both President Trump and Hillary Clinton.” Read the NRCC polling memo

HAPPENING TODAY … NYT, A1: “Jeffrey Epstein Is Accused of Luring Girls to His Manhattan Mansion and Abusing Them,” by Ali Watkins and Vivian Wang: “Federal prosecutors appear to have resurrected a federal sex crimes case against the billionaire financier Jeffrey Epstein by focusing on accusations that he sexually assaulted girls at his mansion in Manhattan — more than a decade after a widely criticized plea deal shielded him from similar charges in Florida.

“Federal prosecutors are expected to unseal the new charges on Monday accusing Mr. Epstein, 66, of running a sex-trafficking operation that lured dozens of underage girls, some as young as 14, to his Upper East Side home, according to three law enforcement officials.” NYT

— ELIE HONIG, CNN contributor and former federal prosecutor (@eliehonig): “It is unusual and notable that SDNY’s Public Corruption Unit is on the Epstein case. I keep thinking back to 2008 when I was in the SDNY and Public Corruption was on a seemingly routine interstate prostitution case. Turned out, then-NY Governor Eliot Spitzer was ‘Client 9.’”

AP’S JIM MUSTIAN and DESMOND BUTLER: “Federal grand jury probing GOP fundraiser Elliott Broidy”: “A federal grand jury in New York is investigating top Republican fundraiser Elliott Broidy, examining whether he used his position as vice chair of President Donald Trump’s inaugural committee to drum up business deals with foreign leaders, according to documents obtained by The Associated Press and people familiar with the matter.

“A wide-ranging subpoena the U.S. Attorney’s Office in Brooklyn recently sent to Trump’s inaugural committee seeks records relating to 20 individuals and businesses. All have connections to Broidy, his investment and defense contracting firms, and foreign officials he pursued deals with — including the current president of Angola and two politicians in Romania.

“Prosecutors appear to be investigating whether Broidy exploited his access to Trump for personal gain and violated the Foreign Corrupt Practices Act, which makes it illegal for U.S. citizens to offer foreign officials ‘anything of value’ to gain a business advantage. Things of value in this case could have been an invitation to the January 2017 inaugural events or access to Trump.

“A statement released to the AP by Broidy’s attorneys said that at no point did Broidy or his global security firm Circinus have a contract or exchange of money with ‘any Romanian government agency, proxy or agent.’” AP

Happy Monday morning. PELOSI has invited the U.S. women’s national soccer team, which defeated the Netherlands Sunday to win the World Cup, to the Capitol. Pelosi’s tweet … When asked yesterday if they’d be invited to the White House, TRUMP said, “We haven’t really thought about it. We will look at that, certainly.”

— L.A. TIMES: “The newly minted Women’s World Cup champions will begin a multigame victory tour Aug. 3 in Pasadena provided the Rose Bowl board, which will meet Monday, approves a proposal for the game.” LAT

THE CENSUS MESS — “Justice Department changing lawyers on census case,” by WaPo’s Matt Zapotosky: “The Justice Department is swapping out the lawyers who had been representing the administration in its legal battle to put a question about citizenship on the 2020 Census, possibly signaling career attorneys’ legal or ethical concerns over the maneuvering ordered by President Trump.

“The department announced the move in a statement, which was issued after The Washington Post inquired about whether the career lawyers on the team planned to withdraw. A person familiar with the matter, who spoke on the condition of anonymity to discuss internal deliberations, said that at least some of the career attorneys harbored concerns about the administration’s handling of the case — although the nature of those concerns and how widespread they were could not immediately be learned.” WaPo

FACEBOOK AND TWITTER have not been invited to Trump’s social media summit on Thursday, per CNN’s Oliver Darcy: “[P]eople familiar with the matter … said they believe the summit would amount to a right-wing grievance session and was not aimed at seriously discussing some of the issues facing large technology companies.” CNN

WHAT THE E-RING IS READING: “Admiral to lead Navy instead will retire; bad judgment cited,” by AP’s Robert Burns: “The four-star admiral set to become the Navy’s top officer on Aug. 1 will instead retire, an extraordinary downfall prompted by what Navy Secretary Richard Spencer on Sunday called poor judgment regarding a professional relationship. …

“Spencer provided no details about the unnamed individual, but other officials said Spencer was referring to [Adm. William] Moran having recently taken public affairs counsel from Chris Servello, who was removed from his position as public affairs adviser to Richardson in 2017 and given a non-punitive letter of reprimand for drinking and fraternizing with junior officers during and after a December 2016 Navy Christmas party.

“Servello was accused of making unwanted sexual passes while dressed as Santa at the party. No charges were filed against him. He retired from the Navy last May at the rank of commander. Servello had previously worked for Moran as a public affairs officer.” AP

“Greeks turned instead to the resurgent center-right New Democracy party led by Kyriakos Mitsotakis, a Harvard-educated former banker and son of a 1990s prime minister. His party secured almost 40 percent of the vote and a comfortable majority of 158 seats in the 300-seat Parliament.

“Mr. Tsipras’s party, Syriza, got about 31 percent of the vote — a stinging defeat for the prime minister personally and a bookend to what began as a social experiment, just as populist parties from the left and the right are on the ascent elsewhere in Europe.” NYT

2020 WATCH — “Democratic field readies for the big shrink,” by Chris Cadelago: “With the first debates and two quarters of fundraising behind them, strategists with the leading Democratic campaigns and party operatives are beginning to rethink the conventional narrative of the 2020 primary.

“Gone is the expectation of a massive candidate pile-up when the early states begin voting, and a long, drawn-out primary. Few are worried anymore about the prospect of a brokered convention. Instead, the campaigns are revising their strategic outlooks to account for a field that is dramatically winnowed well before Iowa voters go to the caucuses — perhaps to as few as eight candidates on Feb. 3.

It is 6:05 a.m. and I am actually writing this myself instead of letting the computer generate it because several of you have asked if I’d get back into this habit.  For you, dear reader, anything.

So, here’s the news you need to know and also, undoubtedly, you want to know my thoughts on yesterday’s soccer matches.
Can we all agree the American women’s soccer team is incapable of playing and complaining at the same time.
It’s not very good soccer, so I guess they have to supplement with social commentary.  And don’t forget, they booted that Christian player from the team because she didn’t want to wear the LGBTABCDEFGHIJKLMNOPQRSTUVWXYZ whatever.  You know you want to click on my very candid thoughts right here.  Here’s a quick sample:  “It is the worst collision of feminist virtue signaling and lame on field performance that exists on planet earth. “I watched real soccer on Sunday night when the U.S. men’s team lost to Mexico. It was a great game with great on field performance. The American men lost and had not even half the social commentary that the women’s team generated before, during, and after their win. “Oh, the women are complaining about that too because they claim they’re going to be overshadowed. Yes, yes you are. Because your on field play is not comparable.”  You know you want read the whole thing.

Also, Democrats now have another entrant into their Presidential primary.  This one matters more than most.  Tom Steyer is a billionaire Democrat donor and his entry into the already supersaturated primary is a signal that he thinks the existing field sucks.  Go here for the details.

By the way, let me know what you think of this format. I’m literally experimenting as I type.  More after this little ad break.   Peter Heck points out how the President keeps winning because his enemies suck so bad and are really bad whiners.  
He writes, “Trump is not a genius.  It’s just his political opponents are exceedingly ignorant.”  But there’s more to it than that.  They always dial up every complaint to 12 and most of the stuff they’re complaining about isn’t worth complaining about.  His opponents lack any measurable discernment because they’re in a constant state of outrage.  There are some great, laughable examples here.

Why are progressives so intent on sexualizing and sexing up our children.  
Please go read this by Peter Heck.  This does not end well for any of us. “The overt sexualization of elementary school children who don’t know any better, all for the pleasure and entertainment of adults, is acceptable and shouldn’t be condemned.  But objectifying a 17-year-old professional who at least knows enough to willfully write and perform sexually-explicit lyrics is unacceptable? I admit to being utterly confused by those rules.  And I’m left wondering again why God’s parameters for human sexuality aren’t a better alternative for all of us?”

Lawmakers return to Capitol Hill this week in a mad dash to their August recess with issues crowding center stage, including oversight by House Democrats, government spending, debt ceiling negotiations and the upcoming testimony by former special counsel Robert Mueller next week.    Democrats are wedded to oversight as a potent weapon against President Trump and the executive branch. As Jacqueline Thomsen and Morgan Chalfant report, Speaker Nancy Pelosi (D-Calif.) is banking on multiple ongoing congressional probes to hold the administration accountable as the number of lawmakers calling for a formal impeachment inquiry grows. According to The Hill’s whip list, 81 House Democrats (and one former Republican) have called for an impeachment inquiry that Pelosi is working to discourage.    The Speaker points to the party’s strides in the judicial branch against the Trump administration as proof that her party is pursuing an effective strategy. Legal experts and congressional history back her up. Federal judges, for example, generally side with Congress’s oversight powers in court battles over executive privilege. Experts told The Hill that even without impeachment on the table, House Democrats are still more likely to win their court fights with the administration — including before the Supreme Court.    “I think that Congress’s role as the oversight organization is so compelling that the Supreme Court would uphold the

subpoenas,” said Jill Wine-Banks, a member of the special prosecutor’s team during Watergate. 

The House Oversight and Reform Committee will be back at it with high-profile hearings, headlined on Wednesday with a withering appraisal of the treatment of migrant children at the southern border by the Department of Homeland Security (DHS). Chairman Elijah Cummings (D-Md.) invited acting DHS Secretary Kevin McAleenan and acting Customs and Border Protection Commissioner Mark Morgan to testify.  

The hearing was announced amid worsening conditions last week after a group of House Democrats toured the facility in Clint, Texas, and decried what they witnessed. It also comes after an inspector general’s report said investigators found “dangerous overcrowding and prolonged detention” of immigrant children and adults at facilities in the Rio Grande Valley, adding that the detained children require “immediate attention and action.”

The president and administration officials fired back at the report and subsequent reporting by The New York Times, which Trump called a “hoax.” McAleenan defended the conditions at the Texas facility, acknowledging it’s an “extraordinarily challenging situation.”

The fight over the border and immigration policy is expected to rage on, especially as the DHS appropriations bill remains a point of friction between moderate and progressive House Democrats. Moderates won the most recent battle over a $4.6 billion supplemental spending measure focused on needs at the border, a victory that did not sit well with progressives in the House caucus.

Politico: Threat of budget disaster rises amid discord in both parties.

> Across the Capitol, Senate Foreign Relations Committee Chairman Jim Risch (R-Idaho) is walking a political tightrope as he tries to craft new Saudi Arabia legislation. According to Jordain Carney, Risch, a low-profile senator who sticks closely to Trump, wants a bill that can win over the Senate and the White House, a potentially herculean goal given the deep divisions in the wake of journalist Jamal Khashoggi’s death. 

He’ll face his first test as soon as this week, when he’s expected to give his forthcoming bill a vote in the Senate Foreign Relations Committee, where a majority of his members supported recent resolutions to box Trump in on Saudi Arabia. 

Congress had hoped to resolve one trade issue that now appears stalled before lawmakers leave for the six-week August break. Ratification of the U.S.-Mexico-Canada Agreement (USMCA), which the White House has lobbied Congress to clear, now looks like a question mark.  

As Cristina Marcos reports, House Democrats from across the spectrum are demanding that the trade pact with Mexico and Canada be renegotiated, citing concerns with the implications for labor standards and drug prices. While they insist they want to get the USMCA passed, they aren’t holding themselves to a deadline.

LEADING THE DAY
2020 CAMPAIGN: With roughly 16 months until Election Day, multiple factors should give the president a sense of optimism as his reelection bid gains steam, even as he faces negative polling against potential Democratic challengers.    As Ian Swanson, Sylvan Lane and Julia Manchester write, a number of things are going Trump’s way, leaving him better positioned for victory in a second term — namely, a strong economy that is showing little sign of slowing down, the burgeoning and divisive Democratic presidential primary, and the financial edge he is likely to have next year as Democrats wrap up their primary contest.    On the economic side, Trump has been the recipient of strong economic numbers throughout his 2 ½ years in office, including a 3.7 percent unemployment rate, the second-lowest figure recorded in nearly 50 years, and a gain of 224,000 jobs in the economy in June. Additionally, wages ticked up last month and the stock market remains strong as the Dow Jones Industrial Average hit a new record.    “We have very good pro-growth policies, low taxes, deregulation, opening energy, trade reform,” top White House economic adviser Larry Kudlow recently told Bloomberg TV. “I think the incentives of our supply-side policies are working.”   Trump clearly continues to see former Vice President Joe Biden as a formidable opponent and has not ceased attacking him whenever he can. Most recently, Trump tweeted about Biden’s work with segregationists and plan to reverse the Republican tax cuts passed into law in late 2017.    However, Biden has stumbled lately and has seen his poll numbers dip, giving Sen. Kamala Harris (D-Calif.) and Sen. Elizabeth Warren (D-Mass.) an opening. Both are more progressive than Biden, something Republicans would welcome.    Financially, the president holds a major advantage over the eventual Democratic nominee. In the second fundraising quarter, Trump’s reelection bid and the Republican National Committee raised $105 million. By contrast, South Bend, Ind., Mayor Pete Buttigieg raised nearly $25 million, pacing the Democratic field.    Additionally, Trump’s approval numbers have reached some of the highest points of his presidency, although they consistently remain below 50 percent, considered by political scientists to be a warning sign for past incumbents who sought second terms. According to a new Washington Post-ABC News poll, 47 percent of registered voters approve of Trump, the highest number the poll has produced. The most recent RealClearPolitics aggregate of polls puts Trump’s approval figure at 45 percent, the second-highest since his inauguration.    One potential speed bump cropped up once again on Sunday, however. Days after he announced his departure from the Republican Party, Rep. Justin Amash (Mich.) declined once again to rule out a third party run for president in 2020, a possibility that could create headaches for the president’s reelection efforts.    “I still wouldn’t rule anything like that out. I believe that I have to use my skills, my public influence, where it serves the country best. And I believe I have to defend the Constitution in whichever way works best,” he told CNN’s “State of the Union”
  Most notably, Amash could hurt the president in Michigan, where Trump won in 2016 by less than 11,000 votes over Hillary Clinton and has little margin for error. © Getty Images     > With the first debates in the rearview mirror, a new batch of presidential rankings are out, and there’s a new leader in the clubhouse.   After a strong June, capped off by a rise in the polls and a strong debate performance, Warren has leapfrogged Biden, with Harris trailing the two.    As Niall Stanage writes, Warren is not leading in any national polls. But she’s ascending and her message on the stump is resonating. The Massachusetts senator also appears to be on the brink of supplanting Sen. Bernie Sanders (I-Vt.) as the standard-bearer of the left — a development that could fundamentally reshape the race.   Despite his continued lead in polls nationally and in primary polls, Biden slipped one spot, largely because of the Miami debate and the problems that have emerged since his battle onstage with Harris. The focus on race and school busing eroded his support among black voters. It raised grave questions about whether he would be the strongest candidate against Trump — a rationale for his candidacy. It also stoked concerns on the sensitive issue of his age at 76.    As for Harris, the debate was the fuel she needed to climb into the top tier of the primary battle. It boosted her profile and popularity among voters of color, whose support will be vital if she is to prevail, and put her candidacy in the headlines for days.    > Drop-out Watch?: Rep. While most 2020 candidates campaigned during the July Fourth holiday, Swalwell canceled two days of events in New Hampshire, stoking chatter that he could be the first 2020 Democrat to exit the race. WHITE HOUSE & ADMINISTRATION: President Hassan Rouhani of Iran has placed a risky bet that breaching the terms of the 2015 nuclear deal negotiated with world powers will force the United States to back away from crushing sanctions that slashed the country’s oil exports and crippled its economy. Iran is angling for a way to return to the terms of the agreement or ease sanctions by splitting European nations from the Trump administration, which the Europeans blame for sparking the escalating crisis (The New York Times).   The Hill: Five things to know about Iran’s violations of the four-year-old agreement and the implications.   Secretary of State Mike Pompeo warned Sunday that Iran’s decision to violate the terms of the pact would “lead to further isolation and sanctions,” arguing that Iran should exist under international strictures of no allowable enrichment. A nuclear-armed Iran “would pose an even greater danger to the world,” Pompeo tweeted.
  Trump said Iran “better be careful” as he spoke with reporters before departing New Jersey to return to the White House on Sunday evening (Reuters).   Iranian officials said they would begin enriching uranium above the level allowed by the 2015 nuclear deal “within several hours” on Sunday. The Atomic Energy Organization of Iran indicated that international monitors would be able to confirm the breach today (The Washington Post).   The Trump administration on Friday called for a special session of the United Nations atomic agency board, ratcheting up the pressure on Europe and other allies to take a stand against Iran.   Reuters: Roundup of international reactions to Iran’s announcement it will increase uranium enrichment.   > Census: The president this week expects to receive additional input from Attorney General William Barr and other advisers about whether or how he can add a citizenship question to the 2020 census on his executive say-so as the U.S. Census Bureau began printing the national survey without the question.   “We have four or five ways we could do it,” Trump said last week and again on Sunday, declining to retreat after the Justice and Commerce departments said last week that no such question would appear on the population survey conducted every 10 years.   Barr and his deputies suddenly assigned a new team of lawyers to take over the census cases, The Washington Post and other news organizations reported Sunday night. Court filings today are expected to indicate that the new team is made up of political and career lawyers from the department’s Civil Division and Consumer Protection Branch.      One potential avenue, the president insists, could be an executive order or presidential memorandum, which many legal experts say would immediately be challenged in court. Another possibility, the president said, is to continue printing the census survey without the question and then “maybe do an addendum” to the census next year “after we get a positive decision” from the Supreme Court. Trump has also argued that the 2020 census should be delayed, although its deadlines appear in statute.   The high court last month sent a legal challenge involving the administration’s push for citizenship data back to the Commerce and Justice departments, ruling that the government presented unpersuasive evidence when it said it wanted to protect voting rights by probing every household for citizenship status (The Hill).   Ken Cuccinelli, acting director for Citizenship and Immigration Services, said he’s confident Trump will get his way.   “I think the president has expressed determination. He’s noted that the Supreme Court didn’t say this can’t be asked. They said they didn’t appreciate the process by which it came forward the first time. The president is determined to fix that and to have it roll forward in the 2020 census,” he said on Fox News Sunday (NBC News).   CNN: Why does Trump want such a question added to the census and why is it controversial?   The Hill: The American Civil Liberties Union asked the court on Friday to block the president’s efforts.

He plans to laud the administration’s environmental record during an East Room event at 3:30 p.m. Trump will attend a dinner hosted by Treasury Secretary Steven Mnuchin in honor of Sheikh Tamim bin Hamad al-Thani, the emir of Qatar, who will hold a bilateral meeting with the president at the White House on Tuesday.   Pence will speak at the annual summit of Christians United for Israel at 11 a.m. at the Walter E. Washington Convention Center in Washington.    Pompeo will speak to the news media at 9:15 am. at the State Department. He will address the Foreign Affairs Policy Board at 9:45 a.m. At 2:30 p.m., the secretary plans to follow in the vice president’s footsteps and speak at the Christians United for Israel event in Washington.

Epstein secured one of the nation’s most lenient plea deals for a serial sex offender more than a decade ago in Florida following accusations he sexually assaulted dozens of underage girls. The prosecutor at the time was Alexander Acosta, now the secretary of labor in the Trump administration (The Miami Herald and The New York Times). … ObamaCare is back in court on Tuesday in a closely-watched case as the 5th Circuit Court of Appeals in New Orleans hears arguments supportive of the Trump administration’s push to overturn all of the Affordable Care Act. Regardless of the outcome, Democrats are likely to use the case to paint Republicans as a threat to the private insurance coverage millions of Americans rely on (The Hill). 
 
THE CLOSER
And finally …  The U.S. women’s national team took home its second consecutive FIFA World Cup title on Sunday, defeating the Netherlands 2-0 in Lyon, France behind goals from Megan Rapinoe and Rose Lavelle.    The win culminated a dominating month for the team, which won the program’s fourth World Cup. Over seven games, the U.S. women set a new record for the most goals in a single World Cup, 26, plus another record of 13 goals in the team’s opening match against Thailand.    “It’s surreal. I don’t know how to feel like now. It’s ridiculous,” Rapinoe said. “We’re crazy and that’s what makes us so special. We just have no quit in us. We’re so tight, and we’ll do anything to win.”   Rapinoe was the star of the tournament for the U.S. squad. Playing in her third World Cup, Rapinoe nabbed the Golden Ball, given to the best overall player during the tournament and the Golden Boot, awarded to the top scorer.    The president and the first lady both congratulated the team, with Trump hailing “great and exciting play,” adding that “America is proud of you all!” He told reporters before departing Bedminster, N.J., for the White House that he hasn’t “really thought about” inviting the team to the White House. (He previously invited the team on Twitter whether the U.S. women won the tournament or not.)    Some top female athletes, past and present, used the moment to call for the team to receive equal pay. According to Darren Rovell, each player earned about $250,000 for winning the title. If the men’s team ever wins, each player is slated to receive more than $1.1 million.    The U.S. women’s team will be honored on Wednesday morning with a parade down the Canyon of Heroes in New York City, the second time the program will receive the honor. Their victory was also celebrated with a parade after the team captured the 2015 title.

Team USA Wins!
On Sunday, the U.S. women’s soccer team won its fourth World Cup title and second in a row. Their team account has been using the hashtag #OneNationOneTeam. Given the drama that’s happened over the last couple weeks over who would and would not attend the White House ceremony, it was a good call to come together going into the final game. President Trump tweeted, “Congratulations to the U.S. Women’s Soccer Team on winning the World Cup! Great and exciting play. America is proud of you all!”

Another topic dominating conversation as the team progressed was the pay difference between the women’s team and men’s team. Several politicians tweeted about it and fans cheered “Equal Pay” at the game. The optics aren’t good, but the facts tell a different story. This story comes up every World Cup and there are several articles talking about the business (i.e. cash flow) of professional soccer. Here’s an excerpt from a 2015 article from Business Insider:

“In fact, most of the people who are complaining about the prize money are actually part of the problem. How many of them have actually been to a women’s professional soccer game outside of the World Cup?  The total prize pool for the women’s tournament was $15 million. Of that, the US women’s national team took home $2 million for their victory. That’s less than a quarter of the $9 million the US men’s team got last year for getting knocked out in the round of 16. The total prize pool for the men’s tournament was a whopping $576 million — 40 times the women’s haul.  This brings me to an important question: What separates men’s sports and women’s?  There’s one big difference — revenue. Female soccer players are paid less because their sport makes less. According to the Wall Street Journal, there was $17 million in sponsor revenue for this year’s women’s World Cup compared to $529 million for the 2014 men’s tournament. America’s winning women earned a larger share, about 11%, of the money their tournament made this year from sponsors than the victorious German team, who got just 6.6% of the sponsor revenue from last year’s men’s World Cup as their prize.  The real question is not why female athletes are paid less. People should be asking why fans and sponsors are less interested in supporting women’s sports — and this is what they should be outraged about.” Hopefully, the team and the country will soon have an opportunity to celebrate their win without politics

No Consensus on the Census
Last week there was talk of the Trump Administration not pushing for a question on one’s citizenship status be included in the 2020 census. The president confirmed via Twitter that they were still pursuing it, writing, “The News Reports about the Department of Commerce dropping its quest to put the Citizenship Question on the Census is incorrect or, to state it differently, FAKE! We are absolutely moving forward, as we must, because of the importance of the answer to this question.”

George Washington University Law professor John Banzhaf told the Washington Examiner that it could be done. He said, “There are several rationales — including one based upon the Constitution itself — which could well still persuade the courts to permit a citizenship question on the census, especially if the explanation were included in the executive order now being considered, rather than in some new declaration by the Secretary of Commerce.”

The Examiner also reported that an Economist/YouGov poll found that a majority (53%) think the question should be included, while 32% said it shouldn’t and 14% are not sure.

FIRST READ: For Democrats in the general election, the middle of the electorate still matters

As the 2020 Democratic field largely becomes a race to the left, the latest Washington Post/ABC poll is reminder of how the middle still matters.

In the poll, Joe Biden – despite that rough debate performance – leads President Trump by 10 points among registered voters, while it’s a jump ball with the other Dem candidates, including those like Bernie Sanders and Elizabeth Warren who have pretty high name ID.

The numbers among registered voters:

  • Biden 53 percent, Trump 43 percent (D+10)
  • Kamala Harris 48 percent, Trump 46 percent (D+2)
  • Sanders 49 percent, Trump 48 percent (D+1)
  • Warren 48 percent, Trump 48 percent (even)
  • Pete Buttigieg 47 percent, Trump 47 percent (even)

And it’s Biden’s strength with the middle that fuels his lead.

Among independents, he’s ahead of Trump by 7 points, while the other Dems are tied or trailing, per the Post.

And among moderates, Biden leads the president by nearly 30 points, versus 15 to 21 points for the other Democrats.

SAUL LOEB/AFP/Getty Images Now this doesn’t mean that Biden’s advantage with the middle will last – there’s plenty of evidence to be bearish about his long-term prospects.   It also doesn’t mean that another Dem candidate couldn’t overperform with the middle, especially if he/she goes on a winning streak during the nominating contests—or even win a jump-ball election without dominating among moderates and independents.    And most importantly of all, it’s still REALLY early in sizing up these general-election polls, with Election Day 2020 still nearly 500 days away.   Still, the numbers are a reminder how it’s a math game for Democrats.   Self-described conservatives outnumber self-described liberals by a 35 percent to 26 percent margin, according to a 2019 Gallup poll.   So to win national elections, Dems must run up the score among the 35 percent who are moderates.   (In the 2018 midterms, they won moderates by 26 points and indies by 12 points.)   That’s why the middle still matters.

Biden apologizes for segregationist remarks – nearly three weeks later

Speaking of evidence to be bearish about Biden’s long-term prospects, it took him nearly three weeks to apologize for discussing his ability to work with segregationist senators during the 1970s.

He made the remarks at a June 18 fundraiser, and the Dem pile-on took place the next day.

And he apologized over the weekend on July 6, per NBC’s Marianna Sotomayor.

“Was I wrong a few weeks ago to somehow give the impression to people that I was praising those men who I successfully opposed time and again? Yes I was. I regret it. I’m sorry for any of the pain or misconception…”

NBC’s Mike Memoli adds that Biden took so long to apologize because he wanted to do so while in South Carolina. 

Trump determined to add citizenship question to census

“A top U.S. immigration official said Sunday he’s confident that the Trump administration will add the citizenship question to the 2020 census after their effort to do so was shot down by the Supreme Court,” per NBC News.

“I do think so,” Ken Cuccinelli, acting director of the Citizenship and Immigration Services office, said on “Fox News Sunday.”

“I think the president has expressed determination. He’s noted that the Supreme Court didn’t say this can’t be asked. They said they didn’t appreciate the process by which it came forward the first time.”

Relatedly, the Justice Department announced yesterday “that it was shifting its census effort to a new team of lawyers and indicated there would be more court filings Monday.”

2020 VISION: Shakeup in the Democratic field? 

NBC’s Julia Jester flags that Eric Swalwell will hold a 4:00 pm ET news conference at his campaign headquarters in California.

Is he announcing he’s leaving the 2020 presidential race? Remember, he can still run for his current House seat.

Meanwhile, The Atlantic reports that billionaire Tom Steyer has told staffers at two progressive groups he runs that he’s jumping in the race, and could do so on Tuesday.

Remember, Steyer announced he WASN’T running back in January.

On the campaign trail today: Julián Castro and John Hickenlooper stump in Iowa… Elizabeth Warren, Kirsten Gillibrand and Tim Ryan are in New Hampshire… Kamala Harris hits South Carolina… Beto O’Rourke remains in Tennessee… And Jay Inslee discusses climate change in Oregon.

Six points

That’s the difference in a hypothetical matchup between Trump and a Democrat voters regard as a “socialist,” according to the same WaPo/ABC poll we mentioned above.

In this matchup, 49 percent of registered voters say they’d back Trump, while 43 percent support the Democrat who they believe is a socialist.

That 6-point lead for Trump is better than his head-to-head matchups in the poll versus Biden (whom he trails by 10 points) and other Democrats (with whom he’s essentially tied).

Good morning, it’s Monday, July 8, 2019. Sixty years ago today, a small continent of American soldiers anticipated an evening of R&R at a base camp in the town of Bien Hoa. Located 20 miles north of Saigon, the military outpost housed the South Vietnamese 7th Infantry Division as well as an eight-man detail of the little-known U.S. Military Assistance Advisory Group. Officially, the United States was not involved militarily in Vietnam. But during his second term. President Dwight Eisenhower had authorized the deployment of small teams like this one to advise and assist the South Vietnamese military in their struggle against the Viet Cong — communist guerrillas launching increasingly violent hit-and-run attacks. Most of the Americans sent over there in 1959 were seasoned combat veterans. Two of them, Maj. Dale Richard Buis and Master Sgt. Chester Melvin Ovnand, had seen action in Korea and World War II. So, they knew the danger. But it’s hard to keep your guard up 24 hours a day, as their fellow Americans were reminded 60 summers ago. I’ll have more on the fateful attack at Bien Hoa in a moment. In RealClearScience, Megan Ray Nichols compiled this list amid discussions of a manned mission to Mars. * * * On July 8, 1959, Chet Ovnand wrote a letter to his wife back home in Copperas Cove, Texas, and dropped it off in the post mailbox. Dale Buis, who’d arrived in Vietnam recently, was still showing his new comrades photos of his three young sons, Kurt, Mark, and Lance. That night, Ovnand and Buis were two of the six men in the unit who gathered in the stucco mess hall for a showing of “The Tattered Dress,” a film noir starring Jeanne Crain. When Sgt. Ovnand turned on the lights to change reels, Viet Cong attackers opened fire. Although the guerillas had been targeting South Vietnamese soldiers, government officials, and the mayors of rural villages, except for a single 1957 incident they had avoided engaging with Americans. The gunfire and grenade explosion that pierced the humid summer night signaled a change in tactics. Stanley Karnow, a reporter covering Asia for Time-Life publications, was in Saigon that day in 1959 when he heard about the attack on Americans in Bien Hoa. A World War II veteran who would win a Pulitzer Prize for his comprehensive book about the region, Karnow went to the scene of the ambush. What he discovered after interviewing the survivors appeared in a news story published the following week. Karnow used the word “terrorists” to describe the attackers, as did the U.S. Army. Certainly, the attack was terrifying: Six unarmed Americans take a break from their duties to watch a movie only to be ambushed on their own base. “In the first murderous hail of bullets, Ovnand and Major Buis fell and died within minutes. Captain Howard Boston of Blairsburg, Iowa, was seriously wounded, and two Vietnamese guards were killed,” Karnow wrote. “Trapped in a crossfire, all six might have died had not Major Jack Hellet of Baton Rouge leaped across the room to turn out the lights — and had not one of the terrorists who tried to throw a homemade bomb into the room miscalculated and blown himself up instead. Within minutes Vietnamese troops arrived, but the rest of the assassins had already fled.” In the ensuing years, other details have emerged about the attack, particularly about the brave reactions of the two slain servicemen. It was Ovnand, according to some accounts, who immediately doused the lights. After rushing to the window to ascertain where the shooting was coming from, Buis directed the other men upstairs to get their weapons. It was the last order he ever issued. Second later, he was killed by a bomb that had been planted near where he stood. Dale Buis and Chet Ovnand have the distinction of being the first two names on The Wall, officially the Vietnam Veterans Memorial. At the 1982 dedication of that monument, their names were joined by 57,937 others. More have been added since, including two U.S. military men who died in Vietnam earlier. Today, 58,320 names are on the wall, as others have been added in the course of time, either because their deaths were discovered or as they died of their wounds. For the Buis family, the Wall served as vindication for a cohort of men whose service was not venerated the way it should have been. On the occasion of the 25th anniversary of his father’s death, Kurt Buis expressed satisfaction that the country was “finally acknowledging that my dad’s life and all others were worth something.” If anything, we realize that truism more with the passing of time.  Earlier this year, an American named Mark Gorlinsky posted a poignant note on the Dale Buis Find-a-Gave webpage. Mark Gorlinksy is a son of Victor Gorlinsky, one of the survivors of the Bien Hoa attack. “Major Dale Buis made the ultimate sacrifice and saved his fellow soldiers, one of which was my dad, on July 8, 1959,” Mark wrote. “Words cannot express my sorrow for his loss. But I hope he knows how many lives he has touched.” Carl M. Cannon

Trump Continues to Defy and Embarrass Critics The president continues to defy critics and the critics deserve to be defied. The president is politicizing the 4th of July, critics howled. Worse than that, a talking head said a military parade with tanks would make us look more like the Soviet Union and North Korea.

One would think that the president requesting what turned out to be a very modest showcase of our military would the first step towards militarism—two stationary light tanks and a salute by a few Airforce jets. Not quite the anticipated endless row of heavy tanks, artillery, and missiles rumbling through the streets of Washington; and far from the “excess” and “divisiveness” expected from the liberal pundits…
