Friday, May 31, 2019 More on Mueller “Special counsel Robert Mueller said Wednesday that charging President Donald Trump with a crime was ‘not an option’ because of federal rules, but he used his first public remarks on the Russia investigation to emphasize that he did not exonerate the president.” AP News

On Thursday, “Attorney General William Barr said he believes special counsel Robert Mueller could have reached a decision on whether President Trump committed obstruction of justice, regardless of long-standing Justice Department policy that prohibits the indictment of a sitting president.” CBS News

In case you missed it, you can catch up on yesterday’s edition here, where we covered the first set of analyses of Mueller’s statement. The Flip Side From the Left The left agrees with Barr that Mueller should’ve reached a decision, and is divided on whether Congress should begin impeachment proceedings. “Legal experts and law professors have been popping up ever since Mueller spoke, pointing out that the Department of Justice’s settled ‘opinion’ that a president cannot be prosecuted while in office has never been tested in court. There is no legal bar to Trump’s indictment… [Moreover] Mueller’s secondary argument that to indict Trump would contravene the ‘principles of fairness’ assumes the president would be unable to clear his name in a court hearing – when in fact, it might be fairer, to him and the American public, to afford him that opportunity by bringing charges. As Mueller has unsatisfactorily left it, Trump is above the law, yet not above suspicion.”

“He has declined to clear Trump of wrongdoing. He has also declined to accuse Trump of wrongdoing. Either choice was within his power as special counsel. Instead, Mueller has left the country with a tortured non-conclusion… His statement marginally increases the pressure on the House of Representatives to open impeachment hearings. But it mostly leaves the country exactly where it was, with Trump’s defenders believing he’s innocent and his critics believing he’s guilty.”

That may be why Pelosi’s “taking a middle of the road approach on impeachment… Most voters put the Russian investigation very low on the list of most important issues. In a March CNN poll, 0 respondents listed the Russia investigation or the Mueller report as their most important issue in determining their vote for the 2020 election. Pelosi is a politician who is practicing politics… Launching an impeachment inquiry not supported by the public is probably seen by her as a risky maneuver that puts at risk the Democratic majority.”

“Impeachment at this point is all but certain to end in Trump’s acquittal in the Senate, which is controlled by a Republican majority… A Trump facing impeachment will rally reluctant Republicans to him, with the argument, so effective for Bill Clinton in the 1990s, Even if he did something wrong, it does not merit removal from office… 

“Trump accountability is not an all-or-nothing choice. It’s not now or never. The House can investigate every Trump misdeed, exposing to the light of day everything from allegations of money laundering and bank fraud to the abuse of undocumented-immigrant laborers at Trump-owned properties. It can investigate the Trump-Russia file, not as a case of criminal conspiracy, but as a national-security threat. It can fight the battle for proper Trump financial disclosure in the courts—and summon the national-security professionals who were overruled by Trump when they denied Jared Kushner a security clearance to testify before committees…  wise action is better than urgent action, and the best decision is one that leads to success.”

Counterpoint: “It is no surprise that few Americans are talking about the report over the water cooler… It’s time for Democratic leaders to repackage Mueller’s findings in a form that will be more readily digested by the American people. Unfortunately, the current approach of investigations in no fewer than six committees, multiple subpoenas, innumerable court proceedings and White House delay tactics just creates more confusion. How can the United States focus on the findings if a Democratic House will not singularly focus its investigations? From the cheap seats, it appears that there may be too many balls in the air… 

“Democrats should… use the impeachment process to make the case and move public opinion against the incumbent president rather than wait for public opinion to catch up to the evidence. The country needs to hear from Mueller and witnesses within the serious framework of an impeachment proceeding — no fried chicken buckets and no one-liners, please.”
Donna F. Edwards, Washington Post From the Right The right is critical of Mueller’s decision to issue a statement, and argues that impeachment is unwarranted. “Mueller ditched the presumption of innocence, a bedrock of the American legal system… in surely one of the more gobsmacking utterances ever made by someone from a Justice Department podium, [he stated] ‘If we had confidence that the president clearly did not commit a crime, we would have said so.’ If this standard had been applied to any person other than Donald Trump, it would have been widely denounced and the American Civil Liberties Union would be crusading to keep it from ever emerging again in any context in America… 

“[Mueller] invented an extraconstitutional legal standard for his obstruction investigation and acted, at the very least, in violation of the spirit of the special counsel regulations. His departing act was a public statement meant to influence the public debate in a manner inappropriate for a prosecutor, in part because the public report he wrote that was inappropriate for a prosecutor failed to achieve clarity despite its hundreds of pages.”

“President Trump’s critics are now picking apart [Mueller’s] statement, looking for discrepancies with the carefully chosen words in his report, and searching for hidden meaning and secret messages urging them to impeach the president. Like with a verbal Rorschach test, they are reading between the lines to hear what they want to hear… All Mueller’s news conference did is muddy the waters. Any congressional testimony would do so 10 times over. He should have heeded his own advice, left the building quietly, and, as he put it in his statement, let ‘the office’s written work speak for itself.’”

“Quite a few Democrats believe the subtext of Mueller’s remarks was, ‘Yes, you should impeach the president.’ A matter as important as this shouldn’t be left to subtext. If Mueller really believes that what he laid out in the report warrants impeachment, he could have and should have said, ‘The actions described in the report meet the legal definition of obstruction of justice. If Donald Trump were not president of the United States, he would be charged with the crime of obstruction of justice. Under our Constitution, it is up to Congress to determine the appropriate steps from here’… 
 
“A desire to obstruct justice, and only being hindered by reluctant underlings, is a really bad quality in a president. But it’s also a really thin reed for the first removal of a sitting president in American history. Back in 1998, I thought suborning perjury was sufficient reason to remove a president, but the country disagreed. We are now approaching some sort of emerging consensus that suborning perjury isn’t enough to remove a president from office, but an unfulfilled desire to obstruct justice is… My suspicion is a lot of people apply the legal standard that ‘presidents I don’t like should be impeached, but presidents I do like should not be impeached.’”

“Impeachment may satisfy Mueller and it may satisfy the Democratic base but there’s already a constitutional mechanism for removing Trump from office coming up in 18 months. It’s called an election. Democrats may think impeachment will help them do that but I don’t see a huge appetite for that among the public. I’m sure there will be some new polls out in the next few days to tell us if Mueller’s statement had any impact on the numbers. My guess is they won’t budge very much.”

The longer Democrats drag this out, the less serious they look. They keep saying they need to consider impeachment without doing it. That makes them look like they’re interested in the politics of it, not the reality of it. The American public is largely ready to move on and voters think this issue can be dealt with at the ballot box… So either the Democrats must rush to do impeachment now or they must abandon it to avoid looking political and getting thrown off message… Bob Mueller may have done the President no favors, but he did not do the Democrats any favors either.”

Revelations About MLK’s Past Could Be Detrimental to His Legacy

Yesterday, in British magazine Standpoint, Martin Luther King Jr. biographer David Garrow penned a rather explosive piece revealing previously undisclosed FBI files that detailed shocking events in the life of the legendary civil rights activist. According to the article written by Garrow, King was not only a prolific philanderer, but also an abuser of many women and also someone who reportedly laughed while a friend raped a woman.
 
The weight and validity of the FBI documents themselves raise the first point of contention in the midst of this publication. The files were observations made by an FBI that was under specific instruction to make King look as bad as possible as J. Edgar Hoover was, at the time, totally convinced that King was a full-blown communist with intentions to turn the United States into communists as well. In fact, when the details of these FBI files, which have been available on the National Archives public website since late 2017, Garrow himself stated in an interview with the Washington Post, “The number one thing I’ve learned in 40 years of doing this, is just because you see it in a top-secret document, just because someone had said it to the FBI, doesn’t mean it’s all accurate.”  It is only now that the noted King historian has decided the details of King’s salacious hidden life merits attention and ridicule.
 
The documents were ordered to be sealed in 1977 by a District Judge for a period of 50 years- a date which will officially expire in 2027. A representative for the National Archives stated to me yesterday, “The writer [David Garrow] links to documents released under the President John F. Kennedy Assassination Records Collection Act, which are available through the National Archives and Record Administration’s public website. The research and any interpretation or conclusions in the article are those of the writer/researcher.”
 
But whether or not the allegations are true, the work done by Dr. King as a civil rights activist is now in danger of cancellation. Like all historical figures, he was a human man. That is not an excuse for horrific behavior, but a reminder that the faults of our heroes do not define the good work they did. King’s words are particularly poignant today, in a time that outrage culture and identity politics have replaced his calls for equality and harmony. From his famous “I Have a Dream” speech:
 
“I have a dream that one day right there in Alabama little black boys and little black girls will be able to join hands with little white boys and white girls as sisters and brothers.”
 
“I have a dream that my four little children will one day live in a nation where they will not be judged by the color of their skin but by the content of their character.”
 
These ideas seem to have gone by the wayside as people are valued by their gender, race, religion, and political beliefs to an extreme degree in the modern age. Regardless of the validity of modern accusations against heroes of the past, it is important to remember the gravity of the good work that was done. Should the legacy of Dr. King and his extraordinary work in the advancement and establishment of civil rights for all Americans come under fire because of these 50-year-old FBI documents, we will all lose.

Good morning, it’s May 31, 2019, a Friday, the day of the week I use this forum to pass along a quotation intended to provide inspiration. Today’s comes from Clint Eastwood, born on this date in 1930. Yes, Rowdy Yates turns 90 next year. If you don’t get the reference, you’re younger than I am. Yates was a winsome cattle drover played by a much younger Eastwood on “Rawhide,” a long-running CBS western that aired until the mid-1960s. Eastwood’s big break came after the show’s cancelation, when Italian director Sergio Leone cast him as The Man With No Name in a movie titled “A Fistful of Dollars.” Filmed in Spain, the spaghetti western was the first in a trilogy ending with “The Good, the Bad, and Ugly,” which made Clint Eastwood an international film star. Those movies helped form his on-screen persona, too. Strong and silent, yes, but also capable of lethal violence without remorse — or any emotion at all. Eastwood had come a long way from playing “the conventional white hat,” which is how he described Rowdy Yates. “The hero who kisses old ladies and dogs and was kind to everybody.” (Rowdy sang, too.) That wasn’t quite fair to the character, who could be tough when he needed to be. Either way, boring old compassion wasn’t a criticism ever leveled again at his screen characters as Eastwood methodically gunning down bad guys as “Dirty Harry” Callahan, Josey Wales, The Stranger in “High Planes Drifter,” or William Munny in “Unforgiven.” This wasn’t a star who couldn’t act, however. He was an artist who thought a great deal about his craft, and who would achieve, as he did in “Unforgiven” and other motion pictures, equal acclaim for his directing. “Don’t just do something, stand there,” he’d quip at actors he found too fidgety. “Gary Cooper wasn’t afraid to do nothing.” I’ll have more on this American original, and his memorable words, in a moment. Prompted by local issues that are long-since forgotten, he decided to run for mayor and won. The job paid $200 a month, but as I said, money wasn’t an issue. Although the office was nonpartisan, it turned out that Clint was a Republican. Hardly a shock, if you watched his movies. And not as discordant for a Hollywood leading man as it would be today, when you consider that Ronald Reagan (who carried California in 1980 and 1984) was in his second term in the White House at the time. In later years, Eastwood’s partisanship raised eyebrows, particularly after his curious 2012 gambit at the Republican National Convention. He’d been asked to give a speech that Mitt Romney’s advisers hoped would end with a call-and-response that included Eastwood’s signature “Make my day!” line. Instead they got Eastwood talking to an empty chair that was supposed to signify Barack Obama’s evanescence. Although the 2012 Tampa performance fell flat, this was a man with few flops in his long movie career. By then, his greatest recognition had come as a director. “Unforgiven” had won Best Picture and Best Director. He also won both awards in 2005 for “Million Dollar Baby.” And some film critics thought his best work came in 2008 in a gritty picture called “Gran Torino,” which Eastwood produced, directed, and starred in. He was 78 years old at the time. Everybody wonders why I continue working at this stage,” Eastwood explained. “I keep working because there’s always new stories. FIRST READ: Trump’s latest tariff threat undermines his own trade deal

Talk about a self-destructive action.

Just as President Trump is asking Congress to move forward with his revised free trade agreement with Mexico and Canada, and as Mexico is considering the trade accord, what did the president do?

He threatened slapping tariffs on Mexican goods – unless the country stops the flow of migrants coming through its country and into the United States.

For someone who’s had a pretty bad last seven days (North Korea, Mueller, the controversy over the USS McCain), Trump somehow decided to make it worse.

Mexico has promised to respond “strongly”; U.S. market futures have tumbled; and the Mexican peso sank.

On top of it all, raising tariffs on Mexican goods – and hurting Mexico’s economy – could actually exacerbate the border situation.

“White House officials did not immediately explain how driving up the cost of Mexican goods might stem the flow of migrants. If the tariffs damaged the Mexican economy, more of its citizens would try to cross the border to find work in the United States, experts said,” the Washington Post writes.

And then there’s the timing.

It’s probably not an accident that this tariff threat came the day after Mueller’s statement – and just hours after he took questions on Mueller and Russia.

Is the tariff threat a tantrum? An effort to change the subject?

Whatever the motivation, this is for sure: It doesn’t make it easier to pass that renegotiated free trade deal with Mexico.

A (mostly) muted GOP response  

What also stands out after Trump’s tariff threat is the GOP’s response to it.

Sen. Chuck Grassley, R-Iowa, released a statement in opposition. “This is a misuse of presidential tariff authority and counter to congressional intent,” he said. “Following through on this threat would seriously jeopardize passage of USMCA.”

Sen. Joni Ernst, R-Iowa, joined her colleague: “While I support the need for comprehensive border security and a permanent fix to illegal immigration, this isn’t the right path forward. I’m asking the president to reconsider.”

But that’s it. It’s been either silence from Republicans (who have traditionally been AGAINST tariffs and FOR free trade), or support (see below regarding Sen. Lindsey Graham, R-S.C.).

Also, what does this mean for a state like Texas? (Hello, Sen. John Cornyn, R-Texas, who’s up for re-election next year…)

Maybe one reason for the muted GOP response so far is that they’re waiting to see how serious Trump’s tariff threat actually is.

2020 VISION: California Dreamin’

In all, 14 Democratic presidential candidates will be in California attending the state party’s convention in San Francisco in some kind of capacity – highlighting the state’s importance in the 2020 nominating contest.

The 14: Booker, Buttigieg, Castro, Delaney, Gabbard, Gillibrand, Harris, Hickenlooper, Inslee, Klobuchar, O’Rourke, Sanders, Swalwell and Warren.

The one notable absence: Joe Biden.

Other 2020 odds and ends: NBC’s Garrett Haake reports that the O’Rourke campaign is staffing up, announcing that it now employs 44 staff in Iowa – more than any other state, with 37 dedicated to organizing.

In a CNN town hall, Michael Bennet called out Bernie Sanders and other supporters of Medicare for All, per NBC’s Vaughn Hillyard: “I think they are wrong. I think we’d be much better off by finishing what we started with the Affordable Care Act and having a true public option.”

And NBC’s Gary Grumbach notes that Sanders answered a question about impeachment during a town hall in Nevada: “I believe that the judiciary committee should begin impeachment inquires. Now that’s not impeachment. It’s the first step.”

On the campaign trail today: Bernie Sanders holds a rally in Pasadena, Calif., at 3:00 pm ET… Then, starting at 5:00 pm ET, Sanders, Kamala Harris, Julian Castro and Jay Inslee attend an immigration forum in Pasadena… Elizabeth Warren holds a town hall in Oakland… And Harris attends a Planned Parenthood reception in San Francisco.

On the campaign trail Sunday: Sanders, Castro and Delaney attend the California Democratic convention… Gillibrand, in Iowa, participates in a town hall on Fox News… And Tim Ryan does a CNN town hall from Atlanta, Ga.

That’s the amount Democratic presidential hopefuls have spent on Facebook between May 4 and May 25 on ads mentioning the words “debate” or “stage.” 

That’s according to a new tool from Bully Pulpit Interactive, which tracks the digital spending of the presidential candidates. 

Michael Bennet spent more than any other candidate on debate-related ads during that period—$193,000. The Colorado Democrat has been racing to hit the 65,000 unique donor threshold to qualify for the debate stage because of his late entry into the field. 

Jay Inslee spent the second-most at $173,000, money his campaign might call well spent considering he announced that he hit the threshold last week. 

Kirsten Gillibrand came in third with $139,000 spent on debate-related ads as the New York senator struggles to convert her pre-2020 fundraising strength into a robust presidential fundraising operation.
