Wednesday, May 8, 2019 Trump vs. Congress On Monday, Treasury Secretary Steven Mnuchin refused to provide a copy of President Trump’s tax returns to the House Ways and Means Committee, claiming “that the panel’s request ‘lacks a legitimate legislative purpose’ as Supreme Court precedent requires.” AP News

Two weeks ago, Trump stated that “his White House will be ‘fighting all the subpoenas’ issued by House Democrats in their investigations into his administration.” AP News

On Sunday, Trump tweeted, “Bob Mueller should not testify. No redos for the Dems!” Twitter From the Left The left is alarmed by Trump’s disregard for Congress’s authority, and argues Mueller should testify. “To be sure, presidents and Congress joust often over requests for senior aide testimony or White House documents… The executive and the legislature have, at least until now, fought these battles within a shared, if tense, understanding of the constitutional precedents: Congress has extensive authority to probe an administration’s activities and performance, while presidents retain appropriate latitude to solicit, and keep private, advice from senior staff… Under the Constitution, Congress is a co-equal branch of the government, a fact Trump is unable to understand or unwilling to accept. The courts may yet have to educate him on this point. If he continues to push the confrontation after that, we will be in truly dangerous territory.”
Bob Bauer, Washington Post

Regarding Trump’s tax returns, “the court has repeatedly affirmed the validity of congressional actions taken within the ‘sphere of legitimate legislative activity’ — and it has recognized that this sphere is far-reaching, encompassing ‘inquiries concerning the administration of existing laws as well as proposed or possibly needed statutes.’ In examining Mr. Trump’s tax returns, Congress could determine that legislation forcing disclosure of a candidate’s tax returns is necessary to guard against future presidential corruption and conflicts of interests. Or it might not. As the Supreme Court put it in an instructive 1975 opinion largely upholding congressional prerogatives, ‘To be a valid legislative inquiry there need be no predictable end result.’”
Editorial Board, New York Times

“Lance Cole, a law professor at Penn State University and an expert on congressional investigations, said that because courts have ruled in the past that Congress can’t use its power to peer into citizens’ private lives without some legitimate justification, a judge might be sympathetic to Trump’s argument, particularly if Democrats are asking for lots of old financial documents. However, in the 1990s, Congress probed the details of a 15-year-old real estate deal involving Bill and Hillary Clinton as part of the Whitewater investigation, dredging up personal details from long before Clinton was president. That may bolster the argument that a president can’t really be compared with an ordinary citizen. ‘You can debate the merits of the investigation, but it’s hard for Trump to say that Congress has never done this before.’”
Amelia Thomson-DeVeaux, FiveThirtyEight

Trump is the most financially conflicted president of the modern era. Unlike recent predecessors in the Oval Office, he has chosen not to voluntarily release his tax returns. That limits the public’s full understanding of the financial or business pressures that might inform his policymaking, an understanding that is basic to ethical and transparent governing. It’s the kind of situation that calls for aggressive Congressional monitoring. But in the era of Mnuchin, Barr and Trump, this view is unlikely to prevail unless legislators take the battle just as seriously as the White House does.”
Timothy L. O’Brien, Bloomberg

Regarding Mueller, “the failure to draw any conclusion on whether the president obstructed justice was a massive dereliction of the special counsel’s duty… Congress should now interview Mueller and his senior staff. Each of the 10 instances of possible obstruction should be reviewed and the following question asked and answered: Allowing for the differences between the president and a private citizen, had analogous conduct been engaged in by the citizen, would a grand jury indictment have been sought for obstruction of justice? This would provide, albeit belatedly and bootlessly, a knowledgeable and neutral judgment on the president’s conduct during the Russia investigation.”
David E. Kendall, Washington Post From the Right The right defends Trump’s resistance to subpoenas, and argues that Mueller should not testify. “Disputes over congressional demands for documents and testimony are as old as the republic. Congresses demand; presidents resist. Generally, after a political tussle the two sides meet somewhere in the middle… [But] never before have so many congressional committees issued so many subpoenas demanding documents and testimony from so many executive-branch officials, with so little attempt at negotiation or accommodation…

“This process cannot take place if one side assumes that it has unilateral authority to demand whatever it wishes and that any delay or resistance from the other branch is categorically illegitimate. Trump should abandon his attempt to defy ‘all subpoenas,’ but the House should recognize that the executive is an equal branch of government with constitutional privileges of its own. For a president to assert the rights of his office, as almost every president has done, is neither blameworthy nor impeachable.
Michael McConnell, Washington Post

“Oversight of the executive branch is an important Congressional power, but the Supreme Court has said it should be related to Congress’s legislative function or constitutional duty. It can’t merely be a trawling exercise to see what nasty details they can find to score political points and discredit a President before the 2020 election… If Democrats really believe Mr. Trump is a threat to the Constitution, they should file articles of impeachment and have every Member vote on them.”
Editorial Board, Wall Street Journal

What does [House Ways and Means Committee Chairman Richard] Neal think he’s going to find in [Trump’s tax returns] anyway? That Trump, a well known BSer, isn’t as rich as he says he is? (By the way, tax returns don’t necessarily give any indication of wealth.) That Trump pays as little in taxes as possible, something everyone does and something Trump has proudly admitted a million times? Seizing any individual’s private, legally filed tax returns so that you can leak them to the public — which is exactly what Neal would do — is nothing short of abuse of power.”
Eddie Scarry, Washington Examiner

Regarding Mueller, “House Democrats will likely find Mueller’s testimony as disappointing as his report. Mueller is an institutionalist, someone who respects the norms of the Department of Justice no matter how much he might (or might not) resent Trump and Barr. It’s very unlikely that Mueller would provide any more information to Congress than what he included in his report; he likely felt that he reached the limits of prosecutorial transparency with that report already… Mueller’s testimony will take place whether Trump likes it or not. Better to get it over with now, though, rather than drag this one out into 2020.”
Ed Morrissey, Hot Air

“It’s not as though we don’t already have the special counsel’s version of events. He mustered enormous investigate resources and took two years to write a 400-page report that is available to the public and presumably carefully written (although not necessarily carefully thought through). That should be enough for Mueller to stand on, and enough for Congress to make a decision to impeach or not impeach, or otherwise dispose of the matter as it sees fit…

“[Congress] doesn’t want facts from him. They are already in the report. It wants opinions and sound bites, especially any embarrassing to the president. Congress wants him to spend a couple of high-profile hours further ‘not exonerating’ the president. If Mueller had a proper understanding of his role, he would decline the congressional invitation.”
Rich Lowry, National Review On the bright side…

This Should Bother Way More People Than It Is Congress and various state governments are seeking to release President Trump’s tax returns for no real reason other than to embarrass him. POLITICO Playbook: The New York Times drops another tax bomb on Trump

DRIVING THE DAY

ANOTHER NYT TAX BOMBSHELL … RUSS BUETTNER and SUSANNE CRAIG — winners of the 2019 Pulitzer for a series on Trump’s taxes: “Decade in the Red: Trump Tax Figures Show Over $1 Billion in Business Losses”: “By the time his master-of-the-universe memoir ‘Trump: The Art of the Deal’ hit bookstores in 1987, Donald J. Trump was already in deep financial distress, losing tens of millions of dollars on troubled business deals, according to previously unrevealed figures from his federal income tax returns. …

“The numbers show that in 1985, Mr. Trump reported losses of $46.1 million from his core businesses — largely casinos, hotels and retail space in apartment buildings. They continued to lose money every year, totaling $1.17 billion in losses for the decade.

“In fact, year after year, Mr. Trump appears to have lost more money than nearly any other individual American taxpayer, The Times found when it compared his results with detailed information the I.R.S. compiles on an annual sampling of high-income earners. His core business losses in 1990 and 1991 — more than $250 million each year — were more than double those of the nearest taxpayers in the I.R.S. information for those years.” NYT

— We were at a House vote series when this story popped last night. The reaction from most Republicans was: Didn’t we know he was losing a lot of money in those days?

— MEANWHILE … NYT: “N.Y. Lawmakers Move Closer to Allowing Release of Trump’s State Tax Returns”

WSJ: “Stocks Continue to Fall as Uncertainty Over Trade Talks Persists,” by Avantika Chilkoti: “Global stocks slid on Wednesday as investors closely monitored rising U.S.-China tensions. In Europe, the Stoxx Europe 600 was down 0.2% in morning trading. In Asia, the Shanghai Stock Exchange dropped 1.1%, Hong Kong’s Hang Seng Index was also down 1.1% and Korea’s Kospi dropped 0.4%. The moves echoed sharp losses in U.S. markets Tuesday. Futures pointed to a tepid opening for U.S. indexes with the Dow Jones Industrial Average and S&P 500 futures roughly flat.” WSJ

Good Wednesday morning. President Donald Trump will head to Louisiana next week to talk energy infrastructure and jobs. More from The Advocate

UPDATE … AP: “Students kill classmate, injure 8 at school near Columbine,” by Kathleen Foody and P. Solomon Banda in Highlands Ranch, Colo.: “Two high school students shot and killed a classmate and injured eight others at a charter school in a Colorado community that marked the 20th anniversary of one of the nation’s worst school shootings just weeks ago.

“Douglas County sheriff’s officials said Devon Erickson, 18, and a younger student walked into the STEM School Highlands Ranch Tuesday afternoon and opened fire on students in two classrooms, prompting students to run shouting through the halls or to hide out of sight as gunfire echoed through school.” AP

— DENVER POST: “Ivanka Trump cancels Denver area visit after school shooting”

A QUICK THOUGHT ABOUT BIDEN … JOE BIDEN was the subject of lots of criticism — including plenty in these pages — for taking his sweet time to get into the presidential race. We said the field was taking shape without him, and we couldn’t understand just what he was doing.

BUT NOW, it appears that Biden wasn’t as misguided as we thought. The buzz around Beto, Buttigieg and Harris has subsided a bit. The former VP is raising money at a clip many hadn’t expected. He has assembled a top-tier staff, and put together an impressive list of endorsements in early states like South Carolina, while other candidates are still trying to make inroads.

BIDEN IS ACTING LIKE THE FRONT-RUNNER HE IS — his team is sending daily schedules and has organized a reporting pool for his public fundraisers. So far, he hasn’t had a cringeworthy gaffe, as so many predicted he would. More on Biden’s deep political network from David Siders in Henderson, Nev.

THAT ALL SAID, HILLARY CLINTON was, by far, the most organized candidate in 2016. Look at how that turned out.

TRADE WARS — “Exclusive: China backtracked on nearly all aspects of U.S. trade deal – sources,” by Reuters’ David Lawder, Jeff Mason and Michael Martina

DOJ VS. HOUSE DEMS … ANDREW DESIDERIO and KYLE CHENEY: “Dems moving forward with Barr contempt vote after DOJ talks break down”: “The Justice Department is preparing to ask the White House to invoke executive privilege over special counsel Robert Mueller’s entire report and underlying evidence, a defensive move the night before Democrats on the House Judiciary Committee are set to hold Attorney General William Barr in contempt for refusing to make the report’s full contents available to Congress.

“‘In the face of the committee’s threatened contempt vote, the attorney general will be compelled to request that the president invoke executive privilege with respect to the materials subject to the subpoena,’ Assistant Attorney General Stephen Boyd wrote in a letter to House Judiciary Committee Chairman Jerrold Nadler, asking the committee to hold off on its contempt proceedings.” POLITICO

— NEW: “Poll: Little support for Barr’s handling of Mueller report,” by Steven Shepard: “Amid his escalating clash with Congress, a new POLITICO/Morning Consult poll shows that few voters are praising Attorney General William Barr for how he has handled the release of the Mueller report.

“But while more voters disapprove of Barr’s handling of the report, there’s little sign of the kind of widespread antipathy that would lend public support to congressional Democrats who are considering holding the attorney general in contempt for failing to provide information and testimony to the House Judiciary Committee.

“Fewer than three in 10 voters, 29 percent, approve of the way Barr has handled release of the report, the poll shows. But disapproval of Barr is at just 39 percent — with nearly a third, 32 percent, expressing no opinion.” POLITICO

MEANWHILE … “Democrats appear headed straight to court for Trump’s tax returns,” by Toby Eckert: “House Ways and Means Chairman Richard Neal indicated Tuesday that Democrats would go straight to federal court to try to force the administration to give up President Donald Trump’s tax returns, skipping a subpoena or a contempt vote.” POLITICO

FOR YOUR RADAR — “Iran inches away from nuclear deal amid U.S. sanctions,” by Amir Vahdat and Jon Gambrell in Tehran, Iran: “Iran threatened Wednesday to resume higher enrichment of uranium in 60 days if world powers fail to negotiate new terms for its 2015 nuclear deal a year after President Donald Trump withdrew from the accord, raising tensions as a U.S. aircraft carrier and a bomber wing deploy to confront unspecified threats from Tehran.

“In a televised address, President Hassan Rouhani also said that Iran would stop exporting excess uranium and heavy water from its nuclear program, two requirements of the deal. He did not elaborate on the degree to which Iran was prepared to enrich uranium, which at high levels of enrichment can be used in nuclear weapons.” AP

DON’T WORRY, JARED’S GOT IT! — ANDREW RESTUCCIA and BURGESS EVERETT: “Kushner briefs senators on immigration plan”: “Jared Kushner briefed senators Tuesday on an immigration proposal meant to boost border security and set up a new merit-based system that would keep the number of legal immigrants coming into the U.S. at current levels, according to administration officials and lawmakers.

“Kushner has been quietly working on the plan for several months. He has told allies that he believes he has the buy-in of President Donald Trump and other more hard-line administration officials, even though some Trump allies and the president himself have previously backed efforts to slash legal immigration.

“The proposal is likely to face major headwinds in Congress, where lawmakers have been struggling to make progress on the issue for years. Kushner, a senior White House adviser and the president’s son-in-law, has not yet briefed Democratic lawmakers on the plan.” POLITICO

TRUTH BOMB — BURGESS EVERETT and HEATHER CAYGLE: “Immigration deal likely DOA under Trump”

OUCH! … GABBY ORR and DANIEL LIPPMAN, “Trump campaign distances itself from David Bossie over alleged scam”: “The Trump campaign is distancing itself from one of its highest-profile supporters, David Bossie, two days after the president’s longtime friend was accused of using his political group to scam elderly Republican voters for his own financial gain. ‘President Trump’s campaign condemns any organization that deceptively uses the President’s name, likeness, trademarks, or branding and confuses voters,’ the campaign said in a statement on Tuesday.

“‘We encourage the appropriate authorities to investigate all alleged scam groups for potential illegal activities,’ it added. Following the release of the campaign’s statement on Tuesday, a White House official said Trump was furious to learn of Bossie’s alleged scheme and demanded that his former deputy campaign manager be publicly scolded. ‘This literally came from the top,’ added a person close to the White House, who said that Trump himself ‘was pissed that this was the equivalent of taking from him.’

“The campaign statement was intended to ‘make it very clear that [Bossie] is persona non grata,’ the person said. A person familiar with the president’s thinking said Trump was ‘apoplectic’ when he learned about what Bossie’s group is accused of doing.” POLITICO

BORDER WATCH — “Appeals court allows Trump to keep asylum seekers in Mexico, for now,” by Ted Hesson: “A federal appeals court ruled Tuesday that the Trump administration may, for now, require certain non-Mexican asylum seekers to wait in Mexico pending resolution of their cases.

“A three-judge panel of the U.S. Court of Appeals for the 9th Circuit cited different reasons for permitting the ‘remain in Mexico’ initiative to move forward after a lower court blocked it last month. The appeals court allowed the policy to continue only on a temporary basis, while the court considers broader issues in the case.

“The ruling represents a victory for President Donald Trump, whose immigration policies have faced constant legal challenges. A federal judge in late November halted a separate Trump attempt to bar migrants from seeking asylum if they cross the border between ports of entry.” POLITICO

“U.S. asylum screeners to take more confrontational approach as Trump aims to turn more migrants away at the border,” by WaPo’s Nick Miroff

AS IF IT WASN’T COMPLICATED ENOUGH … WAPO’S ERICA WERNER: “New obstacle for disaster aid bill as Trump administration pushes to add border funding”: “Negotiations on a multibillion-dollar disaster aid bill in the Senate have grown more complicated in recent days with a push by the Trump administration to add emergency spending for the U.S.-Mexico border to the bill, lawmakers and others involved in the talks said Tuesday.

“Senate Appropriations Committee Chairman Richard C. Shelby (R-Ala.) personally made the point to Vice President Pence on Tuesday that introducing a new element into the disaster aid talks could only complicate matters, according to a person familiar with their conversation who spoke on the condition of anonymity to discuss it. …

“The talks over the disaster aid bill were already fraught because of a fight between President Trump and congressional Democrats over spending for Puerto Rico. Trump has yet to agree to a deal offering more than $600 million for the U.S. island territory’s food stamp program, while Democrats say much more is required for needs on many fronts as Puerto Rico recovers slowly from the devastations of Hurricane Maria. Senate Republicans have been prepared to offer more — though perhaps not enough to satisfy Democrats — but it has been unclear whether the White House would support their plans.” WaPo

“Falwell, president of Liberty University, one of the world’s largest Christian universities, said someone had come into possession of what Cohen described as racy ‘personal’ photographs — the sort that would typically be kept ‘between husband and wife,’ Cohen said in the taped conversation. …

“The Falwells enlisted Cohen’s help in 2015, according to the source familiar with Cohen’s thinking, the year Trump announced his presidential candidacy. At the time, Cohen was Trump’s confidant and personal lawyer, and he worked for the Trump Organization.

“The Falwells wanted to keep ‘a bunch of photographs, personal photographs’ from becoming public, Cohen told [actor Tom] Arnold. ‘I actually have one of the photos,’ he said, without going into specifics. ‘It’s terrible.’” Reuters

THE TRUMP ADMINISTRATION — “A day after blocking House demand for Trump’s tax returns, Mnuchin addressed gathering of his top fundraisers,” by WaPo’s Michelle Ye Hee Lee, Josh Dawsey and Damian Paletta:“Treasury Secretary Steven Mnuchin addressed a group of top donors backing President Trump’s reelection Tuesday evening, making an unusual political appearance at a gathering that included industry executives his agency is tasked with regulating. …

But the law prohibits them from being named by their official title in connection with their appearance, either in introductory comments or official event materials, and from soliciting donations.

“The accountants’ one-and-a-half-page memo, titled ‘List of Top Concerns for the Audit Committee,’ details a range of questionable transactions and business arrangements involving several top N.R.A. venders and executives. Contempt of What?
Square this: Attorney General William Barr offered Congressional leaders, both Republicans and Democrats, the opportunity to read the full Mueller report with only minor redactions. But House Democrats have refused to look at it, instead, plotting to hold Barr in contempt of Congressfor not turning over the entire Mueller report.

The public’s copy of the 400+ page Mueller report has only eight percent of material redacted. The version Congressional Democrats are refusing to review has only *two percent* of material redacted. This information consists of grand jury information governed by Federal Rule of Criminal Procedure, which prohibits disclosure of that information, even to Congress.

So why are Democrats attempting to hold Barr in contempt of Congress for refusing to do something he’s actually done?

“What’s happening,” my colleagues at The Heritage Foundation explained in a column at FoxNews.com, “is that House Judiciary Committee Chairman Jerry Nadler, D-N.Y., and his fellow Democrats on the Committee want to hold the attorney general in contempt because he refuses to violate a law passed by Congress!”

They lay out exactly why the grand jury secrecy rules exist, and how they apply to members of Congress.

“It is not surprising that Barr is holding the line and upholding the law,” they conclude. “Congressional threats to hold him in contempt for abiding by federal law are the very height of arrogance – especially in light of reports these congressional leaders have refused to even read the virtually unredacted report already available to them.”

Enter The Wall Street Journal’s Kimberly Strassel, who ponders the real reason Democrats are attempting to hold Barr in contempt—frustration, bitterness, and fear. Fear, most prominently, stemming from his probe into the origins of the Trump-Russia probe. “Do not underestimate how many powerful people in Washington have something to lose from Mr. Barr’s probe,” she wrote. Read her column in the WSJ here

Another School Shooting
At least seven people were injured and two suspects were in custody after a shooting was reported at a Colorado STEM school on Tuesday, according to NBC News. It’s still a developing story, but early reports were once again, horrific.

The Most Ridiculous CNN Abortion Segment Ever
Where to start with this one! Perhaps with CNN commentator Christine Quinn claiming, “When a woman is pregnant, that is not a human being inside of her.” Full clip here.

Then there was Chris Cuomo claiming “nobody” is discussing abortion after birth. But wait...

Then, Cuomo had the gall to claim the “pro- life position is more about faith and feeling than fact.” Interesting, following the claim his guest just made that, “When a woman is pregnant, that is not a human being inside of her.” Sounds a bit like a banana, no?

The entire conversation was dishonest on Cuomo’s part, considering his own state of New York allows women to have abortions *after* 24 weeks in cases where “there is an absence of fetal viability,” or “when necessary to protect a patient’s life or health.” Health here is defined by “all factors — physical, emotional, psychological, familial, and the woman’s age.” National Review’s Alexandra DeSanctis has a good piece breaking down that law here.

And btw—something CNN is probably *not* covering? Democratic Pennsylvania state Rep. Brian Sims filming himself hassling and wanting to dox several teens who were praying outside an abortion clinic, and shouting down an elderly woman. And then, issuing this non-apology for it.

Getting Beat By Boys
I recently traveled to Glastonbury, Connecticut to document the story of biological boys who identify as transgender girls sweeping the girl’s track competitions. I spoke with several female track athletes, who were losing to these athletes and felt the situation was unfair.

Importantly, I discovered another concerning layer to the story: Although there are many students who disagree with the policy allowing biological boys to compete as girls, few felt they could talk publicly talk about it. Why? Because understandably, they’re scared of being labeled as transphobic bigots, and being blacklisted from colleges—ironically, the very institutions where students are supposed to discuss these kinds of things.

I had to disguise the identities and voices of four of the girls I spoke with, but one girl, Selina Soule, was brave enough to go public. Watch (or read) her story here, and please share. With Democrats pushing the “Equality Act,” this policy could be coming to a school near you.

2020 Updates
Biden claims Margaret Thatcher, who died in 2013, is worried about Trump. Whoops.

The more patriotic you are, the more taxes you want to pay, according to Cory Booker

Kamala Harris on Trump tax law: “Get rid of the whole thing!”

Elizabeth Warren calls to impeach Trump. On what grounds? “The Mueller report.” (Yeah, she’s struggling in the polls.)

Pete Buttigieg, an Episcopalian, says God does not have a political party, but “if he did, I can’t imagine it would be the one that sent the current president into the White House.”

And Because It’s Hump Day…  Funny or sad? Kate Middleton (on-camera!) wishes Meghan Markle good luck with the “daunting” first weeks of parenthood. Kraft is helping Moms hire free babysitters for Mother’s Day. (Reminder to get your cards in the mail! ) And finally…who wore it better: Me or Katy Perry? BRIGHT is brought to you by The Federalist.

SCOTT RASMUSSEN

ScottRasmussen.com Launch – Check Out My All New Website No Images? Click here   Good morning,Thirty-seven percent (37%) of voters now trust Republicans more than Democrats when it comes to the economy. A ScottRasmussen.com survey found that 26% percent trust Democrats more. Eighteen percent (18%) don’t trust either party, 10% trust both equally, and 9% are not sure.Monthly polling dating back to last August has always shown the GOP with an advantage on the economy. However, the 11-point margin is up from four-points a month ago. It is the biggest advantage yet recorded for the GOP.Democrats continue to enjoy a double digit lead on health care (38% to 25%) while Republicans have a similar lead on national security (37% to 26%).On immigration, Republicans now have a modest advantage (36% to 32%). A month ago, Democrats held a four-point lead on this issue. It will be interesting to see if this shift is the beginning of a lasting trend or merely statistical noise. The top four issues concerning voters at this time are Health Care (19%), The Economy (15%), Immigration (11%), and National Security (10%).Democrats lead by six on the Generic Congressional Ballot and President Trump’s job approval rating is at 47%. Both figures are updated daily.Fifty-four percent (54%) of voters believe that American society is generally fair and decent. However, 46% take the opposite view and believe it is unfair and discriminatory. There is a wide partisan divide on this question. Eighty-four percent (84%) of Republicans see a generally fair society while 68% of Democrats see the opposite. Independent voters are evenly divided. There is also a huge divide along racial lines. Sixty-three percent (63%) of white voters consider society fair and decent. Seventy-seven percent (77%) of black voters and 66% of Hispanic voters disagree. The survey also found that 33% believe it would be better for Europe to become more like the United States; 30% think that it would be better for the United States to become more like Europe; and 37% are not sure. Finally, 34% of voters have a favorable opinion of Supreme Court Justice Brett Kavanaugh while 33% offer an unfavorable opinion. Another 33% have either never heard of Justice Kavanaugh or don’t know enough to have an opinion. While Kavanaugh is the newest member of the Court, those numbers make him the best known. In fact, five of the nine Justices are unknown by a majority of American voters.Close behind Kavanaugh in terms of name recognition is Justice Ruth Bader Ginsburg. However, she receives a much more positive assessment–44% favorable and 21% unfavorable. The ratings for Ginsburg and all the Justices have changed little since last fall.Overall, 66% now approve of the way the Supreme Court is doing it’s job. Forty-two percent (42%) think it’s ideological balance is about right. The remainder include 32% who believe it is too conservative and 26% who say too liberal.Thank you for your interest in our work,Scott     Stay Informed Up To The Minute and Share ContentDeeper CurrentsScott Rasmussen offers his personal insight, analysis, and opinion on current political races, issues, and controversy. NBC’S MEET THE PRESS

Image

From NBC’s Chuck Todd, Mark Murray and Carrie Dann

FIRST READ: Here’s everything we now know about Trump’s tax returns

Well… now we have a good idea why President Trump won’t release his tax returns.

Because every time we’ve gotten a hint of what they look like, they paint a damning picture – both of his record as a businessman and his tax practices.

On Tuesday night, the New York Times revealed that, according to official IRS tax transcripts, Trump reported losing more than $1 BILLION in losses from 1985 to 1994.

The money graf in the piece: “In fact, year after year, Mr. Trump appears to have lost more money than nearly any other individual American taxpayer, The Times found when it compared his results with detailed information the I.R.S. compiles on an annual sampling of high-income earners.”

Of course, that’s not the only story we know about Trump’s taxes.

Last October, those same New York Times reporters wrote that Trump “participated in dubious tax schemes during the 1990s, including instances of outright fraud, that greatly increased the fortune he received from his parents.”

Last month, in fact, Trump’s sister stepped down from her job as a federal judge, ending an investigation into whether “she violated judicial conduct rules by participating in fraudulent tax schemes with her siblings.”

And during the 2016 campaign, the Times got its hands on Trump’s 1995 tax return, in which he declared a $916 million LOSS.

That deduction was so substantial, the Times said, “it could have allowed him to legally avoid paying any federal income taxes for up to 18 years.”

So last night’s story is a big one. But let’s not forget about the OTHER NYT blockbuster reports on Trump’s taxes.

They don’t paint a pretty picture.

And they help explain why Trump doesn’t want the public to see his most current tax records.

This morning, Trump responded to last night’s NYT reports with a pair of tweets:

By the way, in the 2000 presidential race, Trump spent a lot of time criticizing Bill Bradley.

Why? Bradley helped write that 1986 tax-reform law that changed these write-off schemes.

DOJ threatens House Dems if they vote to hold Barr in contempt

As NBC’s Mike Memoli puts it, the Trump Justice Department is throwing down the gauntlet.

If House Democrats vote to hold Attorney General William Barr in contempt, DOJ writes, Barr will recommend asserting executive privilege over the Mueller report and its underlying documents.

The Washington Post adds that the move all but assures Barr will be held in contempt of Congress.

House Judiciary Committee Chair Jerry Nadler responded with this message, per Memoli: “In the middle of good faith negotiations … [DOJ] abruptly announced that it would instead ask President Trump to invoke executive privilege on all of the materials subject to our subpoena.  This is, of course, not how executive privilege works.”

But as James Fallows asks, “How can you possibly assert Executive Privilege over something that is not simply in Congress’s hands but *on sale in book stores*?”

2020 VISION: Climate soars to the top of the Dem issue list

NBC’s Alex Seitz-Wald writes that climate change “has recently shot to the top of polls of issues that Democratic voters care about in the presidential primary.”

“That’s a big shift from the last presidential election in 2016, when climate change did not get a single question during the debates between Hillary Clinton and President Donald Trump.”

Our most recent NBC News/Wall Street Journal poll showed the top issues among Democratic respondents this way:

Health care: 36 percent of Dem respondents said was their No. 1 issue

Climate change: 20 percent

Jobs and the economy: 12 percent.

On the campaign trail today: Beto O’Rourke campaigns in both Iowa and Minnesota… Amy Klobuchar participates in a town hall on Fox News… Joe Biden raises money in Los Angeles… And speaking at the Machinist Union legislative conference in DC are Kirsten Gillibrand (9:30 am ET), John Delaney (9:45 am ET), Tim Ryan (10:00 am ET), Seth Moulton (10:30 am ET) and Bernie Sanders (11:00 am ET).

TWEET OF THE DAY: Heartbreaking

$1 million.

That’s the amount (at least) that Kamala Harris has raised in minority-majority ZIP codes, more than twice the amount raised in the same areas by her next-closest competitor, Beto O’Rourke.

That’s according to an NBC analysis by Jonathan Allen, Lauren Egan and Jeremia Kimelman.

REAL CLEAR POLITICS

05/08/2019 Share: Carl Cannon’s Morning Note ‘Dark Money’ Disconnect; Bezos’ Reach; Good Hands, Good Times By Carl M. Cannon on May 08, 2019 09:02 am
Good morning, it’s Wednesday, May 8, 2019. Fifty-five years ago today, the Allstate Insurance Company issued a press release from its Skokie, Ill., office on safe driving, specifically on the hazards of impaired driver vision. “Seeing is safety,” it proclaimed. “Ninety percent of driving is based on sight.” Except perhaps for the high quality of the writing, little about that May 8, 1964 press release was surprising. Allstate had always stressed safety in its outreach efforts to the public, and in this one, Edward R. Klamm, the company’s “accident prevention director,” made several points about driving visibility that were mostly common sense: Drivers should pay attention to the road; if they have prescription glasses, they should wear them; don’t don sunglasses at night; don’t “overdrive” your headlights; beware of “heavy eyelids” — a sign of fatigue. Texting wasn’t a thing in the 1960s, but distracted driving was, and Allstate was doing its part as a good corporate citizen to warn Americans about the dangers. I came across the news release five years ago. I wrote about it then, too, primarily because the name of that release’s author intrigued me. The name was G.M. Quarnstrom, which rang a bell, as I’ll explain in a moment. First, I’d point you to RealClearPolitics’ front page, which presents our poll averages, videos, breaking news stories, and aggregated opinion columns spanning the political spectrum. We also offer original material from our own reporters and contributors, including the following: * * * Dems’ “Dark Money” Disconnect: Groups Mum on Disclosure. Susan Crabtree reports that liberal nonprofits are tight-lipped in response to Sen. Sheldon Whitehouse’s call for transparency in campaign financing. U.S. Is Hurtling Toward Sequestration and No One Seems to Care. Rick Berger explains why there’s cause for concern.  Jeff Bezos and Me (and All of US). Myra Adams reflects on the Amazon mogul’s ever-expanding reach into her life. Trump Has Raised Taxes by the Billions. Where’s the Outrage? In RealClearMarkets, Allan Golombek bemoans the “trade taxes” levied on Americans buying goods from China. The Push to Constitutionalize Crime Victims’ Rights. In RealClearPolicy, Walter Olson spotlights the perils created when states promote “a bill of rights” for crime victims. Xi Jinping’s Peace Rhetoric Doesn’t Fool China’s Neighbors. In RealClearDefense, Tao Peng writes that China’s actions speak louder than its words. * * * That surname Quarnstrom in the May 8, 1964 Allstate press release, particularly in a Chicago-area context, was a familiar one and I found myself wondering five years ago when I came across it: Did those initials, G.M., stand for “general manager” — or did they signify a name? Could the press release’s author be related to a legendary California newspaperman and Merry Prankster named Lee Quarnstrom, who’d gone to New Trier High School in Winnetka, Ill., before showing up in the ’60s in the San Francisco Bay Area and hooking up with Ken Kesey and friends? Lee is still around, retired and living in Orange County, Calif., so I gave him a call. My hunch was right, and per my request he sent me a note that night: “Gordon M. Quarnstrom, my dad, had a perfect background for the job when he was hired as Director of Public Relations at the Allstate Insurance Companies’ home office in Skokie in the mid-1950s: GMQ, as he signed notes and personal letters, had been a reporter and city editor at several small newspapers in Washington state before learning the ropes in the ‘other’ Washington — the nation’s capital.” Gordon Quarnstrom also served as executive secretary for U.S. Sen. Warren G. Magnuson, a Washington Democrat, and as executive assistant to Congressman Don Magnuson (no relation). Later, in his role as Allstate’s public relations director, GMQ took on responsibilities for the Allstate Foundation, of which he was eventually named executive director. “He retired from Allstate in 1971 but not from work,” Lee’s note continued. “He signed on with the National Safety Council and was Executive Director of the Chicago Metropolitan Council on Alcoholism. During this time, he produced a travel column that was published in hundreds of small newspapers around the country. He used to call and ask whether I wanted to join his travel-writing business; he might ask, ‘Hey, Lee, do you want to go to the Great Barrier Reef next Tuesday?’ My mother did accompany GMQ on some of his trips, using her writing skills to describe visits to her beloved Ireland, home of many of her ancestors. “After my mother’s death in 1991, GMQ continued the column and eventually married another travel writer, Connie Sherley, and moved to her home in Austin, Texas. He died in Austin in 1999, leaving his widow … as well as my brother Dean and me and three grandchildren. He was still producing travel columns up until confined to his deathbed.” As for Lee, I knew him on the San Jose Mercury News, where he was a much-loved reporter, editor, and columnist in the 1980s and 1990s. He is retired from daily journalism now, a career that began at age 19 as a copy boy, then as a police reporter and rewrite man for the famed City News Bureau of Chicago. Lee Gordon Quarnstrom also worked for several newspapers in Chicago and on the West Coast, was executive editor of Hustler magazine and worked briefly as a young man on a dynamite crew in Olympic National Park. Since I first wrote about the Quarnstrom clan five years ago, Lee’s memoir was published. “When I Was a Dynamiter — or How a Nice Catholic Boy Became a Merry Prankster, a Pornographer and a Bridegroom Seven Times” is highly entertaining, as its title suggests. John and Yoko Ono have a cameo. Ken Kesey, Hunter S. Thompson, Timothy Leary, Tiny Tim, and the Grateful Dead also have roles in Lee’s story, which brings the ’60s to life. The book is also poignant, as it deals with life’s tragedies as well as its joys and high jinks. “Nothing lasts,” Ken Kesey often told his fellow Merry Pranksters. “This becomes more and more clear as time goes by,” Lee Quarnstrom added in his book. “People die. Stuff rots, rusts, disintegrates, decays. Relationships end. Peace is fleeting. Stars explode and vanish. Prophets come and go. Glaciers melt. Pets pass away.” All true, my friend, but one of the joys of writing this essay each morning is resurrecting some of the beautiful words and deeds of the past and bringing them into the sunlight once more, however fleetingly.  Carl M.
