Increased Tariffs on Chinese Goods “Accusing Beijing of ‘reneging’ on commitments it made in earlier talks, the nation’s top trade negotiator said Monday that the Trump administration will increase tariffs on $200 billion in Chinese goods.” AP News From the Left The left criticizes the tariffs for hurting US consumers, and worries about an escalating trade war. “According to a paper published [in] March by economists Mary Amiti of the New York Federal Reserve Bank, Stephen J. Redding of Princeton University and David Weinstein of Columbia University, practically all of the effect of the tariffs ‘fell on domestic consumers and importers up to now, with no impact so far on the prices received by foreign exporters’… the total cost of tariffs on importers and consumers was nearly $1.4 billion a month. In another survey, researchers at the Federal Bank of Atlanta, the University of Chicago and Stanford concluded that tariffs had led to nearly $33 billion worth of reduced investment in the U.S. in 2018 alone.” Luke Barnes, ThinkProgress “The real worry financial markets always have about tariffs… is not so much the tariffs themselves as what comes next. China could retaliate by cutting purchases of American agricultural goods, buying European airplanes rather than American airplanes, or trying to bias the domestic Chinese auto market against American brands. At that point, talks aimed at deescalation might get back under way. But the US could also counter-retaliate. This kind of ‘trade war’ between the world’s two largest economies could spiral out of control and end up severely damaging the global economy.… “Trump’s aides tend to say that this is all overstated. That the basic reality is the US economy is in a strong position, that Chinese leaders’ own position is more tenuous, and that Trump is simply an aggressive negotiator playing for advantage. On the other hand, obtaining that advantage requires him to credibly act like someone who doesn’t understand — or doesn’t care about — the potential harms of a giant trade war. The problem is he’s sometimes much too convincing about it.” Matthew Yglesias, Vox Some note that “Trump can’t make any permanent trade agreements unless Congress agrees. That’s a long process he hasn’t even started. Instead, Trump is using executive authority, which lasts only as long as he is president. Any promise he makes to China will expire on January 20, 2021, just 21 months from now, unless he is reelected. The Chinese know this. That’s why they are in no hurry to make the kind of deals Trump wants. He might ‘encourage’ them with threats and maybe even higher tariffs. But then he risks crashing the markets. So, China’s best negotiating strategy is to wait, which they do very well.” Patrick W. Watson, Forbes Finally, many are criticizing the Trump administration for “[relenting] on imposing sanctions on key Chinese officials involved in carrying out human rights abuses in Xinjiang… in a bid to supposedly counter terrorism, Beijing has set up a vast system of ‘reeducation camps’ to dissuade the region’s predominantly Muslim Turkic minorities, including Uighurs, from embracing religious extremism. Advocates and Uighur exiles abroad point to a totalitarian dragnet that has disappeared a chunk of the region’s population and ushered in a draconian 21st-century surveillance state… [the failure to address this behavior is a] glaring absence in Trump’s showdown with China.” Ishaan Tharoor, Washington Post From the Right The right is critical of China’s trade practices, and supportive of Trump’s tough negotiating tactics. “Beijing has too often violated the global trading rules it agreed to and profits from. It steals trade secrets and intellectual property and handicaps foreign companies with punitive regulation. Chinese abuses have undermined political support for free trade in the U.S… There’s no denying that [Trump’s] border taxes on Chinese goods have prodded Beijing to negotiate, though tariffs have also imposed costs on U.S. consumers and producers, especially in agriculture… “Mr. Xi has to concede more than Mr. Trump does—without being embarrassed in the process. China already has largely free access to the U.S. market and rule of law. China’s main demand is that Mr. Trump lift his tariffs, which is reasonable if China agrees to cease its multiple trade violations. This includes protections for IP, a reduction in tariff rates toward U.S. levels, a reduction in subsidies for state-owned companies, more liberal rules for joint ventures, and an end to cyber theft.” Editorial Board, Wall Street Journal “The president’s tough line now—heading into the final stretch of negotiations—will reduce friction later. China is less likely to cheat on any future agreement if it needs to comply to earn a reduction of these tariffs. China will cheat if the U.S. has no tariffs to enforce it… China has a long history of quickly breaking promises to the West. From refusing to abide by the rules of the World Trade Organization after it joined in 2001 to abandoning President Xi Jinping’s promise to President Obama not to militarize the South China Sea, Beijing’s record makes strong enforcement mechanisms a necessary precondition to any U.S. agreement to a deal.” Michael Pillsbury, Wall Street Journal Trump’s “policy is right on the mark here. Chinese President Xi Jinping intends to destroy the U.S.-led international system of fair commerce under the democratic rule of law. He aims to replace it with one of intellectual theft and feudal mercantilism. China is playing games in the trade negotiations to protect that agenda. But Trump’s tariffs and other economic actions challenge Xi by jabbing at his unelected regime’s economic vulnerability.” Tom Rogan, Washington Examiner “The trade war is, to a large extent, a conflict over the Chinese Communist Party’s most important means of keeping itself in power: subsidies and the state sector… significantly changing China’s trade practices would mean forcing the Chinese Communist Party to upend a core piece of what is holding its fragile political system together… [But] from the American perspective, the costs of living with these trade practices are far too high to justify perpetuating an unreformed trade relationship with China… “If the United States is determined to no longer bear the painful consequences of China’s trade practices, it can either get Beijing to significantly reform its economy—extremely unlikely given the nature of Chinese politics today—or it can decide to curtail the trade relationship… sooner or later, American policymakers will have to face this reality and the uncomfortable implications of it.” Nick Taber, The American Conservative On the bright side… Artificial Intelligence creates never-ending death metal. FIRST IN PLAYBOOK — SENATE MAJORITY LEADER MITCH MCCONNELL ON MUELLER: CASE CLOSED … MCCONNELL will speak on the floor at 10 a.m. to deliver his final thoughts on the Mueller report. McConnell is expected to focus on three “buckets”: Russia’s interference in the U.S. elections, the work of ROBERT MUELLER and A.G. BILL BARR and his view that it is time to stop relitigating the 2016 election. Look for him to invoke the phrase “case closed.”
— WHAT MCCONNELL WILL SAY: “This investigation went on for two years. It’s finally over. Many Americans were waiting to see how their elected officials would respond. With an exhaustive investigation complete, would the country finally unify to confront the real challenges before us? Would we finally be able to move on from partisan paralysis and breathless conspiracy theorizing?
“Or would we remain consumed by unhinged partisanship, and keep dividing ourselves to the point that Putin and his agents need only stand on the sidelines and watch as their job is done for them? Regrettably, I think the answer is obvious.”

THE TARIFF MAN … WSJ: “White House Ratchets Up Trade Fight,” by William Mauldin, Michael Bender and Josh Zumbrun: “Prospects for a speedy conclusion to the U.S.-China trade fight dimmed Monday after U.S. officials accused Beijing of reneging on its promises and vowed to implement President Trump’s threat to raise tariffs quickly on Chinese imports.
“‘Over the course of the last week or so, we’ve seen an erosion in commitments by China, I would say retreating from commitments that have already been made, in our judgment,’ said U.S. Trade Representative Robert Lighthizer, declaring tariffs on $200 billion in Chinese imports would rise to 25% starting Friday. … Mr. Trump’s threat rattled financial markets around the world, but also triggered speculation that it might be a negotiating tactic aimed at getting the best deal out of Beijing. …
“The briefing from Messrs. Lighthizer and Mnuchin, which took place after U.S. markets closed on Monday, made it clear there are deep concerns about the direction of the talks that go beyond negotiating style. — MARKET PEEK … FT: “China’s stock market steadied on Tuesday after Washington and Beijing confirmed trade talks would continue this week despite new tariff threats from US President Donald Trump. The CSI 300 index of major stocks listed in Shanghai and Shenzhen closed up 1 per cent, buoyed by government efforts to avoid a second day of steep declines and reassurances that trade talks would continue.” FT

BEHIND TRUMP’S MUELLER TWEET … AP’S JONATHAN LEMIRE: “The president stewed for days about the prospect of the media coverage that would be given to Mueller, a man Trump believes has been unfairly lionized across cable news and the front pages of the nation’s leading newspapers for two years, according to three White House officials and Republicans close to the White House.
“Trump feared a repeat — but bigger — of the February testimony of his former lawyer and fixer, Michael Cohen, which dominated news coverage and even overshadowed a nuclear summit with North Korean leader Kim Jong Un in Vietnam.
“Trump has long known the power of televised images and feared that Americans would be captivated by seeing — and hearing — Mueller, who has not spoken publicly since being named special counsel.” AP

“Nadler’s firm stance comes as he seeks punitive actions against the attorney general for defying a subpoena for special counsel Robert Mueller’s unredacted report on the Russia investigation and its underlying evidence. — BRIAN FALER: “You’re not getting Trump’s tax returns, Mnuchin tells Democrats”: “Treasury Secretary Steven Mnuchin said their demands raise ‘serious constitutional questions’ and that lawmakers do not have a ‘legitimate’ reason for seeking President Donald Trump’s filings.
“‘The Supreme Court has held that the Constitution requires that Congressional information demands must reasonably serve a legitimate legislative purpose,’ he wrote in a one-page letter to House Ways and Means Chairman Richard Neal (D-Mass). ‘I have determined that the Committee’s request lacks a legitimate legislative purpose’ and ‘the Department is therefore not authorized to disclose the requested returns.’” POLITICO … Mnuchin’s letter
IT SEEMS NEARLY CERTAIN that Ways and Means will hold Mnuchin in contempt — a symbolic move — and then will have to go to court to try to compel the release of Trump’s tax returns.
— BIG PICTURE: Democrats and the White House are rapidly moving toward a series of potential court actions that could help clarify Congress’ oversight role in a global sense. The White House is ignoring demands for documents and declining requests for testimony and records. It might take a while, but the courts are going to have to rule on some of this, which could help define the Hill’s role in oversight for years to come.
SPOTTED: Mnuchin having a long dinner at Cafe Milano as his decision to block the release of Trump’s tax returns played on the cable news TV screens at the bar.

— BACKSTORY: The letter by former federal prosecutors that went viral Monday after it got picked up by The Washington Post has its origins in a recent op-ed in The Daily Beast by Mimi Rocah and Renato Mariotti, “If Trump Weren’t President, He Would Already Be Charged,” we’re told.
Inspired by the article, a loose network of attorneys drafted the letter and enlisted the help of the relatively new NGO Protect Democracy, which then blasted it out to its list of DOJ alums and vetted the respondents. The Cambridge-based group was founded in 2017 by two former associate counsels in the Obama White House, Justin Florence and Ian Bassin, and now has a bipartisan staff of around 30 that works to promote the rule of law and fight what it sees as rising authoritarianism in the U.S.
As for the letter, the list of what is now well over 500 signatories includes people like Jeff Harris, a former Rudy Giuliani deputy; Republicans such as former SDNY judge John Martin and retired prosecutor Donald Ayer, both former George H.W. Bush appointees; and many other former line prosecutors who aren’t especially political.

Treasury Says No To Democrats’ Demand for Trump Tax Returns Yesterday evening, in a letter to the House Ways and Means Committee, Treasury Secretary Steven Mnuchin announced that he would be denying requests from congressional Democrats’ to release six-year’s worth of President Trump’s tax returns. Mnuchin cited that the request facially “lacked a legitimate purpose” and as such, the Treasury Department did not have the authorization to grant the request. From ABC News: “Democrats requested Trump’s personal tax returns under a 1924 provision of the tax code saying the Treasury secretary “shall furnish” any individual’s tax return information to the chairs of three congressional committees “upon written request.” Republicans have accused Democrats of weaponizing the tax code to target Trump, and said the move would set a dangerous precedent. Trump broke with modern precedent as a presidential candidate in 2016 when he refused to release his returns, and has continued to do so while in office. Most presidents since Richard Nixon have voluntarily released their tax returns over the past 40 years, which is not required by law.” Earlier this month, Jim Geraghty of National Review wrote a piece, indicating that, despite Trump’s break with tradition, congressional Democrats’ interest in said tax returns may be unconventional in the way it mimics a “fishing expedition.” Geraghty explains the supposed veil of necessity that the House Ways and Means Committee Chairman Richard Neal has put forth in favor of releasing the returns: “Neal argues that the committee needs the records because “the IRS has a policy of auditing the tax returns of all sitting presidents and vice-presidents, yet little is known about the effectiveness of this program. On behalf of the American people, the Ways and Means Committee must determine if that policy is being followed, and, if so, whether these audits are conducted fully and appropriately.” Geraghty quotes Senator Chuck Grassley of Iowa, Chair of the Senate Finance Committee in response to Neal’s requests: “I, for one, haven’t seen any evidence that the IRS has suddenly changed its policy under this president – that it’s conducting a less thorough review of President Trump’s taxes than it did of previous presidents, or that it hasn’t conducted a review at all. So why are Democrats considering these changes to the tax code now? Why didn’t they raise the issue under President Obama, or President Bush, or President Clinton? The answer is, nothing has changed. There’s no reason to believe the IRS is doing any less due diligence in its review of President Trump’s taxes than it has for any other president in recent memory.” The fight over Trump’s tax returns, yet another exhaustive distraction for congressional Democrats, has become the raison d’etre for the Left after coming up empty-handed on the Russian collusion narrative. Trump Presents Tiger Woods with the Presidential Medal of Freedom True to his tweet following the Masters, President Trump presented Tiger Woods with the Presidential Medal of Freedom, making Woods the fourth golfer in the history of the honor to ever receive it. Past golfers to have been presented with the honor include Arnold Palmer (President George W. Bush), Jack Nicklaus (President George W. Bush), and Charlie Sifford (President Barack Obama). The relationship between Trump and Woods, a mixture of professional and personal, spans decades. From Fox News: “Trump is an avid golfer who played with Woods at Trump’s golf club in Jupiter, Florida, in February. The two are also business associates. Golfers at Trump’s club in Doral, Fla., can stay at the Tiger Woods Villa. At a ribbon cutting ceremony in 2014, Woods lavished praise on the future presidential candidate, calling changes he made to the club “phenomenal.” In Dubai, Woods designed an 18-hole course to be managed by The Trump Organization. The Trump Organization has “repeatedly demonstrated their ability to successfully manage unique, high-end courses and golf clubs, and this is no exception,” Woods said in a 2018 interview in the company’s in-house magazine. Trump has used Woods’ cachet to attract fans to his properties for decades. Trump got Woods to show up at his Taj Mahal casino in Atlantic City, N.J., a day after the golfer’s first Masters victory in 1997. Two thousand fans showed up as Woods walked down a 320-foot red carpet, some of them storming steel barricades to get a closer look. Some critics have blasted Woods over his links with Trump since the real estate mogul was elected president in November 2016. “He’s the president of the United States. Good morning,Fifty-seven percent (57%) of Democrats believe that, in his relations with the Russian government, President Trump is guilty of treason. Just 14% of those in Nancy Pelosi’s party disagree while 29% are not sure.Republicans
reject that notion by an 82% to 7% margin. Among Independent voters,
30% believe he has committed treason while 44% disagree and 25% are not
sure.Among all voters, 33% believe the president is guilty of treason while 45% disagree.The survey also found that 41% of voters believe
the president should be impeached and removed from office. Forty-four
percent (44%) disagree. Support for impeachment has held steady ever since the submission of the Mueller report.
Seventy-one percent (71%) of Democrats believe he should be impeached
while 84% of Republicans reject the idea. Thirty-five percent (35%) of
Independent voters favor impeachment while 45% are opposed.The president’s Job Approval has remained remarkably steady throughout this period. Our daily updates have stayed within two points of 46% every day for more than three months .Special
Counsel Robert Mueller is viewed favorably by 43% and unfavorably by
27%. Twenty-nine percent (29%) have either never heard of him or don’t
know enough to form an opinion.Attorney General William Barr is viewed favorably by 28%, unfavorably by 32%, and is unknown to 40%.Sixty-six percent (66%) of voters approve of the way the Supreme Court is doing its
job. That’s up a point from a month ago and reflects the highest
level of confidence measured in monthly surveys dating back to August
of 2018.Thirty-two
percent (32%) of voters now say the court is too conservative while 26%
think it’s too liberal. A solid plurality–42%–believe the ideological
balance is about right. That’s a huge shift since the heat of the
Kavanaugh confirmation battle. Last November, 43% believed the Court was
too conservative while just 20% said too liberal.In recent months, there has also been a shift in the ideological perceptions of Congress. Last fall,
a plurality believed it was too conservative. Now, a plurality believes it is too liberal.Democrats lead Republicans on the Generic Congressional Ballot by a 42% to 36% margin. FIRST READ: The Fox Effect: Trump’s base bolsters his standing
“Hung
jury” is how Democratic pollster Peter Hart described our
latest NBC/WSJ poll showing a nation divided over the Mueller probe.
And maybe the biggest reason for this stalemate is that
President Trump’s political base – especially those who get their news from Fox – hasn’t budged an inch, according to the poll.
Fewer than 30 percent of
Americans who get their news via broadcast TV, CNN or MSNBC believe
Trump has been honest about the Russia probe, compared with 61 percent
of Fox News viewers.
Just a sliver of
broadcast/CNN/MSNBC viewers say the Mueller report cleared Trump of
wrongdoing, versus 50 percent of Fox News watchers.
And fewer than 40 percent of
those who consume their news via broadcast TV, CNN or MSNBC approve of
Trump’s job performance, compared with 73 percent who get their news
from Fox.
Trump’s overall job rating in the NBC/WSJ poll stands at 46 percent.
For a hung jury to take place in a trial, all it takes is one or more jurors to disagree with the others.
And we’re seeing that take place in the court of American political opinion when it comes to Trump and the Russia probe.

The Fox Effect also strengthens Trump’s hand in his administration’s showdowns with congressional Democrats.
“Treasury Secretary Steven
Mnuchin on Monday rejected House Democrats’ request for President Donald
Trump’s tax returns, failing for the third time to meet a congressional
deadline to turn over the documents,”
per NBC News.
And “House Judiciary
Chairman Jerry Nadler has a scheduled a vote on Wednesday to hold
Attorney General William Barr in contempt of Congress, “citing the
Justice Department’s failure to provide the full text of Mueller’s
report by the Monday morning deadline,”
the AP writes.
More
from the AP: “Nadler, D-N.Y., said Barr’s failure to comply with a
subpoena left them with ‘no choice but to initiate contempt
proceedings.’”
2020 VISION: Pete’s problem
Pete Buttigieg hasn’t been attracting many African-American voters during his swing through South Carolina,
Politico writes.
“He
scheduled a meet-and-greet Monday in Orangeburg — a city that is 76
percent black — but only a dozen or so people of color showed up in a
crowd of more than 100.”
Also:
“At a town hall the night before — held at a North Charleston high
school where minority enrollment is 97 percent in a city that is roughly
half-black — it was another overwhelmingly white audience.”
On “Today” this morning, NBC’s Craig Melvin asked Buttigieg about the lack of African-American voters at his events and what he can do to win them over.
Buttigieg’s response:
“Well, part of it is by laying out an agenda on the issues that black
voters are asking me about most often – home ownership,
entrepreneurship, health, education, criminal justice
reform.”
“But a lot of it’s also
about a relationship,” he said. “It takes a lot of work to make sure
people get to know you. I am determined to do that work, because I’m
determined to compete here in South Carolina.”
On the campaign trail today: Beto
O’Rourke spends another day in Iowa… Julian Castro also campaigns in
the Hawkeye State… Joe Biden hits Nevada… And Amy Klobuchar and Cory
Booker address the Machinist Union’s legislative conference in DC…
DATA DOWNLOAD: And the number of the day is … net +4 and net-9.
Net +4 and net -9.
That’s the overall approval ratings for
ACA, the health care law signed by Barack Obama (41 percent of Americans say it’s a good idea, while 37 percent say it’s a bad idea) and
President Trump’s tax law (27 percent say it’s a good idea, while 36 percent say it’s a bad idea).
One reason for the ACA’s overall higher popularity?
While partisans are
predictably divided about the wisdom of the two signature pieces of
legislation passed by the two presidents,
independents are significantly more pessimistic about the tax law.
Among independents, the tax
law is a net negative 16 points underwater, while they’re more evenly
divided on whether Obamamcare is a good idea or a bad one.

05/07/2019 Share: Carl Cannon’s Morning Note Biden Factor; Confronting China; Nazi Surrender By Carl M. Cannon on May 07, 2019 08:30 am Good morning, it’s Tuesday, May 7, 2019. Seventy-four years ago today, the rickety remnants the Third Reich surrendered to Allied forces closing in on them from all sides. With Hitler dead for a week and his forces collapsing, German commander Hans-Georg von Friedeburg had asked the Americans for terms. The response from U.S. Army Gen. Dwight Eisenhower was that the terms were simple: unconditional surrender, and not just on the Western front, but also on the Eastern front. On May 6, Gen. Alfred Jodl, head of the Wehrmacht operations staff, had radioed Adm. Karl Dönitz, the ranking officer in the German High Command after Hitler’s death. Dönitz authorized Jodl to accede to Eisenhower’s demands. The pact was inked nearly three hours after midnight, so the surrender officially took place on May 7, 1945. I’ll furnish an eyewitness account of that dramatic event, along with a historic footnote, in a moment. In RealClearMarkets, Adam Brandon and John Tamny write that the return of human capital, not factories, is what dictates an area’s fortunes, with New York and Los Angeles as prime examples. * * * The signing ceremony that ended the fighting in Europe in 1945 took place in Reims, the French “City of Kings.” Embedded Western war correspondents were on the scene, all the better to furnish a newsreel bulletin of the event for civilians back home. Among those signing that night were three Allied generals: Ivan Susloparov, an obscure Russian liaison officer; Francois Sevez of France; and Eisenhower’s chief of staff, Walter Bedell “Beetle” Smith. Among the journalists present was Baltimore Sun reporter Price Day, who would win a Pulitzer Prize for foreign reporting in 1949 and later become his newspaper’s editor in chief. His dispatch began this way: “REIMS, France, May 7 — At 2:45 o’clock this warm spring morning, Col. Gen. [Alfred] Jodl signed his name for the fourth time and carefully put down his pen. Europe’s long war was over.” His story continued: “Jodl stood up. His back was rigid, his heels in their black boots were close together. He rested the tips of his fingers on the wide, battered oak table that filled a good part of what, until tonight, was the most secret of all chambers in Europe — SHAEF’s War Room.” Price Day was using an acronym familiar to American and British audiences. It stood for Supreme Headquarters Allied Expeditionary Forces. Day also reported that Beetle Smith and the others present watched impassively as Jodl expressed his thoughts about what was taking place. “With this signature the German people and German armed forces are for better or worse delivered into the victor’s hands,” Jodl said, speaking in his native language. “In this war, which has lasted more than five years, they both have achieved and suffered more than perhaps any other people in the world. In this hour, I can only express the hope that the victors will treat them with generosity.” No answer was given to this entreaty, Day reported. Nor did any of the Allied officers salute the surrendering German officers as they filed out of the room. In the ensuing decades, it can be said that, for the most part, Americans did treat the German people with generosity after that awful war. The Soviets did the opposite, imprisoning East Germany, along with most of Eastern Europe, behind a stifling Iron Curtain. Yet the Allies were not forgiving of the military men they were dealing with on this date in 1945. Dönitz and Jodl were tried for war crimes. The former was imprisoned for 10 years; Jodl was sentenced to death. The German military men expressed shock at even being arrested. “The indictment knocked me on the head,” Jodl later exclaimed. “First of all, I had no idea at all of about 90 percent of the accusations in it. Secondly, I don’t see how they can fail a soldier’s obligation to obey orders. That’s the code I’ve lived by all my life.” During their trial, Jodl and a German general named Wilhelm Keitel amplified on this just-following-orders rationale, which entered the English language as “the Nuremberg defense.” In Jodl’s case it wasn’t totally true: Prosecutors had voluminous evidence, some from Jodl’s own diary, showing that he gave plenty of questionable orders. In any event, the International Military Tribunal that conducted the Nuremberg trials explicitly rejected the idea that following a superior officer’s command absolved perpetrators of war crimes. Eleven convicted Nazi officials met their fate on Oct. 16, 1946. One of the condemned men, Hermann Goering, cheated the hangman by ingesting cyanide. The other 10 — among them Alfred Jodl — went to the gallows, some remorseful and some unrepentant, but all of them guilty. Carl M.
