POLITICO Playbook: Which Biden will show up in 2020?

DRIVING THE DAY

THE BIG QUESTION ABOUT JOE BIDEN … He’ll be the 21st Democrat to enter the party’s 2020 presidential field. There are two theories of BIDEN’S candidacy, and we wonder which one is correct:

— ONE: Twitter isn’t real life, and the former VP is more popular among the Democratic voting rank and file than the Acela Corridor conversation would suggest.

— TWO: Biden’s station at the top of the polls simply reflects his name ID, and once primary voters get a look at the 76-year-old, bipartisan-touting, gaffe-prone Washington insider, they’ll dart in the other direction.

THE WEAKNESS of the second argument is that name ID is a potent weapon, especially in a field filled with unknowns. …

… BUT, as many Dems say to us privately,in a party shifting leftward and skewing younger: Why would Democrats want an old guy who talks about how great he is working with Republicans and has a long record that is far more moderate than where the base is right now?

ONE QUESTION BIDEN WILL HEAR A LOT: Why aren’t more prominent OBAMA-BIDEN alums endorsing his candidacy? Where are foreign policy honchos like Jake Sullivan and Susan Rice? And, most importantly, where is BARACK OBAMA?

ANOTHER QUESTION … How will he compete for campaign cash? Fundraising has always been a weakness of Biden’s. Now, not only will he have to convince Democratic bundlers and big donors that he is the right person to beat President DONALD TRUMP, he will also have to contend with the influx of small-time donors who have flocked to Sens. BERNIE SANDERS and ELIZABETH WARREN.

AND IF HE HAS TO resort to swampy sources of funding — like hosting megadonor fundraising retreats or taking money from Wall Street — Biden will have to fend off political attacks from his rivals, many of whom have sworn off traditional bundling operations.

UH-OH … PHILADELPHIA INQUIRER’S JONATHAN TAMARI and CHRIS BRENNAN: “Joe Biden campaign launch back in flux, potentially delayed”: “Joe Biden’s plans are in flux again. If the former vice president does launch his presidential campaign this week, it won’t involve a trip to Charlottesville, Va., and plans for potential public events in Pennsylvania are also uncertain, according to sources familiar with his plans.

“Even Biden’s widely anticipated entry into the race grew unclear Monday, with the Atlantic reporting that a planned video announcement Wednesday was being pushed back.” Inky

— DAVID SIDERS: “Biden, Beto falter in new progressive straw poll”: “Bernie Sanders has solidified his front-runner standing among members of the progressive political action committee Democracy for America, while Joe Biden and Beto O’Rourke have both fallen back sharply, according to the group’s latest straw poll.

“Elizabeth Warren is now running second to Sanders in the DFA poll — though she trails the independent senator from Vermont by more than 30 percentage points, according to the survey released Tuesday and obtained first by POLITICO.” POLITICO

INSIDE THE HOUSE DEMOCRATIC CAUCUS … LAST NIGHT’S CONFERENCE CALL … “Pelosi beats back calls for Trump impeachment,” by Kyle Cheney, Heather Caygle and Andrew Desiderio:“Speaker Nancy Pelosi on Monday rejected calls to launch impeachment proceedings against President Donald Trump despite new voices in her caucus calling for the House to take that step in the aftermath of special counsel Robert Mueller’s report. …

“‘We can investigate Trump without drafting articles [of impeachment],’ she said during a call with House Democrats … ‘We aren’t going to go faster, we are going to go as fast as the facts take us.’” POLITICO

— KAMALA HARRIS during her CNN town hall Monday night: “‘I believe Congress should take the steps towards impeachment. But I want to say this, because it doesn’t end there … I’m also a realist. … I have also witnessed folks in the United States Congress, and in particular in the GOP, who have been presented with many reasons to push back against this president and they have not.” POLITICO

— WHERE THE OTHER CANDIDATES STAND per STEPHANIE MURRAY — WARREN: Yes; SANDERS and AMY KLOBUCHAR: No; PETE BUTTIGIEG: Trump “deserves” impeachment, but it’s up to the House and Senate to do it.

— WHITE HOUSE YAWNS … GABBY ORR and KATIE GALIOTO: “One administration official said the White House is so unconcerned that it does not currently have a strategy in place for responding to potential impeachment proceedings. … ‘The likelihood that the Democrats will try to impeach the president is next to zero.’” POLITICO

— THIS IS POLITICAL MALPRACTICE by the White House. How can they not plan for something that’s at least a possibility — and will certainly be a topic in the political bloodstream for the foreseeable future?

— MEANWHILE, PELOSI is signaling that she is going to do everything she can to make sure there is enough investigatory action so that no one can complain Democrats are not doing enough. And that, in and of itself, could prove damaging to the White House. Congressional oversight can be quite probing, even if there’s no official impeachment effort.

FIRST IN PLAYBOOK … TOM STEYER APPLIES PRESSURE … Need to Impeach, the Steyer-funded impeach-Trump organization, is dropping $325,000 on MSNBC and CNN nationally and MSNBC, CNN and Fox News in D.C. on a new 30-second ad urging impeachment.

— THE SCRIPT: “It’s all here: 10 detailed acts of obstruction of justice. Robert Mueller’s report lays out a road map for impeachment proceedings against this president, and challenges Congress to do its job. I’m Tom Steyer, and we can’t let this president destroy the public trust, break his oath of office and get away with it. Congress has to do its job and hold him accountable. Please call them at this number. Tell them to get going.” The 30-second spot

I made sure that Mueller was able to do his job without interference. The Mueller report is over for me. Done.’” CNN

I believe that what people really want is for their elected officials in both parties to stop all the fighting and just get to work and get things done. …

“And when it was all over, what had the event delivered? A reminder, more than anything, of just how premature the Democratic primary campaign remains. SCOTUS WATCH — “Trump’s Census Citizenship Question Faces Test in Supreme Court Clash,” by Bloomberg’s Greg Stohr: “[T]he effort by President Donald Trump’s commerce secretary is before the Supreme Court, which will hear the government’s appeal Tuesday in one of the biggest cases of the nine-month term. Democrats Subpoena Former White House Counsel Don McGahn Following Mueller Report
Yesterday afternoon, House Democrats subpoenaed Don McGahn, former White House Counsel, given his role as a key witness in the Mueller investigation. McGahn will testify before the Judiciary Committee in late May, as Democrats attempt to explore the findings released in the infamous Mueller Report last week.

“It’s the biggest move yet by Democrats who control the House to mine Mueller’s findings for evidence on a subject that the special counsel explicitly left to Congress — whether President Donald Trump sought to obstruct justice.
 
…McGahn laid out for Mueller a detailed road map of the president’s failed efforts to halt the special counsel’s probe. The lawyer, who talked to investigators for about two dozen hours and appears more than 500 times in Mueller’s report, described Trump’s unrealized demands to aides to fire Mueller and pressure former Attorney General Jeff Sessions.
 
McGahn left the Trump administration in October after a tenure made tumultuous by his handling of investigations into the Russian election interference. While Trump and McGahn had a contentious relationship near the end, he was credited with successfully advancing Trump’s conservative judicial picks, most notably Brett Kavanaugh’s confirmation to the Supreme Court.”

JoshHammer fromThe Daily Wire made an apt comparison when labeling the Mueller Report as a “Democratic Oppo Research Document” whose purpose was to “hint at non-indictable obstruction of justice grievances in order to possibly tee up the filing of impeachment articles from an overzealous Congress.” 
 
When discussing claims of obstruction of justice, Hammer offered no shortage of critique for the Democrats and their ability to twist a collusion narrative into an obstruction narrative:
 
“Next is obstruction of justice — the focus of Mueller’s criminal probe, into which the initial counter-intelligence probe oh-so-conveniently morphed after the shameful (and partisan) origins of the Steele dossier was laid bare and the fantastical notion of “collusion” was, Adam Schiff’s ceaseless braggadocio notwithstanding, shown to be an utter farce to any sentient human being… 
 
The final result of the Mueller probe is thus its mere utility as a Democratic Party oppo research document for purposes of both the 2020 presidential campaign and the filing of possible articles of impeachment in the U.S. House. This situation clearly never should have transpired, for both partisan interest reasons and fundamental separation of powers reasons. If Congress sought to gin up incitement for impeachment articles, then Congress was perfectly capable of doing so with its own subpoena power and formation of ad hoc investigation committees. And if the Democratic Party wants an oppo research file, then that is what the DNC is for.
 
As Sri Lanka Searches for Answers, Reports Emerge that Warnings Had Been Given
Following the horrific bombing attacks on Christians in Sri Lanka that killed 290 people and wounded 500 others, new reports are emerging that security agencies had warned polices of potential attacks on one of Christianity’s holiest days. FromThe New York Times
 
“In the days leading up to the devastating suicide bombings that killed nearly 300 people in Sri Lanka on Easter Sunday, the country’s security agencies had been closely watching a secretive cell of the National Thowheeth Jama’ath, a little-known radical Islamist organization that security officials in Sri Lanka now say carried out the attacks and may have received help from abroad.

They knew the group was dangerous. They had collected intelligence on the whereabouts of its leaders in the April 11 security memo, which warned of Catholic church bombings. They had been warned even earlier by India that the group, also known by the spelling National Thowheed Jama’ath, was plotting church attacks. They knew as far back as January that radical Islamists possibly tied to the group had stockpiled weapons and detonators.

Why the security agencies failed to act aggressively on the information before the bombings is now an enormous question. It has been further complicated by a feud between the president and prime minister, which left the prime minister ignorant of the information the security agencies possessed — leading to bitter recriminations that have created a new government crisis…
 
Sri Lanka’s president has not provided any satisfying answers about why the security services did not do more to thwart the bombers. Shiral Lakthilaka, a senior adviser, denied that there had been any security lapses. “Everyone has done their job,” he said. “These kinds of alerts are coming time to time. Even U.S. or anyone will not try to panic people.”
 
Given the scale of the attacks, experts are concerned that the attacks were orchestrated by a larger, international network, possibly evenISIS, though ISIS has made no formal claim over the attacks.

MAYOR PETE IS PROBLEMATIC
South Bend Mayor Pete Buttigieg is likely to be a flash in the pan candidate for 2020. Facing off against candidates who’ve won far more votes and winning campaigns in much more meaningful states, he’s unlikely to maintain his current poll standing as effectively third in the race. But he also comes across as smart, capable, and a responsible executive in a pool of candidates who come across as – well – desperate table-jumpers who want to give the crowds whatever they ask. Pete is abidingly midwestern, a gay veteran married to a teacher with their plaid and their dogs. But now according to lefty academics and The Daily Beast, that’s part of the problem.

Good morning, it’s Tuesday, April 23, 2019. Today’s date is a reminder that we do not necessarily follow the crowd and that history occasionally rewards those who do their own thinking. The example I have in mind this morning came in 1956 when Elvis Presley played his first engagement in Las Vegas. Things didn’t go as planned: Young Mr. Presley’s act left an audience of squares nonplused and was duly panned by the press. It turns out there was a lesson in that reaction, which we’ll explore in a moment. Anthony Mills reflects on the connection visitors to the great church felt apart from the awe inspired by its monumental grandeur. 10 Best National Parks Outside the U.S. RealClearLife continues its nature-themed coverage in honor of Earth Day. * * * Elvis Presley was already a big deal in this country by April 1956, so when the New Frontier Hotel booked his band (Elvis, Scotty Moore and Bill Black) for a two-week gig it was something of a coup. “The handsome 21-year-old rock ‘n’ roller’s appearance,” gushed the Las Vegas Sun, “is considered to be the Las Vegas entertainment scoop of the year.” The Sun’s enthusiasm soured, though, when audiences didn’t respond in kind. Elvis and his band mates were booked into the New Frontier’s dinner theater, which may have been a mistake. In that venue, over their watered-down cocktails and lukewarm chicken cordon bleu, the middle-aged, married couples from Middle America sat mostly mute during Elvis’ act, looking perplexed by such numbers as “Blue Suede Shoes” and applauding politely at the end, more out of mercy than anything else, along with gratitude that the din had ended. Noting that the audience “sat through Presley as if he were a clinical experiment,” Newsweek compared the disconnect between the performer and the New Frontier clientele to “a jug of corn liquor at a champagne party.” Taking his cue from the Vegas tourists instead of the young people snapping up Presley’s records all over the country, Bill Willard of the Las Vegas Sun was underwhelmed. “Elvis Presley, arriving here on the wave of tremendous publicity, fails to hit the promised mark,” Willard wrote. “The brash, loud braying of his rhythm and blues catalog (and mind you, they are big hits everywhere, it seems) which albeit rocketed him to the big time, is overbearing to a captive audience.” “For the teen-agers, the long, tall Memphis lad is a whiz,” Willard added. “For the average Vegas spender or show-goer, a bore. His musical sound with a combo of three is uncouth, matching to a great extent the lyric content of his nonsensical songs.” Among The Sun’s readers, however, was an astute letter writer who felt compelled to respond. He was a Vegas resident named Ed Jameson, and he read the paper closely enough to know that Bill Willard usually covered the police beat. His prescient response was published a few days later. “I will try to bravely carry on after reading the report of the SUN’s police reporter concerning Mr. Elvis Presley now holding forth at the Venus Room of the Hotel New Frontier,” Jameson wrote. “I come not to bury Caesar, but to praise him. Despite the acid hemlock broth stirred by the Sun’s copy boy, methinks Mr. Presley will survive and live to sing some more. Not that for many moons to come his name will be well known about the countryside.” As I’ve written previously, Ed Jameson went on in this vein for a while, in prose that captured his own enthusiasm, along with the lingo of the times — and the spirit of the times that were just around the corner: “Perhaps this cat should have studied grand opera, the fiddle or just be satisfied herding a truck. I don’t join that school of thought,” Jameson added. “He’s happy and he’s making lots of other people happy doing just what he is doing naturally. You see, he’s a natural. Any dope knows what a natural is. “This cat Presley is neat, well gassed and has the heart. “Presley has a depth of tone that can sink deeper than a well. He can wilt into a whisper faster than a gossipmonger can throw down a free drink. He is classier than a new sock. … He really makes them cry. He’s a smooth cat, cool and crazy with new stuff. His sound is dreamy and unique, loaded with mystery. “So settle down, dad. …Youth is an exuberant stage of life with the top down. “Presley’s voice is that of American youth looking at the moon and wondering how long it will take to get there. He is not a Rock ‘n’ Roller nor is he a cowboy singer. He is something new coming over the horizon all by himself and he deserves his ever-growing audience. Nobody should miss him. Parents would do well to take their children to hear him. It would be a good way to get to know and understand your own kids.”  Carl M. Cannon

FIRST READ: Why aren’t Democrats pushing for a legislative fix on foreign election interference? 

For all the debate about whether to pursue impeachment proceedings against President Trump, House Democrats have another remedy at their disposal that’s received far less attention.

That idea?

Make a big, explicit legislative push to punish individuals and campaigns trying to take advantage of future foreign interference in U.S. elections.

If a foreign government interfered in a U.S. election, and a particular campaign was eager to receive that help, why not try to pass laws making it harder for that to happen in the future?

Yes, the HR1 bill that House Democrats passed last month calls for a strategy to protect democratic institutions, as well as a commission to study it. But those provisions were buried under the act’s other voting, ethics and campaign-finance measures.

And there’s been little effort to rally around them.

Don’t get us wrong: The impeachment debate is a legitimate one; we’ve covered it here for months.

And sure, the GOP-controlled Senate can stymie any House-passed bill. (Of course, the same is true for impeachment, and the bar is even higher – a two-thirds vote is needed to convict.)

But why aren’t House Democrats trying to call any GOP bluff right now?

If Democrats and Republicans both are concerned about future foreign interference in U.S. elections – and want to prevent it from happening again – why not start there?

The Mueller report made it clear that the United States has 20th century election laws in a 21st century world.

In a world of cyber-threats and misinformation wars, the current laws on the books don’t cut it anymore.

Pelosi: “We don’t have to go to articles of impeachment to obtain the facts”

As for the impeachment debate, House Democratic leaders told rank-and-file members on a conference call yesterday that they will pursue aggressive investigations into President Trump – but won’t commit to beginning impeachment proceedings.

Some of the highlights of the call, per NBC’s Leigh Ann Caldwell, Rebecca Shabad and Frank Thorp:

“We have to save our democracy. This isn’t about Democrats or Republicans. It’s about saving our democracy,” House Speaker Nancy Pelosi said, according to a person on the call. “If it is what we need to do to honor our responsibility to the Constitution — if that’s the place the facts take us, that’s the place we have to go.”

But Pelosi added that saving the Democracy doesn’t necessarily constitute impeachment.

“We don’t have to go to articles of impeachment to obtain the facts, the presentation of facts,” she said.

Also: Two lawmakers, Reps. Val Demings of Florida and Jared Huffman of California, both spoke up in support of impeachment, according to two sources on the call

Supreme Court hears the Census/citizenship case

The other big story we’re watching today: The U.S. Supreme Court is hearing oral arguments over the Trump administration adding a citizenship question to the 2020 census.

NPR: “In multiple lawsuits brought by dozens of states, cities and other groups, three federal judges at U.S. district courts have issued rulings blocking the administration’s plans for the question. It asks, ‘Is this person a citizen of the United States?’”

More: “All three judges — in New York, California and Maryland — ruled that [Commerce Secretary Wilbur] Ross’ decision to include the question violated procedures for adding new census questions under administrative law. The judges in California and Maryland have also ruled that adding the question is unconstitutional because it hurts the government’s ability to carry out the constitutional mandate for a once-a-decade head count of every person living in the U.S.”

2020 VISION: Town Hall-Palooza

Last night, five Dem presidential hopefuls participated in CNN town halls in New Hampshire. Here’s a brief summary from NBC’s campaign reporters and correspondents:

Amy Klobuchar (per NBC’s Ali Vitali)

Defended pursuing a public option for health care rather than Medicare for All, and she dodged whether anything in the Mueller report was impeachable: “I believe I’m the jury here, so I’m not going to predispose things. I’m not going to say whether it is or isn’t. But I will say there are very disturbing things that would lead you to believe there’s obstruction of justice.”

Elizabeth Warren (also per NBC’s Vitali)

Argued that the House should begin impeachment proceedings against Trump, said she supports the Green New Deal, and responded to a question about getting “Hillary’d” in 2020: “One might say you persist. Organize. Build a grassroots movement … and that’s how I’m going to be the first women elected president of the United States.”

Bernie Sanders (per NBC’s Shaquille Brewster)

Resisted the push for impeachment, saying Congress should continue investigating. And he maintained that felons, including the Boston Marathon bomber, should be allowed to vote while in prison.

Kamala Harris (per NBC’s Vaughn Hillyard)

Said that Congress “should take the steps towards impeachment”; announced she’d sign four different executive actions if Congress doesn’t pass gun legislation in the first 100 days of her presidency; and said the Medicare for All bill she co-sponsored would allow for some supplemental private insurance.

Pete Buttigieg (per NBC’s Josh Lederman)

Said that Trump “deserves impeachment” but didn’t say whether Congress should pursue it; he disagreed with Sanders that incarcerated felons should be allowed to vote while in prison; and said that while Sanders and President Trump are “stupendously different,” they’ve both tapped into “anti-establishment energy.”

On the campaign trail today: Bernie Sanders, Kamala Harris and Seth Moulton campaign in New Hampshire… Elizabeth Warren and Amy Klobuchar hit South Carolina… And Cory Booker stumps in Wisconsin.

DATA DOWNLOAD: And the number of the day is … five out of six

That’s the number of progressive policy proposals that showed majority support in a March CNBC poll.

The survey measured support for six Democratic-led initiatives. Here’s how they measure up:

  • A federal requirement for paid maternity leave (84 percent support )
  • Increased federal funding for child care (75 percent support)
  • A $15 federal minimum wage (60 percent)
  • Tuition-free college at state and public institutions (57 percent)
  •  Single-payer Medicare for All (54 percent)
  • A universal basic income (28 percent)

While some opponents of Democrats have decried measures like tuition-free college and Medicare for All proposals as unrealistic or even socialist, those plans remain notably popular in public polling.

Fewer than a third of respondents said that they strongly opposed any of the five proposals that received majority support.

Click here   Good morning,After a weekend of media coverage about the Mueller Report, the president’s job approval rating remains steady at 45%. This continues a remarkable period of stability. Since January 28, every single daily update has been within two percentage points of 46%.Data collected on Sunday night and Monday morning also showed no change in support for impeachment.  Currently, 41% believe President Trump should be impeached and removed from office. However, 45% disagree and 15% are undecided.Eighty-one percent (81%) of Republicans are now opposed to impeachment while 70% of Democrats favor it. Independent voters are more evenly divided with 37% in favor and 47% opposed.One topic where opinion has shifted is concern about automation and robotics. Fifty-three percent (53%) of voters nationwide now fear that automation and robots will eliminate needed jobs and create mass unemployment. That’s up 12 points since November.Still 31% consider it at least somewhat likely they will someday own a robot themselves. That total includes 48% of voters under 35 and just 10% of senior citizens.Finally, 73% of voters say that the economy is a Very Important issue.
