Friday, April 19, 2019 Editor’s note: Happy Easter and Pesach (Passover)! We’re taking a brief hiatus to celebrate – be back in full swing next Wednesday! Mueller Time On Thursday, “Attorney General William Barr… released a redacted version of special counsel Robert Mueller’s report on Russian interference in the 2016 election to Congress and the public. The special counsel spent nearly two years investigating attacks on the 2016 presidential election and whether the Trump campaign coordinated with the Russians behind [them].” NPR

AP News From the Left The left thinks the report is devastating for President Trump, and that Mueller offered compelling evidence that Trump committed obstruction of justice. “We learned that two Trump campaign officials, campaign manager Paul Manafort and Manafort’s deputy Rick Gates, were regularly providing polling information to a Russian national whom Gates believed to be a ‘spy.’ We learned that, after Trump publicly called on Russia to find Hillary Clinton’s emails, he privately ordered future National Security Adviser Michael Flynn to find them. Flynn reached out to a man named Peter Smith who (apparently falsely) told a number of people that he was in contact with Russian agents. We learned that Trump foreign policy adviser George Papadopoulos attempted to arrange meetings between Trump and Putin, and that Trump personally approved Papadopoulos’s work on this front… 

“What the report finds is not clear-cut evidence of a quid-pro-quo. Instead, what we see is a series of bungled and abortive attempts to create ties between the two sides, a situation in which the Trump team and Russia worked to reach out to each other (and vice versa) without ever developing a formal arrangement to coordinate.”

The behavior detailed in Mueller’s report ought to make it easier for both politicians and the public to render their verdict.”

A prosecutor appointed and overseen by Trump’s Justice Department is still capable of discovering the facts about this president. The FBI and intelligence agencies weathered a Mueller-documented campaign of presidential intimidation. The fact that a coolheaded Mueller didn’t call for legal prosecution, when half the country was calling for Trump’s scalp, in some ways affirms the integrity of the system…

“Congress may shy from impeachment; the public may even, inexplicably, decide that Trump deserves a second term. But the facts will be there for future historians — and for the millions around the world who have worried (or celebrated) that our system is cracking… Mueller’s report is a win for the slow tortoise of the truth.”

Minority View: “The sweeping Mueller investigation ended with zero indictments of zero Americans for conspiring with Russia over the 2016 election. Both Donald Trump, Jr. and Jared Kushner – the key participants in the Trump Tower meeting – testified for hours and hours yet were never charged for perjury, lying or obstruction, even though Mueller proved how easily he would indict anyone who lied as part of the investigation…

“As Mueller himself concluded, a reasonable debate can be conducted on whether Trump tried to obstruct his investigation with corrupt intent. But even on the case of obstruction, the central point looms large over all of it: there was no underlying crime established for Trump to cover-up.”
Glenn Greenwald, The Intercept From the Right The right sees the report as vindication of President Trump’s claims of innocence, and criticizes Mueller’s analysis of obstruction of justice. “The investigation into the Trump campaign’s relationships with various foreign actors and into the president’s possible obstruction of justice has come to a conclusion, and that conclusion is that there was no criminal collusion and insufficient evidence to support an obstruction prosecution. In a reasonable world, this would be the obvious time to move on… the reasonable conclusion here is to concede that there was smoke (maybe just the smell of smoke) but no fire, that some of Trump’s actions may have been unseemly but that there’s no law against unseemliness.”

Mueller’s investigation involved his own team of 19 lawyers, as well as 40 FBI agents, intelligence analysts and forensic accountants. It racked up 2,800 subpoenas, 500 search warrants, 230 orders for communication records, 50 orders for pen registers, 13 requests for evidence from foreign governments, and interviews with 500 witnesses. Are we to believe that this wasn’t enough?”

He and his campaign did not conspire or coordinate with Russians to steal the 2016 election. Try as he did to find a crime regarding Russia or obstruction of justice, Mr. Mueller found nothing to prosecute… Mr. Mueller essentially reveals a President behaving in predictable Trumpian fashion at being investigated for a crime he didn’t believe he committed—and which even Mr. Mueller now concedes he didn’t commit. There was no underlying crime, and the investigation continued with full White House cooperation.”

THE POST-MUELLER STATE OF PLAY …

— THE MOST DONALD TRUMP thing ever: The president probably would have obstructed justice had he been willing to fire ROBERT MUELLER himself. Instead, the notoriously conflict-averse Trump relied on aides — longtime Washington hands like then-White House counsel Don McGahn — who ignored his request to ax the special counsel.

— @realDonaldTrump, 5:31 p.m. Thursday: “I had the right to end the whole Witch Hunt if I wanted. I could have fired everyone, including Mueller, if I wanted. I chose not to. I had the RIGHT to use Executive Privilege. I didn’t!”

— CAPITOL HILL DEMOCRATS we spoke with Thursday believe Trump has done enough to deserve impeachment, even though they won’t say it publicly. The president tried to curb the Mueller probe on multiple occasions. They know they can’t remove him from office — they’d need 20 Republican senators — and they know that impeachment is not popular. So they’re kind of stuck. Heather Caygle, Sarah Ferris and John Bresnahan on Democrats running from impeachmentNYT’s Nick Fandos: “Democrats Draw Closer to a Dicey Question: Whether to Impeach Trump”

HOUSE SPEAKER NANCY PELOSI scheduled a caucus conference call for Monday, and wrote this in a letter to her colleagues from Ireland, where she is on congressional travel: “The Mueller report states, ‘We concluded Congress has authority to prohibit a president’s corrupt use of his authority in order to protect the integrity of the administration of justice,’ which ‘accords with our constitutional system of checks and balances and the principle that no person is above the law.’ Congress will not be silent.”

ONE THING TO WATCH FOR … Do House Democrats censure Trump? It would be a way to publicly rebuke the president without launching the politically divisive option of impeaching him.

— REPUBLICANS, OF COURSE, ARE THRILLED. They believe there was no smoking gun, and they can see America beginning to move on. More from Melanie Zanona, Sarah Ferris and Burgess Everett

— MANY HILL INSIDERS were surprised at the lack of redactions in the report delivered to Congress.

— THE NEXT TURN OF THE SCREW is going to be A.G. BILL BARR’S testimony to the House and Senate Judiciary committees. Congressional hearings are almost never as useful as they could be. It will be interesting to see if Democrats can keep the process under control.

There Was No Collusion and There Was No Obstruction
After much anticipation, the Mueller report was released yesterday after 22 months of investigation in – at first – possible Russian collusion by President Trump to steal the election. The investigation came up short on collusion and went down the rabbit hole chasing an obstruction charge but also found nothing. 
 
Former federal prosecutor Andrew McCarthy breaks down exactly how badly Robert Mueller biffed this entire process in the New York Post.

“The most remarkable thing about special counsel Robert Mueller’s 448-page report is how blithely the prosecutor reversed the burden of proof on the issue of obstruction.”
 
“In his report, Mueller didn’t resolve the issue. If he had been satisfied that there was no obstruction crime, he said, he would have so found. He claimed he wasn’t satisfied. Yet he was also not convinced that there was sufficient proof to charge. Therefore, he made no decision, leaving it to Attorney General William Barr to find that there was no obstruction.

This is unbecoming behavior for a prosecutor and an outrageous shifting of the burden of proof: The constitutional right of every American to force the government to prove a crime has been committed, rather than to have to prove his or her own innocence.”

Mueller and company dragging the American people along for an almost two-year circus which proved to be nothing more than a pathetic partisan attempt to undermine the President is definitely annoying. But the real villains in this tale are the “journalists” of the mainstream media who willfully participated in this completely fabricated fairytale from day one. They decided they would do anything to remove Trump from his elected post as President, even if it meant completely beclowning themselves. 
 
Even after the report was released yesterday, journalists were grabbing at any straw to make their former claims seem even remotely legitimate in the face of actual facts. 
 
Madeline Osburn at The Federalist highlighted some of the craziest claims by members of the media. This list includes one particularly challenged claimant who says that “Innocent people don’t need memes” in response to Donald Trump’s “Game of Thrones” inspired meme yesterday. 
 
David Marcus points out that the real bombshell from yesterday’s report was actually Russia’s social media campaign, which of course also duped the media. (The Federalist):

“Conducted by the Internet Research Agency (IRA), a Russian government-backed social media troll farm, the extent and reach of the operations is astounding. Collectively, the report says, “The IRA’s social media accounts reached 10s of millions of US persons.” It also controlled Facebook groups such as “United Muslims of America,” that had 300,000 followers when it was shut down in 2017.

In total the report says that at least 29 million and perhaps as many as 126 million people were reached by the propaganda campaigns. The danger of this is not merely that the propaganda might help determine the outcome of viewers’ voting decisions. What is far worse is that, on that scale, the Russians can make fringe, divisive positions and rhetoric appear to Americans to be, if not mainstream, at least vastly more prominent than they really are.

Even the news media was not immune to these efforts. The report outlines that on multiple occasions ‘U.S. media outlets also quoted tweets from IRA-controlled accounts and attributed them to the reactions of real U.S. persons.’ It is very possible, if not likely that the real target of the IRA was not to sway an election, but rather to sow discord and distrust among Americans. And it looks like the news media was an unwitting accomplice.”

Good morning, it’s Friday, April 19, 2019, the day when I provide an end-of-the week quote to provide inspiration for the weekend. That’s tricky today, as April 19 is a momentous — and often lethal — day in U.S. history. Many of the most pivotal events have a New England connection: The American Revolution became a shooting war on Lexington Green on this date in 1775; the first blood was let in the Civil War on April 19, 1861 when a secessionist mob in Baltimore attacked a train carrying Union troops from Massachusetts. Known as Patriots’ Day in the Bay State, it’s also when the first Boston Marathon was run in 1897. April 19 is the culminating date of the deadly 1993 government siege at Waco, Texas — and the bombing by domestic terrorists of the Alfred P. Murrah Federal Building in Oklahoma City two years later.  This is also Tax Week, and today’s quote concerns the mixed feelings Americans have about paying their fair share — or any share. Although most Americans tend to view taxes as a necessary evil, there’s never been a consensus about how much we should pay, or even who should pay. Edmund Burke (who wasn’t an American but provided inspiration to our rebellion) gave voice to that sentiment, as have others, including several U.S. presidents. “The wisdom of man never yet contrived a system of taxation,” Andrew Jackson noted in 1832, “that would operate with perfect equality.”
Fair enough, onetime U.S. Treasury Secretary William Simon conceded. But Simon suggested in 1977 that Americans are entitled to “a tax system which looks like someone designed it on purpose.” (Before I continue, I should give credit where it’s due: These quotes were unearthed by the incomparable Fred R. Shapiro, editor of The Yale Book of Quotations.) Little is new in the debate over taxes. John Adams noted in an 1818 letter to a friend that Founding Father James Otis insisted during the revolution that “taxation without representation is tyranny.” This line is used today by Washington, D.C., residents while agitating for a voice in the U.S. Senate. As early as 1787, Thomas Paine warned of one natural result of a muscular foreign policy. “War,” he wrote, “involves in its progress such a train of unforeseen and unsupposed circumstances … that no human wisdom can calculate the end. It has but one thing certain, and that is to increase taxes.”
That is still true today. In addition, the rate of taxation has been debated through the ages. Filene said. “I took all of it from them.” Elizabeth Warren, call your speechwriters. Another longstanding source of controversy is estate taxes. “Nothing is certain,” goes the old adage popularized by Benjamin Franklin, “except death and taxes.” But wasn’t death supposed to end one’s obligation to the taxman? Apparently not, and that’s a touchy subject Will Rogers handled with his customary wit: “I don’t see why a man shouldn’t pay an inheritance tax,” he quipped in 1926. “If a country is good enough to pay taxes to while you are living, it’s good enough to pay in after you die. By the time you die you should be so used to paying taxes that it would just be almost second nature to you.” But I promised you an Edmund Burke quote, so here it is: Opining on this date in 1774 about taxation in America, Burke wrote: “To tax and to please, no more than to love and to be wise, is not given to men.” It’s a sentiment every member of Congress can relate to… and it’s our quote of the week. FIRST READ: The Mueller report is out. What do Democrats do next?

There’s one all-consuming question for the Democratic Party now that the Mueller report has been released: What now?

The ball is in Congress’s court. And Democrats are about to face a huge split about whether to pursue an impeachment proceeding with obvious political downsides, or to pass on the opportunity to set a historic precedent and hold the president accountable.

Members of Congress often say that they want to serve in a time of consequence. Well, it doesn’t get more consequential than this.

On the one hand: Democratic 2020 candidates have been reflecting the reality on the ground, which is that voters don’t seem to have much appetite for impeachment at all. That’s reflected in public polling, too, and there’s a clear risk than an impeachment fight would be perceived as Democrats overplaying their hand.

Nancy Pelosi knows all of that.

But congressional leaders also face the opposite question: Without trying to hold the president accountable, what might they be mainstreaming for the future?

If they let this go, do they normalize this type of presidential behavior in the future?

If they don’t pursue impeachment, what message are they sending about what a president can get away with?

It’s a political dilemma, but also an ethical one.

What’s the right thing to do here, if you’re a Democratic leader? And does the right POLITICAL decision align with the right ETHICAL one when it comes to the long arc of history?

How Trump desensitized America long before the Mueller report

So much of the commentary around the Mueller report has revolved around the parsing of legal arguments about collusion and obstruction.  

 But beyond the legal weeds, this glaring picture remains:

Trump and key members of his team showed themselves in this report to be unbothered by foreign interference in U.S. elections, unconcerned about following the letter or the spirit of the laws about the conduct of a campaign, and unencumbered by the obligation to tell the truth to the American people.

And we’ve already been so desensitized to it, because so much of the evidence Mueller provided was either reported contemporaneously or simply uttered in public.  

The report lays out that:

  • Trump’s campaign hoped and expected to benefit from information stolen and released by Russian efforts.
  • Members of his team were “receptive” to some offers of assistance to the campaign from Russia, and they failed to report any of it to any authorities.
  • Trump consistently urged aides to make public statements with which they disagreed or were uncomfortable.
  • He repeatedly encouraged people on his team to obtain Hillary Clinton’s emails. Leading that effort, Michael Flynn asked two campaign supporters for help, which included trolling the “dark web.”
  • He directly encouraged his Attorney General to investigate a political foe (Hillary Clinton).
  • He and his associates publicly and privately dangled the possibility of pardons to witnesses in the investigation.
  • At least three aides — Sarah Sanders, KT McFarland and Reince Priebus — knowingly disseminated false information to the press.

Any of those items, taken alone, would seem earth-shattering if they were suddenly being revealed by Mueller’s team for the first time.

But we’ve known the broad contours of that behavior for so long, either because it leaked (like Trump ordering Don McGahn to fire Mueller, but backing off when he threatened to resign), or because Trump said it aloud (like his tweets about his displeasure with Jeff Sessions or his professed enthusiasm for Wikileaks)

So, many of the most damning parts of the report were things we already knew.

But seeing them all in one place is a reminder of this administration’s crisis of credibility.

With so many instances of misleading the press and the public, it’s hard to see how this White House ever gets the benefit of the doubt — on anything — again.

DATA DOWNLOAD: And the number of the day is … at least 11

At least 11.

That’s the number of people in Trump’s orbit who the Mueller report shows did NOT go along with a potentially problematic request from the president.

The Special Counsel stated that: “The president’s efforts to influence the investigation were mostly unsuccessful, but that is largely because the persons who surrounded the president declined to carry out his orders to accede to his requests.”

Who are those “persons”? Here’s the list our White House unit put together:

Don McGahn: Refused to ask Rosenstein to fire Mueller and threatened to resign instead after president had asked him to do “crazy s***”

James Comey: Did not, as Trump asked, publicly push back on the suggestion the president had a connection to Russian election interference

Corey Lewandowski: Did not deliver Trump’s message to Sessions that he should confine the Russia investigation to future election interference only

Rick Dearborn: Did not deliver Trump’s message to Sessions that he should confine the Russia investigation to future election interference only

Dan Coats: Refused to say publicly that no link existed between President Trump and Russia after he was asked to in Oval Office 2017 meeting

Rob Porter: Did not reach out to Rachel Brand, to discuss possibility of installing her as AG to remove Sessions and end investigation, because he was “uncomfortable with the task”

Jeff Sessions: Recused himself, despite the president asking him not to, and stayed recused, even when he was later asked by Trump to “unrecuse”

Chris Christie: Did not follow through with the president’s request to call Comey and “tell him that the President still really like[s] him” the day after Flynn resigned  

Rod Rosenstein: Refused to do a press conference, at the president’s direction, that it was all his [Rosenstein’s] idea to fire Comey, and later told other DOJ officials that he would not participate in putting out a “false story”  

James Clapper: Refused to make a public statement refuting allegations in Steele dossier, per an email from Clapper to Comey  

KT McFarland: Ultimately did not write an internal letter stating that the president had not directed Flynn to discuss sanctions with Russian Ambassador Sergey Kislyak.

One thing that stands out to us in that list? Most of those people are no longer part of the administration. If they were the guardrails then, who are the guardrails now?

Another thing that stands out: Trump might not be a fan of Reince Priebus and Don McGahn today, but he should be thanking them. The team Priebus put together — and particularly the hiring of McGahn — may have been the only thing that saved Trump from his own worst impulses on obstruction.

2020 VISION: Yes, it looks like Biden is a go for next week

There’s some fresh buzz today about a Biden announcement coming next week after a new piece in the Atlantic cites a possible Wednesday kickoff.

Our own Mike Memoli has been reporting about a possible announcement next week, too, and we know that Biden has already filmed a video at his childhood home in Scranton.  

Our question: What’s the big picture opening message for Biden’s entry into this race?

That he’s the unifier who can convince both sides to recognize each other’s decency again?  

The crusader who’ll fight a lofty “battle for the soul of this nation”

The brawler who once said he would have fought Trump in high school (a statement he later said he regretted.)  

A return to normalcy?

And it looks like Biden’s own CAMPAIGN hasn’t figured out that message yet.

The Atlantic reports that the campaign is weighing a more lighthearted announcement on the “Rocky” steps in Philadelphia OR one in Charlottesville to take on Trump on race and division. Those are two radically different opening messages. One’s upbeat and hopeful, and one is solemn and weighty.

That sure seems like a huge decision to be indecisive about less than a week before go time.
 

On the campaign trail today: Beto O’Rourke and Pete Buttigieg  are in New Hampshire …. Tim Ryan and Kirsten Gillibrand campaign in Iowa… Cory Booker is in Nevada… and Bernie Sanders and Kamala Harris are both in South Carolina.

On the campaign trail Saturday: Buttigieg remains in New Hampshire, where Elizabeth Warren will also be campaigning…. Booker and Jay Inslee are in the Nevada… Ryan remains in Iowa, and Sanders and Harris remain in South Carolina.

On the campaign trail Sunday: Kamala Harris heads to Easter service in Columbia, South Carolina.
