Tuesday, October 1, 2019 Hong Kong Protests “Hong Kong was in lockdown on Tuesday, with barricades in the city center, shuttered stores and a heavy riot police presence, as authorities scrambled to ensure protests do not overshadow China’s National Day festivities in Beijing. The former British colony has been wracked by nearly four months of street clashes and demonstrations.” Reuters

Both sides are applauding the protestors and calling on world leaders to support them as much as possible:

“Hong Kong’s protesters are outfoxing Beijing worldwide… From Oslo to Osaka, Congress to the United Nations, Taiwan to Twitter, Hong Kongers have taken their DIY approach to protest to a global audience. Celebrity supporters testify in high-profile settings; highly targeted, crowdfunded media campaigns aim to keep the issue in the spotlight; and viral videos, catchy slogans, and even a movement anthem and flag help magnify the message on social media… [In the] battle over international public opinion, it is Beijing and its minions that are outgunned.”

This Whistleblower is Clearly a Coordinated Hit Job It does not mean the complaint is invalid or inappropriate. But can we please dispense with the idea that this is just one honest public servant out to blow a whistle. The roll out of allegations against the President via the media is coordinated and deeply troubling. The whistleblower prepared a detailed complaint and it leaked. Democrats clearly had knowledge of it. There was clearly buzz building with reporters briefed on the President’s conversations with Ukraine’s President. THE STORY EVERYONE IS TALKING ABOUT — “Trump Pressed Australian Leader to Help Barr Investigate Mueller Inquiry’s Origins,” by NYT’s Mark Mazzetti and Katie Benner: “President Trump pushed the Australian prime minister during a recent telephone call to help Attorney General William P. Barr gather information for a Justice Department inquiry that Mr. Trump hopes will discredit the Mueller investigation, according to two American officials with knowledge of the call.

“The White House curbed access to a transcript of the call — which the president made at Mr. Barr’s request — to a small group of aides, one of the officials said. The restriction was unusual and similar to the handling of a July call with the Ukrainian president that is at the heart of House Democrats’ impeachment inquiry.

“Like that call, Mr. Trump’s discussion with Prime Minister Scott Morrison of Australia shows the president using high-level diplomacy to advance his personal political interests.

“The discussion with Mr. Morrison shows the extent to which Mr. Trump views the attorney general as a crucial partner: The president is using federal law enforcement powers to aid his political prospects, settle scores with his perceived ‘deep state’ enemies and show that the Mueller investigation had corrupt, partisan origins.” NYT

— WAPO’S DEVLIN BARRETT, SHANE HARRIS and MATT ZAPOTOSKY: “Barr has already made overtures to British intelligence officials, and last week the attorney general traveled to Italy, where he and Durham met senior Italian government officials and Barr asked the Italians to assist Durham, according to one person familiar with the matter, who spoke on the condition of anonymity to discuss a sensitive issue. It was not Barr’s first trip to Italy to meet intelligence officials, the person said.

“The Trump administration has made similar requests of Australia, said people who discussed the interactions on the condition of anonymity because they involve an ongoing investigation and sensitive talks between governments.” WaPo

— FLASHBACK: Barr was spotted in Playbook PM on Aug. 15 at the Rome Marriott Grand Flora Hotel. Barr, who was dressed in a suit, was accompanied by multiple staffers and had a significant security detail presence as he was whisked into the hotel.

House Democrats fired their latest salvo in their impeachment battle with President Trump on Monday, subpoenaing Rudy Giuliani, the president’s lawyer, for documents related to their investigation into Trump’s push for the Ukrainian government to investigate former Vice President Joe Biden. Three House Democratic committee chairmen called for Giuliani to comply with the subpoena by Oct. 15. The subpoena requires the former New York City mayor to hand over communications about Hunter Biden, the former vice president’s son, and efforts by Giuliani or his associates to pressure current or former Ukrainian officials to investigate matters regarding the Bidens or any other American. “Your failure or refusal to comply with the subpoena, including at the direction or behest of the president or the White House, shall constitute evidence of obstruction of the House’s impeachment inquiry and may be used as an adverse inference against you and the president,” the three chairmen told Giuliani in a joint letter (The Hill).   Giuliani recently said in interviews that he saw the merits and downsides of cooperating with the investigation but would ultimately follow the advice of Trump as to whether he would do so.

“It would give me a chance to explain what was really happening,” he said. Giuliani has also put the spotlight on the State Department further into the Ukraine discussion, saying that he possesses texts from them asking for his involvement in the matter. 

 “I have 40 texts from the State Department asking me to do what I did,” Giuliani said (The Washington Post).

The subpoena came as the president raged against the continued push by House Democrats, with much of his ire directed at House Intelligence Committee Chairman Adam Schiff (D-Calif.). Trump accused Schiff of committing treason for exaggerating parts of his call with Ukrainian President Volodymyr Zelensky. Trump was likely referring to Schiff’s remarks at last week’s hearing with Joseph Maguire, the acting director of national intelligence, where he paraphrased what he considered actions of wrongdoing by the president, including to “make up dirt on my political opponent” (The Hill).

Along with Schiff, Trump has continued to zero in on the whistleblower, whom the president has derided as a “#FakeWhistleblower.” He told reporters on Monday that he wants to know the identity of the whistleblower despite laws that protect their identity. 

“We’re trying to find out about a whistleblower,” Trump told reporters in the Oval Office a day after tweeting that he deserves to “meet my accuser” and asserting that whistleblower laws were changed before the report was submitted, which is inaccurate (The Hill).

Amid the president’s airing of grievances, multiple new reports emerged on a number of different investigative fronts. On Ukraine, The Wall Street Journal reported that Secretary of State Mike Pompeo was on the July 25 phone call, which puts the State Department more directly in the impeachment line of fire. 

Additionally, The New York Times reported shortly thereafter that Trump pressed Australian Prime Minister Scott Morrison to help Attorney General William Barr investigate the origins of former special counsel Robert Mueller’s investigation. The Department of Justice said in a statement on Monday night that the president contacted foreign countries at Barr’s request to ask them for assistance in an ongoing investigation into the origins of the probe (The Hill).

In Congress, Senate Majority Leader Mitch McConnell (R-Ky.) confirmed that the Senate would have “no choice” but to take up articles of impeachment if the House eventually passes them. However, he noted that how much time the Senate spends on the articles is another discussion. 

“I would have no choice but to take it up. How long you’re on it is a whole different matter,” McConnell told CNBC.

Meanwhile, Trump’s allies on Capitol Hill are following his pugnacious lead and are casting doubt on the entire saga. Rep. Liz Cheney (R-Wyo.), the No. 3 House Republican, said that the Ukraine call appears to her like “a political set up” (The Hill). 

Others have been pushing back on the whistleblower’s account and have attacked the individual’s credibility.

“It doesn’t come from a person with personal knowledge. It’s like I heard these people say this, and now I’m reporting it. I think that is pretty bizarre,” said Sen. John Cornyn (R-Texas). “Secondly, after a certain point, it doesn’t just allege facts, it really is kind of a dossier or political diatribe, so I think there are plenty of reasons to be skeptical. Having said that, we are in the process of talking to the director of National Intelligence and the inspector general” (The Hill). 

With impeachment front and center in Congress now, some Democrats, especially those from more moderate states, are growing concerned that the inquiry and process could drag out and divert focus from the party, even though Speaker Nancy Pelosi (D-Calif.) remains intent on limiting the scope and time of the process. As Alexander Bolton reports, Democrats in the upper chamber are urging Pelosi and her colleagues to keep a “laser-like” focus on the Ukraine call and not drift into other areas.

LEADING THE DAY
CONGRESS: House Republicans saw two more of their members announce their planned retirements or imminent resignations on Monday as the party continues to see a shake-up in its ranks ahead of what is expected to be a tenuous 2020 cycle for the party. Rep. Mac Thornberry (R-Texas), the ranking member on the House Armed Services Committee, announced Monday his retirement from Congress at the end of his term. The announcement from Thornberry, a well-respected House GOP member, came only a week after telling The Hill that he did not intend to leave the chamber.  However, Thornberry is term-limited atop the committee, an issue that has plagued House Republicans the past two cycles. Politico reported last week that House Minority Leader Kevin McCarthy (R-Calif.) floated the possibility of changing the term limit rule for committee chairmen and ranking members during a meeting with GOP leadership last week. While some of the Texas seats are in reach for Democrats in 2020, the 13th Congressional District is considered a safe GOP seat. Trump pulled 80 percent from the district in his 2016 win, while Thornberry won reelection in 2018 with 81 percent (The Hill).

 On the other side of the ball, Rep. Chris Collins’s (R-N.Y.) resignation from Congress is expected to be official today after he pled guilty to insider trading charges in federal court. The resignation of Collins, who was one of the first GOP members to endorse Trump in 2016, allows the House GOP to breathe a sigh of relief, as his ruby red district is less likely to remain competitive with him out of the picture and off the ballot.  “I’m glad to see this resolved. The seat should now be off the competitive list as it is Trump territory,” said one New York Republican closely watching Collins’s case. “This saves us a lot of money and resources which can now go elsewhere in the country to further the cause” (The Hill). Including Thornberry and Collins, 20 House Republicans will have left office or announced their intention to leave office at the end of the cycle. 
 
IN FOCUS/SHARP TAKES
POLITICS: Presidential candidates scrambled until just before midnight Monday to close out the third quarter of the Federal Election Commission fundraising year with as large a haul as possible. Candidates have until Oct. 15 to officially report their war chest totals (if they don’t reveal them beforehand). With just 125 days until the Iowa caucuses on Feb. 3, presidential candidates are running out of time to raise sufficient resources to chase their top-tier rivals. Sen. Bernie Sanders (I-Vt.) announced early Tuesday that he raised $25.3 million in the third quarter from 1.4 million donations, and $61.5 million overall during the cycle. The campaign’s average donation is $19.  Sanders made his announcement only minutes after South Bend, Ind., Mayor Pete Buttigieg revealed his own total. Buttigieg posted $19.1 million for the past three months, a solid follow-up after he raised nearly $25 million in the second quarter. In total, Buttigieg has raised more than $51 million this cycle and has attracted more than 580,000 individual donors, including 182,000 new donors in the third quarter. The average donation in the third quarter was roughly $32.  The total “positions us solidly as one of the top three fundraisers in this race,” said campaign manager Mike Schmuhl in a memo. “We will have the resources to go the full distance, and to win, the 2020 nominating contests.” Neither campaign revealed how much they retained in cash on hand.

 Sen. Cory Booker (D-N.J.) announced on Monday his campaign hit his down-to-the-wire goal of raising at least $1.7 million, which he said will allow him to remain in the presidential contest. Booker’s campaign manager said the contributions would go toward ballot access and hiring staff, among other needs. The senator raised $4.5 million during the second quarter, but spent nearly $1 million more than that (The Associated Press). Trump’s team worked last week, through the weekend and on Monday to turn impeachment and the president’s assaults on Democrats into prominent themes in fundraising entreaties to supporters online. By Monday afternoon, the emails from Trump claimed his campaign was $243,250 short of a $3 million goal it outlined on Sunday. Trump and the RNC previously reported pulling in more than $210 million since the start of 2019, more than his Democratic rivals combined (The Associated Press). Politico reports how successful and prepared Trump’s campaign has been for months to capitalize on impeachment in its fundraising. Tara McGowan, a Democratic digital strategist who worked for a pro-Hillary Clinton super PAC in 2016, marveled at Trump’s “ability to very quickly define any event or issue on his terms and energize his base.” The online advertising “provides him with a huge competitive advantage over Democrats [and] enables Trump to set the narrative on his terms.’” Trump’s campaign and the RNC reported raising more than $13 million last week in the three days following the launch of the House impeachment inquiry. Montana Gov. Steve Bullock (D) said he will apply to receive public financing for his struggling presidential campaign. In a memo Monday, Bullock’s campaign manager cast the decision to seek out public funds for his presidential bid as a show of the governor’s commitment to campaign finance reform, an issue that he has put at the center of his campaign since announcing his candidacy in May. Bullock has lagged in polls and was shut out of the last Democratic primary debate under Democratic National Committee rules that gauge fundraising and early public support (The Hill). Joe Biden’s campaign scaled back investment in digital ads before the quarterly deadline. While the campaign’s spending on traditional television ads in Iowa picked up. It is considered rare in modern presidential races to pull back from online campaign advertising, even among nationally known candidates with access to voter lists, advantages Biden can claim. One explanation, which was dismissed by Biden’s team, is that the campaign is seeing weak digital results, including from its ads on Facebook and Google. The former vice president enjoys stronger support among older voters, which may help explain his campaign’s targeted digital spending on certain swaths of the electorate (The New York Times).

And finally … There’s always someplace in the United States that experiences the first blast of winter weather as summer gives way to autumn. Over the weekend and on Monday, that place was the Northern Rockies. They called it “preseason snow” because it’s unusual to see blizzard-like conditions in September. Gov. Bullock declared an emergency and at least eight school districts remained closed on Monday. In parts of Montana, four feet of snow sent vehicles skidding on interstates, felled heavy tree limbs and interrupted power (The Weather Channel).

Another Phone Call, Another Impeachment Wrinkle
The impeachment inquiry has spurred fresh reporting into the president’s habits on calls with foreign leaders—and the White House’s handling of the transcripts. The media treated as major last night reports about a phone call between Trump and the Australian prime minister. Is this damning? Probably not. (Ross Douthat has some thoughts.) But here’s more from the New York Times:

“President Trump pushed the Australian prime minister during a recent telephone call to help Attorney General William P. Barr gather information for a Justice Department inquiry that Mr. Trump hopes will discredit the Mueller investigation, according to two American officials with knowledge of the call.

The White House curbed access to a transcript of the call — which the president made at Mr. Barr’s request — to a small group of aides, one of the officials said. The restriction was unusual and similar to the handling of a July call with the Ukrainian president at the heart of House Democrats’ impeachment inquiry. Like that call, Mr. Trump’s discussion with Prime Minister Scott Morrison of Australia shows the president using high-level diplomacy to advance his personal political interests.”

Are We Really In The Midst Of An Impeachment Inquiry?
In short, yes. But until there’s an impending impeachment vote on the House floor, consider the possibility that Nancy Pelosi has deftly provided herself with some wiggle room. The “inquiry” is primarily a rebranding of the hearings and investigations that House Democrats have been pursuing for months. Wrapping those efforts under the “impeachment inquiry” label gives Democrats in deep-blue districts the ability to say they’re actively trying to unseat Trump, and purple-district Democrats the ability to simply say they’re trying to get to the bottom of the issues. If public opinion—or reporting—unfolds in a direction that calms some of the impeachment fervor, the “inquiry” could possibly fade. I think that’s unlikely, but it’s less of a formal designation than it sounds.

1.) Sterigenics is leaving Willowbrook, eliminating a key source of cancer-causing gas in Chicago’s western suburbs TUESDAY, OCT 1 For more than a year, community activists in Chicago’s western suburbs fought to drive Sterigenics out of Willowbrook. The village’s mayor and leaders of surrounding communities threatened to seize the company’s sterilization plant through eminent domain. Even pro-business state lawmakers clamored for the controversial facility to close for good.
But in the end, it appears a routine business decision helped nudge the company to abandon its Willowbrook operation, which federal records show was one of the nation’s largest industrial sources of cancer-causing ethylene oxide pollution.
2.) ‘This is beyond repugnant’: Illinois GOP Rep. Adam Kinzinger blasts Trump as president warns of treason and civil war over impeachment TUESDAY, OCT 1 President Donald Trump is warning that the Democrat-driven impeachment proceedings and any move to oust him from office amount to “treason” and would spark a civil war, prompting outrage from a Republican congressman in Illinois.
After Trump tweeted a conservative pastor’s comment that removing him would provoke a “civil war-like fracture” in America, Rep. Adam Kinzinger responded with a tweet of his own: “I have visited nations ravaged by civil war. … I have never imagined such a quote to be repeated by a President. This is beyond repugnant.”
Kinzinger, a former Air Force pilot, represents an Illinois district Trump won in 2016. The Tribune reached out to the White House for reaction, but a spokesman for the president didn’t respond.
It was a busy day in Washington: We learned that Democrats subpoenaed Rudy GiulianiSecretary of State Mike Pompeo was on the Trump-Ukraine call and Trump wanted Australia to help AG William Barr investigate the origins of the Russia probe.

3.) Special prosecutor in Jussie Smollett probe admits contributing $1,000 to Kim Foxx’s campaign in 2016 TUESDAY, OCT 1 The special prosecutor appointed to look into the politically charged case against former “Empire” actor Jussie Smollett revealed that he’d co-hosted a 2016 fundraiser for now-Cook County State’s Attorney Kim Foxx at his high-powered law firm and also cut a $1,000 check to her campaign.
Dan K. Webb, the co-chairman of Winston & Strawn, wrote that he had “no recollection” of attending the fundraiser or making a donation that he said was likely done at the behest of a colleague at the firm who put on the event. Still, the revelation could potentially throw a wrench in Webb’s ongoing inquiry.
4.) Lightfoot steps up PR battle in her standoff with the Chicago Teachers Union TUESDAY, OCT 1 Mayor Lori Lightfoot stepped up the public relations battle in her standoff with the Chicago Teachers Union by launching a website that lays out the city’s contract offer and the sequence of events in the ongoing negotiations.
With a teachers strike possibly imminent, the contract fight is taking on the added dimension of a struggle for the hearts and minds of Chicagoans, with both sides trying to demonstrate they have broad support to strengthen their position in the event teachers walk out.Chicago teachers authorized a strike last week. Here’s a guide to what to expect.  
5.) Chicago to become largest U.S. public library system to go fine-free for overdue materials that get returned TUESDAY, OCT 1 Chicago public libraries will stop fining people for overdue books and wipe away patrons’ outstanding debt, Mayor Lori Lightfoot announced, saying she wants to help low-income people who have been locked out of borrowing from their neighborhood libraries regain access to the system.Starting today, books people check out automatically will renew up to 15 times if nobody else places a hold on them. Items will be marked as “lost” and accounts will be charged replacement costs one week after the last due date, but the charge will be cleared if the item is returned.

6.) Theo Epstein says change is coming to the Cubs. Could that mean dealing Kris Bryant or Javier Baez? TUESDAY, OCT 1 The Cubs fell into the “winner’s trap” of trusting components of a franchise that has gradually regressed since winning the 2016 World Series, team President Theo Epstein said. And that will result in changes throughout the organization as the Cubs try to return to perennial playoff status.
“You are likely to see change,” Epstein said during a 1-hour, 21-minute news conference, a day after he severed ties with manager Joe Maddon.
Although Epstein said the Cubs are “extremely energized and optimistic about their future,” they might have to consider trading one of the pillars of their success, such as third baseman Kris Bryant or shortstop Javier Baez.

7.) Bears QB Mitch Trubisky reportedly dislocated his left shoulder and slightly tore his labrum. But Matt Nagy wouldn’t confirm that. TUESDAY, OCT 1 Bears quarterback Mitch Trubisky suffered a dislocated left shoulder and slightly torn labrum against the Vikings, ESPN reported, citing an anonymous source. Trubisky reportedly is unlikely to play against the Raiders but does not need surgery. Bears coach Matt Nagy, however, would not confirm any of that at his news conference Monday.

Forty-six percent (46%) of voters nationwide now believe President Trump should be impeached and removed from office. That’s up two points from a week ago and matches the highest level of support measured in 2019 (see topline trends).
The latest ScottRasmussen.com poll found that the number who disagree has fallen five points over the past two week to 40%. Fifteen percent 15% remain undecided.Generally speaking, support for impeachment has remained steady between 41% and 45% all year. This week’s update is the second time support has topped that range. Only once has it fallen below.
The increased support for impeachment has come primarily from Democrats. Seventy-six percent (76%) of Republicans remain opposed to impeachment while 80% of Democrats favor it. Among Independent voters, 40% favor impeachment and 40% are opposed (see crosstab results).
Thirty-two percent (32%) believe it is at least somewhat likely the president will be impeached and removed from office. That’s the highest total of the year. Thirteen percent (13%) consider it Very Likely.It is notable however, that throughout this entire period, the president’s job approval rating (updated daily) has remained stable. For more than eight months, our daily releases have shown his rating within two points of 46% every single day. The Democrat’s advantage on the Generic Congressional Ballot has remained steady as well. Additionally, the number who believe it’s likely that the president will be re-elected has grown throughout the year.
Thirty-seven percent (37%) of voters now believe the president is guilty of treason, a total that includes 65% of Democrats. Ten percent (10%) of Republicans agree, along with 33% of Independent voters (see crosstab results).
Data released recently shows that 43% of voters believe the president behaved inappropriately during his conversation with the Ukrainian president.

DAY ONE OF IMPEACHMENT RECESS
The House Intel Committee will still be calling people and taking testimony, but otherwise, this is the first day for many Democratic members to take the temperature of their home districts. Right now, the real question they face is how quickly they can move on an impeachment vote. http://vlt.tc/3rqd It needs to happen before Thanksgiving to have any real hope of avoiding slipping into the Democratic presidential primary process – and with a current leader and several candidates who are members of the Senate, it would be surprising if Mitch McConnell passed on the opportunity to use impeachment to have an impact on that process.

Now is the Time to Start Reducing the National Debt –
“Expecting economic growth to rescue the US from unprecedented federal deficits is a dangerous gamble, as history shows,” says Valerie Ramey (a professor of economics at the University of California, San Diego) in a recent Wall Street Journal piece entitled “It’s Time to Start Worrying About the National Debt”.
 
Ms. Ramey says, “The usual voices urging fiscal restraint have been drowned out by some policy makers and academic economists who … are urging us in the fashion of Dr. Strangelove to ‘learn to stop worrying and love the national debt’.”
 
The author identifies numerous reasons why federal leaders must deal with the national debt problem now.  She says “Prudent governments keep their fiscal house in order during good times so that they have more fiscal room to deal with bad times”.  Read her entire article HERE.
 
 
Columnist Says US Government is Facing Insolvency –
On August 31 Townhall carried a warning by columnist Beau Rothschild entitled “US Government Facing Insolvency if Nothing Changes”.  He says “Our government is facing some serious problems with spending with no solution in sight”.
 
Rothschild points to a May 2019 report by The Heritage Foundation that made it clear that spending, not a lack of tax revenues, is the primary problem: “The long-run debt problem is not driven by a lack of revenue.  CBO data indicate that over the next 10 years, revenues will be above the 50-year average.”  He says “Our national debt is at approximately $22.5 trillion and we are staring down $1 trillion in annual deficits for as long as the eye can see.”
 
“Maybe politicians are incapable of reform,” says Rothschild, “and need to be subject to a Balanced Budget Amendment to the Constitution. Sadly, it might take insolvency for any reforms to be put in place.  Restraint is needed and if things don’t change, our nation is staring at insolvency and future generations of Americans will have a lower standard of living than we enjoy today.”  Read his piece HERE.
 
 
Single-Year Trillion Dollar US Deficit Surpassed –
A September 9 report by the Congressional Budget Office (CBO) said “The federal budget deficit was $1.067 billion for the first 11 months of fiscal 2019…”.  That report says that although the federal revenues were $102 billion higher than the same period in fiscal year 2018, the federal outlays were $271 billion higher than the same period in fiscal year 2018.  Problem?  Do you think?
 
On September 16 the Daily Signal (Heritage Foundation) carried a commentary by David Ditch.  It said that federal revenues are up 3.4% from 2018, but that “The driving force behind America’s astronomical deficit is the rapid increase in spending.  Federal outlays are up 7% compared to 2018, which far outstrips inflation, population growth, and the economy.”
 
Ditch points out: “With robust global growth over the last several years, a majority of developed nations are taking advantage by shrinking the size of their debt relative to the size of the economy. This ratio, often written as ‘debt-to-GDP’, is important because it points to how well a nation can afford its current level of debt.”  By contrast, he then provides a chart that shows the US leading the world in increased national debt.
 
His chart, based on International Monetary Fund figures, shows the projected change in debt, 2019-2024, in percentage points of GDP, by the 10 largest advanced economies.  These are the projections:
US national debt is expected to rise 13.4%; Italy – 7.7%; Korea – 1.7%; and Japan – 1.3%.  Meanwhile national debt is projected to decline by 2.3% in Spain, 2.4% in France; 2.5% in Australia; 4.9% in Canada; 6.6% in the United Kingdom; and 12.6% in Germany.
 
Ditch notes that “Although the 2019 deficit could ultimately dip below $1 trillion depending on September’s numbers, the fact remains that even a “mere” $960+ billion deficit for the year is inexcusable.”  Read his detailed piece HERE.

Democrat Congressmen Appeal for Fiscal Responsibility –
An early September news release sent out by US Rep. Sharice Davids (KS) describes her efforts to lead a group of Democratic House freshman colleagues “to recommit to fiscal responsibility and abide by Congressional Pay-As-You-Go (PAYGO) budget rules, which ensure that any legislation that may increase the federal deficit is offset by spending cuts or revenue increase”.
 
Nine other Democratic US House members signed on in support of Rep. Davids’ efforts.
 
“Congress must do what we said we would and find ways to pay for bills we propose so we don’t leave future generations mired in debt. That starts with our Committee Chairs prioritizing fiscal responsibility and transparency, and ensuring we have a plan to pay for our priorities before bills make it to the House floor for a vote,” said Davids.
 
 
Ohio Sen. Huffman Calls for Convention to Address Debt –
In an early September speech to a Lima Ohio Optimist Club, State Senator Matt Huffman peppered his talk with historical trivia about the nation’s founding and a history lesson on the Constitution.  He ended with a warning about America’s future.
 
Talking about the federal debt, Huffman said, “The debt has grown exponentially since Sept. 11, 2001, since 18 years ago. It didn’t just happen under President Trump. It didn’t just happen under President Obama. It really started under President George Bush, the second. … Eventually, what will happen is the federal government won’t be able to pay for the things that they are paying for right now.”
 
“There’s no plan for the federal government to deal with the national debt. There is no plan,” Huffman said. “It doesn’t matter if we have Democrats in control or Republicans in control because it’s the same group of people making lots of money from Washington.”
 
Huffman told his audience his preferred solution is a major convention organized by the states to offer a balanced budget amendment. He stressed that the states need the federal government to stay in business, and that his proposal could bring spending back into control without relying on the “guys and gals who are all in charge of the money and power in Washington”.
 
Senator Huffman also opined: “There are a lot of things that should be in our Constitution. The president should be able to have a line item veto, in my opinion. The federal government should not be able to dictate terms for accepting federal money in certain programs. Some people want to abolish the electoral college. Some people want to overturn Citizens United … For my money, if 38 of the 50 states thinks it’s a good idea, then we should do that. That’s the only real opportunity.”

In a related story, a mid-September interview with The Columbia Daily Herald, US Senator Martha Blackburn (TN) reported on conversations she had just completed with local business leaders. 
 
“They are concerned about the federal debt and want us to use this as a time to get it down. Just about everyone in the room supported a balanced budget amendment. This is a group of people who understand that the county’s [credit] rating is important, and the state’s rating is important. They want the federal government to start working the debt down and not passing it along to our grandchildren.”

Another related report by GovTrack Insider on September 11, told about The Budgetary Accuracy in Scoring Interest Costs (BASIC) Act that would require any federal governmental spending or budget projections made by the Congressional Budget Office or Joint Committee on Taxation must include costs related to interest on the national debt.
 
By way of context, the federal deficit was $779 billion last year. It is projected to rise to $960 billion this year.  On its current path, the deficit will exceed $1 trillion annually for the next decade.
 
Interest owed for the national debt is also increasing.  Interest on the debt was $325 billion last year. It’s projected to rise to $372 billion this year. The Congressional Budget Office (CBO) currently projects that by a decade from now, in 2029, a single year of interest expense will be $807 billion.  The report suggests that to put it another way, a decade from now, interest on the deficit alone will be higher than the entire deficit was last year.
 
The House version of the proposed act (HR 3979) has attracted just two cosponsors.  It awaits a potential vote in either the House Rules or House Budget Committee.  The Senate version (S 2435) has also just attracted two cosponsors. It awaits a potential vote in the Senate Budget Committee.  The bills are given zero chance of passage.  See this report HERE.
 
 
Is a ‘Plenary’ Article V Convention a Viable Option? –
Paul Gardiner is a Georgia-based man who has been active in Article V efforts for several years.  He has served in state and national leadership positions for the Convention of States Project (CoSP).  Gardiner has written a paper he calls “A Fresh View of a Constitutional Article V Convention of States”.
 
Gardiner notes that “Conventional wisdom says that an Article V convention of states (COS) to propose constitutional amendments can and/or must be a ‘limited’ convention where the delegates are limited and authorized to only propose, debate and vote on one or a limited set of amendments”.  His paper presents arguments why this may not be the case.   
 
The author (a retired Army officer, Vietnam veteran, and graduate of the University of North Carolina at Chapel Hill, University of Alabama, and the United States Army War College) does not present himself as a constitutional scholar, but relies on his leadership experience in the Article V movement, his personal study of colonial conventions, and the actions of early state legislators as they applied for an Article V convention of states after ratification of the US Constitution.  He also studied the work of noted constitutional scholars and related rulings of the US Supreme Court.
 
Gardiner’s paper leads to questions about the viability of applications for a “limited” Article V convention, and suggests that a plenary (unlimited) convention is what the drafters of Article V actually contemplated as they “established a new way to govern a nation based on federalism”.
 
In view of his findings as they relate to current Article V movements, Gardiner suggests “perhaps

[a]

prudent alternative/additional course of action is for current Article V groups, in conjunction with key state legislators and officials, to thoroughly investigate using 34+ existing aggregated, qualifying applications to call for a [non-limited] COS where any and all amendments can be proposed, debated, and voted upon.  Recent analyses indicate that at least 30 such qualifying applications currently exist”.

Gardiner concludes by saying “It would appear that the various Article V groups have everything to gain and little to lose from pursuing such a strategy.”  And, [S]imply dismissing a [non-limited] COS as an improbability without a thorough, well-funded investigation does a disservice to all Americans.  Further, the American people could be potentially deprived of the use of a crucially important ‘checks and balances’ tool purposely put into the constitution by the Founders”.  Read Gardiner’s 3-page whitepaper (with bibliography) HERE.


The Implications of the National Popular Vote Movement –
This newsletter tries to focus exclusively on Article V and federalism issues and developments.  For that reason, until now, no space has been given to the Electoral College vs. National Popular Vote issue.

A significant and growing portion of US citizens, regardless of party affiliation, has begun to question the institution known as the Electoral College.  In the mistaken belief that the American form of government is primarily a pure democratic one, citizens (and often their legislators) consider the Electoral College a relic of the past, or error of the Founders that needs to be done away with.

It should be noted that the words “Electoral College” do not appear anywhere in the US Constitution or any of its amendments.  However “electors” who comprise the so-called Electoral College are referenced numerous times in both the original Constitution and four of the ratified amendments.  In other words, the concept of the Electoral College as a mechanism for electing the nation’s two principle executives is interwoven throughout America’s principle governing document.  

If… a big IF… that mechanism is to be constitutionally replaced, the Constitution would have to be amended.  There is provision for that possibility in the fifth Article of the Constitution.  Unfortunately the promoters of the current National Popular Vote Interstate Compact (NPVIC) have made no effort to use that constitutional provision.

Also IF that mechanism were to be replaced, it would have a significant impact on another concept that is interwoven throughout the US Constitution… federalism… the notion that American is first and foremost a federation of states with governing powers divided between the national government and the states.

For these reasons this newsletter will begin containing content to assist state legislators in understanding the many implications surrounding the Electoral College vs. the Popular Vote concept.

An Update on Missing Article V Applications – 
The past few editions of this newsletter have highlighted various state-approved Article V convention applications that were never properly received by Congress.  There has been progress.

Constitutional amendment expert Gregory Watson reports that Tennessee’s 2014 House Joint Resolution No. 548 (for a BBA-focused convention) was belatedly received by the US Senate, as reflected on page S5406 of the September 10, 2019 Senate portion of the Congressional Record.  On September 11 Mississippi’s 2019 Senate Concurrent Resolution No. 596 (a CoSP [Convention of States Project] convention application) was formally received by both the US House and Senate.  Then on September 19 Arkansas’ 2019 Senate Joint Resolution (another CoSP application) was officially filed with both houses of Congress.

Mr. Watson points out that the following BBA-focused Article V applications have yet to be fully and properly filed with Congress: Nebraska’s 2010 Legislative Resolution No. 538 has not been formally received by either the US House or Senate.  Both Utah’s 2015 House Joint Resolution No. 7 and Wyoming’s 2017 House Enrolled Joint Resolution No. 2, while filed with the US House, have yet to be formally received by the US Senate.

Likewise, the following Article V applications related to the CoSP effort have yet to be fully/properly filed with Congress:  Louisiana’s 2016 Senate Concurrent Resolution No. 52, while filed with the US House, has still not been formally received by the US Senate.  Utah’s 2019 Senate Joint Resolution No. 9 has been filed with the US House, but still has not been formally received by the US Senate. 

Gaining approval of Article V state applications is such a time-consuming process, it would be sad to see all that work go to waste by failure to properly and fully notify both houses of Congress of that state action.

When drafting Article V applications, the drafters need to carefully include directions as to who (what state official) is responsible for transmitting the approved version of the resolution to both houses of Congress.

In an effort to assist state legislatures and state officials who are tasked with notifying Congress of a jointly-approved Article V application, the State Legislators’ Article V Caucus has prepared a five-page guide entitled “The Proper Way to Transmit State-Approved Article V Applications to Congress”.  It can be found HERE.

FIRST READ: The Ukraine story looks worse for Trump’s State and Justice departments

This Ukraine story already didn’t look great for Mike Pompeo’s State Department and William Barr’s Justice Department.

And today it looks a lot worse.


For starters, we now know Pompeo was ON that July 25 phone call, in which President Trump asked Ukraine’s president to investigate Joe Biden and his son.

Here’s what Pompeo said about the incident when ABC News asked him about it back on Sept. 22:

ABC: The Wall Street Journal is reporting that President Trump pressed the president of Ukraine eight times to work with Rudy Giuliani to investigate Joe Biden’s son. What do you know about those conversations?

POMPEO: So, you just gave me a report about a I.C. whistle-blower complaint, none of which I’ve seen.

Additionally, the transcription memo of the July 25 call has Trump asking Ukraine’s president to help him with “Crowdstrike” and “the server” – meaning the effort to discredit Russia’s interference in the 2016 presidential election.

“I would like to have the attorney general [Barr] call you or your people, and I would like you to get to the bottom of it,” Trump said on the call.

And guess what we’ve learned Barr has been doing.

“Attorney General William P. Barr has held private meetings overseas with foreign intelligence officials seeking their help in a Justice Department inquiry that President Trump hopes will discredit U.S. intelligence agencies’ examination of possible connections between Russia and members of the Trump campaign during the 2016 election, according to people familiar with the matter,” the Washington Post writes.

More: “Barr has already made overtures to British intelligence officials, and last week the attorney general traveled to Italy.”

The travel by Barr comes as we’ve also learned that Trump asked Australia’s prime minister to investigate the origins of Robert Mueller’s Russia probe.

Now there is a potentially legitimate reason for the United States to reach out to Australia – if you want to understand how the Russia probe all began with George Papadopoulos.

But there’s also a not-so legitimate reason.

“Barr’s conversations with foreign counterparts have raised concerns among some intelligence officials that he may be seeking to substantiate conspiracy theories raised by some on the political right to defend Trump,” the Post adds.

Giuliani suggests he might not comply with subpoena

Hours after Democratic committee chairmen subpoenaed Rudy Giuliani for Ukraine documents relating to their impeachment inquiry, Giuliani suggested he might not comply.

“I have received a subpoena signed only by Democrat Chairs who have prejudged this case. It raises significant issues concerning legitimacy and constitutional and legal issues including, inter alia, attorney client and other privileges. It will be given appropriate consideration,” Giuliani tweeted. 

But remember what House Intel Chairman Adam Schiff said on “Meet the Press” this past Sunday: Refusals or prevention to comply with subpoenas and testimony might be treated as obstruction of justice.

DATA DOWNLOAD: And the number of the day is … 47 percent. 

47 percent.

That’s the share of registered voters who say President Trump should be impeached *and removed from office* in a new Quinnipiac poll, up 10 points from the same poll’s results last week.

The new survey, which was in the field September 27-29, found 47 percent in favor of impeachment and removal, while 47 percent disagreed.

That’s compared to just 37 percent who supported impeachment and removal in a poll fielded September 19-23.

The movement has largely been among Democrats.

The previous poll showed support for impeachment and removal at 73 percent among Democrats, 34 percent among independents and 4 percent among Republicans.

The new poll shows it at:

Democrats:  90% (+17)

Independents: 42% (+8)

Republicans: 7% (+3)

2020 VISION: Bernie outraises Pete in the 3rd quarter

NBC’s Gary Grumbach and Shaquille Brewster report that Bernie Sanders raised $25.3 million in the third fundraising quarter – up from $18 million in the second quarter.

The other campaign to release its numbers this morning is Pete Buttigieg’s, which said it hauled in $19.1 million – down from $24.9 million last quarter.

So here are the numbers so far for the third quarter:

On the campaign trail today: Tom Steyer stumps in Iowa, hitting Council Bluffs… And Tulsi Gabbard is in New Hampshire, where she visits Nashua and Londonderry.  

Dispatches from NBC’s embeds: Bernie Sanders cast doubt on who he might be competing against in a general election. NBC’s Amanda Golden and Gary Grumbach report that at a campaign stop yesterday in New Hampshire, Sanders said, “But given the impeachment process that is now taking place, if it’s not Trump, we’re gonna beat Mike Pence more – even worse. So I don’t know who the Republicans will bring forth, but whoever it is, we’re gonna beat them.”

And Golden, who’s covered Sanders and Warren in New Hampshire, has noticed some key differences between how the two candidates promote their progressive messages: “Both Sanders and Warren hit similar points in their stump speeches, though they perform them differently. Sanders tends to hit his points back-to-back with little embellishment (health care, climate, etc.), whereas Warren tells more of a personal story to narrate how she came to hold the positions that she does.”

Good morning, it’s Tuesday, Oct. 1, 2019. On this date in 2015, distinguished New York-based classical music conductor Michael Barrett posted a classic Christian hymn as his “song of the day.” The singer was Jessye Norman, who passed away yesterday at age 74. The song, “Let Us Break Bread Together,” is much older. An African American spiritual first put on paper in 1925, it emerged out of the Deep South in pre-Civil War times. Evoking the Last Supper, it is sung or played on the organ today during communion at churches all over North America. But its original first verse seems to have been “Let us praise God together.” It is a song about perseverance and unity. If its provenance is haunting, so is its melody. Over the decades, it has been sung by Paul Robeson as a somber hymn, by Marian Anderson as a sacred and subtle rebuke to Jim Crow, by Joan Baez as an overt protest song, and by millions of Christians as a way to celebrate their faith. Jessye Norman’s regal interpretation was nothing less than rapturous. And now she belongs to the angels. In a moment, I’ll have more on this superb soprano, and a personal observation about this hymn. In RealClearEducation, Karin Lips writes that the gender pay gap often hinges on choosing fields with limited income potential.  * * * In its obituary his morning, the New York Times notes that Jessye Norman was a multiple Grammy Award winner and “a towering figure on operatic, concert and recital stages.” That’s a nice summary of her vast range as an artist, but because it’s the Times there’s also this line: “A keen interpreter as well as a magnificent singer, Ms. Norman had a distinctly opulent tone that sounded effortless, never pushed. It was especially suited to Wagner and Strauss.” I know that sounds high-tone, and I chuckled when I first read it. But this observation perfectly illustrates the miracle of Jessye Norman in particular, and music in general. How was it that a black woman born in Augusta, Ga., one month after the end of World War II could give voice to two of the greatest German composers of the ages? The short answer is talent, and diligence in developing that talent. The more complete answer entails understanding how songs and faith — and songs about faith — transcend the walls human beings erect around each other. I first heard “Let Us Break Bread Together” as a pre-teen in a Northern California church. We had moved from the Bay Area to Sacramento because my father took a job covering the state capital for the San Jose Mercury News. My parents searched for a church that fit both their political and spiritual sensibilities, and were led to a small congregation in a black neighborhood. We became one of only two or three white families that belonged to the Oak Park United Church of Christ. It was located at 3308 4th Ave., and headed by a minister with the eponymous name “Chilton Christian.” Although I haven’t laid eyes on the Rev. Christian in 50 years, I still hear his voice any Sunday I’m in church. He had the gift. The congregation’s social mission led to a decision by the pastor and the deacons to allow the Black Panthers to serve breakfast to needy children before school. The Black Panther Party had opened its Sacramento headquarters on 35th Street, a few blocks away. The breakfast program worked for a while, at least until the Panthers started bringing guns to the church. In 1970, a near-riot occurred as police began rousting the group. A 24-year-old policeman, a Vietnam vet, was assassinated by a sniper while on routine patrol in Oak Park. As Bruce Springsteen would sing about his own hometown, “troubled times, they had come.” Chilton Christian is long gone now, as are many of the adults I knew in those years at Oak Park UCC. I hope he’s with Jessye Norman now. As for the troubled times, they seem to have returned to this country. Many Americans have concluded that civility and nonviolence are not the solution. The answer to this alienation, of course, is to break bread together. It need not be on our knees, but it must be together.  Carl M. Cannon
